투르크메니스탄에서 2017년 개최되는 실내 무술 아시안게임을 앞두고 수도 아슈하바트의 미관 개선 사업의 일환으로 약 5만 명 이상이 강제 퇴거됐다고 국제앰네스티가 28일 밝혔다. 국제앰네스티는 강제퇴거로 인한 파괴 규모를 나타내는 위성사진을 함께 공개했다.

국제앰네스티의 위성사진 분석 결과, 2015년 3월부터 4월 사이 아슈하바트 인근 초건리 마을에서 1가구당 평균 5인이 거주하던 주택 5,000가구가 파괴되었다. 이후 9월이 되자 1만 채 이상의 주택이 있었던 이 마을은 완전히 폐허가 되었고, 지금까지도 수도 곳곳에서 철거가 계속되며 수많은 주민들이 집을 잃게 된 것으로 밝혀졌다.

데니스 크리보셰프(Denis Krivosheev) 국제앰네스티 유럽중앙아시아 부국장은 “아시안게임 개최를 계기로 투르크메니스탄의 인권상황을 개선할 수 있는 기회를 얻었음에도, 정부는 교외에서 일자리를 찾아왔거나 이미 다른 곳에서 강제 퇴거된 사람들이 대부분인 이 지역 주민들의 생활 환경을 더욱 악화시키고 있을 뿐”이라며 “정부의 무자비한 퇴거 방식은 명백한 국제인권기준 위반이다. 투르크메니스탄 정부는 즉시 강제퇴거와 불법 철거를 중단하고, 피해 주민들에게 적절한 보상과 대체 주거지를 시급히 제공해야 한다. 특히 겨울이 다가오고 있는 지금이 가장 취약한 때”라고 말했다.

국제앰네스티가 분석한 위성사진은 세계에서 가장 어둠 속에 감춰져 있는 사회의 단면을 엿볼 수 있는 희귀한 자료다. 구르반굴리 베르디무하메도프 투르크메니스탄 대통령은 독재자였던 전임 대통령과 마찬가지로 공포 정치를 통해 국민의 숨통을 조이며 실권을 유지하고 있다. 감시가 만연하고 정부에 반대하는 의견을 거의 찾아볼 수 없는 투르크메니스탄에서는 자신과 주변인들의 안위를 위협하면서까지 감히 목소리를 내려는 사람은 거의 없다.

국제앰네스티를 비롯한 인권감시단체는 투르크메니스탄으로의 입국이 금지된 상태다. 그러나 조사관들의 노력으로 전화 인터뷰 및 신뢰성 있는 소식통을 통한 증언과 철거 현장이 담긴 위성 사진 등을 수집할 수 있었다. 퇴거당한 초건리 주민들은 당시 정부와 경찰이 “탱크처럼 들이닥쳐” 마을 사람들을 강제로 퇴거시켰다고 말했다.

한 마을 주민은 “이제 사람들은 그곳에 가서 오열만 할 뿐”이라며, 마을 사람들의 주택 허가는 무참히 무시당했고, 불도저로 밀린 옛 집 터로 돌아가 슬퍼하는 사람들도 있었다고 전했다. 이 주민은 철거 당시 정부 관계자들이 집에 들이닥쳐 가족들과 함께 당황한 아이들까지 모두 쫓아내던 모습이 아수라장과 다름 없었다고도 증언했다.

베르디무하네도프 대통령은 아시아 올림픽위원회에서 주관하는 이번 실내무술 아시안게임 개최를 앞두고 수도 아슈가바트를 현대화하기 위한 개발 계획 진행을 직접 감독하고 있다. 초건리와 쇼르 구역에 이어서 9월 아슈가바트의 다른 지역에서도 주택 철거가 이루어지는 등 강제퇴거는 조금도 변함없이 계속되고 있다.

베르디무하네도프 정권은 투르크메니스탄에 매장된 다량의 석유와 가스로 힘을 얻고 있으며, 이번 아시안게임 개최는 투르크메니스탄의 국제적인 입지를 더욱 개선시킬 기회로 여겨지고 있다. 국제앰네스티는 해외 각국 정부와 기업에 대해, 투르크메니스탄과의 모든 정치적 또는 경제적 협력사업이 전반적인 인권침해행위에 일조하지 않도록 할 것을 촉구한다.

데니스 크리보셰프 부국장은 “안타깝게도 투르크메니스탄에서 박해와 억압은 일상과도 같은 것이다. 국제사회와 기업체는 베르디무하메도프 대통령이 자국에서 자행하는 인권침해행위를 중단하라고 압박하기 위해 가능한 모든 조치를 취해야 할 것”이라며 “강제퇴거는 어떤 경우에도 정당화될 수 없다. 모든 퇴거는 언제나 최후의 수단으로, 국제인권기준에 따라서만 이루어져야 한다. 이러한 인권기준에는 주거권을 보호할 것과 적절한 법적 및 절차적 안전 조치에 따를 것, 이러한 퇴거 명령에 공포와 박해 없이 반대할 수 있는 권리를 보장할 것 등이 포함된다”고 말했다.

Turkmenistan: Satellite images reveal how mass forced evictions blight upcoming Asian Games

An estimated 50,000 or more people have been forcibly evicted from their homes as part of a push to “beautify” the capital of Turkmenistan ahead of the 2017 Asian Indoor and Martial Arts Games, Amnesty International revealed today as it published satellite images showing the extent of the devastation.

Amnesty International’s analysis of satellite images shows that 5,000 houses, each home to an average of five people, were destroyed in the Choganly neighbourhood near Ashgabat between March 2014 and April 2015. The organization has since learned that the entire neighbourhood – comprising more than 10,000 houses – was entirely razed to the ground by September and that fresh demolitions are continuing in other areas of the capital rendering many families homeless.

“Instead of using the Games as an opportunity to clean up Turkmenistan’s human rights record, local authorities there have only succeeded in worsening living conditions for residents, many of whom had moved to Ashgabat from the countryside in search of work or had already been evicted elsewhere,” said Denis Krivosheev, Amnesty International’s Deputy Programme Director for Europe and Central Asia.

“The ruthless way in which they have been evicted is in clear violation of international human rights standards. Turkmenistan’s government must immediately put an end to forced evictions and illegal demolitions, compensate the victims and give them access to adequate alternative housing urgently. They are especially vulnerable as winter approaches.”

