인도네시아: 아체 분쟁 피해자들의 ‘잃어버린 10년’

인도네시아 정부는 아체 분쟁 당시의 수만여 명에 이르는 피해자들과 가족들에게 소중한 사람들의 생사도 알 수 없는 상태로 정당한 대우와 진실규명, 충분한 보상 없이 방치하고 있다고 국제앰네스티가 아체 분쟁 종식 10주년을 맞아 밝혔다.

2015년 8월 15일은 아체 분쟁의 종식을 알린 평화협정이 체결된 지 10년째를 맞이하는 날이다. 그러나 역대 정부가 약속한 것에도 불구하고 과거사 문제에 거의 관심을 보이지 않는 동안, 당시의 피해자들은 여전히 스스로 살아갈 수밖에 없도록 방치되고 있다.

조세프 베네딕트(Josef Benedict) 국제앰네스티 동남아시아 캠페인국장은 “아체 분쟁의 수많은 피해자들에게 지난 세월은 잃어버린 10년과 같았다. 무력 분쟁은 끝이 났지만 인도네시아 정부는 수만여 명에 이르는 피해자와 그 가족들에게 진실과 정의, 충분한 보상을 제공해야 할 의무를 거의 전혀 이행하지 않고 있다”며 “분쟁 종식 10년을 맞아 이러한 문제를 해결하기 위한 진심 어린 노력을 기울여야 한다. 인도네시아 정부는 언제까지나 못 본 체하며 책임을 회피할 수 없다. 아체 분쟁으로 인한 고통을 더욱 연장시키기만 할 뿐”이라고 말했다.

인도네시아 정부군과 아체 주의 분리독립을 지지하는 자유아체운동(GAM) 간에 수십 년 동안 계속된 무력분쟁으로 민간인을 포함해 10,000명에서 30,000명이 목숨을 잃었다.

그러다 2005년 유럽연합(EU)과 동남아시아국가연합(ASEAN)의 감독하에 평화협정이 체결되었고, 분쟁 중 자행된 범죄에 대해서도 해결할 것을 약속했다. 그러나 국제앰네스티는 13일 7개 시민단체와 공동으로 발표한 공개서한을 통해, 아체 주민들은 지금도 정부가 이러한 약속을 이행하기만을 기다리고 있다고 지적했다.

진실을 인정하는 것

정부와 인도네시아 국가인권위원회(Komnas HAM)의 주도로 당시 인권침해행위에 대한 주요 조사가 일부 이루어지기는 했지만, 단편적인 수준에 불과했을 뿐 실종자들의 생사와 행방을 비롯해 사건 경위에 대한 포괄적인 기록을 작성하지는 못했다. 국가적 수준에서 진상규명위원회를 마련하고자 하는 시도는 정치적 의지 부족으로 교착 상태에 빠졌다.

2013년 12월, 아체 주 의회는 지역 수준의 진상규명 및 조정위원회를 설립한다는 내용의 조례를 채택하며 긍정적인 행보를 보였지만, 그로부터 1년 6개월이 지난 지금까지 아무런 진전도 이루어지지 않았다.

피해자와 가족들에 대한 정당한 대우

인도네시아 정부군과 지원부대가 민간인을 노려 공격한 경우 중 많은 수가 반인도적 범죄에 해당할 수 있다는 점과, 분쟁 양측이 저지른 인권침해행위가 전쟁범죄에 해당한다는 점에 대해 이미 강력한 증거가 존재하지만 극히 일부 범죄만이 조사되었을 뿐 독립적인 민간 법원에서 재판을 받은 사람은 아무도 없었다.

국제법상 범죄를 인정하지 않는 인도네시아 형법과 같이 결함 있는 사법제도로 인해 재판을 받을 수 있는 피해자는 거의 없었다. 지난 2000년 설립된 인권재판소는 제한적인 권한만을 지녀, 이곳에서 아체 분쟁 당시의 범죄로 기소된 사람은 아무도 없었을뿐더러 이곳에서 기소된 피고인들은 모두 무죄로 풀려나거나 유죄가 선고되더라도 결국 항소심에서 판결이 번복되었다.

