전쟁범죄와 심각한 인권침해를 부추기는 무기의 무분별한 국가간 이전을 막기 위해 마련된 세계적인 무기거래조약(ATT)이 이번 주 멕시코에서 처음으로 시험대에 오르게 될 것이라고 국제앰네스티가 24일 밝혔다.

8월 24일부터 27일까지 멕시코 칸쿤에서 열릴 제1회 무기거래조약 당사국회의에는 비준국은 물론 2013년 무기거래조약이 채택된 후 이에 서명하거나 이를 비준하지 않은 국가도 참여한다. 무기거래조약 마련을 위해 파트너 NGO들과 함께 20년 이상 캠페인을 벌였던 국제앰네스티 역시 참가할 예정이다.

“칸쿤 회의는 무기거래조약이 거쳐야 할 첫 번째 시험대가 될 것이며, 세계 각국은 생명을 살리는 무기거래조약에 동참함으로써 새로운 역사를 만들 수 있는 중요한 기회를 얻게 될 것”이라며 “국제앰네스티는 이번 회담이 관료주의에 빠지거나, 무책임한 재래무기 이전으로 초래된 고통을 끝내기 위해 효과적이고 투명하게 규제하겠다는 무기거래조약의 본래 취지를 잃지 않도록 최선을 다할 것”이라고 말했다.

 

국제앰네스티가 중점적으로 촉구할 것은 다음의 세 가지다.

  • 국가가 자국의 무기 수출입 규모와 범위에 대해 포괄적으로 보고하게 하는 등, 무기거래조약의 모든 면에서 투명성을 유지할 것.
  • 무기거래조약의 모든 회담 및 절차에 NGO가 의미 있게 참여할 수 있도록 허용할 것.
  • 전쟁범죄와 심각한 인권침해 등 중대한 국제법 위반행위를 저지르는 데 무기를 사용할 위험이 있는 대상에게는 무기 이전을 막아야 한다는 무기거래조약의 의무를 충실히 이행할 수 있는 시스템을 마련할 것.

국가간 무기거래가 지금까지도 비밀리에 이루어지고 있는 만큼 무기거래조약의 주요 목적 중 하나는 투명성이다. 투명성은 각국의 조약 이행 여부를 확인할 수 있는 핵심 수단이기도 하며, 조약의 실제 적용 현황을 평가하는 데 도움이 될 수 있다.

칸쿤 회의의 준비기간 동안 열린 준비회의에서는 시민사회단체의 참여와, 무기 수출입 현황에 대해 어느 정도의 정보를 공개할 것인지를 중점적으로 논의했다.

일부 국가는 향후 열릴 무기거래조약 회의에 시민사회의 역할을 대폭 제한하고, 주요 쟁점을 비공개 회의에서 비밀리에 논의함으로써 이들의 참여를 통제하려 하기도 했다.

국제앰네스티 역시 일부 국가가 무기거래조약에 따라 보고해야 할 사항을 최소한의 수준으로 줄이려 했다는 점에 충격을 받았다. 이렇게 될 경우 매년 이전된 무기의 재정적 가치만을 보고하면 될 뿐, 선적 규모, 물품의 수, 소화기와 경화기 등 각 종류별 통계에 대한 핵심적인 세부사항은 공개하지 않을 수 있다.

이전된 무기의 최종 목적지와 용도에 대한 세부 사항 역시 비밀에 부쳐져, 불법 거래소 및 허가받지 않은 최종 사용자에게 무기가 이전되는 것을 막기 위한 중요한 정보를 얻지 못하게 된다.

마렉 마친스키 국장은 “가장 중요한 논의 과정에서 시민사회를 배제하고, 무기 수출입에 관한 연례보고를 공개하지 않는 것은 ‘여느 때와 다름없이’ 여전히 무기이전을 비밀리에 이루어지게 하며 무기거래조약의 취지를 저해하는 것이다. 이를 용납해서는 안 된다”며

“국제 무기이전에 대해 법적 구속력이 있는 세계적인 규제를 만들고자 각국과 시민사회가 함께 노력한 끝에 무기거래조약이라는 큰 성과를 이뤘다. 시행 단계에 들어서서도 계속해서 생산적으로 참여할 수 있기를 기대한다. 각국 정부는 세계 무기거래의 전체적인 현황을 파악할 수 있는 포괄적이고 투명한 보고 의무 조항을 채택해야 한다”고 말했다.

 

배경정보

1990년대 초부터 국제앰네스티는 파트너 NGO들과 함께 잔혹행위와 인권침해를 부추기는 재래무기 및 탄약의 이전을 통제하고자 국제적인 무기거래에 대해 강력하고 법적 구속력이 있는 세계적인 규제를 마련하기 위해 캠페인을 벌여 왔으며, 전세계 100만 명 이상이 이에 참여했다.

2013년 4월 2일, 유엔총회를 통해 총 155개국의 찬성표로 채택된 무기거래조약은 2014년 12월 24일부터 모든 당사국에 대해 구속력 있는 국제법으로써 발효되었다.

프랑스, 독일, 이탈리아, 스페인, 영국 등 세계 10대 무기 수출국에 속하는 5개국 역시 무기거래조약을 비준한 72개국에 속한다. 현재 세계 최대 무기 생산국이자 수출국인 미국은 조약에 서명했지만 아직 비준하지는 않은 58개국 중 하나다. 중국, 캐나다, 러시아 등의 주요 무기 생산국은 조약에 서명하거나 이를 비준하기를 거부했다.

무기거래조약은 대량학살, 반인도적 범죄, 전쟁범죄에 무기를 사용하는 것으로 알려진 국가에 대한 무기이전을 막는 강력한 규제를 포함하고 있다. 무기거래조약에 참여한 국가는 국제인권법 또는 국제인도법을 심각하게 위반하는 행위에 수출된 무기가 사용될 위험을 막기 위해 객관적인 평가를 수행해야 한다.

국제적인 무기이전은 비밀리에 이루어지지만, 세계적인 거래 규모는 매년 미화 1천억 달러에 이를 것으로 추정되고 있다.

국제앰네스티는 심각한 인권침해에 기여하거나 이를 용이하게 하는 무책임한 무기이전에 대해 계속해서 기록하고 폭로해 왔다.

이렇게 기록된 내용 중에는 구소련 및 러시아, 벨라루스, 우크라이나, 중국 등에서 주로 생산된 무기와 탄약이 수단으로 이전된 후, 남부 코르도판과 다르푸르 및 인접한 남수단의 분쟁 당사자들에게 사용된 정황도 포함되어 있다. 국제앰네스티는 최근 남부 코르도판에서 병원과 학교 등 민간 지역을 대상으로 계속된 무차별 공격에 대해 기록한 바 있다. 이는 그 규모와 성격을 보아 전쟁범죄에 해당하며, 반인도적 범죄에도 해당할 수 있는 공격이었다.

이라크와 시리아에서는 무분별하게 생산된 무기가 자칭 이슬람국가(IS) 및 그 외의 무장단체로 이전되었다. 이렇게 이전된 무기는 즉결처형, 강제실종, 강간, 고문 등 심각한 인권침해를 쉽게 저지르는 데 사용됐다. 주로 1970년대와 80년대 구소련 시절 생산된 소화기와 경화기, 장갑차와 탄약이 확산되면서 엄청난 국내실향민과 난민이 발생하고, 인도주의적 지원이 지연되고, 성폭력 문제가 더욱 악화되는 등 민간인에게 막대한 영향을 끼쳤다.