Amnesty International analyzed satellite images that provide a rare glimpse into one of the world’s most darkly shrouded societies. President Gurbanguly Berdymukhamedov, like his autocratic predecessor, is at the helm of a government that maintains a stranglehold of fear on the population. Surveillance is rife and dissent is rare in Turkmenistan, where the few voices that do dare to speak up risk their own safety and that of their relatives.

Amnesty International and other human rights monitors are barred from the country. However, researchers corroborated details of the evictions depicted in the satellite imagery with testimony from phone interviews and other confidential sources. Former Choganly residents described how authorities, including the police, “burst in like tanks” and forcibly evicted dwellers.

“Now people go there to cry,” said one former Choganly resident, who described how their housing permits were brutally disregarded and some return to grieve on bulldozed plots where their homes once stood. She described to Amnesty International the scene of chaos her family faced when authorities charged into their house forcibly evicting the family, including distraught children.

President Berdymukhamedov has personally overseen the development projects in a bid to modernize Ashgabat ahead of the Games, organized by the Olympic Council of Asia. Following the demolitions in Choganly and the district of Shor, the forced evictions have continued unabated, with the authorities moving on in September to destroy homes in other areas of Ashgabat.

President Berdymukhamedov’s regime is bolstered by the country’s large oil and gas reserves, and the Games are regarded as an opportunity to improve its international standing. Amnesty International is calling on foreign governments and businesses to ensure that neither political nor economic cooperation with Turkmenistan contribute to human rights violations in general.

“Sadly, intimidation and repression is a daily fact of life in Turkmenistan. The international community and businesses must do everything within their power to press President Berdymukhamedov to put an end to the human rights violations perpetrated in the country,” said Denis Krivosheev.

“Forced evictions can never be justified. Any eviction must always be a last resort and in compliance with international human rights standards. This includes protecting the right to housing, ensuring compliance with appropriate legal and procedural safeguards and guaranteeing the right to oppose such evictions without fear and harassment.”

대선 출마를 선언한 유승민 바른정당 의원이 지난해 공직자 재산 신고에서 부친으로부터 상속받은 거액의 부동산을 누락해 신고한 사실이 뉴스타파 취재를 통해 확인됐다. 공직자 윤리법 위반에 해당되는 것으로 현행 공직자윤리법은 상속 재산이라도 사실상 소유한 재산에 대해 신고하도록 규정하고 있다.

뉴스타파 대선후보 검증팀은 유 의원과 그의 부친 유수호 전 의원의 신고 재산을 전수조사했다. 그 결과 지난 2015년 11월 사망한 유수호 전 의원 명의의 부동산 일부가 유 의원과 그의 형제들에게 분할 상속됐다는 사실을 확인할수 있었다.

이 가운데 유 의원이 상속받은 부동산은 모두 4건이었다. 4건의 부동산 모두 유 의원의 형인 유승정 전 서울남부지법 법원장과 공동 상속을 받았다.

유승민 의원이 상속 받은 소유 지분은 유수호 전 의원이 거주하던 대구 대명동 자택의 토지 일부(공시가 기준 약 2.65억 원)와 건물(공시가 기준 약 3.37억 원), 유 전 의원이 생전에 보유했던 대구 남일동 빌딩의 상가(가액 8.1억 원), 그리고 영주시 풍기읍 백리에 있는 임야 18700여 ㎡(가액 1,600만 원)다. 일반적으로 시세보다 낮게 책정되는 공시가와 신고가로 환산해도 이들 부동산의 가액은 14억 원이 넘는다.

특히 대구 도심에 위치한 남일동 상가의 경우, 별도의 임대료가 발생하고 있는 것으로 확인됐다. 현재 이 상가에는 대형 학원이 입주해 있다. 인근 부동산업자는 한 달의 300만 원 안팍의 임대료가 가능한 위치라고 말했다. 빌딩 관리업체는 상가 임대료가 유의원 형제에게 바로 지급된다고 말했다.

하지만 2016년 3월 공시된 유 의원의 재산 신고 내역에는 이들 상속 부동산 4건을 신고하지 않았다. 공직자윤리법(6조 ‘변동사항 신고’)에 따르면,  재산변동신고는 이전 연도의 12월 말일 기준으로 작성해 이듬해 2월까지 신고하도록 돼 있다. 유 의원의 부친 유수호 전 의원이 별세한 시점은 지난 2015년 11월 7일이다. 당시 상속받은 재산은 현행법 상 공직자 재산 신고 대상에 포함된다.   

이번에 뉴스타파 취재를 통해 확인된 상속 재산까지 합하면 유승민 의원의 전체 재산은 50억 원이 넘는20170302다. 그는 2016년 3월 국회공보에 공개된 유 의원의 재산 신고액은 36억여 원이었다.

유 의원이 상속받은 재산의 등기부 등본에 따르면, 상속 후 부동산의 등기는 유수호 전 의원이 별세한지 6개월이 지난 2016년 5월에서야 이뤄졌다. 시점상 유 의원이 20대 총선을 치르고 난 뒤다.  현행법상 상속받은 부동산의 등기 시기를 제한하는 규정은 없다.  

하지만 공직자윤리법 시행규칙 등에 따르면 상속중인 재산 등 등기 명의인이 아직 아니지만 사실상 부동산을 소유하고 있는 경우에도 반드시 신고하도록 규정하고 있다. 공직자윤리위원회 관계자는 뉴스파와의 통화에서 “등기 명의인이 아니더라도 사실상 소유하고 있는 부동산을 재산 신고 과정에서 누락한 것은 엄연히 위법”이라고 설명했다.

“시행규칙 등에 따르면 상속 재산을 포함, 본인의 명의로 되어있지 않은 재산이라도 실소유하고 있으면 사유를 기재하고 신고도록 되어 있다. 누락했을 경우 상급기관에 통보하여 징계에 처하게 하거나 경고를 할 수 있다.” – 공직자윤리위원회 관계자

이 때문에 이른바 금수저 논란을 피하기 위해, 새로 생긴 상속 재산을 고의로 누락해 전체 재산 규모를 줄이려 하지 않았냐는 의혹을 불러일으킨다. 실제 유 의원은 20대 총선에서 이른바 ‘배신자 파동’으로 인해 새누리당 공천 탈락과 무소속 출마라는 정치적 시련을 겪었다.