충분하고 실질적인 보상

일부 피해자들에게는 보상을 지급하려는 노력이 있었지만, 결국 진전되지 못한 채 필요한 만큼 충분한 포괄적 보상 프로그램을 마련하는 데는 실패하고 말았다. 정부가 지원하는 보상 및 재건 프로그램인 아체재건기구(Ache Reintegration Agency)는 인권침해 피해자들을 대상으로 한 것이 아니었으며, 분쟁 중 성폭력 피해를 당한 수많은 여성들에게는 아무런 도움도 되지 않았다.

국제앰네스티는 2013년 발표한 보고서 <과거를 마주할 때>를 통해 현재 아체 주민들이 처해 있는 참담한 상황을 집중 조명했다.

아체 피해자 대표는 국제앰네스티에 “정부가 왜 아직도 우리가 인권침해 피해자라는 사실을 인정하지 않는지 알고 싶다”며 “우리가 싸우는 것은 정부에 반대해서가 아니라, 우리가 겪은 일을 정부가 기억하게 하기 위해서이다. 그들은 잊을 권리가 없다”고 전했다.

권고사항

조세프 베네딕트 국장은 “이제는 아체에서 벌어진 일을 직시하는 데 더 이상 시간을 허비할 수 없다. 정부는 분쟁 당시 심각한 인권침해가 자행되었음을 인정해야 하며, 정의 구현과 진실 규명, 보상을 위한 첫걸음으로 즉시 국제기준에 따라 진상규명위원회를 설립해야 할 것”이라며 “지금까지도 ‘사라진’ 소중한 사람들에게 무슨 일이 벌어졌는지도 모르는 채 살아가기 위해 몸부림치는 가족들이 있는 한편, 정작 책임자들은 활보하고 다니고 있다. 이러한 상황은 분노를 낳고, 이것이 미래에 다시 폭력으로 돌아올 수 있다”고 말했다.

국제앰네스티는 또한 EU와 ASEAN 국가에 평화협정 내용을 충실히 이행하도록 감독하지 못한 책임을 다할 것을 촉구한다.

A ‘lost decade’ for victims of Indonesia’s Aceh conflict

Indonesia is still failing tens of thousands affected by the devastating Aceh conflict, leaving family members and victims in the dark about the fate of loved ones and without justice, truth and full reparation Amnesty International said ahead of the 10-year anniversary of the conflict’s end.

Saturday 15 August 2015 marks a decade since the peace agreement that signalled the end of the Aceh conflict. But despite promises by successive Indonesian governments, victims are still left to fend for themselves while authorities show little interest in addressing past crimes.

“This has been a lost decade for far too many people affected by the Aceh conflict. Even if the violence has ended, Indonesian authorities have almost completely failed in their duty to provide truth, justice and full reparation to tens of thousands of victims and their family members,” said Josef Benedict, Amnesty International’s Campaigns Director for South East Asia.

“The 10-year anniversary of the conflict’s end must become the start of a genuine effort to address these issues. Indonesian authorities cannot continue to bury their heads in the sand and shirk responsibility – it is only prolonging the suffering in Aceh.”

Between 10,000 and 30,000 people, including many civilians, were killed during the decades-long Aceh conflict between Indonesian government forces and the pro-independence Free Aceh Movement (Gerakan Aceh Merdeka, GAM).

The peace agreement in 2005, monitored by the EU and Association of South East Asian Nations (ASEAN), included commitments to address crimes committed during the conflict. But in an open letter with seven other organizations today, Amnesty International outlines how the people of Aceh are still waiting for the government to make good on these promises.

