엘살바도르의 극단적인 낙태금지법에 따라 유산이나 응급상황을 겪은 여성들이 불법 낙태 시술을 받은 혐의로 갇히면서, 수백 명 자녀의 삶에 참담한 영향을 끼치고 있다고 국제앰네스티가 11월 30일 발표한 보고서를 통해 밝혔다.

보고서 <헤어진 가족, 끊어진 인연>에서는 터무니없는 낙태금지법으로 갇힌 여성의 아이들이 대부분 금전적으로 힘든 상황에 부닥치거나 어머니와 연락을 주고받지도 못하는 현실이 담겨있다.

아스트리드 발렌시아(Astrid Valencia) 국제앰네스티 중앙아메리카 조사관은 “엘살바도르 정부는 유산이나 임신 합병증을 겪은 여성을 부당하게 가둘 때마다 그 자녀들 역시 가난과 정신적 고통 속에 살아가도록 내몰고 있다”며 “임신 합병증을 겪은 여성들에게만 적용되는 엘살바도르의 ‘유죄 추정의 원칙’으로 수백 명이 희생되었고, 여성들은 최대 40년까지의 징역형에 처했으며, 의사와 환자 사이에 절대적인 공포 분위기가 조성되었다. 지금이야말로 엘살바도르의 이러한 시대착오적인 낙태금지법을 철폐해야 할 때”라고 말했다.

모든 경우에 대한 낙태 시술이 범죄화됨에 따라 최소 19명 이상의 여성들이 근거가 미약하거나 결정적이지 못한 증거로도 살인과 같은 중대한 범죄로 유죄 선고를 받고, 장기간의 징역형에 처해 현재 교도소에 갇혀 있다. 이들 중 대부분은 가정의 생계를 책임지고 있었다. 이런 여성들이 투옥되면 가족들이 벌이하고 아이들을 돌봐야 하는데, 주로 극심하게 어려운 상황에 처한 경우가 많았다.

경제적 수입이 전혀 없고, 교도소가 집에서 멀리 떨어진 탓에 대부분의 가족은 사랑하는 가족을 면회하기도 어렵다. 일부의 경우 수개월 넘게 자녀를 만나지 못하는 여성들도 있었다.

유산을 겪은 이후 ‘고의 살인’ 죄로 징역 40년형을 선고받고 현재 수감 중인 32세 여성 마리아 테레사 리베라는 2011년 갇힌 이후 지금까지 열 살 난 아들을 만난 것이 겨우 4번에 불과했다.

마리아 테레사의 아들은 그녀가 수감된 교도소로부터 수 시간 떨어진 곳에 할머니와 함께 살고 있는데, 교도소를 한번 방문하려면 엄두도 못 낼 정도로 비싼 비용이 든다. 마리아 테레사가 벌어오던 수입이 끊기고, 정부의 지원도 없어 마리아 테레사의 시어머니 역시 손자를 키우는 데 큰 어려움을 겪고 있다.

마리아 테레사는 욕실에서 거의 실신한 상태로 피를 심하게 흘리고 있는 것을 시어머니가 발견해 병원에 옮겨졌으나 그 자리에서 체포되었다. 병원 직원이 낙태한 것으로 의심하고 경찰에 신고했던 것이다.

재판 과정에서 마리아 테레사의 직장 상사 중 한 명이 그녀가 임신한 사실을 2011년 1월에 이미 알고 있었다며 불리한 증언을 했다. 이 증언이 사실이라면 유산 당시 임신 11개월째였다는 말이 된다. 이처럼 터무니없는 증언조차도 유죄를 선고하는 근거로 이용됐다.

마리아 테레사의 어린 아들은 어머니의 부당한 구금으로 유난히 힘든 시간을 보내고 있다.

마리아 테레사의 시어머니인 “이사벨”은 교도소를 방문할 때마다 겪는 고통에 대해, “손자를 데리고 처음 면회를 갔을 때는 정말 힘들었다. 손자는 심하게 울음을 터뜨렸고 나도 마찬가지였다. 아이는 교도소를 떠나지 않으려고 했다. 너무나 고통스러워서 아이를 데리고 나가는 것도 잠시 포기해야 했다. 아이에게도, 엄마에게도 너무나 힘든 일이기 때문이었다”고 전했다.

테오도라 델 카르멘 바스케스는 2008년 직장에서 사산한 후 “고의 살인” 죄로 징역 30년이 선고됐다. 그녀의 11살 난 아들은 면회를 거의 오지 못한다.

테오도라는 2008년 30년 형을 선고받았다. 11살 난 아들은 엄마를 거의 만날 수 없다.

베르타(가명) 역시 이와 비슷하게 임신 합병증을 겪고 기소되어 거의 1년간을 감옥에서 보냈다. 수감되어 있던 기간의 절반 동안은 열 살 난 아들을 만날 수 없었다.

“베르타”는 2010년 7월 출혈이 심한 상태로 지역 병원을 찾았다가 체포되었다. ‘고의 살인’ 죄로 기소되었지만 정작 본인은 임신한 사실조차 몰랐다. 재판이 시작할 때까지 변호사를 만나지도 못했다. 베르타가 기소된 죄목으로 유죄가 선고되면 최대 징역 50년형까지 처할 수 있었다. 사법절차가 시작된 지 거의 1년 만에 베르타는 무죄가 선고됐다. ‘치료 목적, 윤리적, 우생적 낙태 비범죄화를 위한 시민단체’라는 지역 인권단체의 소속 변호사들이 새로운 증거를 제출한 덕분이었다.

그러나 재판 과정과 교도소에 갇혔던 당시의 경험은 베르타와 가족들의 삶에 엄청난 상처를 남겼다.

베르타는 당시의 경험 때문에 여전히 정신적으로 힘든 상태이며, 이후 어떤 형태의 보상이나 배상도 받지 못했다고 국제앰네스티에 전했다.

베르타는 “몇 년이 지나더라도 그 때로 인한 고통은 여전히 마음속 깊은 곳에 남아 있다”고 말했다.

베르타의 어머니는 당시 베르타가 부당하게 교도소에 갇히면서 끼친 영향에 대해, “딸이 감방에서 지내는 동안 추위로 고생하고 있을 것을 생각하니 잘 때도 이불을 덮지 못했다. 이불을 덮지 않으면 함께 고통을 나눌 수 있겠다고 생각했기 때문이었다. 지금도 아무리 추워도 이불을 덮지 못하는 걸 보니 여전히 상처가 아물지 않은 것 같다. 지금은 베개도 딱딱한 바위처럼 느껴진다. 예전과는 전혀 달라졌다”고 국제앰네스티에 전했다.

