5일 대만에서 6명의 사형이 집행된 것은 정의실현과는 관계없는 퇴보적인 결정이라고 국제앰네스티가 밝혔다. 5일 저녁 대만의 4개 교도소에서 남성 6명이 총살형에 처해졌다. 모두 살인으로 사형을 선고받은 사람들이었다.

이들에 대한 사형집행은 지난주 타이페이에서 8세 소녀가 끔찍하게 살해된 사건으로 대중의 분노가 극에 달한 가운데 이루어진 것이었다.

윌리엄 니(William Nee) 국제앰네스티 조사관은 “죄 없는 여학생에게 벌어진 끔찍한 살인 사건에 분노하는 것은 매우 당연한 일이며 이처럼 극악무도한 범죄를 저지른 범인은 반드시 마땅한 처벌을 받아야 하지만, 사형이 그 답이 될 순 없다”며 “사형을 집행하기로 결정한 것은 분노한 대중을 달램으로써 좋은 점수를 얻으려는 정부의 정치적 계산이 엿보인다. 정부는 이날의 결정으로 정치적 리더십의 부재를 증명했다”고 말했다.

총살형에 처해진 6명의 남성은 타이페이 교도소의 청친언, 왕슈팡, 차오 티엔서우와 타이난 교도소의 왕춘친, 가오슝 교도소의 왕유렁, 타이중 교도소의 황추왕 등이다.

대만에서의 사형집행은 모두 비밀리에 진행되고 있으며, 사형수의 가족과 변호인들에게 사전에 고지하는 경우는 거의 없다.

지난 2014년, 대만은 5명에 대해 사형을 집행하고 1명에 대해 새로 사형을 선고했으며, 모두 살인으로 유죄가 선고된 사람들이었다.

대만은 2014년 사형을 집행한 단 22개국 중 하나로, 41개국이었던 20년 전 기록과 비교되는 수치다. 현재 총 140개국이 법적 또는 실질적 사형폐지국이다.

윌리엄 니 조사관은 “이번 사형집행 결정은 사형폐지를 장기적인 목표로 본다던 대만 정부의 발표와 완전히 상반되는 조치다. 정부는 정치적 도구로 사형집행을 이용하는 것을 중단하고, 사형폐지를 위한 첫걸음으로써 공식적으로 사형집행 유예를 선포해야 한다” 고 말했다.

사형이 다른 처벌에 비해 더욱 효과적이라는 설득력 있는 증거는 존재하지 않는다. 사형과 살인 발생률간의 상관관계에 대해 유엔이 포괄적인 연구를 진행한 결과, 사형이 종신형에 비해 범죄 억지력이 더욱 강하다는 과학적인 증거는 찾을 수 없었다.

국제앰네스티는 범죄의 성질 또는 정황, 개인의 유, 무죄 여부와 그 외 특성, 국가의 사형집행 방법에 관계없이 모든 경우에 대해 사형에 반대한다. 사형은 세계인권선언에 명시된 생명권을 침해하는 것이며, 극도로 잔인하고 비인도적이며 굴욕적인 처벌이다.

Taiwan: Six executed in politically motivated decision

The execution of six people in Taiwan today is a regressive decision that does not deliver justice, Amnesty International said.

The six men were executed by firing squad at four different prisons in Taiwan earlier this evening. All had been convicted of murder.

The executions were carried out amidst public outrage following the abhorrent murder of an eight year old girl in Taipei last week.

“The public outrage at the horrific murder of an innocent schoolgirl is totally understandable and the perpetrators of such heinous crimes must face justice, but the death penalty is never the answer,” said William Nee, researcher at Amnesty International.

“The decision to carry out the executions reeks of political calculations by a government attempting to gain points by quelling public anger. The government has today demonstrated a failure of political leadership.”

The six men executed by firing squad were: Cheng Chin-wen, Wang Hsiu-fang, and Tsao Tien-shou at a prison in Taipei; Wang Chun-chin at a prison in Tainan; Wang Yu-lung at a prison in Kaohsiung; and Huang Chu-wang in Taichung.

Executions in Taiwan are shrouded in secrecy, with the families and lawyers of those executed rarely informed in advance.