Arms Trade Treaty impact to be decided at Mexico conference

The global Arms Trade Treaty (ATT), created to rein in the poorly regulated international arms transfers that fuel war crimes and serious human rights abuses, will face its first major test in Mexico this week, Amnesty International said today.

The ATT’s first Conference of States Parties, taking place in Cancún from 24-27 August, will be attended by dozens of states, including some that have neither signed nor ratified the treaty since its adoption in 2013. Amnesty International, which campaigned alongside NGO partners for more than two decades to make the ATT a reality, will also attend the meeting.

“Cancún marks the first major test for the Arms Trade Treaty, and states will have an important opportunity to make history by following through on the treaty’s lifesaving goals,’ said Marek Marczynski, Head of Military, Security and Police at Amnesty International.

“We’ll be making sure the talks don’t get bogged down in bureaucracy or lose sight of the ATT’s guiding principles – effective and transparent regulation to end the human suffering caused by irresponsible flows of conventional arms.”

Three major areas Amnesty International will be pressing for are:

  • transparency in all aspects of the ATT, including comprehensive state reporting on the scale and range of their arms imports and exports;
  •  making sure NGOs are allowed to participate meaningfully in all treaty meetings and processes; and
  •  putting in place mechanisms to ensure that states honour their treaty obligations by preventing transfers of weapons to anyone who risks using them for serious violations of international law, including war crimes and other serious human rights violations.

Transparency is one of the ATT’s main objectives since the global trade in arms has, up until now, been shrouded in secrecy. It is also a key means of demonstrating that States are implementing the treaty, and will help to assess how the ATT is being applied in practice.

During the run-up to the Mexico conference, discussions in preparatory meetings focused on the ongoing participation of civil society groups, as well as how much information on arms imports and exports states should report and make publicly available.

Some states are trying to curb the role of civil society by significantly restricting their participation in future ATT conferences and making an increasing number of key decisions behind closed doors in secret sessions.

Amnesty International is also alarmed that states have attempted to strip their ATT reporting requirements down to a bare minimum. This means that they may only be obliged to report on the financial value of transfers annually, without providing crucial details about the size of the shipment, the number of items and an accounting of each category of small arms and light weapons included.

Details about where the weapons would end up and for what purpose would also be secret, which is crucial information aimed at preventing diversion of arms into illicit markets and to unauthorized end users.

“Shutting civil society out of some of the most important discussions and not making annual reports on arms imports and exports public will mean ‘business as usual’ – arms transfers will remain shrouded in secrecy, undermining the purpose of the ATT. This must not be allowed to happen,” said Marek Marczynski.

“A great deal has been achieved through the work of civil society alongside States to win legally binding, global rules on international arms transfers. We look forward to continue playing a constructive role as we move into the implementation phase. States must adopt comprehensive and transparent reporting requirements that give a full picture of the global trade in arms.”

Background
Since the early 1990s Amnesty International has campaigned with NGO partners to achieve robust, legally binding, global rules on international arms transfers to stem the flow of conventional arms and munitions that fuel atrocities and human rights abuses. More than a million people around the world joined the campaign.

On 2 April 2013, a total of 155 states voted in the UN General Assembly to adopt the Arms Trade Treaty. It entered into force as binding international law on 24 December 2014, for all states parties.

Five of the top 10 arms exporters – France, Germany, Italy, Spain and the UK – are among the 72 states around the world to have already ratified the ATT. The USA, by far the largest arms producer and exporter, is among 58 other countries that have signed but not yet ratified the treaty. Other major arms producers like China, Canada and Russia have resisted signing or ratifying the treaty.

The ATT includes a number of robust rules to stop the flow of arms to countries when it is known the arms would be used for genocide, crimes against humanity or war crimes. Governments that are part of the ATT will now have to carry out objective assessments to avoid an overriding risk that an arms export would be used to commit serious violations of international human rights law or international humanitarian law.

International arms transfers are shrouded in secrecy but the value of the global trade is estimated to be approaching US$100 billion annually.
Amnesty International has continued to document and expose irresponsible arms transfers that contribute to or facilitate grave abuses.
This includes weapons and ammunition predominantly manufactured in the Russian Federation/former Soviet Union, Belarus, Ukraine and China transferred to Sudan, and subsequently used by all sides of the conflicts in South Kordofan and Darfur as well as neighbouring South Sudan. In South Kordofan, Amnesty International has recently documented a series of indiscriminate attacks on civilian areas, including hospitals and schools, of a nature and scale that constitute war crimes and possibly crimes against humanity.

In Iraq and Syria, rampant arms proliferation has seen arms transfers being diverted to the armed group calling itself Islamic State and other armed groups. These arms are being used to facilitate summary killings, enforced disappearances, rape and torture, amongst other serious human rights violations. The spread of arms and ammunition – mostly Soviet/Warsaw Pact-era small arms and light weapons, armoured vehicles and artillery dating back to the 1970s and 80s – has caused untold impact on the civilian population, creating large flows of internally displaced peoples and refugees, impeding access to humanitarian assistance and exacerbating gender-based violence.

이스라엘의 핵실험 실태를 폭로했던 모데르차이 바누누(Mordechai Vanunu)가 언론과 인터뷰를 가졌다는 이유로 11일 가택연금에 처해진 것은 가혹한 보복성 판결이라고 국제앰네스티가 밝혔다.

예루살렘 법원은 바누누가 9월 4일 이스라엘 방송사 채널2와 인터뷰를 나눈 것과 관련해 9월 10일 일주일간의 가택 연금에 처해진 것에 불복하고 제기한 항소를 11일 기각했다. 또한 바누누가 인터넷을 사용하거나 기자와 접촉하는 것 역시 금지할 것을 명령했다.

필립 루서(Philip Luther) 국제앰네스티 중동-북아프리카 국장은 “모르데차이 바누누에게 가해진 금지 처분은 가혹한 보복성 처벌”이라며 “최근 바누누의 자유를 탄압하고 있는 것은 바누누가 1986년 사건으로 18년이라는 시간을 감옥에서 보내며 이미 큰 대가를 치렀음에도 지금까지도 처벌을 고집하며 본보기로 삼겠다는 이스라엘 정부의 결정을 보여주는 또 하나의 사례에 불과하다. 바누누에게 더 이상의 처벌을 가한다고 해도 이스라엘의 국가 안보에는 아무런 도움이 되지 않는다. 바누누가 폭로했던 정보는 이제 거의 30년 전의 것으로, 이미 유효한 기간을 훨씬 넘긴 상태”라고 말했다.

국제앰네스티는 모르데차이 바누누를 표현의 자유를 평화적으로 행사했다는 이유만으로 자유를 빼앗긴 양심수로 간주한다.

바누누는 지난 1986년 영국 신문사 선데이타임즈(The Sunday Times)에 이스라엘의 핵실험 실태를 폭로했다가 독방 구금 11년을 포함, 18년간 교도소에 수감되어 있었다. 당시 이스라엘 비밀정보기관 모사드(Mossad)는 바누누가 해당 내용을 폭로하자 이탈리아에서 그를 납치해 장기간 비밀 구금하기도 했다.

바누누는 2004년 형기를 마치고 출소했지만 그의 시련은 지금까지도 계속되고 있다. 해외여행을 가거나 외국 대사관 주변에 접근하지 못하는 것은 물론, 인터넷 사용이나 외국인과의 대화도 금지되는 등 군이 부과하는 불필요한 보복성 제재의 대상이 되고 있다.