아스트리드 발렌시아 조사관은 “엘살바도르 정부는 어린아이들에게 이처럼 감당할 수 없는 고통을 선고하기보다는, 여성을 그저 ‘출산 기계’로 취급하는 것만이 목적인 현행법을 재검토하는 데 여력을 집중해야 할 것”이라고 말했다.

1998년 개정형법에 따라, 엘살바도르는 강간, 근친상간에 의한 임신이거나 산모의 생명이 위험에 처한 경우에도 상관없이 모든 경우에 대한 낙태 시술을 금지했다. 이로 인해 여성들이 즉시 유죄로 몰리며 부당한 기소와 형법의 오적용이 계속되고 있다. 경제적으로 넉넉하지 못한 여성들은 특히 낙태금지법으로 더욱 큰 영향을 받았다.

EL SALVADOR’S TOTAL ABORTION BAN SENTENCES CHILDREN AND FAMILIES TO TRAUMA AND POVERTY

El Salvador’s extreme anti-abortion law is having a devastating effect on the lives of scores of children whose mothers, having suffered miscarriages or other obstetric emergencies, are being held behind bars accused of having illegal abortions, said Amnesty International in a new report today.

Separated families, broken ties, reveals how children of women jailed under the absurd anti-abortion law are often left facing difficult financial circumstances and prevented from staying in touch with their mothers.

“Each time authorities in El Salvador unfairly lock up a woman for having a miscarriage or suffering pregnancy related complications, they are also condemning her children to a life of poverty and trauma,” said Astrid Valencia, Central America Researcher at Amnesty International.

“El Salvador´s ‘guilty until proven innocent’ approach when it comes to women who suffer pregnancy-related complications has cost scores of lives, landed women in prison for up to 40 years and created an environment of absolute fear amongst doctors and patients. It is high time for El Salvador to abolish this outdated ban.”

At least 19 women are currently in jail, in the context of a total criminalization of abortion, convicted of serious offences such as homicide and sentenced to long prison terms on weak or inconclusive evidence. Most of them were their household’s main breadwinners. Since their incarceration, their extended families are responsible for providing and looking after their children, often in extremely difficult circumstances.

The lack of financial resources and the long distances between their homes and the prisons prevents many of the families from visiting their loved ones in prison. In some cases, women were not able to see their children for months.

Maria Teresa Rivera, a 32-year-old woman currently serving a 40 year prison sentence for “aggravated homicide” after having a miscarriage has only seen her ten-year-old son four times since she was jailed in 2011.

The boy lives with his grandmother several hours away from the prison and the journey is prohibitively expensive. Without Maria Teresa’s income and with no official support, her mother- in- law is also struggling to provide for her grandson.

Maria Teresa was arrested in a hospital after her mother-in-law found her in her bathroom almost unconscious and bleeding heavily. Staff at the hospital reported her to the police and accused her of having an abortion.

During the trial, one of Maria Teresa’s bosses testified against her saying she knew she was pregnant in January 2011. This would have made her 11 months pregnant by the time the miscarriage took place. The outrageous testimony was used as one of the pieces of evidence to convict her.

María Teresa´s young son is having a particularly difficult time dealing with his mother’s unfair detention.

“Isabel”, María Teresa´s mother in law, told Amnesty International of the traumatic visits to the prison: “The first time I took the child it was very hard. He cried a lot and I did too. He didn’t want to leave the prison. It was so hard that I stopped taking him for a while because it was tough for both of them.”

Similarly, Bertha (not her real name), spent nearly a year in jail also prosecuted for homicide after suffering a pregnancy-related complication. She was not able to see her 10- year-old son during half the time she was in prison.

“Bertha” was arrested in July 2010 in a local hospital, where she had arrived heavily bleeding. She was charged with “aggravated homicide” although she did not know she was pregnant. “Bertha” did not meet her lawyer until the trial started. The penalty for the crime she was accused of could be as high as 50 years in jail. Bertha was found innocent almost a year after the process against her began, when lawyers from the local human rights group Citizen Group for the Decriminalization of Therapeutic, Ethical and Eugenic Abortion provided new evidence on the case.

The trial and the time she was forced to spend in jail, however, left a profound mark on Berta’s life and her relatives.

She told Amnesty International that she is still traumatized by the experience and said she has not receive any kind of compensation or reparation measures.

“Even though several years have passed, the pain stays deep inside,” she said.

Talking about the impact of Bertha’s unfair incarceration on her family, her mother said: “To sleep, I couldn’t use the covers because during those days, when she was in the cells, I would start to think that she was suffering from the cold and so I wouldn’t cover myself so that I could experience her suffering. And now, I can’t use the covers even if I’m cold, so I know I’m still affected by it. Now, the pillow feels like a stone…I’m not the person I used to be.”

“Instead of sentencing children to this unbearable suffering, authorities in El Salvador should focus their energies in reviewing legislation that serves no purpose but to treat women as little more than ‘human vessels’,” said Astrid Valencia.

Following a change in the Penal Code in 1998, abortion in El Salvador has been banned in all circumstances – even when the pregnancy is the result of rape, incest or when the life of the woman is at risk. The change in the law has led to wrongful prosecutions and misapplication of criminal law where women are immediately assumed guilty. Women with few economic resources are particularly affected by the ban.

슬로바키아 동부의 한 작은 마을, 점심시간이 되자 어린이들의 웃음소리가 학교 운동장에 울려퍼진다. 높이 치솟은 인근 공장의 굴뚝에서 뿜어내는 회색 연기가 묵직하게 가라앉은 이곳은 특별할 것도 없는 평범한 마을이다. 다만 이 마을에 한 가지 평범하지 않은 점이 있다. “경미한 정신장애” 진단을 받고, 다른 아이들과 격리되어 소위 “특수” 학교에 배정 로마족 어린이들의 비율이 높다는 것이다.

로마족은 ‘정신 장애’?

실제로 이 마을의 로마족 어린이 500 여 명 중 3분의 1 정도가 상당히 축소된 교육과정을 가르치는 특수학교에 다니는 것으로 추정된다. 평범하지 않은 이러한 관행은 안타깝게도 슬로바키아 곳곳에서 낯설지 않게 벌어지고 있다. 2015년 유럽위원회는 로마족 어린이를 “경미한 정신장애”라고 일상적으로 오진해 다른 학생과 격리하는 방식으로 차별하는 슬로바키아에 대해 조약 위반 소송에 착수했다.