In 2014, Taiwan carried out five executions and imposed one new death sentence, all involving people convicted of murder.

Taiwan was one of only 22 countries to carry out executions in 2014, compared to 41 countries 20 years ago. A total of 140 states have now abolished the death penalty in law or practice.

“The executions fly in the face of the government’s stated long term goal to abolish the death penalty. The government must cease using executions as a political tool and should establish an official moratorium on executions as a first step towards abolition.”

There is no convincing evidence that the death penalty prevents crime more effectively than other punishments. A comprehensive study carried out by the United Nations on the relationship between the death penalty and homicide rates concluded that research has failed to provide scientific proof that executions have a greater deterrent effect than life imprisonment.

Amnesty International opposes the death penalty in all cases without exception, regardless of the nature or circumstances of the crime; guilt, innocence or other characteristics of the individual; or the method used by the state to carry out the execution. The death penalty violates the right to life as proclaimed in the Universal Declaration of Human Rights. It is the ultimate cruel, inhuman and degrading punishment.

방글라데시 정부가 야당 지도자 모티우르 라흐만 니자미의 사형을 집행한 것은 전쟁범죄 피해자들에게 정의를 구현해줄 수 없는 안타까운 행보라고 국제앰네스티가 밝혔다.

방글라데시 정당 ‘자마트 에 이슬라미’ 대표 모티우르 라흐만 니자미의 교수형이 5월 10일 다카 중앙교도소에서 집행됐다. 니자미는 1971년 방글라데시 독립전쟁 당시 지식인들을 집단 학살하고 살인, 고문, 성폭행을 자행한 혐의로 지난 2014년 10월 방글라데시 전범 특별재판소에서 사형을 선고받았다.

참파 파텔(Champa Patel) 국제앰네스티 동남아시아 지역국장은 “방글라데시 정부가 모티우르 라흐만 니자미의 사형을 집행한 것은 실망스러운 일이다. 1971년 독립전쟁 중 자행된 끔찍한 사건의 피해자들은 마땅히 정당한 대우를 받아야 하지만, 또 다른 사람의 목숨을 빼앗는 것이 답은 아니다”라며 “사형은 어떤 경우에든 인권 침해에 해당하지만, 부실한 절차를 거쳐 부과되었을 경우에는 더욱 문제가 된다. 니자미의 재판과 전범재판소에 회부되기 전 일반적인 사법절차의 공정성에 대해서도 심각한 의혹이 제기되었지만 아직도 이 문제는 해결되지 않고 있다. 과거 잔혹행위의 피해자들은 허술한 사법 절차보다 더 나은 대우를 받아야 한다”고 말했다.

파텔 국장은 또 “방글라데시 정부는 사형과 같은 잔혹하고 돌이킬 수 없는 형벌로부터 등을 돌려 세계 대부분의 국가들과 같은 대열에 합류하고, 사형 폐지를 목적으로 사형집행 유예를 선포해야 한다”고 말했다.

국가정부는 전쟁범죄의 책임성을 확립해야 할 의무가 있으며, 방글라데시 정부가 이를 따르고 있는 것은 긍정적이다. 그러나 국제앰네스티와 유엔을 비롯한 다수의 공신력 있는 단체들은 전범재판의 공정성에 관해 심각하고 중요한 문제점들을 제기했지만 아직까지 이에 대해서는 다루어지지 않고 있다.

파텔 국장은 “방글라데시의 이번 사형집행 결정은 정치적으로 민감한 시기에 이루어진 것으로, 여야 모두는 평정을 유지해야 한다. 보안군은 평화적 시위를 벌일 권리를 존중해야 하고, 여야 정치지도자들은 지지자들에게 인권침해행위를 자제할 것을 촉구해야 한다”고 말했다.

국제앰네스티는 범죄의 성질이나 가해자의 특성, 사형집행 방법을 막론하고 모든 경우에 예외 없이 사형을 반대한다.

2015년 방글라데시에서 사형이 선고된 사람은 최소 197명으로, 이 중 4명은 전범 특별재판을 통해 사형이 선고됐다. 방글라데시는 2015년 4명에게 사형을 집행했고, 이 중 전범재판에서 사형을 선고받은 사람은 3명이다.