그러나 이번 주 체포되기 전까지만 해도 이스라엘 국내 언론사 기자와 대화하는 것은 금지사항이 아니었다. 바누누 측 변호인은 해당 인터뷰가 이스라엘 군 검열관에게 사전 승인을 받은 것으로, 바누누의 석방 조건을 위반하는 것이 아니라고 주장했다.

채널2 측은 정보 제공자 보호 원칙을 철저히 지키는 중으로, 바누누와 나눈 인터뷰 영상의 편집되지 않은 원본을 제출하라는 경찰의 요구를 거부하고 있다.

배경정보

모르데차이 바누누는 2004년 형기를 마친 이후 표현과 집회, 결사의 자유를 행사하고자 여러 차례 시도했지만 이스라엘 대법원은 이를 모두 묵살해 왔다.

일례로 지난해 대법원은 영국에서 공익제보자를 주제로 열린 국제앰네스티 행사에 참여하고, 의원 54명의 초청을 받은 영국 의회 행사에 참석할 수 있도록 바누누의 해외여행 금지 조치를 해제해 달라는 바누누 측 변호인의 청원서를 기각한 바 있다.

지난 2010년에는 외국인과 대화를 나누고 베들레헴의 크리스마스 미사에 참석하려고 했다는 이유로 제재를 위반했다며 유죄를 선고 받고 3개월간 수감되기도 했다.

Israel: ‘Vindictive’ ruling keeps whistle-blower Vanunu under house arrest

Today’s court decision to keep Israeli nuclear whistle-blower Mordechai Vanunu under house arrest for giving a media interview is vindictive and heavy-handed, Amnesty International said.

The Jerusalem district court turned down his appeal against a week of house arrest imposed yesterday in connection with an interview he gave to Israeli broadcaster Channel 2 on 4 September. The sentence also prohibits him from using the internet or speaking to any journalists.

“The restrictions on Mordechai Vanunu are punitive and vindictive,” said Philip Luther, Middle East and North Africa Director at Amnesty International.

“The latest attacks on Vanunu’s freedom are just one more example of the Israeli authorities’ determination to continue to exact retribution and make an example of him for what he did in 1986 and for which he paid the high price of 18 years in prison.

“Punishing him further now does nothing to protect Israel’s national security – any information he disclosed almost three decades ago is by now way past its sell-by date.”

Amnesty International considers Mordechai Vanunu to be a prisoner of conscience, deprived of his liberty solely for peacefully exercising his right to freedom of expression.

He previously spent 18 years in prison, including 11 years in solitary confinement, for revealing details of Israel’s nuclear arsenal to the British newspaper The Sunday Times in 1986. Following that disclosure, agents from Israel’s intelligence agency Mossad abducted him in Italy and held him in prolonged secret detention.

Though Mordechai Vanunu was released in 2004 after serving his sentence, his ordeal continues today. He remains subjected to military orders that impose punitive and unnecessary restrictions, including bans on foreign travel or going near foreign embassies, as well as restrictions on his internet use and communications with foreigners.

But, until his arrest this week, he had not been barred from speaking to Israeli journalists. Vanunu’s lawyers say that he did not breach his release conditions – the interview was given prior approval by an Israeli military censor.

Channel 2 is apparently standing fast to the principle of protecting their sources and has refused to give police the unedited footage of their recent interview with Mordechai Vanunu.

Background

Since Mordechai Vanunu’s release from prison in 2004, Israel’s Supreme Court has repeatedly quashed his attempts to be able to exercise his rights to freedom of expression, assembly and association.

Last year, for example, the Supreme Court denied a petition from his lawyers to lift his travel ban so he could participate in an Amnesty International event on whistle-blowers in the UK and attend an event at the UK parliament to which he was invited by 54 members of parliament.

In 2010 he was imprisoned for three months after being convicted of breaching his restrictions by speaking to foreigners and attempting to attend Christmas Mass in Bethlehem.

마이크로소프트의 스카이프, 스냅챗 등 IT기업들의 메신저 앱에서 제공되는 인스턴트 메시징(IM) 서비스에 기본적인 개인정보 보호 기능이 탑재되어 있지 않아 이용자의 인권침해가 우려된다고 국제앰네스티가 21일 밝혔다.

국제앰네스티는 새롭게 발표한 ‘메신저 보안 순위’에서 전 세계적으로 가장 널리 사용되는 11개의 모바일 메신저 앱을 대상으로 메신저상에서 이용자의 개인정보와 표현의 자유를 보호하기 위한 조치로서 암호화 기술을 어떻게 활용하는지 평가했다.

셰리프 엘세이드 알리(Sherif Elsayed-Ali) 국제앰네스티 기술과 인권 국장은 “모바일 메신저가 사적인 공간이라고 생각한다면 오산”이라며 “메신저에서의 대화는 사이버 범죄와 정부의 감찰이라는 지속적 위협에 노출되어 있는 것이 현실”이라고 말했다. 알리 국장은 이어 “특히 스냅챗 등 앱을 통해 누구보다도 활발하게 자신의 개인정보와 사진을 공유하는 젊은 층이 피해를 입을 가능성이 크다”고 말했다.

국제앰네스티는 IT기업들이 메신저 보안 유지를 위해서 종단간 암호화 기술을 필수적으로 도입해야 한다고 강조했다. 종단간 암호화 기술은 메시지 전달과정 전체를 암호화해 수신자와 발신자를 제외한 누구도 데이터를 읽을 수 없도록 하는 기술이다. 최하위 순위를 기록한 기업들의 메신저는 적절한 암호화 수준을 갖추고 있지 않다는 것이 국제앰네스티의 설명이다.

개인 정보 보호를 위한 최고의 메신저 앱은?

셰리프 엘세이드 알리 국장은 “IT기업들은 우리가 익히 잘 알고 있는 위협 요소들로부터 이용자의 개인정보와 표현의 자유를 보호해야 할 책임이 있다. 하지만 기업들은 적합한 보안 수준을 갖춘 암호화 기술을 제공하지 못해 위협 발생 초기 단계에서부터 실패하고 있다”고 말하며 “수백만 명의 메신저 이용자들은 가장 기본적인 수준의 개인정보 보호조치도 받지 못하고 있는 실정이다”고 지적했다.

국제앰네스티가 이번에 발표한 ‘메신저 보안 순위’는 11개 IT기업을 대상으로 이들 기업이 운영하는 메시지 서비스가 ▶이용자의 개인정보와 표현의 자유에 대한 온라인상의 위협을 인지하는가 ▶종단간 암호화 기술을 기본 설정으로 지원하는가 ▶이용자에게 개인정보와 표현의 자유에 대한 위협요소가 있는 것을 알리고 자사 메신저에 적용된 암호화 기술의 보안수준에 대해 공개하는가 ▶정부가 이용자 데이터와 관련하여 요청한 사항과 요청 사항에 대해 어떤 조치를 취했는지 이용자에게 고지하는가 ▶자사 메신저에 적용된 암호화 기술의 기술적 세부 사항을 공개하는가 등의 다섯 가지 항목에 대한 답변을 토대로 점수를 집계해 총점 100점 기준으로 평가한 것이다.