이에 대해 유승민 의원은 취재진과의 만남에서 “아버지가 돌아가신지 얼마되지 않아 신고하지 못한 것”이라며 “2017년 재산신고 때는 (누락됐던) 부분들을 다 반영했다”고 말했다.

또 유 의원 측 관계자는  “(당시 재산 신고 과정에서) 실무자의 실수가 있었던 것으로 보인다”고 말했다. 그러면서 “2016년 재산신고 당시 공직자윤리위나 선관위의 지적이 없었고 상속재산 신고에 대한 별도의 설명도 없었다”고 해명했다. 또 상가 임대료 부분에 대해서도 “임대사업자등록과 관련 세금 납부 등 모든 과정을 정상적으로 완료한 상태다”고 밝혔다.   

최근 경제력 없는 대학생 자녀가 2억 원 가까운 예금을 보유한 것으로 드러난데 이어, 공시지가 등으로만 14억 원 넘는 상속 재산을 신고하지 않은 사실까지 확인되면서 유승민 의원을 둘러싼 도덕성 논란은 불가피할 것으로 보인다.

유승민 바른정당 의원은 대구에서 4선을 한 중진 의원이다. 미국 위스콘신 대학에서 경제학 박사 학위를 받고 한국개발연구원(KDI) 선임연구위원을 지낸 ‘경제통’이다. 2015년 2월 새누리당 원내대표에 선출됐지만, ‘배신자 파동’을 겪고 중도 사퇴했다.

‘전통 의술사’의 ‘마법약’ 조제 위해 백색증이 있는 사람의 특정 신체부위 노려

 

국제앰네스티는 2016년 6월 발표한 보고서를 통해, 백색증이 있는 사람이 신체부위를 노리는 사람들에게 ‘짐승처럼 쫓기며 살해당하는’ 실태를 공개했다. 백색증이 있는 사람의 뼈는 말라위와 모잠비크의 전통 의술사가 부와 행운을 부르는 주문 및 마법약을 만들고자 구입하는 것으로 알려져 있다.

배경정보

말라위에서 2014년 11월 이후 지금까지 최소 20명 이상의 백색증이 있는 사람이 피살되었으며, 그 중 두 사건은 올해 벌어졌다.
말라위 경찰청에 따르면 2014년 11월 이후 지금까지 신고된 백색증이 있는 사람 관련 범죄는 최소 117건이다.
*백색증이 있는 사람은 행운을 부르는 주술적인 힘이 있다는 믿음 때문에 이들의 신체부위를 노리는 사람들에게 표적이 된다.
말라위에는 약 7천명에서 1만 명의 백색증이 있는 사람들이 살고 있는 것으로 추정된다.

백색증이 있는 사람에 대한 습격 사건이 해결되지 않는다면, 이처럼 끔찍한 범죄의 가해 용의자들이 활개를 치게 된다.

2017년 살인 사건

2016년 6월부터 12월까지 6개월 정도 주춤하던 백색증이 있는 사람 대상 살인 및 습격 사건은 2017년 1월부터 다시 급증하기 시작했다.

2017년 2월 28일, 31세 여성이 머시 자이나부 반다(Mercy Zainabu Banda)는 릴롱궤에서 손과 오른쪽 가슴, 머리카락이 없는 시신으로 발견되었다.

2017년 1월 10일에는 19세 마달리초 펜술로(Madalitso Pensulo)가 오후 다과 초대를 받고 티욜로 지역 믈론다 마을에 위치한 친구 집으로 향하던 중 피살되었다. 행인이 비명소리를 들었지만 경찰이 현장에 도착했을 때 그는 이미 숨진 뒤였다.

 

그 외의 공격

길거리 습격은 물론 집의 벽을 부시고 침입해 납치 시도

가장 최근 벌어진 납치 사건은 5월 28일, 9세 소년 마예소 아이작(Mayeso Isaac)이 괴한 10명에게 끌려간 것이었다. 아이작이 친척의 초대를 받고 이웃나라 모잠비크를 방문하던 길에 벌어진 사건이었다. 말라위와 모잠비크 양국 정부는 이 소년의 실종 사건에 대해 신속하고 효과적인 수사를 보장할 의무가 있다.

2017년 3월 9일, 릴롱궤의 자택에서 잠을 자던 길버트 다이르(Gilbert Daire)는 남성 4명이 집의 벽을 드릴로 뚫고 침입한 공격에서 살아남았다. 이들 남성은 다이르의 이웃들이 개입하자 현장에서 달아났다. 용의자 중 한 명은 마을 주민들의 신고로 체포되었지만, 이후 법정에서 무죄 판결을 받았다.

“돈이 필요해서” 엄마와 함께 낮잠 자는 2살 아이 납치 시도

4월에는 은치시 콜웨 마을에서 두 살 짜리 미셰크 샘슨(Misheck Samson)이 어머니 옆에서 잠을 자던 중 납치를 당할 뻔 했다. 이 아기를 납치하려 모의한 3명의 남성이 체포됐다. 그들은 돈이 필요해서 납치를 시도했다고 경찰에 자백했다.

2월 17일, 36세 여성 에밀리 쿨리운데(Emily Kuliunde)는 도와에서 납치 당할 위기를 가까스로 면했다. 마을 주민들이 용의자들을 붙잡아 경찰에 넘긴 것이다. 용의자들은 여전히 경찰에 구속되어 있다.

아버지가 팔아버리겠다 협박하는 경우도

또다른 사례로, 2017년 2월 1일 모잠비크 국경 인근의 은체우 지역에 사는 아모스 제무스(Amos Jemus)는 아버지에게서 자신을 팔아 넘기겠다는 협박을 당했다고 한다.

 

형사정의의 실패

말라위에서 경찰은 범죄 가해 용의자들을 직접 기소하고 이들에게 유죄 판결을 내릴 수 있는 권한이 있지만, 자원이 부족해 관련 교육이 거의 이루어지지 않는다. 그 결과 대부분의 사건이 형편없이 처리되거나, 용의자에게 유죄가 선고되는 경우도 거의 없다. 백색증이 있는 사람에 대한 범죄, 특히 살인 사건 대부분이 재정 부족으로 용의자를 소송하는 경비 지원이 어려워서 재판에 이르지 못한다.