로마족은 빈곤과 소외의 악순환 속에 갇히게 된다.

아주 극소수의 로마족만이 중등교육을 받거나, 압도적으로 낮게 사회의 기대치를 벗어난다. 국제앰네스티와 유럽로마족인권센터가 발표한 조사 결과에 따르면, EU가 슬로베키아 정부에 벌금을 부과하겠다고 경고한 후에도 로마족 어린이의 처우에는 변화가 거의 없었다.

대폭 축소된 교육, 출발부터 다른 로마족 어린이들

학교가 끝나고 아이들이 돌아간 후, 담당 교사들에게 로마족 아이들의 미래에 대해 묻자 서로를 바라보며 웃었다. “다들 선생님이나 의사가 되고 싶고 싶어해요.” 한 교사는 이렇게 말했다. “하지만 아이들이 되고 싶어하는 것과 커서 닥칠 현실 사이에는 엄청난 괴리가 있죠.” 그 어조는 충격적이었다.

로마족 아이들도 다른 아이들과 같이 꿈이 있는데, 이들을 가르치는 교사들조차 이를 무시하는 것처럼 보였다. 대폭 축소된 교육과정으로는 출발부터 그 길이 막혀있다는 것을 아주 잘 알고 있기 때문이다. 로마족 어린이들은 이처럼 교실에 들어서는 순간부터, 다른 사람들에게는 모두 주어지는 선택의 기회가 없다.

로마족이 슬로바키아 사회에 기여하는 바가 거의 없다는 메시지를 철저히 주입받고 있다.

꿈도 꿀 수 없게 만드는 학교 교육

많은 로마족 어린이는 모국어로 슬로바키아어를 사용하지 않지만, 우리가 방문한 특수학교 중 한 곳에서는 슬로바키아어 수업 시간에 그림 활동을 했다. 한 남성은 아들이 17세에 특수학교를 졸업한 뒤에도 슬로바키아어로 읽고 쓰거나 말하는 것은 불가능했다고 전했다. 대부분이 슬로바키아어 구사 능력이 떨어져서 특수학교에 보내진 것임에도 불구하고 말이다.

로마족 아이들은 공부를 계속하고 싶어도 직업학교에 들어가는 것 외에는 선택의 여지가 거의 없다. 조사 대상 지역 중 한 곳의 로마족 남자아이들은 인근 공장에서 운영하는 사립 직업학교에 입학했다가 인근 공장에서 판매하는 전기 플러그를 연결하는 데 대부분의 시간을 보냈다고 말했다. 여자아이들은 “여성 실습” 수업을 받는다. 로마족 여자아이들에게 요리와 집안일 등 “현모양처”가 되는 법을 가르치는 전국적 프로그램의 일환이다.

로마족 어린이들의 진로의 협소함은 소냐(Soňa)와의 인터뷰에서 더욱 분명하게 드러났다. 소냐는 영특한 8학년 학생이지만 학교를 졸업하면 뭘 하고 싶냐는 질문에는 어깨를 으쓱했다. “직업학교에 가서 재봉을 배우겠죠. 여기 있는 다른 애들처럼요.”

차별과 편견을 숨기지 않는 교사

대부분의 교사들이 로마족 어린이의 성적 부진 원인으로 가정환경을 탓했다. 그러나 포용교육 제도가 보장되어야 할 빈곤층 어린이의 교육 지원 방법에 대해서는 아무런 제안도 하지 않았다.

그들(교사)에게 로마족 어린이는 투자할 가치도 없는 존재이다.

교사들은 학생들에게 인종차별적인 생각을 숨기려고도 하지 않는다. 한 교사는 근무하는 학교를 “작은 동물원”이라고 부르며, 자신의 아이는 절대 이 학교에 보내지 않을 것이라고 했다. 인터뷰한 다른 교사 중 하나도 근친상간을 언급하며 로마족에 대한 만연한 선입견을 드러내기도 했다.

2015년 슬로바키아 정부는 특수학교와 특수반에 로마족 어린이가 과도하게 배정되는 것에 대해 로마족 사회의 “높은 근친상간 비율” 때문이라고 해명했다. 그러나 슬로바키아의 교육제도에서 로마족 어린이들이 뒤처지는 진짜 이유는 반복적인 잘못된 진단과 정부의 해결 의지 부족 때문이다.

특수학교 배정 과정에서 책임자들의 문화적 편견도 어린이들의 교육을 방해한다.

현재 슬로바키아에는 약 32만에서 48만명의 로마족이 살고 있는 것으로 추정된다. 소수민족으로는 상당수를 차지하지만 수세기 동안 계속되는 차별과 낙인에 시달리고 있다.

21세기인 지금, 로마족은 슬로바키아 국내법, 유럽법, 국제법에 명시된 대로 차별 없이 교육을 받을 권리가 있다.

슬로바키아 정부는 지금의 상황을 해결하지 않을 경우 막대한 EU 벌금을 물게 됐다. 슬로바키아가 옳은 일과 법적 의무를 존중하기에는 이미 너무 늦었다. 로마족과 사회의 다른 구성원 간의 깊은 균열을 메우지 못한다면, 현 세대와 미래 세대는 계속해서 대가를 치르게 될 것이다.

러시아 정부는 블로거 루슬란 소콜로브스키(Ruslan Sokolovsky)의 공개 재판을 통해, 가혹한 ‘반극단주의법’ 등의 형사사법제도를 노골적으로 남용했다고 국제앰네스티가 11일 밝혔다.

예카테린부르크의 한 법원은 22세 블로거 소콜로브스키에게 “혐오를 조장”하고 “종교인에게 불쾌감을 준” 혐의로 3년 6월의 징역형과 집행유예를 선고했다. 소콜로브스키는 지난 2016년 9월, 우랄 예카테린부르크의 한 성당에서 ‘포켓몬 고(Pokémon Go)’를 했다는 이유로 체포되었다.

러시아 정부는 소콜로브스키에게 유죄를 선고함으로써 이 끔찍한 ‘신성모독’ 법에 맞서려는 사람들에게 강력한 메시지를 전달하고 있다. 이는 표현의 자유에 대한 또다른 공격인 것.

