세계 난민위기 대응 8개 계획

세계 선진국들이 어찌할 바를 모르고 서로 언쟁만 벌이는 동안 끔찍한 인도적 환경에서 고통받고 있는 수백만 명을 외면하고 있는 도덕적 참사는 후세에 부끄러운 유산으로 남게 될 것이라고 국제앰네스티가 밝혔다. 국제앰네스티는 12일 세계적인 난민 위기에 대응하기 위한 8개 계획을 발표했다.

시리아, 이라크, 아프가니스탄의 끔찍한 폭력 사태와, 사하라 이남 아프리카 및 다른 지역에서 벌어진 수 차례의 무력 분쟁으로 인해 전 세계 난민의 수는 역사적으로도 유례 없는 수준으로 증가했다. 한편 동남아시아 지역에서는 다시 “항해기”에 들어서면서, 미얀마의 탄압을 피해 떠나왔으나 인신매매와 그 외 인권침해의 희생자로 전락하게 되는 로힝야족 수천여 명이 이에 포함될 것으로 예상된다.

이처럼 세계적인 난민 위기에 대처하는 방식은 부끄러운 수준으로, 특히 세계적으로 선진국에 속하는 국가들은 인도주의적 원조와 난민 재정착 요청을 모두 무시하고 있다. 재정착이 필요한 난민은 115만 명에 이르지만 선진국들이 제공한 재정착지는 그 중 불과 약 10%만을 수용할 규모에 그쳤다. 그러는 동안 개발도상국들은 난민 수백만 명을 거의 아무런 지원 없이 수용하고 있는 실정이다.

“전례 없이 계속되는 세계적인 난민 위기로 수백만 명이 절망 속에 살아가고 있지만 선진국들의 대응은 참담한 수준이다. 지금이 바로 후대에 길이 남게 될 중요한 순간으로, 이들이 대응 방향을 바꾸지 않는 한 매우 혹독한 역사의 심판을 받게 될 것”

이라며 “국제적인 난민보호제도는 2차대전 이후 중요한 안전조치로 마련되었지만, 선진국들이 전쟁과 탄압을 피해 온 취약한 사람들을 보호하지 못하고 안타까운 실책을 계속해서 범할 경우 무용지물로 전락할 위험이 있다”고 말했다.

부담 감내해야 하는 빈곤국

최근 수 개월 동안 유럽연합 국가에 입국한 난민의 수가 증가했다는 내용이 언론에 대서특필된 반면, 현실은 세계 각지의 난민 위기로 인한 부담을 빈곤국들이 모두 감당해야만 하는 상황이다. 주로 중동, 아프리카, 아시아 지역의 개발도상국들이 현재 총 1,950만명의 난민 중 86%를 수용하고 있다.

이러한 부담을 나누기 위한 선진국들의 노력은 턱없이 부족한 수준이다. 난민 위기에 대한 인도주의적 원조는 계속해서, 대부분 심각할 정도로 예산이 부족한 상태다. 예를 들어 지난 10월 2일 시리아 난민에 대한 유엔의 인도주의적 지원 요청은 필요 예산의 46%를 모금하는 데 그쳤으며, 남수단 난민을 위한 원조 기금은 초라하게도 목표액의 17%만을 채웠다. 이는 난민들이 식량, 의료품, 그 외 인도주의적 지원을 받는 데 참담하리만치 큰 영향을 미치고 있다.

“수천 명이 바다에서 목숨을 잃거나 철조망 아래의 비참한 환경에서 살아가고 있는 동안, 많은 국가들은 이처럼 전례 없는 위기에 맞서기보다 사람들을 국경 밖으로 쫓아낼 방법을 강구하기에만 바쁘다. 이는 매우 심각한 도덕적 파탄이다” 살릴 셰티

살릴 셰티 사무총장은 “다음 달 터키에서 열릴 G20 총회에서 각국 정상들은 세계적인 난민 위기 해결을 위해 유지 가능한 인도적 기금 확보를 보장할 수 있도록 분명한 일정과 함께 구체적인 계획을 마련하기 전까지는 회의장을 떠나서는 안 될 것이다. 그렇지 못할 경우 리더십의 완전한 실패로 돌아가게 될 것”이라며 “수천 명이 바다에서 목숨을 잃거나 철조망 아래의 비참한 환경에서 살아가고 있는 동안, 많은 국가들은 이처럼 전례 없는 위기에 맞서기보다 사람들을 국경 밖으로 쫓아낼 방법을 강구하기에만 바쁘다. 이는 매우 심각한 도덕적 파탄”이라고 말했다.

8개 계획

결국 난민 위기는 그 근본적인 원인이 해결되면 종식될 수 있다. 국가정부는 분쟁과 만연한 인권침해를 끝내기 위해 노력해야 할 것이나, 이는 달성하기 어려울뿐더러 오랜 시간이 필요한 일이다.

그러나 세계적인 난민 위기로 인한 끔찍한 여파를 줄이기 위해 선진국들이 지금 바로 나설 수 있는 일도 있다. 국제앰네스티는 다음 8개 우선 영역에 대해 구체적인 행동에 나설 것을 촉구한다.