재판이 이루어지게 되더라도, 수사과정이 허술하고 인정될 만한 증거가 부족하기 때문에 용의자가 석방되는 경우가 잦다.

살인을 저지할 유일한 방법은 현행법이 효과적으로 시행되도록 보장하고, 기소 과정과 정부 부서간 협력이 효율적으로 이루어지게 하는 것이다.

“백색증이 있는 사람에 대한 극악무도한 범죄가 이처럼 증가하는 것은 범죄조직 사이에 잡히지 않을 것이라는 자신감이 높아지고 있다는 것을 보여준다. 이들 조직은 말라위의 형사사법제도가 제 기능을 하지 못하는 상황을 이용하고 있다. 정부는 이러한 공격을 완전히 뿌리뽑기 위해 결단력 있는 조치를 취해야 한다”고 말했다.

세계 난민위기 대응 8개 계획

세계 선진국들이 어찌할 바를 모르고 서로 언쟁만 벌이는 동안 끔찍한 인도적 환경에서 고통받고 있는 수백만 명을 외면하고 있는 도덕적 참사는 후세에 부끄러운 유산으로 남게 될 것이라고 국제앰네스티가 밝혔다. 국제앰네스티는 12일 세계적인 난민 위기에 대응하기 위한 8개 계획을 발표했다.

시리아, 이라크, 아프가니스탄의 끔찍한 폭력 사태와, 사하라 이남 아프리카 및 다른 지역에서 벌어진 수 차례의 무력 분쟁으로 인해 전 세계 난민의 수는 역사적으로도 유례 없는 수준으로 증가했다. 한편 동남아시아 지역에서는 다시 “항해기”에 들어서면서, 미얀마의 탄압을 피해 떠나왔으나 인신매매와 그 외 인권침해의 희생자로 전락하게 되는 로힝야족 수천여 명이 이에 포함될 것으로 예상된다.

이처럼 세계적인 난민 위기에 대처하는 방식은 부끄러운 수준으로, 특히 세계적으로 선진국에 속하는 국가들은 인도주의적 원조와 난민 재정착 요청을 모두 무시하고 있다. 재정착이 필요한 난민은 115만 명에 이르지만 선진국들이 제공한 재정착지는 그 중 불과 약 10%만을 수용할 규모에 그쳤다. 그러는 동안 개발도상국들은 난민 수백만 명을 거의 아무런 지원 없이 수용하고 있는 실정이다.

“전례 없이 계속되는 세계적인 난민 위기로 수백만 명이 절망 속에 살아가고 있지만 선진국들의 대응은 참담한 수준이다. 지금이 바로 후대에 길이 남게 될 중요한 순간으로, 이들이 대응 방향을 바꾸지 않는 한 매우 혹독한 역사의 심판을 받게 될 것”

이라며 “국제적인 난민보호제도는 2차대전 이후 중요한 안전조치로 마련되었지만, 선진국들이 전쟁과 탄압을 피해 온 취약한 사람들을 보호하지 못하고 안타까운 실책을 계속해서 범할 경우 무용지물로 전락할 위험이 있다”고 말했다.

부담 감내해야 하는 빈곤국

최근 수 개월 동안 유럽연합 국가에 입국한 난민의 수가 증가했다는 내용이 언론에 대서특필된 반면, 현실은 세계 각지의 난민 위기로 인한 부담을 빈곤국들이 모두 감당해야만 하는 상황이다. 주로 중동, 아프리카, 아시아 지역의 개발도상국들이 현재 총 1,950만명의 난민 중 86%를 수용하고 있다.

이러한 부담을 나누기 위한 선진국들의 노력은 턱없이 부족한 수준이다. 난민 위기에 대한 인도주의적 원조는 계속해서, 대부분 심각할 정도로 예산이 부족한 상태다. 예를 들어 지난 10월 2일 시리아 난민에 대한 유엔의 인도주의적 지원 요청은 필요 예산의 46%를 모금하는 데 그쳤으며, 남수단 난민을 위한 원조 기금은 초라하게도 목표액의 17%만을 채웠다. 이는 난민들이 식량, 의료품, 그 외 인도주의적 지원을 받는 데 참담하리만치 큰 영향을 미치고 있다.

8개 계획

결국 난민 위기는 그 근본적인 원인이 해결되면 종식될 수 있다. 국가정부는 분쟁과 만연한 인권침해를 끝내기 위해 노력해야 할 것이나, 이는 달성하기 어려울뿐더러 오랜 시간이 필요한 일이다.

그러나 세계적인 난민 위기로 인한 끔찍한 여파를 줄이기 위해 선진국들이 지금 바로 나설 수 있는 일도 있다. 국제앰네스티는 다음 8개 우선 영역에 대해 구체적인 행동에 나설 것을 촉구한다.