세르게이 니키틴(Sergei Nikitin) 국제앰네스티 러시아 사무소장은 “루슬란 소콜로브스키의 종교 관련 발언이 폄하적이라고 받아들이는 사람들도 있겠지만, 이것만으로는 기소할 이유가 되지 못한다. 그는 종교인들의 심기를 거스르는 것만으로 처벌하는 러시아의 가혹한 형법을 공개적으로 비판한 것다.”이라며 “러시아 정부는 소콜로브스키에게 유죄를 선고함으로써 이 끔찍한 ‘신성모독’ 법에 맞서려는 사람들에게 강력한 메시지를 전달하고 있다. 독실한 신앙심을 위해서도 아니고, 러시아의 종교의 자유를 보호하려는 순수한 의도로도 말이 안 된다. 특히 불과 지난 달 정부가 ‘여호와의 증인’ 종교를 금지한 것만 봐도 그렇다. 이는 표현의 자유에 대한 또다른 공격인 것”이라고 말했다.

루슬란 소콜로브스키의 유죄 판결은 이미 언론매체의 자체 검열이라는 걱정스러운 결과를 낳았다. 이러한 자체 검열의 가장 최근 사례로 케이블TV 채널인 2×2는 ‘교회 포켓몬 고’ 사건을 풍자한 미국 인기 애니메이션 ‘심슨(The Simpsons)’의 에피소드를 방영 금지했다.

배경

루슬란 소콜로브스키는 2016년 9월 3일 “종교 장소에서 신도들의 신앙심을 모욕하려는 목적으로 명백한 반사회적 정서를 공개적으로 표현하는 행위”와 “혐오 조장” 혐의로 체포되었다.

예카테린부르크의 가장 큰 교회 중 한 곳에서 휴대폰을 이용해 ‘포켓몬 고’를 하는 소콜로브스키의 유투브 영상은 이러한 형사절차의 구실로 이용됐다. 검찰은 체포 이후 소콜로브스키가 이전에 업로드한 영상까지 대대적으로 조사했고 총 17개 영상을 유죄 근거로 제시했다.

루슬란 소콜로브스키가 유죄 선고를 받은 것은 러시아 형법 282조(혐오 및 적대감, 인간 존엄의 모욕 조장)와 148조(양심의 자유와 종교의 자유의 침해)에 따른 것이다. 2016년 한층 더 강화된 282조는 러시아에서 정부를 비판하거나 반대하는 사람들을 대상으로 빈번히 사용되고 있다.

형법 148조는 2013년 개정되면서 흔히 ‘배교법’으로 알려진 조항이 포함되었다. 이 조항은 펑크 그룹 ‘푸시 라이엇(Pussy Riot)’이 모스크바의 한 러시아정교 성당에서 벌인 정치적 퍼포먼스와 같은 행위를 처벌하는 데 사용되었다. 당시 ‘푸시 라이엇’ 멤버들은 ‘무법주의’ 혐의로 임의 기소, 구금되었다.

튀니지에서 22세 대학생이 ‘동성 관계’를 맺었다는 이유로 징역 1년이 선고되면서 동성애 관련 논란에 불이 붙었다. 모하메드 살라흐 벤 아이사 튀니지 법무장관은 29일 공개적으로 동성애 비범죄화를 촉구하는 획기적인 행보를 보이기도 했다.

튀니지 수스 법원은 9월 22일 필명 ‘마르완(Marwan)’으로 알려진 남성에게 항문 성교의 “증거”를 인정받고자 항문 검사를 강행한 끝에 유죄를 선고했다. 국제앰네스티는 성적 지향성 또는 성 정체성만을 이유로 체포 및 구금된 경우 양심수로 간주한다.

9월 6일, 경찰은 수스에서 발생한 한 남성의 살인 사건과 관련해 마르완을 소환했다. 마르완은 살인 사건과의 연관성은 일절 부인했으나 살인 누명을 쓸 수도 있다는 경찰의 위협으로 피해 남성과 성관계를 가진 사실을 인정했고, 이 때문에 튀니지 형법 230조에 따라 징역 3년까지 처해질 수 있는 “남색” 혐의로 기소되었다. 형법 230조는 “여성 동성애”역시 범죄로 규정하고 있으나 실제 레즈비언 여성을 구금하는 데 적용된 경우는 거의 없다.

튀니지의 레즈비언, 게이, 양성애자, 성전환자, 인터섹스(LGBTI) 활동가들은 마르완 사건에 빠르게 대응했다. 이들 활동가 단체는 올해 초 진보적인 성향의 새로운 연립정부가 들어서면서 힘을 얻어 최근 더욱 큰 목소리를 내고 있는 가운데, 동성간의 합의된 성관계를 범죄화하는 것은 튀니지의 신규 헌법에 명시된 주요 권리 두 가지인 사생활을 보호받을 권리와 차별받지 않을 권리를 침해하는 것이라고 주장하며 이에 반대하는 캠페인을 벌여 왔다.

일부 단체는 심지어 강제 항문 검사를 철폐할 것을 촉구하는 온라인 캠페인을 시작했는데, 이는 튀니지에서 전례가 없었던 움직임이다.

모하메드 살라흐 벤 아이사 튀니지 법무장관은 마르완의 유죄 판결이 나온 지 수 일 뒤에 진행된 언론 인터뷰를 통해, 현행 형법 230조가 헌법에서 보장하는 사생활의 권리를 침해하고 있으며 폐지되어야 할 조항임을 인정했다. 튀니지의 인권활동가들은 이 기회를 놓치지 않고, 이 발언이 말로만 그치는 것이 아니라 행동으로 이어질 수 있도록 튀니지의 동성애 담론의 방향을 바꿔야 할 것이다.

안타깝게도 마르완 사건만이 유일한 사례는 아니다. 국제앰네스티는 최근 튀니지의 성폭력 근절 캠페인을 진행하며 2009년부터 2014년 사이 게이 남성을 대상으로 이루어진 체포, 구금, 기소 사례를 다수 기록한 바 있으나 활동가들은 알려지지 않은 사례가 훨씬 더 많다고 주장한다.

튀니지의 게이 남성들은 단지 “여성스러워” 보이거나, 게이 남성들아 자주 찾는다고 알려진 장소에서 다른 남성과 이야기를 나눴다는 이유만으로 체포되었다고 국제앰네스티에 전했다. 많은 사람들이 마르완과 마찬가지로 증거도 없이 체포되어, 항문성교 여부를 증명한다는 이유로 과학적인 근거도 없는 항문 검사를 강요당했다. 국제앰네스티는 이렇게 항문 검사를 강요하는 것도 고문 또는 부당대우에 해당하는 것으로 보고 있다.