  1. 난민 위기에 대해 지속적이고, 충분하고, 예측 가능한 기금을 마련하라: 난민 위기에 관한 모든 인도적 기금은 반드시 충분한 투자를 받아야 하고, 더불어 대규모의 난민을 수용하고 있는 국가들에게 의미 있는 재정적 지원을 제공함으로써 난민과 지역사회에 필요한 서비스를 제공할 수 있도록 도와야 한다.
  2. 유엔난민기구(UNHCR)가 확인한 재정착 필요 난민들을 모두 이주시켜라: UNHCR 발표에 따르면 현재 취약한 상태로 재정착이 필요한 난민들은 115만 명에 이른다. 국제앰네스티는 향후 2년 내로 이 숫자가 145만 명까지 증가할 수 있다고 추정한다.
  3. 난민에게 안전하고 합법적인 입국 경로를 마련하라: 모든 사람들은 피난할 권리를 행사하기 위해 위험한 뱃길을 떠날 필요가 없어야 한다. 정부는 난민의 가족 재통합을 더욱 간편하게 하고, 대상 국가로 이주해 망명을 신청할 수 없는 조건에 있는 취약한 난민들에게 인도적 비자를 발급할 수 있도록 하고, 해외 난민들에게 자국의 취업비자와 학생비자 발급 비율을 일정 부분 할당해야 한다.
  4. 생명을 구하라: 국가정부는 이주 정책을 적용하기보다 조난자 구조를 우선해야 한다. 바다를 건너려 하는 난민들을 비롯해 사람들이 목숨을 잃을 위기에 처했을 경우 정부는 수색구조 작전에 충분히 투자하고 즉시 조난자를 구조해야 한다.
  5. 국경지대에 도달한 난민들에게 입국을 허용하라: 이러한 난민들은 유효한 여행서류를 소지했는지 여부와 상관없이 공식적인 국경통과지역을 지나도록 허가 받아야 한다. 정부는 본국의 탄압이나 폭력을 피해 온 사람들을 막는 어떠한 조치도 취해서는 안 된다. 이러한 조치에는 비자 또는 관련 서류 없이는 입국을 거부하거나, 난민들이 국경을 넘지 못하도록 사람들의 등과 경계 울타리를 떠밀거나, 위험한 경로를 택할 수밖에 없게 하는 것 등이 포함된다.
  6. 외국인혐오와 인종차별 타파를 위해 노력하라: 정부는 난민과 이주민이 경제적, 사회적 문제의 원인이라고 암시하거나 직접적으로 언급하는 것과 같이 먼저 외국인혐오에 빠지지 않도록 주의해야 한다. 또한 인종차별 또는 그 외의 차별을 명시하고 있거나, 사실상 그로 이어질 수 있는 법과 관행을 개정해야 한다. 또한 외국인혐오나 인종차별에 기반한 폭력 문제를 해결하기 위해 효과적인 정책을 마련해야 한다.
  7. 인신매매 타파를 위해 노력하라: 정부는 인신매매조직을 수사 및 기소할 수 있도록 효과적인 조치를 취해야 한다. 또한 인신매매 피해자들에게 보호와 지원을 제공하고, 이들이 난민지위 인정 또는 재정착 절차를 신청할 수 있도록 해야 한다. 인신매매 타파를 위한 모든 노력은 반드시 사람들의 안전을 최우선으로 해야 한다.
  8. 난민협약을 전세계적으로 비준하고, 국내적으로 강력한 난민 제도를 마련하라: 국가정부는 난민 지위를 신청하고 누릴 수 있는 권리를 법적으로 인정하고, 난민 신청을 공정하게 평가할 수 있는 절차를 마련하고, 난민의 기본권과 교육, 의료 등의 서비스 접근을 보장해야 한다.

Catastrophic moral failure as rich countries leave millions of refugees to cruel and uncertain fates

Eight-point plan to respond to global refugee crisis

The catastrophic moral failure of world leaders who dither and squabble among themselves while callously leaving millions of people to suffer in disastrous humanitarian conditions will define their legacy for generations to come, said Amnesty International today as it released an eight-point plan to tackle the multiple global refugee crises.

Horrific violence in Syria, Iraq, Afghanistan, and multiple conflicts in sub-Saharan Africa and elsewhere have brought the global refugee population to historic highs. Meanwhile Southeast Asia’s “sailing season” is again getting under way, with many more refugees likely to join the thousands of Rohingya who have fled persecution in Myanmar, only to fall prey to trafficking and other abuses.

The response to these global refugee crises has been shameful, particularly from the world’s richest countries, who have ignored appeals for humanitarian aid and to resettle vulnerable people. Wealthy countries have offered resettlement places to only around a tenth of the 1.15 million people who need them. Meanwhile developing counties are hosting millions of refugees with almost no support.

“The unprecedented multiple global refugee crises are leaving millions of people in desperation, but the response of the wealthy countries is a catastrophic failure. This is a pivotal moment which will define current world leaders’ legacy for generations to come ? history will judge them very harshly unless they change course,” said Salil Shetty, Secretary General of Amnesty International.

“The international refugee protection regime drawn up as a crucial safeguard after World War II risks being left in tatters if world leaders continue in their deplorable failure to protect vulnerable people fleeing war and persecution. Refugees have an international right to seek and enjoy asylum.”

Poor countries bearing the brunt

While the increase in the number of refugees reaching the European Union has dominated headlines in recent months, the reality is that poorer countries are being forced to bear the brunt of coping with the world’s multiple refugee crises. Developing countries mainly in the Middle East, Africa and Asia are currently hosting 86% of the world’s total 19.5 million refugees.