탠센트, 블랙베리, 스냅챗 100점 만점에 30점 미만

중국 IT기업 탠센트(Tencent)는 자사 메신저의 이용자 개인정보 보호조치가 미비한 수준이고 투명성 부문에서도 가장 낮은 평가를 받아 이번 조사에서 100점 만점에 0점으로 최하위를 기록했다. 블랙베리(Blackberry)와 스냅챗(Snapchat)dms 각각 20점과 26점을 받아 탠센트 다음으로 하위권에 머물렀다. 인권 보호에 있어 꾸준히 정책적인 노력을 기울이고 있는 마이크로소프트(Microsoft)도 자사 메신저인 스카이프(Skype)의 암호화 기술이 매우 기초적 수준에 불과해 종합 40점으로 조사대상 11개 기업 중 8위에 그쳤다. 하위권에 속한 4개 기업 모두 이용자의 대화에 종단간 암호화 기술을 적용하고 있지 않다.

매일 1억 명 이상이 사용하는 미국의 메신저 스냅챗도 저조한 성적을 기록했다. 엄격한 개인정보 보호 정책이 있기는 하지만 사실상 이용자의 개인정보 보호에 소극적이라는 평가다. 스냅챗도 종단간 암호화 기술을 활용하지 않으며 이용자에게 인권침해 가능성이나 메신저에서 사용하고 있는 암호화 기술 정보를 고지하지 않아 투명성 부문에서 낮은 점수를 받았다.

페이스북, 애플 개인정보 보호 선두주자로 나서

물론 어떤 서비스도 아직까지 100% 보안을 보장해주지는 않는다. 이번 조사에서는 페이스북 메신저와 왓츠앱을 합해 20억 명의 이용자를 보유하고 있는 페이스북(Facebook)이 100점 만점에 종합 73점으로 1위에 올랐다. 페이스북은 평가대상이 된 11개 기업 중 인권침해위협에 대응하기 위한 조치로서 암호화 기술을 가장 적극적으로 활용하고 있는 것으로 드러났으며 자사 보안책에 대해서도 이용자에게 충분히 고지하고 있다는 평가를 받았다.

한편 페이스북 메신저는 종단간 암호화 기술을 활용한 ‘비밀 대화’ 기능을 새롭게 도입했다. 하지만 이용자가 직접 기능을 활성화해야 하기 때문에 페이스북이 전체 이용자 데이터에 대한 접근 권한을 가지고 있다는 점에서 여전히 암호화 수준이 낮았다. 왓츠앱의 경우 종단간 암호화 기술을 기본 설정으로 지원하며 이용자에게 메신저에 적용된 암호화 기술 정보를 명확하게 공시하고 있다.

애플(Apple)은 자사 메신저인 아이메시지와 페이스타임에서 이뤄지는 모든 종류의 대화에 대해 완벽한 종단간 암호화 기술을 적용해 종합 67점을 받았다. 그러나 애플 역시 일반 문자메시지가 아이메시지보다 보안성이 떨어진다는 점을 이용자들에게 더욱 명확하게 고지해야 할 필요가 있다. 개방형 암호화 프로토콜을 도입해 완벽한 독립적 검증 체계를 도입해야 한다.

소수만 기본적인 보안 수단으로 종단간 암호화 기술 적용

전 세계적으로 매일 수억 명의 사람들이 왓츠앱, 스카이프, 바이버 등의 모바일 메신저를 이용하고 있다. 이들 가운데는 심각한 인권탄압 문제를 안고 있는 국가에서 목숨을 걸고 일하는 인권활동가, 야당 정치인, 언론인도 포함되어 있다.

점점 더 빈번하게 발생하는 대규모 데이터 침해 사고와 정부의 대중 감시가 수그러들 기미가 보이지 않는 상황에서는 최고 수준의 암호화 기술과 메시지 데이터 접근 권한에 대한 투명한 공개가 대화 내용을 보호할 수 있는 핵심 수단이다. 하지만 평가대상 중 애플, 라인, 바이버 3개 기업만이 자사 메신저에서 종단간 암호화 기술을 기본 설정으로 지원하는지 평가하는 항목에서 합격 판정을 받았다.

셰리프 엘세이드 알리 국장은 “대부분의 IT 기업들의 이용자의 개인정보 보호 정책이 기준에 미달”된다며 “전 세계 각지의 활동가들이 정보당국의 감시를 피해서 자신을 보호하기 위해 암호화 기술에 크게 의존하고 있다. IT 기업들이 인권침해 위협에 대해 안일하게 대처해서 이들을 위험에 노출시키는 것은 매우 무책임한 행동”이라고 말했다.

그는 또 “온라인상에서 이용자의 개인정보와 표현의 자유가 앞으로도 보장될지는 많은 부분 IT기업들이 어떻게 하느냐에 달렸다. 대화 내용을 보호하는 새로운 서비스를 도입할 수도 있고, 감시 당국에 이용자들의 메시지 데이터를 고스란히 갖다 바칠 수도 있다”고 말했다.

국제앰네스티는 IT기업들에 자사 메신저에 종단간 암호화 기술을 기본 설정으로 지원하라고 촉구하고 있다. 일반 시민뿐 아니라 전 세계 평화적 활동가들과 박해받는 소수자들이 표현의 자유를 행사할 수 있게 되고 이로써 자신들의 권리를 보호받을 수 있기 때문이다. 국제앰네스티는 또 메신저 서비스 이용자의 개인정보와 표현의 자유를 보호하기 위해 IT기업들이 도입한 정책 및 조치들의 세부 사항을 전부 공개할 것을 요구하고 있다.

Snapchat, Skype among apps not protecting users’ privacy

Tech companies like Snapchat and Skype’s owner Microsoft are failing to adopt basic privacy protections on their instant messaging services, putting users’ human rights at risk, Amnesty International said today.

The organization’s new ‘Message Privacy Ranking’ assesses the 11 companies with the most popular messaging apps on the way they use encryption to protect users’ privacy and freedom of expression across their messaging apps.

“If you think instant messaging services are private, you are in for a big surprise. The reality is that our communications are under constant threat from cybercriminals and spying by state authorities. Young people, the most prolific sharers of personal details and photos over apps like Snapchat, are especially at risk,” said Sherif Elsayed-Ali, Head of Amnesty International’s Technology and Human Rights Team.

Amnesty International has highlighted end-to end encryption, a way of scrambling data so that only the sender and recipient can see it, as a minimum requirement for technology companies to ensure that private information in messaging apps stays private. The companies that ranked lowest on the scorecard do not have adequate levels of encryption in place on their messaging apps.

“It is up to tech firms to respond to well-known threats to their users’ privacy and freedom of expression, yet many companies are falling at the first hurdle by failing to provide an adequate level of encryption. Millions of people are using messaging apps that deny them even the most basic privacy protection,” said Sherif Elsayed-Ali.

Amnesty International’s ‘Message Privacy Ranking’ ranks technology companies on a scale of one to 100 based on how well they do five things:

• Recognize online threats to their users’ privacy and freedom of expression
• Apply end-to-end encryption as a default
• Make users aware of threats to their rights, and the level of encryption in place
• Disclose details of government requests to the company for user data, and how they respond
• Publish technical details of their encryption systems

Tencent, Blackberry and Snapchat score less than 30/100

Chinese firm Tencent came bottom, scoring zero out of 100, ranked as the company taking least action on messaging privacy, and the least transparent. It was followed by Blackberry and Snapchat scoring 20 and 26 respectively. Despite Microsoft’s strong policy commitment to human rights, it is still using a weak form of encryption on Skype, scoring 40 and leaving it four places from the bottom. None of these companies provide end-to-end encryption of their users’ communications.