한편 성전환자들 역시 단지 성별에 대한 기존의 고정관념과 사회적 표준에 따르지 않는다는 이유만으로 공중도덕 위반 혐의로 체포, 기소되었다고 국제앰네스티에 전했다.

그러나 이러한 관습법으로 인한 영향은 언제 체포되고 기소될 지 모르는 위험에 처하는 것 이상으로 훨씬 심각한 수준까지 이르고 있다. 전세계적으로 동성애가 범죄화된 경우 LGBTI에 대한 폭력이 더욱 만연해지고, 이들이 경찰에게 인권침해와 가혹행위 대상이 되거나 가족과 사회로부터 위협받는 것에 관대한 분위기가 조성되는 것으로 나타났다. 안타깝게도 튀니지 역시 예외는 아니다.

국제앰네스티와 인터뷰를 나눈 LGBTI 중에는 그들의 성 정체성이나 성적 지향성 때문에 칼에 찔리거나 베이고, 머리를 걷어차이고, 담배꽁초에 지져지고, 살해 위협까지 당한 사람들도 있었다. 경찰에 신고한다 해도 형법 230조로 인해 무시되는 경우가 많았다.

일부의 경우 경찰이 국제법적 의무에 따라 이러한 동성애, 성전환 혐오 범죄를 절차대로 조사하는 대신, 레즈비언 여성을 비롯한 생존 피해자들에게 본인이 기소되고 싶지 않다면 고발을 취하하라고 경고하거나 공개적으로 위협하기도 했다. 어떤 사례에서는 이렇게 기소될 것을 우려한 LGBTI들의 두려움을 이용해 경찰관들이 이들을 협박하고 금품을 갈취하거나 때로는 성추행까지 저질렀다. 게이 남성이나 성전환자들은 체포되지 않기 위해 경찰관에게 뇌물을 주거나 휴대폰 또는 귀중품을 포기할 수밖에 없는 경우가 많다.

이 때문에 강간이나 성폭행을 당한 LGBTI 피해자들은 대부분 경찰에 나서서 신고하기를 꺼리고 있다.

튀니지뿐만 아니라 세계 어느 곳에서도 합의하에 동성 파트너와 성관계를 갖는 것을 범죄화하는 것은 국제법과 국제기준에 위반되는 일이다.

최근 튀니지에서 LGBTI 인권에 대해 실질적인 공론을 이끌어내고자 하는 움직임은 이 사안이 긍정적인 방향으로 나아가는 작지만 중요한 걸음을 마침내 내딛고 있다는 희망을 갖게 한다.

하지만 궁극적으로 형법 230조를 폐지하고 합의하의 동성간 성관계를 완전히 비범죄화해야만 튀니지 정부에 차별과 폭력을 막는 적절한 보호대책을 마련할 것이라는 희망이 생길 것이다. 정부는 마르완을 즉시 석방하고, 성 정체성이나 성적 지향성만을 이유로 체포되거나 기소되는 사람이 없도록 관련법 개정 절차에 착수해야 한다.

Challenging Tunisia’s homophobic taboos

The case of a 22-year-old student sentenced to one year in prison for engaging in “homosexual relations” has finally sparked public debate on same-sex relations in Tunisia. Yesterday, the Minister of Justice Mohamed Salah Ben Aissa made a ground-breaking public call for the decriminalization of same-sex relations.

A court in Sousse convicted the man, known under the pseudonym Marwan, on 22 September after forcing him to undergo an anal examination to establish “proof” of anal sex. Amnesty International considers people who are arrested and detained solely on the basis of their sexual orientation or gender identity to be prisoners of conscience.

On 6 September, police had summoned Marwan in relation to the murder of a man in Sousse. When he denied any involvement in the crime, but admitted to having sex with the victim reportedly after the police threatened to bring a murder charge against him, he was charged with “sodomy” under Article 230 of the Penal Code which carries a maximum three-year prison sentence. The article also criminalizes “lesbianism” although it is rarely used to detain lesbian women.

Tunisia’s lesbian, gay, bisexual, transgender and intersex (LGBTI) activists quickly adopted Marwan’s case. Such groups have become increasingly vocal in recent months, emboldened by the creation of a new, more liberal, coalition government earlier this year. They have campaigned against the criminalization of consensual same-sex relations stressing that it violates two key rights guaranteed under Tunisia’s new Constitution – the right to a private life and non-discrimination.

Some groups have even launched an online campaign calling for an end to forced anal examinations – an unprecedented move in Tunisia.

Speaking in a media interview days after Marwan’s sentencing, Minister of Justice Mohamed Salah Ben Aissa acknowledged that Article 230 violates the constitutional right to private life and should be repealed. Tunisia’s human rights defenders must seize this momentum and change the course of the country’s discourse on this issue to ensure that words are turned into action.

Sadly, Marwan’s case is not isolated. As part of its campaign to end sexual and gender-based violence in Tunisia, Amnesty International has recently documented several cases of arrest, detention and prosecution of gay men between 2009 and 2014, but activists say that many more go unreported.

Gay men in Tunisia have told Amnesty International that they were arrested purely because they appeared to look “effeminate” or because they were seen speaking to another man in an area known to the police to be frequented by gay men. Like Marwan, many were arrested without evidence, and were forced to undergo an anal examination to establish proof of anal sex despite the fact that there is no scientific basis for such invasive examinations. Amnesty International believes forced anal examinations amount to a form of torture or other ill-treatment.

In other cases, transgender individuals told Amnesty International that they were arrested and prosecuted for offending public morals merely because they do not conform to established gender stereotypes and social norms.

But the impact of these laws reaches far beyond the constant risk of arrest and prosecution. Around the world, the criminalization of same-sex relations fosters violence against LGBTI people and creates a permissive environment where they can be subjected to police abuse and harassed and intimidated by their families and communities. Unfortunately, Tunisia is no exception.

Amnesty International has spoken to LGBTI people who have been stabbed or slashed with knives, kicked in the head, burnt with cigarette butts and threatened with death because of their gender identity or sexual orientation. Their reports to the police however, were often dismissed or ignored because of provisions in Article 230.