Wealthier countries are not doing nearly enough to share the burden. Humanitarian appeals for refugee crises are consistently ? and often severely ? underfunded. For example, as of 2 October, the UN’s humanitarian appeal for Syrian refugees was only 46% funded, while the appeal for South Sudan refugees only reached a pitiful 17% of its goal. This is having a devastating impact on refugees’ access to food, medicine and other humanitarian assistance.

“When the G20 leaders meet next month in Turkey, they should not leave the room until they have a concrete plan with clear timelines to guarantee full and sustainable humanitarian funding for the world’s multiple refugee crises; anything less will be an utter failure of leadership,” said Salil Shetty.

“Instead of rising to the challenge of this unprecedented crisis, many governments have been busy devising ways to keep people outside their borders while thousands are dying at sea or enduring squalid conditions in the shadow of razor-wire fences. This is moral bankruptcy of the highest order.”

Eight-point plan

Ultimately, refugee crises end when their root causes are addressed. States should seek to end conflicts and widespread human rights abuses, but these goals are difficult to achieve and take time.

However, there are things the world’s richest countries can do right now to lessen the devastating impact of the world’s refugee crises. Amnesty International is calling for concerted action in eight priority areas:

  1. Continuous, sufficient and predictable funding for refugee crises: all humanitarian appeals for refugee crises must be fully funded, in addition to providing meaningful financial support to countries hosting large numbers of refugees to help them provide services to refugees and their host communities.
  2. Fulfilling all resettlement needs identified by the UN Refugee Agency (UNHCR): 1.15 million vulnerable refugees currently need resettlement, according to UNHCR. Amnesty International estimates this number could increase to 1.45 million over the next two years.
  3. Safe and legal routes for refugees: people should not have to embark on dangerous journeys to seek their right to refuge. States should facilitate family reunification for refugees, introduce humanitarian visas to allow vulnerable refugees who do not qualify for resettlement to travel to these states and apply for asylum, and allocate a proportion of their work and student visas programmes to refugees in other countries.
  4. Saving lives: states must prioritize saving people in distress over implementing immigration policies. In situations where people are in danger of death, including ? but not limited to ? people attempting sea crossings, states should invest in search and rescue operations and immediately come to the rescue of people in distress.
  5. Ensure access to territory for refugees arriving at borders: those seeking asylum should be allowed to enter through official border crossings, regardless of whether or not they have valid travel documents. States should refrain from taking any measures that prevent people from fleeing a country where they face persecution or violence; these include refusal of entry without visas or other documentation, push backs and border fences that prevent refugees from entering a country or forces them to take dangerous routes.
  6. Combat xenophobia and racism: governments must refrain from engaging in xenophobia themselves, for example by implying or directly claiming asylum-seekers and migrants are to blame for economic and social problems. Governments must also reform any laws or policies that explicitly or practically result in racial or other forms of discrimination. Governments must also have effective policies to address xenophobic and racial violence.
  7. Combat trafficking: states must take effective action to investigate and prosecute trafficking gangs. States should offer protection and assistance to victims of trafficking and ensure they have access to refugee status determination procedures and/or resettlement opportunities. All efforts to combat trafficking and people smuggling must put people’s safety first.
  8. Global ratification of the Refugee Convention and developing robust domestic refugee systems: states must recognize in law the right to seek and enjoy asylum, have fair domestic procedures to assess refugee claims and must guarantee refugees their fundamental rights and access to services, such as education and healthcare.

키프로스 국회가 동성 시민결합을 인정한 것은 키프로스의 레즈비언, 게이, 양성애자, 성전환자, 인터섹스(LGBTI)에 대한 차별을 철폐하고 완전한 결혼평등을 이룩하기 위해 중요한 첫걸음을 내디딘 것이라고 국제앰네스티가 밝혔다.

26일 표결로 이러한 법안이 통과된 것은 1998년 키프로스가 동성간 성관계를 비범죄화한 후로 계속해서 진전을 이룩해 온 결과다. 동성 시민결합을 인정하겠다는 정치적 결정이 나오기까지 2년에 걸친 기나긴 여론 수렴 과정을 거쳤다.

엘리자 고로야(Eliza Goroya) 국제앰네스티 그리스-키프로스 캠페이너는 “키프로스의 LGBTI 활동가들은 이날과 같이 성소수자의 결합을 법적으로 인정받는 첫걸음을 내딛기 위해 수 년에 걸쳐 노력해 왔다. 이날의 결정은 긍정적이기는 하나 너무 오랫동안 지연된 것으로, 모든 사람이 법적으로 완전한 결혼평등을 누릴 수 있기까지는 아직도 할 일이 많이 남아 있다”고 말했다.

시민단체 ‘어셉트 LGBT 키프로스(Accept LGBT Cyprus)’의 코스타스 가브리엘리데스(Costas Gabrielides)는 “이번 결정은 LGBTI뿐만 아니라 모든 소수자들을 위해 중요한 걸음을 내디딘 것”이라고 밝혔다.

이번에 채택된 새로운 법안을 통해 올바른 방향으로 나아가는 중요한 계기를 마련하게 됐지만, 국제앰네스티는 키프로스가 성적 지향성 및 성 정체성에 기반한 차별 철폐를 위해 완전한 결혼평등을 이룩하기까지는 아직 남은 과제가 많다고 지적한다.