  1. 난민 위기에 대해 지속적이고, 충분하고, 예측 가능한 기금을 마련하라: 난민 위기에 관한 모든 인도적 기금은 반드시 충분한 투자를 받아야 하고, 더불어 대규모의 난민을 수용하고 있는 국가들에게 의미 있는 재정적 지원을 제공함으로써 난민과 지역사회에 필요한 서비스를 제공할 수 있도록 도와야 한다.
  2. 유엔난민기구(UNHCR)가 확인한 재정착 필요 난민들을 모두 이주시켜라: UNHCR 발표에 따르면 현재 취약한 상태로 재정착이 필요한 난민들은 115만 명에 이른다. 국제앰네스티는 향후 2년 내로 이 숫자가 145만 명까지 증가할 수 있다고 추정한다.
  3. 난민에게 안전하고 합법적인 입국 경로를 마련하라: 모든 사람들은 피난할 권리를 행사하기 위해 위험한 뱃길을 떠날 필요가 없어야 한다. 정부는 난민의 가족 재통합을 더욱 간편하게 하고, 대상 국가로 이주해 망명을 신청할 수 없는 조건에 있는 취약한 난민들에게 인도적 비자를 발급할 수 있도록 하고, 해외 난민들에게 자국의 취업비자와 학생비자 발급 비율을 일정 부분 할당해야 한다.
  4. 생명을 구하라: 국가정부는 이주 정책을 적용하기보다 조난자 구조를 우선해야 한다. 바다를 건너려 하는 난민들을 비롯해 사람들이 목숨을 잃을 위기에 처했을 경우 정부는 수색구조 작전에 충분히 투자하고 즉시 조난자를 구조해야 한다.
  5. 국경지대에 도달한 난민들에게 입국을 허용하라: 이러한 난민들은 유효한 여행서류를 소지했는지 여부와 상관없이 공식적인 국경통과지역을 지나도록 허가 받아야 한다. 정부는 본국의 탄압이나 폭력을 피해 온 사람들을 막는 어떠한 조치도 취해서는 안 된다. 이러한 조치에는 비자 또는 관련 서류 없이는 입국을 거부하거나, 난민들이 국경을 넘지 못하도록 사람들의 등과 경계 울타리를 떠밀거나, 위험한 경로를 택할 수밖에 없게 하는 것 등이 포함된다.
  6. 외국인혐오와 인종차별 타파를 위해 노력하라: 정부는 난민과 이주민이 경제적, 사회적 문제의 원인이라고 암시하거나 직접적으로 언급하는 것과 같이 먼저 외국인혐오에 빠지지 않도록 주의해야 한다. 또한 인종차별 또는 그 외의 차별을 명시하고 있거나, 사실상 그로 이어질 수 있는 법과 관행을 개정해야 한다. 또한 외국인혐오나 인종차별에 기반한 폭력 문제를 해결하기 위해 효과적인 정책을 마련해야 한다.
  7. 인신매매 타파를 위해 노력하라: 정부는 인신매매조직을 수사 및 기소할 수 있도록 효과적인 조치를 취해야 한다. 또한 인신매매 피해자들에게 보호와 지원을 제공하고, 이들이 난민지위 인정 또는 재정착 절차를 신청할 수 있도록 해야 한다. 인신매매 타파를 위한 모든 노력은 반드시 사람들의 안전을 최우선으로 해야 한다.
  8. 난민협약을 전세계적으로 비준하고, 국내적으로 강력한 난민 제도를 마련하라: 국가정부는 난민 지위를 신청하고 누릴 수 있는 권리를 법적으로 인정하고, 난민 신청을 공정하게 평가할 수 있는 절차를 마련하고, 난민의 기본권과 교육, 의료 등의 서비스 접근을 보장해야 한다.

Catastrophic moral failure as rich countries leave millions of refugees to cruel and uncertain fates

Eight-point plan to respond to global refugee crisis

The catastrophic moral failure of world leaders who dither and squabble among themselves while callously leaving millions of people to suffer in disastrous humanitarian conditions will define their legacy for generations to come, said Amnesty International today as it released an eight-point plan to tackle the multiple global refugee crises.

Horrific violence in Syria, Iraq, Afghanistan, and multiple conflicts in sub-Saharan Africa and elsewhere have brought the global refugee population to historic highs. Meanwhile Southeast Asia’s “sailing season” is again getting under way, with many more refugees likely to join the thousands of Rohingya who have fled persecution in Myanmar, only to fall prey to trafficking and other abuses.

The response to these global refugee crises has been shameful, particularly from the world’s richest countries, who have ignored appeals for humanitarian aid and to resettle vulnerable people. Wealthy countries have offered resettlement places to only around a tenth of the 1.15 million people who need them. Meanwhile developing counties are hosting millions of refugees with almost no support.

“The unprecedented multiple global refugee crises are leaving millions of people in desperation, but the response of the wealthy countries is a catastrophic failure. This is a pivotal moment which will define current world leaders’ legacy for generations to come ? history will judge them very harshly unless they change course,” said Salil Shetty, Secretary General of Amnesty International.

“The international refugee protection regime drawn up as a crucial safeguard after World War II risks being left in tatters if world leaders continue in their deplorable failure to protect vulnerable people fleeing war and persecution. Refugees have an international right to seek and enjoy asylum.”

Poor countries bearing the brunt

While the increase in the number of refugees reaching the European Union has dominated headlines in recent months, the reality is that poorer countries are being forced to bear the brunt of coping with the world’s multiple refugee crises. Developing countries mainly in the Middle East, Africa and Asia are currently hosting 86% of the world’s total 19.5 million refugees.

Wealthier countries are not doing nearly enough to share the burden. Humanitarian appeals for refugee crises are consistently ? and often severely ? underfunded. For example, as of 2 October, the UN’s humanitarian appeal for Syrian refugees was only 46% funded, while the appeal for South Sudan refugees only reached a pitiful 17% of its goal. This is having a devastating impact on refugees’ access to food, medicine and other humanitarian assistance.

“When the G20 leaders meet next month in Turkey, they should not leave the room until they have a concrete plan with clear timelines to guarantee full and sustainable humanitarian funding for the world’s multiple refugee crises; anything less will be an utter failure of leadership,” said Salil Shetty.

“Instead of rising to the challenge of this unprecedented crisis, many governments have been busy devising ways to keep people outside their borders while thousands are dying at sea or enduring squalid conditions in the shadow of razor-wire fences. This is moral bankruptcy of the highest order.”

Eight-point plan

Ultimately, refugee crises end when their root causes are addressed. States should seek to end conflicts and widespread human rights abuses, but these goals are difficult to achieve and take time.