In some cases, instead of duly investigating these homophobic and transphobic crimes – as is their obligation under international law – the police warned or openly threatened survivors, including lesbian women, to drop their complaints if they did not wish to be prosecuted themselves. In other cases police officers have exploited LGBTI people’s fears of prosecution to subject them to blackmail, extortion and, at times, sexual abuse. Gay men and transgender individuals who do not want to be arrested are often forced to bribe police officers and give up their phones or other valuables.

Because of this, LGBTI survivors of rape and other sexual assault are often reluctant to come forward and report such attacks to the police.

The criminalization of consensual sex between same-sex partners whether in Tunisia or elsewhere in the world is contrary to international law and standards.

The recent moves to open up real, public debate on LGBTI rights offer a glimmer of hope that Tunisia is finally taking small but crucial steps in the right direction for progress on this issue.

But ultimately, only through repealing Article 230 of the Penal Code and decriminalizing consensual same-sex relations once and for all, will the Tunisian authorities have any hope of providing adequate protection against violence and safeguarding against discrimination. The Tunisian authorities should immediately release Marwan and embark on a process of amending legislation to ensure that no one is arrested and prosecuted on the basis of their gender identity and sexual orientation.

트랜스젠더 성노동자이자 지역단체 에스테 아모르(Este Amor, This Love)의 활동가이기도 한 제시카 루비 모리(법적 성명: 엘비스 게레로(Elvis Guerrero))는 2017년 6월 3일 도미니카 동부 이구에이 지역의 한 황무지에서 훼손된 시신으로 발견됐다. 언론 보도에 따르면 유력한 용의자 1명이 구금된 상태다.

TRANSSA(Trans Siempre Amigas – Trans Always Friends)의 대표 크리스티안 킹(Cristian King)은 2006년 이후 기록된 트랜스젠더 여성 피살 사건은 38건이지만 지금까지 단 4명에게만 유죄가 선고됐다고 밝혔다. 킹 대표는 최근 관련 사건 수사를 위해 도미니카 검찰청 인권팀과 TRANSSA가 긴밀하게 협력하고 있다고 국제앰네스티에 전했다.

몇 주 전에는 지난 2014년, 마찬가지로 트랜스젠더 여성이었던 킴벌리 소디(Kimberly Sody)를 살해한 혐의로 피고에게 징역 20년형이 선고되기도 했다.

도미니카공화국의 LGBTI 단체들은 오래 전부터 트랜스젠더 인권 보호를 위해 ‘성정체성법(Gender Identity Law)’ 도입을 촉구했다. 지난해 입안된 ‘반차별법’ 초안은 도미니카 내 다수의 집단에 영향을 미치고 있는 뿌리깊은 역사적인 차별, 특히 그 중에서도 성정체성, 성적 지향, 민족에 기반한 차별 문제를 해결하고자 마련된 것이었다. 이 법안은 아직 국회에 상정되지 못한 상태다.

“도미니카공화국 정부는 이러한 법안이 시행될 수 있도록 시민사회단체와 계속해서 협력해야 한다. 이런 범죄는 반드시 독립적이고 공정하게 조사해야 한다. 정부는 이번 사건의 동기에 영향을 미쳤을 가능성이 있는 차별적인 요소를 밝히기 위해 모든 조치를 취해야 한다.”

카리브해 지역 취약공동체연합(by the Caribbean Vulnerable Communities Coalition, CVC)이 2012년 발표한 연구에 따르면 도미니카공화국의 트랜스젠더 여성 성노동자 중 중학교 교육과정을 이수한 사람은 전체의 35%에도 미치지 못했다. 교육과정에서부터 밀려난 트랜스젠더 여성 대부분은 최소 16세의 어린 나이부터 성매매에 참여하게 된다. 이처럼 일찌감치 사회적으로 소외되면서 이들은 빈곤과 더욱 극심한 폭력에 직면한다. 트랜스젠도는 성노동과 같은 범죄화된 노동으로 떠밀리는 경우가 많은데, 이로 인해 향후에는 경찰의 인권침해와 임의 구금에도 노출된다.

같은 연구 결과, 트랜스젠더 성노동자 중 80%가 성노동자로서 겪는 차별보다 성전환자로서 겪는 차별이 훨씬 크고 느낀 것으로 밝혀졌다. 트랜스젠더 성노동자 중 35% 이상은 길을 걷던 도중 신체적인 폭행을 당한 경험이 있었고, 40% 이상은 손님에게, 20% 이상은 연인에게 신체적 폭행을 당했다. 80%는 최소 1회 이상 체포되거나 구금된 적이 있었으며, 36%는 구속되지 않기 위해 경찰관에게 성접대를 한 경험이 있었다.

이란의 청소년 수백 명이 18세 이전에 저지른 범죄로 인해 사형수로 살아가고 있다고 국제앰네스티는 26일 새로 공개한 보고서를 통해 비판했다. 이 보고서는 계속되는 아동 인권침해를 은폐하고, 세계 최대 소년범 처형 국가라는 충격적인 사실에 대한 비판을 면하려는 정부의 최근 시도와 관련해 그 실상을 폭로하고 있다.

보고서 <사형수로 자라나다: 이란의 사형제도와 청소년 범죄자(영문)>는 이란 정부가 계속해서 청소년 사형수들을 처형대로 보내고 있다고 폭로하면서, 당국이 일부 개혁을 통해 긍정적인 성과가 있었던 것처럼 발표하고 있으나, 실제로는 아직 사형을 선고하고 있다는 점을 밝히고 있다.

사이드 부메두하(Said Boumedouha) 국제앰네스티 중동북아프리카 부국장은 “이번 보고서는 아동 인권을 부끄러우리만치 경시하고 있는 이란 정부의 실태를 밝히고 있다. 범죄 당시 18세 이하였던 청소년에 대해서는 법적으로 사형 부과를 절대적으로 금지하고 있음에도 이란은 이를 명백히 위반하며 청소년 사형수들을 계속해서 처형하고 있는 몇 안 되는 나라 중 하나”라며 “이란 소년사법제도에 다소의 개혁이 이루어지긴 했으나, 여전히 여성은 9세, 남성은 15세부터 사형에 처할 수 있도록 허용하는 법률을 유지하고 있어 세계 대부분 국가보다 뒤처져 있다”고 말했다.