아직은 완전한 결혼평등에 미치지 못한다는 점 외에도, 국제앰네스티는 키프로스에서 여전히 LGBTI에 대한 차별이 계속되고 있다는 점을 지적했다. 동성 연인에게 공동 입양권이 인정되지 않고, 성전환자의 바뀐 성별이 법적으로 인정되지 않으며, 인터섹스를 대상으로 한 “정상화” 수술이 법적으로 금지되지 않고 있는 점 등이 그 예다.

23세의 레즈비언 활동가인 알렉산드라는 “[새로운 법을 통해] LGBTI뿐만이 아닌 더 많은 사람들이 보호받게 되었다. 키프로스가 조금씩 앞으로 나아가고 있다는 신호”라며 “이제는 완전한 결혼평등과 입양권을 인정받기 위해, 또한 우리 중 가장 취약한 성전환자들이 자기 자신을 인정받을 수 있도록 노력해야 할 때”라고 말했다.

키프로스의 결정으로 그리스의 인권활동가들과 LGBTI 역시 희망에 부풀 것으로 보인다. 그리스 역시 키프로스와 비슷하게 동성 시민결합을 인정하는 법안을 곧 표결에 부칠 예정이다.

현재 유럽 지역 대부분의 국가가 완전한 결혼평등 또는 동성 시민결합을 지지하고 있다.

The Cypriot Parliament’s recognition of the right to same-sex civil unions is an important first step towards eradicating discrimination and achieving full marriage equality for lesbian, gay, bisexual, transgender and intersex (LGBTI) people in Cyprus, Amnesty International said.

Yesterday’s vote shows how far Cyprus has come since decriminalizing same-sex sexual relations in 1998. It was preceded by a lengthy public debate over the past two years following political promises to recognize civil partnerships.

“LGBTI activists in Cyprus have fought for years for this first step in the legal recognition of their intimate relationships. This a positive but long-overdue, and there is still a lot of work ahead before everybody can enjoy full marriage equality under the law,” said Eliza Goroya, Greece and Cyprus Campaigner at Amnesty International.

“This is an important step forward not only for the LGBTI community, but for every marginalized community,” said Costas Gabrielides from the NGO Accept LGBT Cyprus.

While the new law marks a significant move in the right direction, Amnesty International notes that more work is needed to achieve full marriage equality in Cyprus to combat discrimination on the grounds of sexual orientation and gender identity.

Besides falling short of full marriage equality, the organization noted that LGBTI people face continuing discrimination in Cyprus. This includes a lack of joint adoption rights for same-sex couples, the legal recognition of transgender people, and the banning of “normalizing” surgeries for intersex people.

“[The new law] means more people feel safer, not only LGBTI people. The message is that Cyprus is moving forward,” said Alexandra, a 23-year-old lesbian activist. “We now need to fight for full marriage equality and adoption rights, and also the most vulnerable among us: transgender people that are not recognized for who they are.”

The move by Cyprus is expected to buoy hopes for human rights activists and LGBTI people in Greece, where a similar bill on same-sex civil unions is expected to go to a vote soon.

The majority of European states now support full marriage equality or same-sex civil partnerships.

참파 파텔(Champa Patel) 국제앰네스티 동남아시아태평양 상임조사고문은 “복면을 씌우고 의자에 포박하는 등 관타나모 수용소를 연상시키는 악명 높은 전략으로, 유엔 아동권리협약과 고문방지협약을 모두 위반하는 충격적인 행위에 해당한다. 호주의 소년원제도를 철저히 재정비하는 한편, 그 일환으로 법집행 및 교정제도 내에서의 의자포박, 복면 사용을 즉시 금지할 것을 요청한다”고 말했다.

그는 이어 “성인 남성 3명에게 강제로 옷이 벗겨지며 고통스러워하는 한 어린이의 모습과 아이들이 최루가스에 숨이 막혀가는 가운데 들려오는 교도관들의 웃음소리는 수년간 노던 준주 및 호주 전역 구금시설에서의 아동 인권 보호 증진 요청을 묵살해 왔던 결정권자들의 뇌리에 강렬히 각인되어야 한다”고 말했다.

7월 26일, ABC의 방송프로그램‘포 코너스(Four Corners)’는 호주 노던 준주의 다윈에 위치한 돈 데일 소년원에서 2010년부터 2015년까지 구금된 10대 소년들을 학대하는 교도관들의 모습이 담긴 영상을 공개했다.

끔찍한 영상

이 끔찍한 영상에서 소년들은 바닥에 내동댕이쳐지고 욕설을 듣거나, 강제로 옷이 벗겨져 나체로 독방에 감금되었다. 일부 아이들은 수도도 없고, 햇빛도 거의 들지 않는 감방에서 거의 하루 24시간을 갇혀 지내며 학교에 다니거나 교육자료를 접할 기회도 박탈당했다.

얼굴에 복면을 씌우는 관행은 특히 관타나모 수용소와 아부그라이브(Abu Ghraib) 교도소에서 주로 사용되는 것으로, 다수의 인권단체가 고문 및 잔혹하고 비인도적이며 굴욕적인 대우에 해당한다고 지적했다.

의자에 포박하는 것이 다른 안전한 대체안보다 더 효과적인 법집행수단이라는 증거는 없다.

이번 공개된 영상에는 교도관들이 소년 5명이 갇혀 있는 격리구금시설에 최루가스를 남용하는 모습도 담겨 있다. 이 시설은 제대로 환기가 되지 않고 출구도 없어 신체적 부상, 질식은 물론 사망까지 이를 수 있는 위험이 더욱 높았다.