Acknowledging the truth

Although there have been some important initiatives by the authorities and the National Human Rights Commission (Komnas HAM) to investigate human rights abuses committed, these have been piecemeal at best and failed to establish a comprehensive record of what happened, including the fate and whereabouts of those disappeared. Attempts to establish a truth commission on the national level have stalled due a lack of political will.

In December 2013, the Acehnese local parliament took the positive step of passing a bylaw to establish a local Truth and Reconciliation Commission – but a year and a half later, no progress has been made in implementing it.

Justice for victims and their families

There is overwhelming evidence that many of the violations directed against civilians by Indonesian security forces and their auxiliaries may amount to crimes against humanity and that human rights violations and abuses committed by both sides of the conflict amount to war crimes. Despite this, only a handful of the crimes have been investigated and no one has been prosecuted before independent civilian courts.

A flawed legal framework means few victims have access to the courts, while Indonesia’s Criminal Code does not recognize crimes under international law. The Human Rights Courts that have existed since 2000 have a limited mandate, and all prosecutions before them – none of them for crimes committed in Aceh – have resulted in either acquittals or convictions that were overturned on appeal.

Full and effective reparation

There have been efforts to compensate some victims, but these have not gone far enough and fall short of the comprehensive reparations programme that is needed. The Aceh Reintegration Agency, a government-sponsored compensation and reintegration programme, was not designed to address the harm suffered by victims of human rights abuses, and did nothing to help the many women targeted by sexual violence during the conflict.

In a 2013 report, Time to face the past, Amnesty International highlighted the devastating consequences the current situation has for communities in Aceh.

“[We] want to know why until now the government has not acknowledged that we suffered human rights abuses,” an Aceh victims’ representative told Amnesty International. “We are still fighting, not against the government, but for the government to remember what happened to us. They do not have the right to forget.”

Recommendations

“There is no time to lose in facing up to what happened in Aceh. Authorities must acknowledge that serious human rights violations and abuses were committed during the conflict, and as a first step towards justice, truth and reparation establish immediately a truth commission in line with international standards,” said Josef Benedict.

“Today, family members still do not know what has happened to ‘disappeared’ loved ones and are struggling to get by, while those responsible walk free. The situation is breeding resentment that could sow the seeds of a future return to violence.”

Amnesty International also calls on EU and ASEAN states to take responsibility for their failures to ensure full implementation of the peace agreement.

학교를 대상으로 사우디아라비아 주도 연합군이 여러 차례 공습을 가하면서 국제인도법을 위반하고, 예멘 어린이 수천 명의 교육받을 기회를 가로막고 있다고 국제앰네스티가 11일 새롭게 발표한 브리핑을 통해 밝혔다. 사우디 주도 연합군은 미국과 영국 등의 국가로부터 무기 공급을 받고 있다.

브리핑 <‘폭격 당한 아이들’: 공격받는 예멘 학교>는 예멘 현지 조사를 바탕으로, 2015년 8월과 10월 사이 학교를 대상으로 5차례의 공습이 벌어져 민간인 5명이 숨지고 어린이를 포함해 14명이 다친 사건에 대해 다루고 있다. 공습 당시 학교에 학생들은 없었지만, 폭격으로 인해 학교 건물이 심각한 피해를 입거나 파괴되면서 학생들에게 장기적인 영향을 미치게 되었다.

하드란 마을의 케이르 학교 역시 여러 차례 공습을 당하면서 재건이 불가능할 정도로 큰 피해를 입었다. 이 마을은 학교 외에도 민간 주택 2채가 폭격을 당해 어린이 2명이 숨지고 그 어머니가 부상을 입었으며, 근처 이슬람 사원 역시 폭격으로 기도를 하고 있던 남성 1명이 숨지고 1명이 다치기도 했다.

국제앰네스티는 이번 브리핑에서 다룬 5건의 공습에 대해 독립적이고 공정하게 조사할 것과 책임자를 처벌할 것을 촉구했다. 또한 불법 공습으로 인한 피해자와 그 가족들에게 충분한 보상을 제공할 것을 연합군에 요청했다.