Snapchat, a US-based company used by more than 100 million people every day, also scored badly. Although it has a strong policy commitment towards privacy, in practice it does not do enough to protect its users’ privacy. It does not deploy end-to-end encryption, for example, and is not transparent in informing users about the threats to their human rights or its use of encryption.

Facebook, Apple lead the way

No company provides watertight privacy, but Facebook, whose apps Facebook Messenger and WhatsApp together have 2 billion users, has the highest score with 73 out of 100. Facebook is doing the most out of the 11 companies assessed to use encryption to respond to human rights threats, and is most transparent about the action it’s taking.

However, despite including end-to-end encryption as an option with its new “secret conversation” feature, Facebook Messenger’s default mode uses a weaker form of encryption, which means Facebook has access to all the data. WhatsApp uses end-to-end encryption by default and notably provides clear information to users about encryption within the app.
Apple scored 67 out of 100, providing full end-to-end encryption in all communications on its iMessage and Facetime apps. But Apple needs to do more to make users aware that SMS messages are less secure than iMessages. The company should also adopt a more open encryption protocol that allows for full independent verification.

End-to-end encryption: a basic protection few firms provide Instant messaging services like WhatsApp, Skype and Viber are used by hundreds of millions of people every day. This includes human rights activists, opposition politicians and journalists living in countries where their work could put them in grave danger.

With large data breaches occurring all too frequently and governments’ mass surveillance operations unabated, the strongest encryption as well as transparency about who has access to message data, is key to protecting them. Yet only three firms, Apple, Line and Viber scored full marks for providing end-to-end encryption by default on all their messaging apps.

“Most technology companies are simply not up to standard when it comes to protecting their users’ privacy. Activists around the world rely on encryption to protect themselves from spying by authorities, and it is unacceptable for technology companies to expose them to danger by failing to adequately respond to the human rights risks,” said Sherif Elsayed-Ali.

“The future of privacy and free speech online depends to a very large extent on whether tech companies provide services that protect our communications, or serve them up on a plate for prying eyes.”

Amnesty International is calling on companies to apply end-to-end encryption to messaging apps as a default. This would help protect the rights of everyday people, as well as peaceful activists and persecuted minorities all over the world by enabling them to exercise their freedom of speech. It is also calling on technology companies to publish full details of the policies and practices they have in place to meet their responsibility to respect the rights to privacy and freedom of expression.

Eight of the companies responded; we did not receive any response from Blackberry, Google or Tencent.

살릴 셰티(Salil Shetty) 국제앰네스티 사무총장은 “시리아 시위가 처음 시작된 이후로 지난 5년간의 세월은 엄청난 규모의 공포와 유혈사태로 얼룩져 왔다. 시리아 정부군이 평화적인 시위대를 향해 처음 발포했던 순간부터 민간인의 고통과 잔혹함은 시리아 사태를 비극적으로 상징하게 되었다”고 말했다.

또한 “시리아군을 비롯해 자칭 ‘이슬람국가(IS)’와 같은 비정부 무장단체는 인권과 전쟁법은 물론, 자신들로 인해 목숨을 잃고 상처 입거나, 피난을 떠나고, 포위당한 지역에서 굶주리는 민간인들에 대해 싸늘한 무관심으로 일관하고 있다. 시리아군은 민간 지역에 무자비한 ‘드럼통 폭탄(barrel bomb)’ 공격을 가하고, 대규모의 납치 활동과 산업 규모의 조직적 고문을 자행하는 등 끔찍한 전략을 사용하며 반인도적 범죄를 버젓이 저질렀다. 특히 IS와 같은 일부 무장단체는 세계 언론에 주목받는 점을 이용해 시리아인과 외국인을 막론한 민간인을 납치하고 약식 처형하는 등 자신들이 저지른 전쟁범죄를 아랑곳 하지 않고 홍보하고 있다”고 말했다.

다음은 지난 5년간 시리아 사태가 최악으로 치닫게 된 다섯 가지 결정적 순간을 정리한 것이다.

  • 반정부 시위가 시작된 지 3일이 지난 2011년 3월 18일, 남부 데라아(Dera’a)에서 반정부 성향의 그래피티를 그렸다는 이유로 체포, 고문당한 소년들의 석방을 요구하던 평화적 시위대를 향해 시리아군이 실탄을 발사했다. 이날 이후 시위는 유혈 사태로 번졌고, 이날의 발포는 정부군이 평화적인 시위를 탄압하는 데 치명적 무력을 광범위하게 사용하며 결국 전면적인 무장 분쟁으로까지 이어지게 되는 전조였다.
  • 2013년 8월 다마스쿠스 동부 고타(Ghouta)에서 화학무기 공격으로 고통스러워하는 주민의 모습을 담은 영상이 공개되면서 세계는 충격에 휩싸였고, 시리아에서 자행되고 있는 끔찍하고 잔혹한 인권침해에 대해 경종을 울렸다. 그러나 안타깝게도 이는 빙산의 일각에 불과했다. 화학무기 외에도 확산탄과 같은 금지 무기를 사용해 공격하거나 정기적인 미사일, 박격포 폭격을 가하면서 시리아 전역에서는 매일같이 점점 더 많은 사람들 목숨을 잃고 있다. 그런데도 유엔 안전보장이사회는 시리아 상황을 국제형사재판소(ICC) 검찰부에 회부하는 데 합의하지 못했고, 특히 러시아와 중국은 거부권을 행사해 민간인 보호 결의안 통과를 여러 차례 저지하는 등 수년째 제대로 대처하지 못하고 있다.
  • 2014년 1월 다마스쿠스 외곽 야르무크(Yarmouk)에서 봉쇄된 지역에 갇힌 주민들이 구호물품을 받기 위해 길게 늘어선 충격적인 모습은 시리아 전역의 봉쇄된 지역에서 식량과 의료 지원이 부족해 죽어가는 수천 명의 안타까운 현실을 알리는 계기가 되었다. 야르무크 외에도 모아다미야(Moadamiya), 동부 고타, 마다야(Madaya), 알포아(al-Fouaa) 등지를 봉쇄하며 정부군과 무장단체는 주민들의 굶주림을 전쟁 무기로 사용했다. 현재 시리아 15개 지역에서 40만 명 이상이 봉쇄지역에 갇혀 있다. 최근 합의된 휴전 협정의 일환으로 봉쇄지역에 한정된 수준의 구호물품이 전달되고 있지만, 여전히 이곳 주민들은 아사할 위험에 처해 있으며 제한 없는 인도적 지원이 절실히 필요한 상황이다.
  • 2014년 1월, 시리아군 출신 제보자가 비밀리에 촬영한 고문당하고, 굶주리고 불탄 시신들의 섬뜩한 사진이 공개됐다. ‘카이사르 고문 사진’으로 알려진 이 사진들은 시리아의 수용소 내에서 제도적인 고문과 비사법적 처형이 이루어지고 있다는 또 하나의 강력한 증거로, 바사르 알 아사드(Bashar al-Assad) 대통령 정권이 반대자를 무자비한 수법으로 처벌하고 있음을 전 세계에 알렸다. 아직도 수만 명이 시리아 보안정보당국에 체포된 이후 행방이 묘연한 상태다.
  • 2015년 9월 시리아 정부를 지원하는 러시아의 첫 공습이 시작됐다. 표면상으로는 IS를 노린 공격이었지만 대부분 반군 점령 지역이 폭격을 당했다. 러시아의 참전으로 공습이 더욱 격화되었고, 특히 시리아 북부 지역에서는 전쟁범죄로 추정되는 공격까지 가해지며 민간인 수백 명이 목숨을 잃었다. 최근에는 알레포 인근에서 러시아와 시리아 전투기가 전략적으로 병원을 폭격하며 명백한 국제법 위반행위를 저질렀다.