전범 특별재판소는 1971년 방글라데시 독립전쟁 당시 자행된 대규모 인권침해행위를 조사하기 위해 2010년 방글라데시 정부가 설립했다. 국제앰네스티는 전쟁범죄 책임자들을 재판에 회부하려는 정부의 움직임은 환영했지만, 피고인들에게 사형에 의존하지 않은 공정한 재판이 이루어져야 할 것이라고 촉구했다.

Bangladesh: Nizami execution will not deliver justice

The execution of Motiur Rahman Nizami today is a deplorable move by the Bangladeshi authorities which will not deliver justice to the victims of war crimes, Amnesty International said today.

Motiur Rahman Nizami, the current chief of Bangladeshi political party Jamaat-e-Islami, was hanged at Dhaka Central Jail today. He was sentenced to death by the International Crimes Tribunal (ICT) in Bangladesh in October 2014 after he was convicted of charges relating murder, torture, rape and the mass killing of intellectuals during Bangladesh’s War of Independence in 1971.

“We are dismayed that Bangladeshi authorities have executed Motiur Rahman Nizami. The victims of the horrific events of the 1971 Liberation War are entitled to justice, but taking another life is not the answer,” said Champa Patel, Amnesty International’s Director of the South Asia Regional Office

“The death penalty is always a human rights violation, but its use is even more troubling when the execution follows a flawed process. There are serious questions about the fairness of Motiur Rahman Nizami’s trial – and of proceedings before the ICT more generally – that have not been addressed. Victims of past atrocities deserve better than a flawed process.

“We urge the Bangladeshi authorities to join most of the world by turning its back on this cruel and irreversible punishment, and impose a moratorium on the implementation of the death penalty with a view to its eventual repeal.”

The government has a duty to ensure accountability for war crimes, and it is positive that the Bangladeshi authorities are taking steps in this direction. But many credible organizations including Amnesty International and the UN have raised serious and important issues around the fairness of the ICT trials which have not been addressed.

“Today’s decision comes at a politically sensitive time for Bangladesh, and all sides must ensure calm prevails across the country. Security forces should ensure that the right to peaceful protest is respected, while political leaders on all sides should call on their supporters to refrain from human rights abuses,” said Champa Patel.

Background

At least 197 people were sentenced to death in Bangladesh in 2015, including four people sentenced to death by the International Crimes Tribunal (ICT). Bangladesh carried out four executions in 2015, three of whom were sentenced by the ICT.

금태섭 더불어민주당 의원 (초선·서울 강서갑)이 사형제 폐지를 위한 한국 정부의 국제협약 가입을 촉구하는 결의안을 발의한다고 4일 밝혔다. 국제앰네스티 한국지부와 협력해 금 의원이 이날 발의한 결의안은 ‘시민적 및 정치적 권리에 관한 국제규약 제2차 선택의정서’ 가입을 촉구하는 내용과 오는 12월 국제연합 (UN) 총회에서 7차 사형 모라토리엄 (집행 중단) 결의안에 한국 정부가 찬성 투표할 것을 촉구하는 내용을 담고 있다.

‘시민적 및 정치적 권리에 관한 국제규약 제2차 선택의정서 (이하 제2차 선택의정서)’는 가입국이 사형 집행을 전면 중단하고 사형제 폐지를 위해 필요한 모든 조치를 취해야 한다는 내용을 담고 있다. 현재 전세계 85개국이 가입했지만 한국은 아직 가입하지 않았다. 특히 제2차 선택의정서는 탈퇴 조항을 별도로 두고 있지 않아 당사국이 임의로 사형 집행을 재개할 수 없다는 점에서 실질적인 사형 폐지의 효과를 낼 수 있는 수단이 될 수 있다.