참혹한 학대

국제앰네스티 호주지부는 노던 준주 소년원에서 최루가스를 사용하는 등의 학대행위에 대해 계속해서 우려를 제기했으며, 지난 5년간 다른 2개주 지역에서 이와 비슷하게 심각한 학대가 이루어진 것에 대해서도 대응한 바 있다.

국제앰네스티는 호주 정부에 유엔 고문방지협약 선택의정서(OPCAT)를 비준하고 소년원에 대한 독립적인 감사가 이루어지도록 할 것을 다른 단체들과 함께 수년간 촉구해 왔다. 현재 호주는 고문방지협약 선택의정서 서명국이지만 아직 비준하지는 않았다. 이 선택의정서를 비준하면 모든 구금시설을 무제한적으로 방문할 수 있는 독립적 국가기관(National Preventive Mechanism, NPM)을 설립해야 한다.

ABC가 공개한 영상은 호주에서 선주민 구금률이 부끄러울 정도로 높다는 것을 재차 강조하는 것이기도 했다. 선주민 청소년이 구금될 확률은 비선주민 청소년보다 26배 이상 높았다. 호주 선주민과 토레스해협 선주민 청소년이 호주의 10세부터 17세 사이 청소년 인구에서 차지하는 비율은 5%를 조금 넘는 정도에 불과하지만, 구금된 청소년 중에서는 절반 이상(59%)을 차지하고 있다.

국제앰네스티 호주지부는 지난해 발표한 보고서를 통해 웨스턴, 퀸즈랜드, 노던 준주의 상황이 특히 더욱 심각한 수준이며, 호주 전역에 변화가 시급하다고 강조했다.

2012년 아동인권위원회(Committee on the Rights of the Child, CRC)는 호주의 소년사법제도가 국제기준에 상응하는 수준이 되려면 상당한 개정이 필요하다고 밝혔으며, 일례로 호주에서 형사책임이 인정되는 최소 연령은 10세로, 아동인권위원회가 국제적으로 인정하는 최소 연령보다 두 살 어리다는 점을 지적했다.

Australia: Guantanamo-style abuse of child prisoners shows current detention system has failed

Chilling footage showing detained Indigenous children being tear gassed and a child being hooded and strapped to a restraint chair in Australia’s Northern Territory must serve as a wakeup call for the government on the need to urgently change its policies on juvenile detention, Amnesty International said today.

The organization is calling on Australia’s authorities to immediately ratify the UN Optional Protocol to the Convention against Torture (OPCAT) as a way of ensuring that detention facilities are thoroughly and independently monitored.

“Hooding and the use of restraint chairs are notorious tactics that recall the horrors of Guantanamo Bay – they constitute a shocking violation of both the UN Convention on the Rights of the Child and the Convention against Torture. We are calling for an immediate prohibition on the use of restraint chairs and hooding for law enforcement and in the prison system, as part of a complete overhaul of Australia’s juvenile detention system,” said Champa Patel, Amnesty International’s Senior Research Adviser for South East Asia and the Pacific.

“The image of a distressed child being forcibly stripped by three men, and the sound of guards laughing while children choke on teargas, should be ingrained on the minds of Australia’s leaders, who for years have ignored calls for better protection of children’s human rights in detention facilities in Northern Territory and across the country.”

On Monday 26 July ABC’s Four Corners Program screened footage of the Don Dale Youth Detention Centre in Darwin, Northern Territory which showed prison officials abusing detained teenage boys from 2010 to 2015.

Chilling scenes

In a series of chilling scenes, the boys were shown being knocked to the floor and verbally abused, or forcibly stripped and then left naked and alone in locked rooms. Some were kept locked in their cells for almost 24 hours a day with no running water, little natural light, and were denied access to school and educational material.

A number of human rights bodies have determined that the practice of hooding, most notably used at Guantanamo Bay and in the Abu Ghraib prison camp, constitutes a form of torture and other cruel, inhuman and degrading treatment.

There is no evidence that the use of restraint chairs is more effective as a means of law enforcement thansafer alternatives.

The film also shows prison officials misusing tear gas by pumping it into a confined isolation unit where five boys were locked in their cells with limited ventilation and no exit, increasing the risk of physical injury, suffocation and even death.

Horrendous abuse

Amnesty International Australia has repeatedly raised concerns about tear gassing and other abuses in Northern Territory youth detention centres, and in the past five years has also responded to similar serious allegations in two other states.

Amnesty International, along with others, has for years been calling on Australia to ensure that youth detention centres are being independently inspected by ratifying the UN Optional Protocol to the Convention against Torture (OPCAT). Australia is currently a signatory to OPCAT, but has not yet ratified it. Ratification would mean the establishment of a National Preventative Mechanism (NPM), an independent national body which would have unlimited access to all places of detention.

“Only after it ratifies OPCAT can the Australian Government, and all states and territories in its jurisdiction, be held to account for the mistreatment of people in detention facilities. This alarming new footage proves that Australia cannot delay any longer – children are suffering horrendous abuse,” said Champa Patel.

Discrimination

The ABC footage has also highlighted, once again, the shameful rate of Indigenous incarceration in Australia. In 2013–2014, Indigenous young people were 26 times more likely to be in detention than non-Indigenous young people. Aboriginal and Torres Strait Islander young people make up just over five per cent of the Australian population of 10 to 17-year-olds, but more than half (59 per cent) of those in detention.