최근 수년간 이란 정부는 범죄 당시 청소년 범죄자의 정신적인 발달과 성숙도를 재량적으로 평가한 결과에 따라 사형을 다른 형벌로 대체할 수 있도록 허용하는 2013년 개정형법 도입을 자축했다. 그러나 이러한 조치만으로는 축하할만한 이유가 될 수 없다. 실제로는 오히려 20년 전 이란이 유엔 아동권리협약(CRC)을 비준할 당시 청소년에 대한 사형제도 부과를 완전히 폐지하겠다고 약속한 내용을 지금까지도 지키지 않고 있다는 사실을 드러낸 것밖에는 안된다.

이란은 아동권리협약의 당사국으로서 18세 이하의 모든 사람을 아동으로 대우하고, 이들에게 사형 또는 석방 가능성 없는 무기징역을 절대 부과하지 않도록 보장해야 한다는 법적 의무가 있다.

그러나 국제앰네스티의 보고서에 2005년부터 2015년 사이 사형이 집행된 것으로 기록된 청소년 범죄자의 수는 73명에 이른다.

유엔 발표에 따르면 지금도 최소 160명 이상의 청소년 사형수가 복역 중이다. 이란의 사형제도 사용에 관한 정보는 비밀에 부쳐지는 경우가 많으므로 실제 숫자는 더욱 높을 것으로 보인다.

국제앰네스티는 보고서를 통해 청소년 사형수 49명의 이름과 수감 장소를 파악할 수 있었다. 대부분이 평균적으로 7년 동안 갇혀 있었던 것으로 밝혀졌다. 국제앰네스티가 기록한 일부 사례의 경우에는 사형 선고를 받고 갇힌 기간이 10년을 넘기기도 했다.

사이드 부메두하 부국장은 “이번 보고서는 삶의 귀중한 시간을 빼앗긴 채 사형수로 살아가는 청소년 사형수들의 매우 비참한 현실을 보여주고 있다. 이들은 고문과 부당대우로 자백을 강요당하고, 이러한 자백을 근거로 판결이 내려지는 등의 불공정한 재판으로 사형을 선고받은 경우가 많았다”고 말했다.

다수의 사례에서 정부는 청소년 사형수의 사형 집행 일정을 결정한 후, 사형 집행 불과 몇 분 전에 다시 연기하며 사형수로서의 고통을 더욱 극심하게 만들었다. 이는 그야말로 매우 잔혹하고, 비인도적이며 굴욕적인 대우이다.

정의 구현 실패한 ‘단편적’ 개혁

2013년 5월 이란 개정형법이 채택되면서 청소년 사형수들의 처우가 마침내 현장에서나마 개선될 것이라는 조심스러운 기대가 있었다. 개정형법에서는 판사가 범죄 당시 청소년 범죄자의 정신적 성숙도를 평가하고, 그 결과에 따라 사형을 다른 형벌로 대체해 부과할 수 있도록 한다. 2014년 이란 대법원은 모든 청소년 사형수가 재심 신청이 가능하다고 말했다.

그러나 개정형법이 채택된 지 거의 3년이 지난 지금도 여전히 청소년 사형수에 대한 사형집행이 계속되고 있으며, 어떤 경우에는 청소년 사형수에게 재심을 신청할 권리가 있다는 사실조차 알리지 않기도 했다.

또한, 보고서는 안타깝게도 최근 개정된 형법에 따라 재심을 받은 청소년 사형수들이 범죄 당시 “정신적으로 성숙”한 것으로 판정되어 다시 사형이 선고되는 일이 증가하는 경향을 지적하며, 거의 아무것도 변화한 것이 없다는 명백한 증거라고 꼬집었다.

부메두하 부국장은 “재심 허용과 그 외 단편적인 개혁은 이란 소년사법제도의 진전 가능성을 보여줬다며 크게 환영을 받았지만, 이는 그저 잔혹한 결과만을 낳은 변덕스러운 과정에 불과했다는 사실이 점차 드러나고 있다”고 말했다.

어떤 경우에는 판사가 ‘사람을 죽이면 안 된다는 것을 알고 있는지’와 같은 간단한 질문을 근거로 청소년 범죄자의 “성숙도”를 판단하기도 했다. 또한, 어린 나이로 인한 아동의 미성숙과 정신질환으로 발생하는 책임능력 문제를 빈번히 혼동해, 청소년 범죄자가 ‘정신질환자’가 아니므로 사형이 선고되어야 마땅하다고 판결하는 경우도 많았다.

파테메흐 살베히(Fatemeh Salbehi)는 16세 때 강제로 결혼해야 했던 남편을 살해한 혐의로 2015년 10월 처형됐다. 파테메흐는 재심에서 정신 감정이라며 기도를 하거나 종교 서적을 공부했는지 정도의 기본적인 질문을 받고, 불과 몇 시간 만에 사형이 재선고됐다. 이외에도 하미드 아흐마디, 아미르 암롤라히, 샤바쉬 마흐무디, 사자드 산자리, 살라르 샤디자디 등 5명은 범죄의 특성을 알고 있고 정신질환을 가지고 있지 않다는 판사의 판단으로 재심에서 사형을 다시 선고받았다.

사이드 부메두하 부국장은 “청소년 범죄자에 대한 사형선고와 집행을 금지하는 법을 시급히 만들어야 이런 결함들을 해결할 수 있을 것”이라며 “청소년 범죄자의 삶과 죽음을 판사의 변덕에 맡겨서는 안 된다. 이란 정부는 한참 부족한 수준의 성의 없는 개혁에 그칠 것이 아니라, 정말로 필요한 것은 모든 청소년 사형수들을 감형하고 청소년에 대한 사형 부과를 완전히 철폐하는 것임을 받아들여야 한다”고 말했다.

이란이 국제외교무대에 다시 참여하고 있는 만큼 세계 각국은 이러한 신규 채널을 이용해 이번 보고서에서 확인된 사례에 대해 이란 정부에 문제를 제기하고, 즉시 모든 청소년 사형수들을 감형할 것을 촉구해야 한다.

배경

2015년 6월 이란 정부는 형사 기소된 청소년이라면 반드시 특수소년법원에서 재판을 받도록 명시한 개정안을 발의했다. 이전까지는 사형이 선고될 수 있는 범죄로 기소된 청소년의 경우 성인 법원에서 재판을 받는 것이 일반적이었다.

특수소년법원 설립은 환영할만한 조치지만, 실제로 이를 통해 청소년에 대한 사형 부과를 막을 수 있을지는 지켜봐야 할 일이다.