파키흐 상임고문은 “불법 공습으로 의심되는 사례가 계속해서 증가하고 있음에도 사우디아라비아 주도 연합군과 그 지원국들이 이를 조사하지 않는 것은 이번 전쟁이 예멘 민간인들에게 초래한 참담한 결과를 냉담히 무시하고 있음을 시사한다”며 “다음 주 예정된 평화회담의 결과와는 상관없이, 이러한 불법 공습에 대한 독립적인 조사에 착수하고 책임자를 처벌하는 것이 무엇보다 중요하다”고 말했다.

이번 분쟁으로 예멘의 교육제도 전반이 피해를 입고 있다. 유엔아동기금(UNICEF)에 따르면 예멘 어린이의 최소 34%가 2015년 3월 첫 공습이 시작된 이후 학교에 가지 못했다. 사나아에 위치한 예멘 교육부가 국제앰네스티에 제공한 자료에 따르면 학교 254곳은 완전 파괴, 608곳은 부분적으로 피해를 입었으며 421곳은 분쟁으로 국내실향민이 된 사람들을 수용한 탓에 현재 운영되지 못하는 학교는 1,000곳이 넘는다.

학교에 대한 공습은 사상자를 발생시킬 뿐만 아니라 주민들을 공포로 몰아넣고, 학생들이 심리적 트라우마를 겪는 원인이 되고 있다.

“지금 우리는 두려움과 공포 속에서 살고 있어요. 오늘도 비행기를 봤는데 너무 무섭고 겁이 났어요.” 지난 8월 연합군의 폭격으로 파괴된 호데이야 시 만수리야 마을의 알아스마 학교에 다니던 12세 어린이의 말이다.

호데이야 시에 위치한 또 다른 학교인 알샤이메 여학교는 학생 3,200명을 수용하던 곳으로, 이 학교의 교장은 2015년 8월 며칠 사이에 연달아 2번 폭격을 당하면서 2명이 숨졌던 당시의 공포를 이렇게 전했다. 공습 당시 학생들은 학교에 없었지만 이로 인해 남성과 여성 각각 1명이 숨졌다.

“인간성의 종말이라고 생각했어요. 배움의 전당인 학교가 이런 식으로 사전 경고도 없이 폭격을 당하다니… 인간성이란 건 어디 있나요? … 이런 장소를 폭격하는 건 어떤 전쟁이라도 불법이에요.”

공습에 앞서 소셜미디어를 비롯한 온라인상에서 학교가 무기 저장고로 사용되고 있다는 내용의 루머가 퍼졌으나, 교장은 이러한 루머가 사실이 아니며, 이에 따라 학교 전체를 수색했지만 무기는 전혀 발견되지 않았다고 국제앰네스티에 밝혔다.

예멘에서 여러 분쟁 당사자들이 학교를 군사적 목적으로 이용하는 경우는 상당수 있었지만, 이번 브리핑에서 다룬 5건의 사례에서는 무기의 흔적이나 2차 폭발의 증거, 이외에 군사적 목적으로 사용되었음을 암시하는 증거를 전혀 찾을 수 없었다.

정부군과 비정부 무장단체 모두 군사적 목적 또는 인근의 군사 작전을 위해 학교를 이용하는 것을 자제하고, 이 때문에 학교가 정당한 군사적 목표 또는 공격 대상이 됨으로써 민간인을 위험에 빠뜨리고 어린이 교육에 장기적으로 부정적인 영향을 미치지 않도록 해야 한다.

올해 초 채택된 무력분쟁 시 어린이에 관한 유엔 안전보장이사회 결의안 2225호는 분쟁의 모든 당사자에 대해 “학교의 민간적 특성을 존중”할 것을 촉구하고, 또한 학교를 군사적으로 이용할 경우 학교가 국제법상 정당한 공격 대상이 됨으로써 어린이의 안전을 위협할 수 있다는 점에 대해 심각한 우려를 표하고 있다.