또한 미국 뉴욕에서 열리고 있는 제73차 UN 총회에서는 ‘사형 모라토리엄 (집행중단) 결의안’이 상정될 예정이다. 한국은 앞선 6차례의 결의안 투표 (2007년, 2008년, 2010년, 2012년, 2014년, 2016년)에서 모두 기권함으로써 세계적 추세에 역행했다. 이 기간 동안 찬성국가는 104개국에서 117개국으로 증가했다. 또한 한국이 21년째 사형 집행을 중단했다는 점에서 이 결의안에 찬성하지 않을 실효적인 이유가 없다.

한국은 사형 모라토리엄 선언에 나서야 합니다

 

2018년 10월 10일은 세계 사형 폐지의 날입니다. 국제 앰네스티는 한국이 사형 폐지의 첫 단계로서 사형 모라토리엄을 즉각적으로 선언할 것을 요구합니다.

국제 앰네스티는 범죄의 성격, 유무죄 여부, 집행의 방식과 관계없이 모든 범죄에 대한 사형 집행을 반대합니다. 사형은 생명권을 침해하는 잔혹하고 비인간적인 형벌입니다.

사형제 폐지가 바람직하다는 것은 국제법에서도 나타나 있습니다. ‘시민적 및 정치적 권리에 대한 국제규약’은 특정 상황에서 사형을 허용하고 있지만 이것이 사형제 폐지를 막거나 연기하기 위해 사용되어서는 안된다고 명확히 밝히고 있습니다.

이 규약의 해석을 담당하는 국제연합 (UN) 인권위원회는 일반 논평에서 “시민적 및 정치적 규약에 관한 국제규약은 일반적으로 (사형제) 폐지가 바람직하다고 강력히 제시하고 있다. 위원회는 사형제 폐지를 위한 모든 조치가 생명권 향유에 있어서의 진보로 고려돼야 한다고 결정한다.”고 밝혔습니다. 한국은 1990년 이래 이 조약의 당사국이지만 아직 사형제 폐지에 관한 제2차 선택의정서를 비준하지 않았습니다.

오는 12월 10일은 세계인권선언 채택 70주년입니다. 세계인권선언 이후 전 세계는 사형 폐지에 관한 놀랄 만한 성취를 이뤄냈습니다. 1948년 선언이 채택되던 당시 전세계적으로 8개 국가만 모든 범죄에 대해 사형제를 폐지한 바 있습니다. 1977년 국제 앰네스티가 사형폐지 운동을 시작할 당시 오직 16개 국가만이 사형 제도를 전면 폐지했습니다. 오늘날 전세계적으로 106개국이 사형제를 전면 폐지했고 142개국이 실질적 사형 폐지국가로 분류되고 있습니다.  2000년 이후 사형제도를 전면 폐지한 국가는 30개국에 달합니다. 미국의 코네티컷, 델라웨어, 일리노이, 매릴랜드, 뉴저지, 뉴멕시코, 뉴욕주 등도 지난 2000년 이후 사형제를 폐지했습니다.

2017년에는 기니와 몽골이 모든 범죄에 대해 사형제를 철폐했고 과테말라가 살인과 같은 통상 범죄에 대해 사형제를 폐지하였습니다. 부르키나파소는 새 형법에서 통상 범죄에 대해 사형을 배제함으로써 가장 최근에 사형을 폐지한 국가가 됐습니다. 감비아는 2018년 2월 공식 사형 모라토리엄 (집행 중단) 선언을 한 뒤 지난 9월에는 ‘시민적 및 정치적 권리에 관한 국제규약’ 2차 선택의정서에 가입하였습니다.

20년 이상 사형 집행을 하지 않고 최근 2년간 사형을 선고하지 않았다는 점에서 한국은 전 세계 다수 국가의 흐름에 발맞춰 사형제를 폐지하기 위한 최적의 조건을 갖추고 있습니다.