In a report released last year, Amnesty International Australia stressed that the situation is particularly bad in Western Australia, Queensland and the Northern Territory and highlighted the urgent need for change throughout Australia.

“It is no coincidence that the boys seen in this footage are Indigenous – the UN Convention on Torture acknowledges that discrimination paves the way for torture and ill-treatment. By failing to tackle entrenched racism against Indigenous people and huge inequalities in health, education and housing, the Australian government has allowed this culture of abuse to flourish,” said Champa Patel.

In 2012 the Committee on the Rights of the Child (CRC) said that Australia’s juvenile justice system required substantial reform before it would meet international standards, noting, for example, that children in Australia are held criminally responsible from the age of 10, two years younger than the CRC’s internationally acceptable minimum.

12월 21일, 에콰도르 경찰은 모로나 산티아고에 위치한 수아르-아추아르 공동주립연방센터 시설에 강제 진입하고 선주민 인권옹호자 아구스틴 와차파 대표를 체포했다.

최근 모로나 산티아고의 동광 건설 계획에 반대하고 나섰던 수아르 선주민들이 정부로부터 일련의 폭력행위와 괴롭힘, 압력을 당한 데 이어 와차파 대표 역시 체포된 것이다.

선주민 인권옹호자를 체포하기 앞서, 에콰도르 내무부는 12월 20일 지역 단체인 환경행동협회(Corporación Acción Ecológica)를 폭력행위 혐의로 고발했다. 이들은 SNS에 해당 지역에서 채광을 할 경우 미치게 되는 환경 영향에 대한 정보를 게시하고, 이로 인해 벌어질 수 있는 인권침해도 함께 강조했었다.

이러한 행정 조치에 직면하게 된 환경행동협회는 올해 안에 폐쇄될 위기에 놓였다.

킹스턴 시내의 화려한 오렌지 스트리트에 강렬한 햇빛이 내리쬐며 점심시간이 다 되었음을 알렸다.구석에 둔 작은 라디오에서 레게 음악이 흘러나오는 가운데 젊은이들 여럿이 길가에서 담소를 나누고, 작지만 분주한 미용실에서는 세 명의 여성 오전에 있었던 일을 공유한다. 그 옆에서, 점심시간에 몰려들 손님을 대비해 열심히 난로를 닦고 있는 청년이 있다.

19세인 다쿠안 작슨은 수도 킹스턴의 이 분주한 구역에서 일하며 살아가는 사람들을 위해 점심을 제공하는 작은 식당을 운영하고 있다.

다쿠안은 요리를 하는 사람이 아니다. 적어도 몇 달 전까지는. 그러나 폭풍같은 비극이 가족을 덮치면서 일곱 남매 중 막내였던 그는 가업을 물려받기로 결심하게 됐다.

작은 방, 노란 벽에 걸린 한 청년의 웃고 있는 사진은 지난 3년 동안 가족들의 삶을 뒤바꿔 버린 사연을 짐작하게 한다.


당시 29세였던 다쿠안의 형 나키에아는 출중한 요리 실력으로 근방에서도 명성이 자자했다. 2014년 1월 20일 아침에도 그는 자메이카 국립혈액원 지역 사무소에서 대량으로 주문한 닭튀김을 바쁘게 준비하고 있었다. 목격자의 증언에 따르면 바로 그 때, 경찰관 한 명이 식당에 들이닥쳐 그에게 총을 발사했다.

경찰차 뒷좌석에 던져진 나키에아는 병원으로 옮겨졌지만 결국 숨을 거뒀다. 부검 결과 사인은 2개의 총상이었다. 목격자들에 따르면 경찰이 총을 쐈을 당시 나키에아는 비무장 상태였다.

경찰은 범행 용의자를 찾고 있던 중이었다. 용의자의 행색은 레게(dreadlocks) 머리를 한 남성이었고, 나키에아가 바로 그 모습이었던 것이다.

여동생 샤켈리아는 그 날 오빠의 이름을 외치는 소리에 잠이 깬 순간, 시간이 멈춘 것 같았다고 회상했다.

“방 안으로 뛰어들어갔더니 평소와 다름없이 음식이 전부 준비되어 있었어요. 그 때 바닥에 오빠의 슬리퍼 한 짝과 … 핏자국을 발견했죠. 심장이 덜컥했어요. 그 날 제 인생은 끝난 거나 마찬가지예요.”

샤켈리아는 3년 전 오빠가 총에 맞았던 바로 그 자리에 서서 그렇게 말했다.


샤켈리아는 식당 문을 잠가 버렸고, 거의 본능적으로 현장을 보존했다.

그의 직감은 정확했다.

나키에아가 숨진 뒤, 가족들은 살해 용의자들이 처벌받을 수 있도록 끈질긴 법정 싸움을 계속했다.

그러나 판사 앞에는 하루도 서 보지 못했고, 경찰은 가족들을 표적 삼아 괴롭힘과 위협, 폭력을 가하고 있다.

“정의를 위한 이 싸움은 제 삶의 전부가 되어 버렸어요. 저는 공부도 그만두고, 지난 3년 동안 치른 모든 비용을 메꿔야 했죠” 말하는 샤켈리아의 눈에 절망의 눈물이 차올랐다.

이런 경찰의 습격과 괴롭힘, 정부의 무대응에 아버지는 매일 천천히 죽어가고 계세요.