국제앰네스티의 이번 브리핑 역시 미국, 영국 등 사우디아라비아 주도 연합군에 무기를 공급하는 모든 국가에 대해, 전쟁범죄 등 국제법 위반행위를 저지르는 데 이용될 무기의 이전을 모두 시급히 중단해야 한다고 강조하고 있다. 특히, 연합군에 무기를 공급하는 국가들은 범용 폭탄과 전투기, 전투헬리콥터 및 관련 부품과 구성요소의 이전을 중단해야 한다.

지난달 미국 국방부는 사우디아라비아에 MK89 시리즈의 범용 폭탄을 포함해 총 12억 9,000만달러 규모의 무기 이전을 승인했다. 해당 무기가 불법 공습에 이용되어 민간인 사망자 수백 명을 발생시켰다는 국제앰네스티의 발표에도 불구한 일이었다.

파키흐 상임고문은 “사우디아라비아 주도 연합군 소속 국가들이 전쟁법과 국제인도법을 위반하고 있다는 명백한 증거가 있음에도 미국을 비롯한 동맹국들이 이들에 대한 무기이전을 허가하고 있다는 것은 그야말로 충격적인 일이다. 이러한 무기 이전은 모두 즉시 중단되어야 한다”고 말했다.

영국과 같은 무기거래조약의 당사국들은 이전된 무기가 민간인, 민간 표적을 공격하거나 국제인도법을 위반하는 데 쓰인다는 것을 알고 있을 경우 이러한 무기의 이전을 허가하는 것이 금지되어 있다.

Bombing of schools by Saudi Arabia-led coalition a flagrant attack on future of Yemen’s children

Saudi Arabia-led coalition forces have carried out a series of air strikes targeting schools that were still in use, in violation of international humanitarian law, and hampering access to education for thousands of Yemen’s children, said Amnesty International in a new briefing published today. The coalition forces are armed by states including the USA and UK.

The briefing ‘Our kids are bombed’: Schools under attack in Yemen, investigates five air strikes on schools which took place between August and October 2015 killing five civilians and injuring at least 14, including four children, based on field research in Yemen. While students were not present inside the schools during the attacks, the strikes caused serious damage or destruction which will have long-term consequences for students.

“The Saudi Arabia-led coalition launched a series of unlawful air strikes on schools being used for educational – not for military – purposes, a flagrant violation of the laws of war,” said Lama Fakih, Senior Crisis Advisor at Amnesty International who recently returned from Yemen.

“Schools are central to civilian life, they are meant to offer a safe space for children. Yemen’s young school pupils are being forced to pay the price for these attacks. On top of enduring a bitter conflict, they face longer term upheaval and disruption to their education – a potentially lifelong burden that they will be forced to shoulder.”

In some cases the schools were struck more than once, suggesting the strikes were deliberately targeted.

“Deliberately attacking schools that are not military objectives and directly attacking civilians not participating in hostilities are war crimes,” said Lama Fakih.

The damage has severely disrupted the schooling of the more than 6,500 children who attend classes at the schools in Hajjah, Hodeidah and Sana’a governorates. In certain cases the schools had been the only ones in the area. No evidence could be found in any of the five cases to suggest the schools had been used for military purposes.

In October 2015 the Science and Faith School in Beni Hushayash, Sana’a was attacked on four separate occasions within the space of a few weeks. The third strike killed three civilians and wounded more than 10 people. The school, which was the only one in the village, was providing education to 1,200 students.

The Kheir School in the village of Hadhran, Beni Hushaysh, also suffered multiple air strikes causing extensive damage rendering it unusable. Other air strikes on the same village struck two civilian homes, killing two children and injuring their mother, and a nearby mosque, killing one man and injuring another, who were praying at the time of the attack.