However, there are things the world’s richest countries can do right now to lessen the devastating impact of the world’s refugee crises. Amnesty International is calling for concerted action in eight priority areas:

  1. Continuous, sufficient and predictable funding for refugee crises: all humanitarian appeals for refugee crises must be fully funded, in addition to providing meaningful financial support to countries hosting large numbers of refugees to help them provide services to refugees and their host communities.
  2. Fulfilling all resettlement needs identified by the UN Refugee Agency (UNHCR): 1.15 million vulnerable refugees currently need resettlement, according to UNHCR. Amnesty International estimates this number could increase to 1.45 million over the next two years.
  3. Safe and legal routes for refugees: people should not have to embark on dangerous journeys to seek their right to refuge. States should facilitate family reunification for refugees, introduce humanitarian visas to allow vulnerable refugees who do not qualify for resettlement to travel to these states and apply for asylum, and allocate a proportion of their work and student visas programmes to refugees in other countries.
  4. Saving lives: states must prioritize saving people in distress over implementing immigration policies. In situations where people are in danger of death, including ? but not limited to ? people attempting sea crossings, states should invest in search and rescue operations and immediately come to the rescue of people in distress.
  5. Ensure access to territory for refugees arriving at borders: those seeking asylum should be allowed to enter through official border crossings, regardless of whether or not they have valid travel documents. States should refrain from taking any measures that prevent people from fleeing a country where they face persecution or violence; these include refusal of entry without visas or other documentation, push backs and border fences that prevent refugees from entering a country or forces them to take dangerous routes.
  6. Combat xenophobia and racism: governments must refrain from engaging in xenophobia themselves, for example by implying or directly claiming asylum-seekers and migrants are to blame for economic and social problems. Governments must also reform any laws or policies that explicitly or practically result in racial or other forms of discrimination. Governments must also have effective policies to address xenophobic and racial violence.
  7. Combat trafficking: states must take effective action to investigate and prosecute trafficking gangs. States should offer protection and assistance to victims of trafficking and ensure they have access to refugee status determination procedures and/or resettlement opportunities. All efforts to combat trafficking and people smuggling must put people’s safety first.
  8. Global ratification of the Refugee Convention and developing robust domestic refugee systems: states must recognize in law the right to seek and enjoy asylum, have fair domestic procedures to assess refugee claims and must guarantee refugees their fundamental rights and access to services, such as education and healthcare.

파키스탄 관습법에 따라 살인 가해자는 피해자 가족에게 ‘다이얏(diyat)’ 또는 소위 ‘피 묻은 돈(blood money)’으로 불리는 보상금을 지급하면 혐의를 없앨 수 있다. ‘명예 살인’과 같이 피해자의 가족이 가해자일 경우에는 가족들에게 사면을 받고 수감 등의 처벌을 받지 않을 수 있다.

현재 파키스탄 국회에서는 소위 ‘명예살인’ 범죄에 관한 선처 조항을 삭제하는 법안을 논의 중이다. 국제앰네스티는 이러한 범죄가 처벌되지 않는 관행을 종식시킬 것을 요청하나, 그 처벌 방법에 사형이 포함되는 것에는 반대한다.

Pakistan: End impunity for so-called ‘honour’ crimes

The Pakistani authorities must end impunity for so-called ‘honour’ killings and other violence against women, Amnesty International said today.

“The tragic killing of Qandeel Baloch, at the hands of her brother, has highlighted the need for urgent action to protect women and men from crimes that are justified as a defence of family honour,” said Champa Patel, Amnesty International’s South Asia Director.

Amnesty International welcomes the decision of the Punjab authorities to register Qandeel Baloch’s murder as a crime against the state, and refuse her family the legal right to grant their son clemency.

“This needs to become the rule rather than the exception. Pakistan needs to undertake structural reforms that end impunity for so-called ‘honour’ killings, including by passing legislation that removes the option of clemency for such killings without resorting to the death penalty as a punishment,” said Champa Patel.

Qandeel Baloch’s brother has confessed to strangling his sister to death during her sleep on 15 July, triggering global outrage.

Under Pakistan’s current laws, the family of a murder victim may pardon the perpetrator, including on payment of compensation known as ‘diyat’ or ‘blood money’. In cases of so-called honour killings, where members of the victim’s own family are responsible for the crime, the perpetrator may be pardoned by their own family and not face imprisonment or any other punishments.

“By failing to hold perpetrators of so-called ‘honour’ killings accountable for their crimes, the Pakistani state has been forfeiting its duty to the victims and letting a climate of impunity take reign. This leaves many thousands of people – mostly women and girls – from all walks of life and across the country at risk of falling victim to these crimes,” said Champa Patel.

In its latest annual report, the Human Rights Commission of Pakistan said that nearly 1,100 women were killed in Pakistan last year by relatives on so-called ‘honour’ grounds. In 2014, the figure was 1,000, and in 2013, it was 869.

Under international law, culture, custom, religion, tradition or so-called ‘honour’ cannot ever be considered a justification for any act of violence against women.

“There is no honour in killing women under any circumstances. The state must respect and protect women’s right to life, equality, and dignity so that they can make life decisions of their own without fear of retribution or violence,” said Champa Patel.

Background

The Pakistani parliament is currently debating a bill that, if passed, would lead to the removal of the option of clemency for so-called ‘honour’ crimes. While Amnesty International calls for an end to impunity for such crimes, it opposes the death penalty as a possible punishment.

Amnesty International opposes the death penalty in all cases without exception, regardless of the nature or circumstances of the crime; guilt, innocence or other characteristics of the individual; or the method used by the state to carry out the execution.

나이지리아의 치복에서 여학생 219명이 무장단체 보코하람에 납치되어 전 세계적인 공분을 일으키고, #BringBackOurGirls 캠페인을 벌이게 한 사건으로부터 2년 반이라는 시간이 흘러, 마침내 좋은 소식이 찾아왔다.

10월 17일 아부자에서는 납치되었던 소녀 21명이 가족의 품으로 돌아오는 감동적인 행사가 있었다. 아이들은 다시는 보지 못할 줄 알았던 부모와 따뜻한 포옹을 나눴다.

하지만 완전히 행복한 결말을 맞은 것은 아니었다. 돌아온 아이들은 30개월간의 포로 생활로 정신적인 충격과 고통에 시달리고 있으며, 여전히 행방을 알 수 없는 200여명의 다른 아이들은 생사조차도 거의 알려지지 않았다.

분쟁의 덫에 걸린 다른 아이들에 대해서는 더더욱 알려진 바가 없다. 보코하람이 아니라, 나이지리아 정부에게 끔찍한 인권침해를 당하고 있는 아이들이다.

국제앰네스티가 5월 발표한 조사 결과, 보르노 주의 수도 마이두구리에서는 120명이 넘는 소년들이 악명 높은 “기와(Giwa)” 수용소의 질병이 들끓는 감방에 독방 구금되어 있는 것으로 드러났다. 5세 미만의 어린이들도 여성 감방 세 곳에 구금되어 있었다.