사형이 다른 형벌보다 범죄 예방 효과가 크다고 주장할 만한 근거는 전혀 없습니다. 사형과 살인 범죄 발생과의 상관관계에 대해 가장 포괄적으로 연구한 UN의 보고서는 “사형이 무기징역보다 살인 범죄 억지 효과가 크다는 과학적 증거를 제시하는 데 실패했다. 앞으로도 그와 같은 결론이 나올 것으로 예상하기 어렵다. 전체적으로 (조사 결과) ‘살인 범죄 억지 효과 가설’을 지지할 만한 긍정적 근거를 제시하기 어렵다”고 결론지었습니다. 이미 사형제를 폐지한 국가들의 통계는 사형제를 폐지한 이후 이전에 사형의 대상이 되던 범죄 발생의 증가가 나타나지 않았다는 사실을 보여줍니다. 예를 들어 캐나다에서는 사형제를 폐지하기 1년 전이었던 1975년에 인구 10만명당 살인 범죄 발생률이 3.09 였지만 1980년 2.41로 하락하였습니다. 인권 보호와 증진에 관련하여 사형제를 유지하는 현재 한국의 상황은 수용할 수 없는 선택지입니다. 세계 사형폐지의 날에 즈음하여 국제 앰네스티는 한국 정부가 사형제를 전면 폐지할 것을 촉구합니다.

사형제 폐지가 보류된 상황에서, 국제 앰네스티는 우선 한국정부가 다음과 같은 조치들을 취할 것을 요구합니다.

  • 공식적인 사형 모라토리엄을 즉시 선언하고 현재 사형수들은 다른 형벌로 전환해야 합니다.
  • 73차 UN총회에서 사형 모라토리엄 결의안에 찬성 투표해야 합니다.
  • ‘시민적 및 정치적 권리에 관한 국제규약 제2차 선택의정서’에 가입해야 합니다.

유엔이 사상 처음으로 신임 사무총장 선출 과정을 공개한 가운데, 차기 사무총장은 국제사회가 난민 원조에 임하는 태도를 다시 점검하고, 잔혹행위를 끝내고 무력분쟁에 휘말린 민간인을 보호하기 위해 가능한 모든 행동에 나서야 할 것이라고 국제앰네스티가 밝혔다.

국제앰네스티와 6개 인권단체는 유엔 평화유지군의 인권침해와 시리아, 이라크, 예멘, 남수단 등 주요 분쟁지역에서의 인권 보호 실패로 손상된 유엔의 인권 신뢰도를 회복하기 위해 차기 사무총장이 반드시 따라야 할 여덟 가지 우선순위를 제시했다.

선거 과정 공개의 일환으로 반기문 사무총장의 후임이 될 후보자들은 4월 12일부터 14일까지 열리는 유엔 총회에서 각자의 비전을 설명하고 질문에 답할 예정이다.

살릴 셰티(Salil Shetty) 국제앰네스티 사무총장은 “세계는 인권침해를 저지르는 국가에 맞서 일어설 강력한 유엔 사무총장이 필요하다. 유엔의 모든 활동에 인권을 가장 중시하지 않는다면 그 사명을 다하는 것은 불가능하다”며 “유엔을 이끌어 갈 후보자들은 지금부터 인권을 지지하고 나서야 하며, 이에 대한 반발을 두려워해서는 안 된다. 인권에 대한 헌신을 배척하려는 회원국이 있다면 이는 유엔 헌장을 위반할 뿐만 아니라 유엔의 미래까지 위태롭게 하는 것”이라고 말했다.

 

국제앰네스티와 파트너 단체들은 차기 유엔 사무총장에게 다음의 여덟 가지 사안을 최우선적으로 다룰 것을 촉구한다.