Amnesty International is calling for the five attacks highlighted in this briefing to be investigated independently and impartially and for those responsible to be held accountable. It is also asking the coalition to provide full reparation to victims of unlawful attacks and their families.

“The lack of investigations by the Saudi Arabia-led coalition, and those who provide them with arms and other support, into a growing list of suspected unlawful attacks suggests a chilling apathy for the devastating consequences this war has wrought on civilians in Yemen,” said Lama Fakih.

“Regardless of the outcome of planned peace talks next week it is crucial that independent investigations into these and other unlawful strikes are undertaken and that those responsible are held to account.”

The country’s entire education system has suffered as a result of the conflict. According to UNICEF (United Nations International Children’s Emergency Fund) at least 34% of children in Yemen have not been to school since the air strikes first began in March 2015. The Sana’a based Ministry of Education has also shared data with Amnesty International reflecting that more than 1,000 schools are out of operation: 254 completely destroyed, 608 partially damaged and 421 being used as shelters for people internally displaced by the conflict.

As well as killing and injuring people, the attacks on schools have terrified civilians and caused students to suffer psychological trauma.

“Right now we are living in fear and terror. Today I saw the plane and I was very afraid and terrified,” said one 12-year-old child who attends al-Asma school in Mansouriya, Hodeidah which was destroyed in a coalition bombing in August.

The director of another school in Hodeidah city, the al-Shaymeh Education Complex for Girls, which catered for some 3,200 students described her horror after the school came under attack twice within a matter of days in August 2015 killing two people. No students were present at the school during the attack, but a man and woman were killed.

“I felt that humanity has ended. I mean, a place of learning, to be hit in this way, without warning… where is humanity? …It is supposed to be illegal in any war to strike such places,” she said.

Prior to the attack, rumours had circulated online, including in social media, suggesting the school had been used to store weapons, but the director told Amnesty International this was untrue and that the school had been searched following the rumours- no weapons were found.

Although there have been occasions where schools in Yemen have been used for military purposes by the various parties to the conflict, in all five of the cases highlighted in this briefing no weapon remnants, evidence of secondary explosions or any other evidence was found by Amnesty International to indicate that the schools had been used for military purposes.

Both state and non-state armed groups should refrain from using schools for military purposes or operating nearby, which can have the effect of making them schools lawful military targets and subject to attack, consequently putting civilians at risk and having long-term adverse impact on children’s access to education.

UN Security Council Resolution 2225 on children in armed conflict adopted earlier this year calls on all parties to conflict to “respect the civilian character of schools” and also expresses serious concern that the military use of schools may render them legitimate targets of attack under international law and would endanger the safety of children.

Amnesty International’s briefing also highlights the urgent need for all states who supply arms to the Saudi Arabia-led coalition, including the USA and UK, to suspend all transfers of weapons which are being used to commit violations of international law, including war crimes, to those carrying out attacks. In particular, states supplying arms to coalition forces should suspend transfers of general purpose bombs, fighter jets, combat helicopters and their associated parts and components.

Last month the US State Department approved an arms transfer worth $1.29 billion to Saudi Arabia, which includes the transfer of general purpose bombs from the Mark/ MK89 series, despite the fact that Amnesty International has documented their use in unlawful air strikes that have killed scores of civilians.

“It is simply appalling that the USA and other allies of the Saudi Arabia-led coalition have continued to authorise arms transfers to members of the coalition, despite the clear evidence that they are not complying with the laws of war – international humanitarian law. All such transfers must halt immediately,” said Lama Fakih.

“States supplying weapons to the coalition must also use their influence to press coalition members to act in compliance with their international obligations and to investigate violations of international humanitarian law.”

Countries such as the UK, that are party to the Arms Trade Treaty, are prohibited from authorizing an arms transfer if they have knowledge that the arms would be used to commit attacks against civilians, civilian objects or other violations of international humanitarian law.

5년 전, 리비아에서 시작된 평화적인 시위는 순식간에 무장분쟁으로 번져 서방의 군사개입까지 이루어지게 되었고, 결국 2011년 10월 무아마르 카다피 대령이 사망하면서 끝나게 되었다.