From hope to horror: Five years of crisis in Syria

A horrifying catalogue of human rights abuses including war crimes and crimes against humanity have overwhelmed Syria over the past five years causing human suffering on a vast scale, said Amnesty International, marking the five-year anniversary of the start of anti-government protests in the country on 15 March 2011.

“The five years since the uprising in Syria first began have been marred by horror and bloodshed on a colossal scale. From the moment that Syrian government forces first opened fire on peaceful protesters, brutality and civilian suffering have been the tragic hallmarks of this crisis,” said Salil Shetty, Secretary General of Amnesty International.

“Government forces and non-state armed groups, including the one calling itself the Islamic State (IS), have displayed a callous indifference to human rights and the laws of war as well as the civilians they have killed, maimed, displaced and, in some areas under siege, starved.

“Government forces have brazenly committed crimes against humanity through the use of appalling strategies such as relentless barrel bomb attacks on civilian areas, a campaign of mass disappearances and systematic, industrial-scale torture. Some armed groups, particularly IS, have exploited the international media spotlight to cynically broadcast their own war crimes, such as the abduction and summary killing of Syrian and foreign civilians.”

Here is a reminder of five key moments that saw the crisis in Syria go from bad to worse over the past five years:

On 18 March 2011, three days after the start of the uprising Syrian government forces opened fire on peaceful protesters in the southern city of Dera’a, using live ammunition against demonstrators demanding the release of boys arrested and tortured for anti-government graffiti. This marked a bloody turning point, and was a precursor to the widespread use of lethal force by government forces to suppress peaceful protests, which eventually evolved into a full-blown armed conflict.

Video footage showing civilians suffering from the effects of a chemical weapons attack in Eastern Ghouta, east of Damascus in August 2013 shocked the world, acting as a wake-up call to the horrific and cruel nature of the abuses being committed in Syria. Sadly, this was just the tip of the iceberg. Across Syria, civilians continued to be killed on a daily basis often in far greater numbers in attacks using both other banned weapons such as cluster munitions and regular bombs, missiles and mortars. However, for years the UN Security Council dragged its feet, with member states failing to unite to refer the situation in Syria to the Prosecutor of the International Criminal Court and Russia and China in particular blocking several resolutions on the protection of civilians using veto powers.

The surreal images of crowds of besieged civilians queuing for aid parcels in Yarmouk on the outskirts of Damascus in January 2014 brought to life the tragic reality that thousands of people trapped under siege across Syria were dying from lack of food and medical care. Beyond Yarmouk starvation has been used as a weapon of war by both government forces and armed groups in areas such as Moadamiya, Eastern Ghouta, Madaya and al-Fouaa. Today more than 400,000 people are under siege in 15 locations across Syria. Despite limited deliveries of aid to besieged areas as part of the ceasefire agreed in recent weeks, civilians are still at risk of starving to death and in desperate need of unfettered humanitarian aid.

Harrowing photographs showing tortured, starved and burnt bodies, known as the “Caesar” torture photos, were smuggled out of Syria by a military defector and published in January 2014. These provided the strongest evidence yet of systematic torture and extrajudicial executions taking place inside government detention centres, opening the world’s eyes to the ruthless tactics used to punish those who dare to oppose the government of President Bashar al-Assad. Tens of thousands remain missing after being arrested by one of Syria’s various security and intelligence forces.

Russia began its first air strikes in support of the Syrian government in September 2015, ostensibly targeting IS but mostly hitting areas under the control of armed opposition groups. Russia’s entry into the fray has led to intensive aerial bombardments, particularly in northern Syria, that have killed hundreds of civilians, including in attacks that appear to be war crimes. Most recently an offensive in the vicinity of Aleppo has seen Russian and Syrian warplanes bomb hospitals as part of its military strategy in flagrant violation of international law.

압바스 파이즈(Abbas Faiz) 국제앰네스티 몰디브 조사관은 “국가 비상사태를 선포한 것이 정부 반대세력에 대한 억압이나 인권침해 심화의 전조가 되어서는 안 된다. 정부는 이번 비상사태를 언론의 자유를 탄압하거나 인권을 침해하는 수단으로 이용하지 말아야 한다”며 “몰디브 정부는 최근 2년 사이 더욱 활발해진 반정부 활동 및 표현의 자유를 짓밟은 걱정스러운 전례가 있다. 비상사태 기간 동안 정부가 국제인권법상의 의무를 존중하는 것이 무엇보다 중요하다”고 말했다.

압둘라 야민 압둘 가윰 대통령이 선포한 한 달간의 비상사태로, 평화적인 집회와 시위를 벌일 권리, 몰디브 국민이 다른 국가를 자유롭게 오갈 권리, 임의로 구금되지 않을 권리 등 헌법이 명시하는 다수의 인권에 대한 효력이 중단된다. 국제법상 임의 구금은 비상사태에도 금지된 행위다. 대통령의 비상사태 선포는 의회의 승인만을 기다리고 있다. 몰디브 의회는 이 건으로 11월 5일 소집된 상태다.

국제앰네스티는 몰디브 정부에 비상사태 선포와 이에 관련된 특정 조치 실시 결정에 대해 신중하고 타당한 근거를 제시할 것을 촉구한다. 정부는 어떤 경우를 막론하고 반드시 국제인권법에 따라 행동해야 한다.

Maldives: State of emergency an alarming development in continuing crackdown on human rights

President Abdulla Yameen’s declaration of a 30 day state of emergency in the Maldives ahead of planned anti-government protests raises the prospect of further attacks on dissent and human rights in the country, said Amnesty International today.

“The declaration of a state of emergency must not be a precursor to a further crackdown on dissent or other human rights violations. The government should not use this state of emergency to silence free speech or infringe on other human rights,” said Abbas Faiz, Amnesty International’s Maldives Researcher.

“The Maldivian authorities have a disturbing track-record of supressing freedom of expression and any form of opposition, which has intensified over the last two years. It is vital that authorities respect their obligations under international human rights law during this period of emergency.”

The one month-long decree by President Abdulla Yameen Abdul Gayoom suspends several constitutional rights, including the right to peaceful protest, freedom of peaceful assembly, the right for Maldivians to travel to and from the country, and the right not be detained arbitrarily. Under international law, arbitrary detention is prohibited even in times of emergency. The decree is awaiting approval by the Maldives Parliament, which has been called to session for this purpose on 5 November.

Amnesty International is calling on the government to provide careful justification for their decision to proclaim the state of emergency and any specific measures it includes. The authorities must ensure that they are acting in accordance with international human rights law at all times.

관타나모 수용소

미국 해군기지 내 테러범 수용소 관타나모 수용소 폐쇄를 위한 현 정부의 노력은 인정하지만, 오바마 대통령이 처음 약속했던 수용소 폐쇄 기한으로부터 6년이 지난 지금도 여전히 수십여 명이 석방되지 못한 채 수감되어 있다는 사실은 국제적으로 상당히 우려되는 점입니다. 미국 정부가 국제적인 공정한 재판절차에 따라 수감자들을 기소할 의도가 없다면 모두 즉시 석방할 것을 재차 촉구합니다.