지난 10년간 10대 청소년의 뇌 발달에 관한 신경학적 연구 결과 등 청소년기와 범죄 간의 연관성을 다룬 학제간 사회과학 연구자료는 청소년의 과실 정도가 성인에 비해 적게 고려되어야 한다는 주장의 근거로 인용되었다. 이러한 연구 결과는 2005년 미국 대법원이 18세 이전에 저지른 범죄로 유죄가 선고되었을 경우 사형을 부과하지 못하도록 결정한 논의의 근거로도 인용되었다.

Iran’s hypocrisy exposed as scores of juvenile offenders condemned to gallows

Scores of youths in Iran are languishing on death row for crimes committed under the age of 18, said Amnesty International in a damning new report published today. The report debunks recent attempts by Iran’s authorities to whitewash their continuing violations of children’s rights and deflect criticism of their appalling record as one of the world’s last executioners of juvenile offenders.

Growing up on death row: The death penalty and juvenile offenders in Iran reveals that Iran has continued to consign juvenile offenders to the gallows, while trumpeting as major advances, piecemeal reforms that fail to abolish the death penalty against juvenile offenders.

“This report sheds light on Iran’s shameful disregard for the rights of children. Iran is one of the few countries that continues to execute juvenile offenders in blatant violation of the absolute legal prohibition on the use of the death penalty against people under the age of 18 years at the time of the crime,” said Said Boumedouha, Deputy Director of Amnesty International’s Middle East and North Africa Programme.

“Despite some juvenile justice reforms, Iran continues to lag behind the rest of the world, maintaining laws that permit girls as young as nine and boys as young as 15 to be sentenced to death.”

In recent years the Iranian authorities have celebrated changes to the country’s 2013 Islamic Penal Code that allow judges to replace the death penalty with an alternative punishment based on a discretionary assessment of juvenile offenders’ mental growth and maturity at the time of the crime. However, these measures are far from a cause for celebration. In fact, they lay bare Iran’s ongoing failure to respect a pledge that it undertook over two decades ago, when it ratified the Convention on the Rights of the Child (CRC), to abolish the use of death penalty against juvenile offenders completely.

As a state party to the CRC Iran is legally obliged to treat everyone under the age of 18 as a child and ensure that they are never subject to the death penalty nor to life imprisonment without possibility of release.
However, Amnesty International’s report lists 73 executions of juvenile offenders which took place between 2005 and 2015.

According to the UN at least 160 juvenile offenders are currently on death row. The true numbers are likely to be much higher as information about the use of the death penalty in Iran is often shrouded in secrecy.
Amnesty International has been able to identify the names and location of 49 juvenile offenders at risk of the death penalty in the report. Many were found to have spent, on average, about seven years on death row. In a few cases documented by Amnesty International, the time that juvenile offenders spent on death row exceeded a decade.

“The report paints a deeply distressing picture of juvenile offenders languishing on death row, robbed of valuable years of their lives – often after being sentenced to death following unfair trials, including those based on forced confessions extracted through torture and other ill-treatment,” said Said Boumedouha.

In a number of cases the authorities have scheduled the executions of juvenile offenders and then postponed them at the last minute, adding to the severe anguish of being on death row. Such treatment is at the very least cruel, inhuman and degrading.

‘Piecemeal’ reforms failing to deliver justice

Iran’s new Islamic Penal Code adopted in May 2013 had sparked guarded hopes that the situation of juvenile offenders under a death sentence would finally improve, at least in practice. The Code allows judges to assess a juvenile offender’s mental maturity at the time of the offence, and potentially, to impose an alternative punishment to the death penalty on the basis of the outcome. In 2014, Iran’s Supreme Court confirmed that all juvenile offenders on death row could apply for retrial.

Yet almost three years after the changes to the Penal Code, the authorities have continued to carry out executions of juvenile offenders, and in some cases, they even fail to informed the juvenile offenders of their right to apply for a retrial.

Tragically, the report also points to a growing trend where juvenile offenders retried under recent reforms are judged to have attained “mental maturity” at the time of the crime and resentenced to death, in blatant evidence of how little has changed.

“Retrial proceedings and other piecemeal reforms had been hailed as possible steps forward for juvenile justice in Iran but increasingly they are being exposed as whimsical procedures leading to cruel outcomes,” said Said Boumedouha.

In some cases, judges have concluded that a juvenile offender was “mature” based on a handful of simple questions such as whether he or she understood that it is wrong to kill a human being. They have also repeatedly confused the issue of lack of maturity of children due to their age with the diminished responsibility of individuals with mental illness, concluding that a juvenile offender was not “afflicted with insanity” and therefore deserved the death penalty.

Fatemeh Salbehi was executed in October 2015 for murdering her husband whom she was forced to marry at 16. She was resentenced to death after a retrial session lasting only a few hours in which the psychological assessment was limited to a few basic questions such as whether or not she prayed or studied religious textbooks. In five other cases Hamid Ahmadi, Amir Amrollahi, Siavash Mahmoudi, Sajad Sanjari, and Salar Shadizadi were resentenced to death after courts presiding over their retrials concluded that they understood the nature of the crime and were not insane.

“The persisting flaws in Iran’s treatment of juvenile offenders highlight the continuing and urgent need for laws that categorically prohibit the use of the death penalty against juvenile offenders,” said Said Boumedouha.

“The life or death of a juvenile offender must not be left at the whim of judges. Instead of introducing half-hearted reforms that fall woefully short, Iran’s authorities must accept that what they really need to do is commute the death sentences of all juvenile offenders, and end the use of the death penalty against juvenile offenders in Iran once and for all.”

As Iran re-enters the world of international diplomacy it is also crucial that world leaders use such new channels to raise the cases identified in this report with the Iranian authorities and to urge them to immediately commute all death sentences for juvenile offenders.

Background

In June 2015 Iran introduced reforms specifying that juveniles accused of a crime must be dealt with by specialized juvenile courts. Previously juvenile offenders accused of capital crimes were generally prosecuted by adult courts.
Although the introduction of specialized juvenile courts is a welcome step, it remains to be seen whether this will prevent further use of the death penalty against juvenile offenders in practise.

Over the past decade, interdisciplinary social science studies on the relationship between adolescence and crime, including neuroscientific findings on brain maturity of teenagers, have been cited in support of arguments for considering juveniles less culpable than adults. Such findings were invoked during arguments which ultimately persuaded the US Supreme Court to abolish the death penalty against individuals convicted of committing a crime while under 18 years of age in 2005.