이후 과도정부가 수립되었지만 반카다피 세력 출신 무장단체들이 아무런 처벌 없이 심각한 범죄를 저지르는 것을 막을 수는 없었다. 리비아는 2014년 5월부터 민병대와 무장단체 간의 충돌로 또다시 새로운 무력 분쟁에 휩싸였고, 2개 정부로 분열되는 등 여전히 깊은 갈등에 시달리고 있다.

리비아의 인권은 다음과 같은 일곱 가지 방식으로 공격받고 있다.

1. 분쟁 양측 모두 민간인과 민간 시설에 무차별적이고 직접적인 공격을 가하는 등 전쟁범죄와 중대한 인권침해행위를 저질렀다. 정치적 또는 인종적 소속, 출신, 의견 때문에 납치되고 고문을 당한 사람은 수백여 명에 이른다.

2. 무장단체의 활동이 통제불능 수준에 이르렀다. 자칭 ‘이슬람국가’(IS)는 특정 지역을 점령한 후 극단적으로 해석한 이슬람 율법을 적용해 주민들을 공포에 빠뜨리고 있다. 여성들에게 엄격한 이슬람식 복장을 강요하거나, 공개처형 방식으로 살인을 저지르고 피해자의 시신을 공개된 장소에 방치하는 경우도 있었다. 또한 채찍질형이나 절단형을 공개적으로 집행하고, 이러한 범죄행위를 소셜 미디어상에 홍보하기도 했다.

3. 난민과 이주민들은 심각한 인권침해에 노출되어야 했다. 리비아 안팎의 밀입국 경로를 따라 수많은 사람들이 고문, 착취, 성폭행을 당하거나 무기한 구금을 당했다. 항해에 적합하지 않은 배를 이용해 리비아에서 지중해를 건너 유럽으로 가려던 사람도 수천 명에 이르렀다. 2015년 한 해 동안 2,880명 이상이 북아프리카 지역에서 이탈리아로 향하려다 바다에서 목숨을 잃었다


4. 리비아 전역에서 벌어지는 분쟁과 폭력으로 가장 큰 타격을 받는 것은 민간인들이다. 약 250만 명이 깨끗한 식수, 위생시설, 식량 등의 인도적 도움이 필요한 상황이며, 43만 명 이상이 강제이주를 당했다. 전투로 인해 수많은 병원과 의원이 문을 닫고, 파괴되거나 이용할 수 없는 상태가 되었다. 리비아 어린이 중 약 20%가 학교에 다니지 못하고 있다. 유엔은 의료지원과 교육, 난민과 이주민 보호 등 리비아 국민 130만 명에게 기본적인 서비스를 제공하기 위한 인도적 지원을 요청했지만 지원된 액수는 필요 총액의 불과 1%에 그쳤다.
5. 자유로운 발언이 공격당하고 있다. 언론인과 인권활동가, NGO 활동가들은 여러 무장단체로부터 위협을 받거나 납치, 살해당하기까지 한다. TV 방송국들은 로켓 추진식 수류탄으로 공격을 받아 파괴되고 불탔다. 국경없는기자회는 2015년 1월부터 11월 사이 언론인을 대상으로 한 공격이 30회 이상 벌어졌다고 기록했다.

6. 여성들의 인권이 후퇴하고 있다. 여성 활동가들은 위협과 협박을 당했고, 남성 동반인 없이 이동하는 여성들은 무장단체에 상습적으로 희롱을 당했다. 조혼이 더욱 쉬워지고, 남성은 법원의 승인 없이 아내와 이혼할 수 있게 하는 등 한층 더 여성차별적인 조항을 담은 법이 새로 제정됐다.