2016년 2월 23일 미국 정부가 의회에 제출한 폐쇄 계획에서 관타나모 수용소 문제를 인권 사안으로 다루지 않은 점에 대해 유감을 표합니다. 이 폐쇄안은 관타나모 수용소뿐만 아니라 어디서든 고문과 강제실종 등의 국제법상 범죄 및 인권침해행위를 강력히 처벌해야 할 미국의 의무에 대해 전혀 언급하지 않았고, 그 결과 일부 수감자들을 기소나 재판 없이 미국 본토로 이송해 무기한 구금한다는 내용에 그쳤습니다.

국제앰네스티는 관타나모 수용소의 폐쇄가 단순히 인권침해행위를 타지로 옮기는 결과로 이어져서는 안 된다고 끊임없이 주장해 왔습니다. 이번 폐쇄 계획을 비롯해 관타나모 특별 군사위원회를 존치하는 것은 이러한 조건을 충족하지 못할 것입니다. 일반 형사사법제도 내에서 재판이 이루어질 수 있도록 국제적인 공정한 재판 기준을 따르지 않는 군사위원회는 폐지되어야 합니다.

미국의 대 쿠바 경제제재

미국의 경제 제재로 인해 쿠바의 인권은 특히 경제, 사회, 문화적 권리를 중심으로 너무나 오랫동안 침해됐습니다. 국제앰네스티는 미국의 경제제재로 인해 쿠바의 일반 시민들이 의약품 및 기초 생필품을 얻지 못하는 실태를 기록했고, 제재를 해제할 것을 계속해서 촉구했습니다. 쿠바와의 외교 관계를 정상화하려는 미국 정부의 노력을 환영합니다. 또한, 미국 의회에 2015 쿠바 여행자유법, 쿠바 무역법, 쿠바 전자통신진흥법 등 양당 합의 법안의 처리를 촉구합니다.

이주민과 난민

2016년 첫 라틴아메리카 국가 방문을 기해, 오바마 대통령은 쿠바와 아르헨티나의 인권 현황을 고려해야 함은 물론 미국 내 이민자와 망명신청자 수천여 명이 처한 상황을 타개하고, 미국에 입국하려는 이민자 문제에 대해 국제기준에 맞게 임해야 할 것입니다. 2015년 한 해 동안 보호자 없는 어린이 약 4만 명뿐만 아니라 4만 가구가 남부 국경지대에서 체포되었고, 많은 수가 엘살바도르, 온두라스, 과테말라, 멕시코 등지에서 폭력과 불안을 피해 온 사람들이었습니다. 이들은 미국에 체류하기를 고집하며 의료적 지원과 식량, 식수도 제대로 제공되지 않고 변호사 접견도 할 수 없는 시설에서 수개월 동안 수감됐습니다. 미국 정부는 엘살바도르, 과테말라, 온두라스 출신 이주민을 대상으로 현행 난민 재정착 프로그램을 더욱 확대할 것이라고 발표했고, 이는 분명 올바른 방향으로 진전한 것입니다. 그러나 난민 재정착을 위해 국제적으로 취해야 할 조치는 여전히 많이 남아 있습니다. 미주 지역의 인권 상황을 논의한다면 이 문제를 반드시 다뤄야 합니다.

쿠바

국제적 조사

유엔 특별조사관, 미주인권위원회 등 독립적인 인권단체와 인권기구는 수십 년 동안 쿠바에 입국하는 것이 불가능했습니다. 쿠바는 국제앰네스티가 정부로부터 입국 허가를 받지 못한 유일한 미주 지역 국가입니다.

쿠바 내 다양한 인권 사안에 대해 투명성을 높이고 독립적, 객관적인 감시와 기록이 이루어지기 위해서는 독립적인 인권단체의 입국을 허용해야 합니다. 쿠바와 국제사회 간 새롭게 대화가 진행되고 있는 것은 환영할 일이지만, 쿠바 국민의 인권을 더욱 보호하고 증진하기 위해서는 이러한 대화에 국제적 인권 단체 역시 포함되어야 합니다. 인권제도와의 협력을 통해 쿠바는 책임성과 투명성을 환영하고, 다른 미주 국가와 동일한 수준으로 철저한 조사를 받겠다는 의지를 세계에 전달할 수 있을 것입니다.

자의적 체포와 표현, 결사, 집회의 자유 탄압

최근 수년간 쿠바에서는 평화적인 시위대와 정치적 반대세력, 인권옹호자들에 대해 지속적인 탄압과 단기 자의적 체포가 이루어진 것으로 기록됐습니다. 세계 인권의 날인 2015년 12월 10일에는 정부 요원들이 평화적 활동 참여를 막기 위해 반대세력과 기자들을 가택 연금했다는 보고가 있었습니다. 국제앰네스티는 쿠바 형법에서 공무원 모욕, 공무집행 방해, 공공장소 난동 등을 명시한 조항이 표현과 집회, 결사의 자유를 탄압하는 데 이용되고 있음을 매우 우려하고 있습니다. 쿠바는 정부와 사법부가 표현의 자유를 제한하기 위해 이용하는 형법 조항들을 국제기준에 맞게 개정해야 합니다.

아르헨티나

정의회복과 불처벌 종식

1976년 아르헨티나 군사 쿠데타가 일어난 지 40년이 지나는 동안 당시 벌어졌던 심각한 인권침해를 조사하고 재판에 부치는 등 상당한 진전을 이룩했습니다.

그러나 모든 사건에 대해 증인들의 법무를 대리할 효율적인 단체가 필요한 것 등 아직 풀어야 할 과제는 남아있습니다. 독재정권의 민간인 참여 문제, 성범죄 재판 회부 문제 등 새로운 과제도 등장했습니다. 아르헨티나는 군사독재 당시의 인권침해 가해자들을 불필요한 지연 없이 재판에 회부하고, 증인의 안전과 신체적 완전성(physical integrity)을 보호하기 위해 계속해서 노력해야 합니다.

선주민 권리

아르헨티나 헌법과 국제인권법에서는 이미 선주민들의 권리를 인정하고 있지만, 수십 년 동안 아르헨티나의 선주민들은 2등 시민 대우를 받으며 인권을 무시당한 채 폭력과 박해, 차별의 대상이었습니다. 최근 들어 선주민들의 주장과 요구가 아르헨티나에서 정치적, 사회적으로 주목을 받기 시작했습니다.

지난 10년 동안 정부와 사기업, 특히 농업, 채굴 산업에 종사하는 기업들은 아르헨티나 선주민들이 대대로 살아온 거주지에 대한 토지권을 행사하지 못하도록 거대한 장벽을 세웠습니다. 유엔 선주민 특별조사관을 비롯한 국제기구는 개발계획과 천연자원 착취로 영향을 받을 지역사회와 충분히 소통하지 않은 점을 지적하기도 했습니다.

아르헨티나는 선주민과 함께 공동재산의 법적 인정에 관한 특별법 마련을 논의, 협의하고, 국제기준을 적용, 이행함으로써 선주민의 권리를 증진해야 합니다.