또한 같은 조사 결과 기와 수용소에서 1월부터 5월 사이 영, 유아를 포함한 어린이 12명이 영양실조와 질병으로 숨진 것으로 밝혀졌다. (성인 약 150명 역시 목숨을 잃었다.)

이 아이들은 나이지리아와 보코하람의 전쟁으로 인한 잊혀진 피해자들이다.

정부는 기와 수용소에 수감된 사람들은 정규 구금시설로 이송될 예정인 보코하람 용의자들이라고 주장하지만, 실제로는 그저 정부군의 반군 포위망에 붙잡혔을 뿐인 민간 피난민들인 경우가 대부분이다.

아직도 기와 수용소에는 1천 명 이상이 구금되어 있을 것으로 추정되며, 대부분은 공식적인 기소 없이 집단 체포된 사람들이다.

지키지 않은 약속

5월 국제앰네스티 보고서가 발표된 후, 무하마두 부하리 나이지리아 대통령은 CNN의 크리스티안 아만푸어 앵커에게 해당 구금시설에 대해 철저한 조사를 진행할 것이라고 밝혔다.

그로부터 5개월 후, 기와 수용소에서 일부 “확인된 수감자”가 석방됐다는 소식은 있었지만 아동 구금이나, 성인 및 아동 수감자의 사망에 대한 조사는 여전히 이루어지지 않고 있다. 국제앰네스티 조사에 따르면 기와 수용소의 감방은 여전히 수감자로 들어차 있고, 이곳에서 성인과 어린이 수감자들은 여전히 죽어가고 있다.

부하리 대통령이 CNN 생방송을 통해 약속한 이후로도, 국제앰네스티는 기와 수용소에서 15명 이상의 영, 유아가 사망한 점을 확인했다. 구금 중에 새로운 아이들이 태어나기도 하는데, 올해 초 석방된 한 수감자는 그가 구금되어 있던 6개월 동안 아이 15명이 태어났다고 전했다.

최근 기와 수용소에서 석방된 어린 소년 우마르는 수용소의 구금 환경을 국제앰네스티에 전하며, 200명이 넘는 소년들이 같은 감방에 몰려 있었다고 말했다. 국제앰네스티가 5월 기록했던 120명보다 훨씬 증가한 것이었다.

이들이 지낸 감방은 너무 좁았던 나머지, 어떤 아이들은 서로 포개져 잘 수밖에 없었다고 우마르(가명)는 말했다. 아이들은 군에서 인원을 확인할 때를 제외하면 절대 감방 밖으로 나올 수 없었고, 같은 감방에 있던 아이들 중 50명은 6세 이하였다고 한다.

우마르는 가족과 함께 보코하람의 폭력과 박해를 피해 떠났다가 바마의 난민 캠프에서 체포되어 기와 수용소로 끌려갔다. 우마르의 아버지가 보코하람을 지원했다는 혐의를 받았기 때문에, 우마르 역시 기소 없이 기와에 구금된 것이다.

올해 5월까지는 기와 수용소의 성인 수감자 중 한 명이 매일 아침 소년들이 수감된 감방을 찾아와 공부를 가르쳐 주려 했다. 덕분에 아이들은 영어 알파벳과 숫자를 배우고 외웠지만, 이 수감자가 석방된 뒤로는 그저 감방에서 시간이 흐르기만을 기다렸다.

우마르는 아이들에게 주어진 것이라곤 군인들이 감방에서 차고 놀라며 준 공 몇 개가 전부였다고 말했다. 이런 공놀이와 때때로 밖에서 실시하는 인원 점검만이 구금 생활 중 지루함을 해소하는 거의 유일한 방법이었다.

아픈 아이가 의사를 만나려면 대부분 이틀은 기다려야 했다. 우마르와 같은 방에 수감된 아이들 중 많은 수가 말라리아에 걸렸고, 그 중 7세 소년 한 명은 말라리아로 목숨을 잃었다.

“군인들이 그 애를 데리고 나갔어요. 어디로 갔는지는 몰라요.” 우마르는 말했다. “물도, 식량도 부족했고, 비위생적이었어요.”

기와에 수감된 다른 수감자들과 마찬가지로, 우마르는 자신과 다른 아이들도 독방에 구금되어 있었으며 가족들이나 바깥 세상과의 접촉도 허용되지 않았다고 말했다.

더 큰 규모의 위기

납치된 치복 여학생들과 기와에서 죽어간 아이들의 참담한 실태 외에도, 나이지리아 북동부의 “자유로운” 아이들도 그보다 사정이 훨씬 좋지만은 않다.

나이지리아 북동부 지역은 아프리카 최대 규모의 인도주의적 위기를 앞두고 있다. 2009년부터 보코하람은 이 지역에 엄청난 피해를 입히고, 수천 명을 살해했다. 240만 명이 터전을 잃었고, 이들 중 대부분이 어린 아이들이다.

많은 사람들이 난민 수용소의 매우 열악한 환경 속에서, 심각한 영양실조와 탈수, 의료적 지원 부족으로 사망할 위험에 처했음에도 바깥 세계로부터 아무런 지원도 받지 못한 채 살아가고 있다.

보르노 주의 경우 특히 심각한 상황으로, 인도주의적 지원이 시급하다.

유엔아동기금(UNICEF)은 보르노 주의 어린이 약 24만 4천 명이 심각한 급성 영양실조를 앓고 있으며, 치료를 받지 못할 경우 목숨을 잃을 것으로 추정되는 어린이는 49,000명에 이른다고 밝혔다.

우마르가 지냈던 바마 캠프의 난민들은 국제앰네스티에 이곳에서의 끔찍한 생활에 대해 설명하며, 어린이들이 굶주림과 질병으로 사망하는 경우가 빈번하다고 말했다.

바마 캠프를 떠난 한 여인은 이렇게 전했다. “캠프의 여자들 대부분이 아이를 잃었어요. 내가 있던 집단에서는 한 마을에 여자가 15명 있었는데, 죽은 아이들만 20명이었어요.”

국경없는 의사회는 지난해 바마 캠프 주변에 무덤 1,233개가 있는 것으로 파악했다. 이 중 480개가 어린이가 묻힌 것이었다.

할 수 있는 일은 무엇일까?