나키에아를 쏜 경찰관에 대한 사건은 핵심 증인 중 한 명이 후환을 두려워한 나머지 법원 출석을 거부하면서 지난 7월 기각되었다. 충격적이지만 놀랍지는 않은 일이었다.

가족들은 기각 판결에 항소했고, 정의가 구현되기를 지켜보려는 결의는 여전히 굳건하다.


자메이카 경찰, “범죄와의 전쟁”이란 미명 하에 공권력 남발

자메이카는 아메리카 지역에서 가장 범죄율이 높은 국가로 꼽힌다. 2015년 한 해 동안에만 인구 10만명 당 벌어지는 살인 사건은 43회로, 온두라스와 엘살바도르, 베네수엘라의 다음으로 높다.

살인사건 중 8%가 경찰이 저지른 것

지난 20년간 자메이카 정부는 자국의 범죄율을 낮추기 위해 과격한 입장을 취했고, 이로 인해 2000년부터 발생한 경찰의 살인 사건은 3,000건이 넘는다. 2015년에는 자메이카의 살인 사건 중 8%가 경찰관에 의한 것이었다.

자메이카 정부는 이러한 문제를 해결하기 위해 조치를 취하고 있다고 주장하지만, 지난 3년간 경찰의 살인 사건은 급격히 감소한 반면 대부분의 사건이 아직도 기소되지 않았거나 미결로 남아있다. 살인에 경찰이 관련되어 있다는 강력한 증거가 있어도, 지난 20년간 살인으로 유죄를 선고받은 경찰관은 극소수에 불과하다.

상황은 더욱 악화되고 있다. 이번 국제앰네스티 자메이카 보고서에서 나타나듯, 이러한 수치는 일면에 불과하다. 일부 자메이카 경찰은 살인 피해자 유족들이 소송을 제기하지 못하게 이들을 괴롭히거나 협박하고 있으며, 입을 다물도록 위협하는 경우도 많았다.

집 습격, 증인 위협으로 재판을 방해하는 경찰

국제앰네스티가 수십 건의 사례를 바탕으로 조사한 결과, 경찰은 정의를 가로막고 공포심을 심기 위해 불법 전략을 취하고 있는 것으로 드러났다. 경찰은 유족들이 재판에 출석하지 못하도록 집을 습격하거나, 증인을 괴롭히고, 법정에서 증언한 사람들을 위협했다.

어떤 경우에는 유족들을 괴롭히고 이들의 정의 구현을 막기 위해 경찰관들이 피해자의 장례식에까지 나타나기도 했다.

샤켈리아는 국제앰네스티에 다음과 같이 전했다.

자메이카의 문제는 제도예요. 제도가 완전히 붕괴되어 있어요. 오빠를 죽인 건 총을 쏜 사람이지만, 이 사건과 다른 수많은 사건들이 벌어지게 된 건 제도의 탓이에요.

“적어도 법원에 가서, 판사가 사건을 심리할 수 있어야 해요. 모든 증거를 확인하고 변론을 제기할 기회를 얻고 싶어요. 저는 정의를 바랄 뿐이에요. 공평한 싸움은 아니지만, 저는 낙관적인 사람이니까 옳은 일을 위해 계속해서 싸울 거예요.”

3월 8일 EU 정상들과 터키 간 회담 이후에 국제앰네스티는 난민 재정착에 무조건적인 노력을 기울이고 유럽으로 향하는 안전하고 합법적인 경로를 제공해야 하는데, 그 대신 난민과 이주민들을 터키에 돌려보내는 방법에만 계속해서 집착하는 것은 난민 위기에 충격적일 만큼 근시안적이고 비인도적인 태도를 보여주는 것이라고 밝혔다.

아흐메트 다부토울루 터키 총리와 도널드 투스크 EU 상임의장, 장 클로드 융커 유럽집행위원회(EC) 회장은 3월 17일과 18일 열리는 EU 정상회담에 앞서 EU-터키간 최종 합의를 위한 난민 대응 계획의 윤곽을 공유했다.

그리스의 시리아 난민 전원을 터키로 돌려보내고 일부의 난민만을 유럽에 수용하겠다는 이번 계획은 윤리적, 법적 문제를 초래한다. 유럽에서 제공되는 시리아 난민 재정착지는 목숨을 걸고 위험한 뱃길에 올라 그리스로 향했던 시리아 난민들을 대가로 한 것이다.

이베르나 맥고완(Iverna McGowan) 국제앰네스티 유럽국장은 “EU와 터키 정상들은 이날 회담에서 사실상 세계에서 가장 취약한 사람들의 존엄성과 인권을 거래 수단으로 팔아 넘기며 최악의 모습을 보였다. 난민과 난민을 맞교환한다는 발상은 위험하리만치 비인간적일뿐만 아니라, 당면한 인도주의적 위기에 대해 장기적으로 지속가능한 해결책이 될 수도 없다”고 말했다.

이번 계획이 국제법상 적법한가 하는 의혹에 대해 EU 정상들은 EU법상 터키가 ‘안전 국가’로 지정되면 가능할 것이라고 답했다.

국제앰네스티는 ‘안전한 제3국’이라는 개념에 강력히 이의를 제기한다. 충분하고 공정한 절차를 거쳐 망명 신청이 받아들여져야 할 권리를 침해함은 물론, 이후 본국으로 강제송환되는 결과로 이어져 강제송환을 금지하는 농르풀망 원칙을 위반할 수 있기 때문이다. 특히 터키는 현재 국내 상황과 이주민과 난민에 대한 처우를 봤을 때 상당한 우려를 낳고 있다.