표현의 자유와 평화적 집회의 자유

최근 수년간 아르헨티나 정부와 보안군이 사회적 저항에 대처하는 방법은 진보와 역행을 거듭했습니다. 2016년 2월 아르헨티나 안보부는 시위를 진압하고 시위대를 징계할 것을 보안군에 지시하는 “대중 시위 시 보안군 행동지침”을 발표했습니다. 국제앰네스티는 이 행동지침이 표현의 자유와 평화적으로 시위할 권리를 심각하게 제한하는 한편, 시위를 범죄화하는 데 사법제도를 부당하게 사용하는 점이 드러났다고 보고 있습니다.

마지막으로 미국과 쿠바, 아르헨티나 3국 회담에서 생산적이고 인권중심적인 논의가 이루어지길 바랍니다. 국제앰네스티는 3국이 당면한 주요 인권과제에 대해 언제든지 더 많은 정보와 특별 권고사항을 제공할 것입니다.

OPEN LETTER FROM AMNESTY INTERNATIONAL TO USA PRESIDENT BARACK OBAMA, CUBAN PRESIDENT RAUL CASTRO, AND ARGENTINE PRESIDENT MAURICIO MACRI.

On the occasion of President Barack Obama´s upcoming historic visit to Cuba, followed by a two-day visit to Argentina,
Amnesty International would like to take this opportunity to highlight to the three Presidents a number of major human
rights concerns which we hope will be prioritized as part of your discussions.

UNITED STATES OF AMERICA

Detentions at Guantánamo Bay

While we recognize the current administration’s commitment to end the detentions in the US naval base at Guantánamo
Bay, the fact that dozens of detainees remain there more than six years after President Obama’s original deadline for
closure of the detention facility is a cause for huge international concern. We reiterate that any Guantánamo detainee
the USA does not intend to charge for prosecution in proceedings that fully comply with international fair trial standards
should be immediately released.

We regret that the government’s plan for closure submitted to the US Congress on 23 February 2016 fails to address
resolution of the detentions as a human rights issue. The plan for closure makes no reference to the USA´s obligation
to ensure accountability for human rights violations, including crimes under international law of torture and enforced
disappearance that have occurred at the base and elsewhere. The result is a proposal to relocate some individuals for
indefinite detention without charge or trial to the US mainland. We have consistently argued that closure of the
Guantánamo detention facility must not result in the transfer of human rights violations elsewhere. This proposal would
fail this test, as would the retention of military commissions for selected prosecutions. The commissions do not meet
international fair trials standards and should be abandoned in favour of trials in the ordinary criminal justice system.

The US economic embargo on Cuba

For too long, the US economic embargo has undermined human rights in Cuba, particularly economic, social and cultural
rights. Amnesty International has consistently called for lifting of the embargo and documented how it denies ordinary
Cubans access to medication and other basic commodities. We welcome the government’s efforts to re-establish
diplomatic relations with Cuba. We call on the US Congress to pass the following bipartisan bills: The Freedom to Travel
to Cuba Act of 2015, The Cuba Trade Act of 2015, and The Cuba Digital and Telecommunications Advancement Act.

Migrants and refugees

On this first visit to Latin America in 2016, we urge President Obama to not only consider the human rights situations
in Cuba and Argentina but also to address the situation faced by thousands of migrants and asylum seekers in the USA
and ensure his government fully complies with international standards regarding those seeking to enter the country.

Nearly 40,000 unaccompanied children and an additional 40,000 families were apprehended crossing the southern
border in 2015, many fleeing violence and insecurity in El Salvador, Honduras, Guatemala, and Mexico. Families and
unaccompanied children were detained for months while pursuing claims to remain in the country, many held in
facilities that did not provide proper access to medical care, food and water, and access to legal counsel. The US
government announced expansion of the current refugee resettlement program for migrants fleeing from El Salvador,
Guatemala, and Honduras, and this is a step in the right direction, but it still is a far cry from the measures that need
to be taken internationally towards resettling those displaced. This is an issue that cannot be left aside in any discussion
pertaining the human rights situation of the Americas.

CUBA

International scrutiny

Independent human rights organizations and mechanisms, including Special Rapporteurs of the UN and the InterAmerican
Commission on Human Rights, have not had access to Cuba for decades. Cuba is the only country in the
Americas which Amnesty International does not have permission from authorities to access.

In the interest of transparency and to facilitate independent and objective monitoring and reporting on a range of human
rights issues in Cuba, independent human rights organizations should be able to enter the country. While we welcome
the new dialogue between Cuba and the international community, we urge that this dialogue includes international
human rights actors, as a way to advance the protection and promotion of the human rights of the Cuban people.

Working with human rights systems, Cuba could also send a message to the world that it welcomes accountability and
transparency, and that it is willing to be held to the same degree of scrutiny as its peers across the Americas.

Arbitrary arrests and restrictions on freedom of expression, association and assembly

In recent years there have been constant reports of harassment and short-term arbitrary arrests of peaceful protestors,
political dissidents, and human rights defenders in Cuba. On 10 December 2015, International Human Rights Day,
Amnesty International received reports of dissidents and journalists placed under house arrest by state agents in order
to prevent their participation in peaceful activities. Amnesty International is seriously concerned that provisions of the
Cuban Criminal Code, such as contempt of a public official (“desacato”), resistance to public officials carrying out their
duties (“resistencia”) and public disorder (“desórdenes públicos”) are used to stifle free speech, assembly and
association. In line with international standards, Cuba must amend provisions of the Criminal Code that lend
themselves to abuse by state officials and the judiciary to restrict freedom of expression.

ARGENTINA

Access to Justice and the end to Impunity

Forty years have passed since the 1976 coup in Argentina and substantial progress has been made in investigating and
bringing the serious human rights violations that took place during that period to trial.

Challenges still remain, however, such as the need for efficient organization of all cases, including the legal and
paralegal work with witnesses. New challenges have also emerged such as the civilian participation in the dictatorship
and bringing sexual crimes to justice. Argentina must continue its efforts to bring those responsible for the human
rights violations committed during the military dictatorship to trial without unnecessary delay, and to protect the
security and physical integrity of the witnesses in these cases.

Rights of Indigenous Peoples

Argentina’s Constitution and the international human rights law already recognize the right of Indigenous peoples.
However, for decades, Indigenous peoples in Argentina have been treated like second class citizens, subjected to
violence, intimidation and discrimination with their human rights ignored. In recent years, their claims and demands
have started to gain traction on the political and social agenda in Argentina.

Over the last decade state and private interests, especially those of the agribusiness and extractive industries, have
built up enormous barriers between Argentina’s Indigenous people and their rights to their traditional lands.

International bodies, including the UN Special Rapporteur on Indigenous Peoples, have criticised the lack of consultation
with the communities that may be affected by development projects and exploitation of natural resources.

Argentina must make progress with regard to the legal recognition of communal property by discussing and consulting
a special law with the Indigenous Peoples, and must advance their rights through the practice and implementation of
standards.

Freedom of expression and right to peaceful assembly

The way in which the political authorities and security forces tackle social protest in Argentina has experienced both
progress and setbacks in recent years. In February 2016, the Ministry of Security published its “Protocol for Action of
the State’s Security Forces in Public Demonstrations” instructing the security forces to put a stop to social protests and
take criminal action against those participating. In our opinion, this places serious limitations on freedom of expression
and the right of all people to demonstrate peacefully, whilst also representing an improper use of the justice system to
criminalize protestors.

In closing, we wish you productive and human rights-focused discussions as part of your upcoming meetings. Amnesty
International stands ready to furnish the three governments with further information about some of the most pressing
human rights challenges facing the countries and our specific recommendations for addressing these.