부하리 대통령에게 약속을 지킬 것과, 기와 수용소에서의 인권침해와 사망 사건에 대해 철저히 조사할 것을 촉구한다. 기와는 반드시 폐쇄되어야 할 죽음의 수용소다. 보코하람과의 전쟁이 어린이를 수감시킬 변명은 될 수 없다.

이전 정부는 치복 여학생 납치 사건이 처음 발생했을 당시 놀라울 정도로 더딘 대응을 보였다. 이제 부하리 정부는 치복 여학생들을 비롯해 납치된 모든 피해자를 되찾아 오는 데 노력을 아끼지 말아야 한다.

이는 더 큰 규모의 위기임에도 오랜 시간 간과되어 왔다. 분쟁 피해자들의 인도주의적 요구에도 그 대응은 더뎠을 뿐만 아니라 부족하기까지 했다.

정부와 국제사회는 기와 수용소, 보르노 난민캠프와 같은 곳에서 소리 없이 고통받고 있는 아이들을 잊어서는 안 될 것이다. 우리 모두를 부끄럽게 하는, 캠프를 둘러싼 조그마한 무덤들과 함께.

Nigeria’s Forgotten Children

Two and a half years since 219 Chibok schoolgirls were abducted by Boko Haram in Nigeria, sparking a global outcry and the #BringBackOurGirls campaign, there has finally been some good news.

Yesterday, 21 of those girls were reunited with their families in an emotional ceremony in Abuja, embracing the parents they thought they’d never see again.

But it’s not a completely happy ending – the girls are traumatized and distressed after 30 months in captivity, and little is known about the fates of the almost 200 others who are still missing.

And even less is known about the other children caught in the web of this conflict, those who are suffering horrific abuses perpetrated not by Boko Haram, but by the Nigerian government.

An Amnesty International investigation in May revealed that more than 120 boys were being held incommunicado in a disease-infested cell at the notorious Giwa barracks detention center in Maiduguri, the capital of Borno state. Children under five years of age were detained in three women’s cells.

The same investigation showed that 12 children, including infants and babies, died in Giwa between January and May, falling prey to malnutrition and disease. (Nearly 150 adults also lost their lives.)

These children are the forgotten victims of Nigeria’s fight against Boko Haram.

The government claims that Giwa houses Boko Haram suspects in transit to more established detention centers, but in fact, its detainees are just as likely to be displaced civilians caught in the army’s counter-insurgency dragnet.

More than 1,000 people are still believed to be held at Giwa, most of them arrested en masse without being formally charged.

Broken promises

After Amnesty International’s report was published May, Nigerian President Muhammadu Buhari told CNN’s Christiane Amanpour there would be a thorough investigation into the detention facility.

Five months on, there have been reports of some releases of “cleared detainees” from Giwa Barracks, but there has still been no investigation into the detention of children, or into the deaths of adults and children at Giwa. Our research shows that the cells at Giwa are still being filled, and adults and children are still dying there.

Since President Buhari’s on-air promise to CNN, Amnesty International has confirmed the deaths of 15 more babies and toddlers at Giwa. Babies are also being born in detention: one former detainee who was released earlier this year told us that 15 babies were born in the six months she was detained.

Umar, a young boy who was recently released from Giwa, spoke to Amnesty International about conditions there, describing how more than 200 boys were crammed into his cell, a significant increase from the 120 boys Amnesty recorded in the same cell in May.

Their cell is so cramped that some boys have no choice but to sleep on top of each other, said Umar, whose name has been changed to protect his identity. They are never allowed outside, except to be counted by their captors. Umar said that 50 of the boys in his cell were no older than 6.

Umar was taken to Giwa from a displacement camp in Bama after he and his family fled violence and intimidation by Boko Haram militants. His father was accused of aiding the group, and so Umar was locked up in Giwa without charge.

Until May this year, an adult detainee from Giwa would visit the boys’ cell each morning to try to continue their schooling. He taught the boys the English alphabet and numbers by rote, but when he was released, the boys just waited in their cell for the day to pass.

Umar says they had nothing but a few balls provided by the soldiers to roll around the cell. That, and the occasional roll call outdoors, were almost the only things punctuating the boredom of their detention.

It often took two days to get a doctor to see those who were sick. Many of Umar’s cellmates had malaria, including a seven-year-old who died of the disease.

“They took him outside. I don’t know where to,” Umar said. “There was not enough food and water. It was unhygienic.”

As with all detainees at the barracks, Umar claims that he and the rest of the children were held incommunicado and denied access to their families and the outside world.

The wider crisis

Beyond the horror of the abducted Chibok girls and the children left to die in Giwa, “free” children in northeastern Nigeria don’t necessarily fare much better.

The region is facing one of Africa’s largest humanitarian crises. Since 2009, Boko Haram has wreaked havoc in the region, killing thousands of people. Around 2.4 million have been displaced, the majority of whom are children.

Many are living in camps in horrific conditions, at risk of dying from severe malnutrition, dehydration and inadequate medical care, and with little to no assistance from the outside world.

Conditions in Borno State are particularly dire and humanitarian assistance is urgently needed.

Unicef says there are 244,000 children suffering from severe acute malnutrition in Borno, and that an estimated 49,000 children will die if they don’t receive treatment.

Displaced people at the Bama camp where Umar stayed have given Amnesty International harrowing accounts of life there, describing how children regularly succumb to starvation and disease.

“Most of the women have lost children,” one woman told us after leaving Bama. “In our group, there are 15 women from one village — we lost 20 children.”

Médecins Sans Frontières has counted 1,233 graves near the camp in the past year. Of them, 480 were for children.

What can be done?

We call on President Buhari to keep his word and investigate thoroughly the abuse and deaths at Giwa. It’s a death camp that must be closed. The fight against Boko Haram is no excuse to imprison children.

The previous government was astonishingly slow to respond to the Chibok girls’ abduction in the first place; President Buhari’s administration must now spare no efforts to bring them back, along with all the others who have been abducted.

The wider crisis has been neglected long enough. The response to the humanitarian needs of those affected by the conflict has not only been slow, but also inadequate.

The government and international community must not forget the children who suffer in silence in places like Giwa and the displacement camps in Borno, surrounded by tiny graves that shame us all.