7. 사법제도는 거의 제 기능을 하지 못하고 있다. 일부 도시의 경우 너무나 위험한 상황이라 법원을 열지 못할 정도이고, 판사와 변호사가 공격받거나 납치를 당하기도 했다. 카다피에게 충성한 것으로 간주된 수천여 명은 기소나 재판도 없이 수 년 간의 징역에 처해졌다. 전쟁범죄 및 기타 혐의로 기소된 전직 정부 관계자 37명에 대한 재판은 피고인들의 고문 의혹에 대해서는 조사하지 못하는 등 많은 결함을 드러냈다. 국제앰네스티는 2011년 이후 리비아에서 인권침해로 기소된 것으로 알려진 무장단체 단원은 단 한 명도 없다고 파악하고 있다.

배경
2011년 11월, 유엔 안전보장이사회는 카다피 정권의 <중대한 제도적 인권침해>에 관한 보고서가 발표된 후 만장일치로 리비아 상황을 국제형사재판소(ICC)에 회부했지만, ICC는 리비아의 불안정한 정세와 자원 부족을 이유로 계속해서 조사에 착수하지 못하고 있다. 최근 리비아 상황의 추가 조사를 위해 지원을 요청한 ICC의 파투 벤수다 검사는 자신의 요청이 받아들여질 가능성이 거의 없다고 시사하기도 했다.
유엔 안전보장이사회는 또한 인권침해와 폭력행위를 저지른 관련자들에 대해 자산 동결, 출국 금지 등의 제재를 가한다는 내용의 결의안을 다수 채택했지만 지금까지도 시행될 기미는 보이지 않는다.

Libya since the ‘Arab Spring’: 7 ways human rights are under attack

Five years ago, an initially peaceful uprising in Libya quickly developed into armed conflict involving Western military intervention and eventually ended when Colonel Mu’ammar al-Gaddafi was killed in October 2011.

Successive governments then failed to prevent newly-formed militias of anti al-Gaddafi fighters from committing serious crimes for which they never faced justice. The country remains deeply divided and since May 2014 has been engulfed in renewed armed conflict.

Here are seven ways human rights are under attack across the country:

1. All sides have committed war crimes and serious human rights abuses, including indiscriminate and direct attacks on civilians and their property. Hundreds have been abducted and tortured because of their perceived political or tribal affiliation, origin or opinion.

2. Armed groups are out of control. The so-called Islamic State (IS) took over certain areas where it has carried out public execution-style killings, sometimes leaving victims’ corpses on public display. It has also carried out public floggings and amputations, and publicized some crimes on social media.

3. Migrants and refugees face serious abuse. Many are tortured, exploited and sexually abused along the smuggling route in and out of Libya. Others have been detained indefinitely. Thousands have also sought to leave Libya and cross the Mediterranean Sea to Europe in unseaworthy vessels. In 2015, more than 2,880 drowned while attempting the journey from northern Africa to Italy.

4. Civilians bear the brunt of the conflict and violence across the country. Nearly 2.5 million people need humanitarian help including clean water, sanitation and food. Many hospitals and clinics are closed, damaged or inaccessible due to the fighting. Around 20% of children in Libya are not able to go to school.

5. Free speech is under attack. Journalists, human rights activists and NGO workers have been threatened, abducted and assassinated by various armed groups. TV stations have been vandalized, set ablaze and attacked with rocket-propelled grenades. Reporters Without Borders recorded more than 30 attacks against journalists between January and November 2015.

6. Women’s rights are in retreat. Women activists have been intimidated and threatened, and women travelling without a male companion have been harassed by militias. New laws discriminated against women even further, for example by making child marriage easier and allowing men to divorce their wives without obtaining court approval.

7. The legal system is barely functioning. Courts in some cities are closed because it’s so dangerous, and judges and lawyers have been attacked and abducted. Thousands of people seen as being loyal to al-Gaddafi have been detained for years without charge or trial. The trial of 37 former officials for alleged war crimes and other offences was deeply flawed, including its failure to investigate allegations of torture of the defendants.