맥고완 국장은 “터키는 시리아 난민들을 시리아로 강제송환시켰던 바 있고, 지금도 수많은 난민들이 적절한 주거지 없이 절박한 상황 속에 살아가고 있다. 난민 어린이 수만 명은 정규 교육을 받지 못하는 상태다. 유럽이 편리하게 의무를 떠넘길 수 있는 ‘안전한 제3국’으로 간주하기에는 아무리 생각해도 불가능한 일”이라고 덧붙였다.

시리아 난민이 아니더라도 국제적인 보호가 필요한 사람들은 터키로 송환하지 않겠다고 주장하고는 있으나, 대규모로 송환이 이루어지는 제도하에서 이러한 일부 개개인의 권리를 어떻게 보장할 것인가에 대해서는 분명한 설명이 부족한 상태다. 모든 난민들이 시리아 출신이 아니라는 것과, 터키의 난민 제도는 제대로 기능하지 않고 있다는 것이 현재 닥친 현실이다.

이번 계획은 망명 신청이 가능하게 해야 할 EU의 의무를 완전히 웃음거리로 만들었다. 누구든 공정하고 강력한 망명 신청 절차를 밟을 권리가 있다는 원칙에 기반하지 않은 송환 제도는 매우 큰 문제의 소지가 있다.

맥고완 국장은 “이라크와 아프가니스탄 난민들은 시리아 난민과 함께 그리스에 도착하는 난민들 중 약 90%를 차지한다. 이들이 국제적인 보호를 강력히 요구한다는 것을 알면서도 터키로 돌려보낸다면 난민 인권을 존중하겠다는 EU의 주장이 허황됨을 드러낼 뿐”이라고 말했다.

투스크 의장은 또한 서부 발칸반도 지역의 입국 경로를 폐쇄할 것이라고도 언급했다. 이 경로를 차단할 경우 수천여 명의 난민들이 추위 속에서 계획도 없이 시급한 인도적 요구와 국제적으로 보호받을 권리로부터 방치되는 결과로 이어진다.

유럽연합과 국제사회는 난민 위기를 해소하기 위해 인도적, 재정적 지원을 제공하고 더 많은 수의 난민을 수용해 재정착시키는 등 시급히 행동에 나서야 할 것이다.

EU Turkey Summit: EU and Turkish leaders deal death blow to the right to seek asylum

The persistent preoccupation with shipping people back to Turkey instead of making unconditional efforts on resettlement and offering other safe and legal ways to Europe shows an alarmingly short-sighted and inhumane attitude to handling this crisis, said Amnesty International after European Council talks with Turkey today.

Prime Minister of Turkey Ahmet Davutoğlu, President of the European Council Donald Tusk and President of the European Commission Jean Claude Juncker shared the outline of the plan for a final agreement between the EU and Turkey, in advance of the European Council meeting on 17 and 18 March.

The proposal that for every Syrian refugee returned to Turkey from Greece, a Syrian will be settled within the EU is wrought with moral and legal flaws. Unsettlingly, this plan would make every resettlement place offered to a Syrian in the EU contingent upon another Syrian risking their life by embarking on the deadly sea route to Greece.

“EU and Turkish leaders have today sunk to a new low, effectively horse trading away the rights and dignity of some of the world’s most vulnerable people. The idea of bartering refugees for refugees is not only dangerously dehumanising, but also offers no sustainable long term solution to the ongoing humanitarian crisis,” said Iverna McGowan, Head of Amnesty International’s European Institutions Office.

When questioned on the legality of this proposal under international law, EU leaders responded that this would be possible under EU law once Turkey be designated as a ‘safe country’.

Amnesty International strongly contests the concept of a ‘safe third country’ in general, as this undermines the individual right to have asylum claims fully and fairly processed and may result in individuals being subsequently deported to their country of origin – in violation of the principle of non-refoulement. In the case of Turkey in particular, there is huge cause for concern given the current situation and treatment of migrants and refugees.

“Turkey has forcibly returned refugees to Syria and many refugees in the country live in desperate conditions without adequate housing. Hundreds of thousands of refugee children cannot access formal education. By no stretch of imagination can Turkey be considered a ‘safe third country’ that the EU can cosily outsource its obligations to,” she added.

Although it was claimed that those needing international protection that are not Syrian would not be returned to Turkey, it has not been made clear how those individual rights could be guaranteed in the context of a system of mass returns. The reality is that not all asylum seekers are coming from Syria, and Turkey does not have a fully functioning asylum system.

The proposal makes a mockery of the EU’s obligation to provide access to asylum at its borders. Any returns system not built on the principle of an individual’s right to access a fair and robust asylum process is deeply problematic.

“Iraqi and Afghan nationals, along with Syrians, make up around 90 percent of arrivals to Greece. Sending them back to Turkey knowing their strong claim to international protection will most likely never be heard reveals EU claims to respect refugees’ human rights as hollow words,” said Iverna McGowan.

It was also stated by President Tusk that the Western Balkans route would be closed. Closure of this route would lead to thousands of vulnerable people being left in the cold with no clear plan on how their urgent humanitarian needs and rights to international protection would be dealt with.

It is urgent that the European Union and the international community as a whole urgently step up their commitment to solving this crisis, both in terms of humanitarian and other financial assistance and by resettling far greater numbers of refugees.