  • 난민과 이주민 문제에 새로운 해법을 제시하라.
    분쟁과 인권침해로 인해 오늘날 피난민의 수는 2차 세계대전 이래 역대 최대 수준에 이르렀다. 유엔 사무총장은 난민협약에 따라 지속적인 국가간 협력과 공평한 재정착 책임 분담을 바탕으로 난민 문제에 대한 새로운 접근법을 모색하기 위해 꾸준히 노력해야 한다. 또한 가장 먼저 국제 이주를 관리하는 현행 제도를 폭넓게 검토하고, 여기에 인권을 접목시켜야 한다.
  • 대규모 잔혹 범죄를 방지하고 종식시켜라.
    유엔 사무총장은 유엔 헌장이 부여하는 권한으로 분쟁 중 고의적으로 민간인을 공격하는 등의 국제인권법 및 인도법 침해행위를 방지하고 종식시켜야 한다.
  • 시민사회를 보호하라.
    시민사회는 비판세력과 시위에 대한 국가의 탄압을 막기 위해 반드시 필요한 방벽이다. 유엔 사무총장은 시민사회, 특히 인권옹호자와 언론인들을 위해 헌신할 뜻을 분명히 보여야 한다.
  • 소외된 사람들의 인권을 지켜라.
    인권을 존중하지 않는 태도와 차별로 인해 전세계의 가난과 불평등이 더욱 극심해졌다. 신임 사무총장은 소외된 사람들의 인권을 지키고 모든 차별을 종식시키기 위해 노력해야 한다.
  • 성평등을 보장하라.
    유엔 사무총장은 여성인권과 성평등을 증진하기 위해 여성, 평화, 안보 어젠다와 베이징선언 및 행동강령 등의 주요 국제규약을 적용하는 등 주어진 권한 내에서 가능한 모든 행동에 나서야 한다.
  • 불처벌 문화를 타파하라.
    신임 사무총장은 국제법상 범죄행위가 처벌받지 않는 관행을 타파하기 위해 최선을 다해야 한다. 국제형사재판소를 비롯한 국제법원은 법정에서 필요한 모든 정치적, 재정적 지원을 받을 수 있어야 한다.
  • 사형을 폐지하라.
    전 세계적으로 사형 폐지를 향해 상당한 진전이 이뤄졌다. 사무총장은 임기 내 사형 폐지라는 목표를 달성하기 위해 가능한 모든 행동에 나서야 한다.
  • 인권에 대한 유엔의 영향력을 강화하라.
    세계 평화와 안보, 발전의 수호와 더불어 인권은 유엔을 지탱하는 또 하나의 기반이다. 신임 사무총장은 인권에 충분한 관심과 자원을 투자해야 한다. 전세계 모든 사람의 인권을 더욱 존중하고, 누구도 소외되지 않도록 강력하고 혁신적인 조치를 취해야 한다. 또한 질 높은 인사결정과 관계자들의 책임성 강화를 통해 유엔의 청렴도를 유지해야 한다.

Next UN Secretary General must stand up for human rights

 

The next United Nations (UN) Secretary General must overhaul the global approach to aiding refugees and must do everything possible to end atrocities and protect civilians in armed conflicts, said Amnesty International as the process of selecting the leader of the world body is opened to the public for the first time.

Amnesty International and six other human rights organizations have listed eight priorities the next Secretary General must pursue to restore the UN’s credibility on human rights damaged by peacekeeper abuse and failure to protect human rights in major crises like Syria, Iraq, Yemen and South Sudan.

In an effort to open up the selection process, candidates to succeed UN Secretary General Ban Ki-moon will outline their vision and field questions at the UN General Assembly from 12-14 April.

“The world needs a strong UN Secretary General who will stand up to states that commit human rights violations. The UN simply cannot fulfil its mandate without putting human rights at the heart of everything it does,” said Salil Shetty, Secretary General of Amnesty International.

“Candidates to lead the United Nations have to stand up for human rights, starting now. They should not fear a backlash for doing so. Member states that seek to penalize a commitment to human rights would be violating the UN Charter and jeopardizing the future of the UN itself,” said Salil Shetty.

Amnesty International and partners are calling on the next UN Secretary General to address eight priority issues:

  • Deliver a new deal for refugees and migrants.As a result of conflict and human rights abuses, the number of people forced from their homes today is higher than at any point since the Second World War. In support of the Refugee Convention, the Secretary General should work assiduously towards a new global approach to refugees, based on sustained international co-operation and an equitable sharing of responsibilities for resettlement. They must spearhead a broad review of existing structures for managing international migration, integrating human rights within them.
  • Prevent and end mass atrocity crimes.The Secretary General should use the powers awarded under the UN Charter to help prevent and end major violations of international human rights and humanitarian law, such as the deliberate targeting of civilians in conflicts.
  • Defend civil society.Civil society is a vital bulwark against state crackdowns on dissent and protest. The Secretary General must display a clear commitment to civil society, in particular human rights defenders and journalists.
  • Champion the rights of marginalized people.Discrimination, and the failure to respect human rights, have deepened poverty and inequality across the world. The new Secretary General must champion the rights of marginalized people and seek to end all forms of discrimination.
  • Ensure gender equality.The Secretary General must do everything within her or his power to advance women’s rights and gender equality, helping to implement key commitments such as the Women, Peace and Security agenda and the Beijing Declaration and Platform for Action.
  • Combat impunity.The new leader of the United Nations must be committed to fighting impunity for crimes under international law. They must ensure that the International Criminal Court and other internationalized tribunals receive the political and financial support they need.
  • End the death penalty.Significant progress has been made towards abolishing the death penalty worldwide. The Secretary General must do everything possible to achieve the goal of total abolition within their term in office.
  • Strengthen the impact of the United Nations on human rights. Human rights form the third pillar of the UN, along with the maintenance of international peace, and security and development. The new Secretary General must ensure that human rights are given sufficient prominence and resources. They must take bold and transformative steps to improve the respect for human rights worldwide, leaving no-one behind. They must also safeguard the integrity of the organization through making high-quality appointments and ensuring accountability of UN personnel.

태국 군사정부가 새 개헌안의 찬반을 묻는 국민투표 시행을 앞두고 이에 관한 논의를 노골적으로 차단하려 하고 있다고 국제앰네스티가 27일 밝혔다.

4월 27일 태국에서 페이스북(Facebook)에 댓글을 남긴 이용자 중 최소 10여 명이 군부가 제정한 새 법률에 따라 구금되거나 기소됐다. 군부가 추진하고 있는 새 개헌안이 논란의 중심이 된 가운데 이에 관해 언급하는 댓글을 남겼다가 체포된 것이다.

새로 제정된 법에 따라 기소된 이용자들은 최대 징역 10년형과 20만 바트(미화 5,715달러)의 벌금형에 처할 수 있다.

“페이스북 게시물에 댓글을 다는 것만으로 실형 10년과 엄청난 벌금을 감수해야 한다면서, 개헌안에 관해 개방적이고 솔직한 논의가 이루어지길 바라는 것 자체가 어불성설이다.”

조세프 베네딕트(Josef Benedict) 국제앰네스티 동남아시아 캠페인 국장은 “페이스북 게시물에 댓글을 다는 것만으로 실형 10년과 엄청난 벌금을 감수해야 한다면서, 개헌안에 관해 개방적이고 솔직한 논의가 이루어지길 바라는 것 자체가 어불성설”이라며 “태국 군사정부는 댓글을 남긴 이용자들에 대해 즉시 기소를 취소하고, 이들을 조건 없이 석방해야 한다. 국민이 직접 정치적 결정권을 행사할 국민투표에 대해 어떤 정부도 무엇이 적절한 발언인지를 결정할 권한은 없다”고 말했다.

태국 군사정부가 발표한 새 개헌안에 관해 찬반을 묻는 국민투표는 8월 7일 시행될 예정이지만, 그에 앞서 정부는 표현의 자유를 행사할 권리를 더욱 강력히 탄압하고 있다. 정치적 사안에 관해 간단히 의견을 표현하기만 해도 체포되거나 처벌받는 일이 거의 매일같이 벌어지고 있다.

솜차이 스리수티야꼰(Somchai Sriusthiyakor) 선관위원은 개헌안에 관해 정부가 인정하지 않는 발언을 한 이용자들을 “본보기로 삼겠다”는 충격적인 발언을 한 바 있다.

스리수티야꼰 위원은 이번에 기소된 이용자들이 “상스럽고 과격한 언어를 사용했다”며, 그러나 “논리와 근거를 갖춘 학술적인 논의”는 정부에서도 적극 환영한다고 밝혔다.

베네딕트 국장은 “스리수티야꼰 선관위원은 선진적인 토론이 이루어지길 바라는 것이라고 주장하지만, 정부가 비판세력을 침묵시키기 위해 취한 조치를 보면 정부의 태도와 다른 의견은 절대 용납하지 못하는 것 같다”고 말했다.

Thailand: Release Facebook commenters now

Thailand’s military government is brazenly seeking to shut down debate ahead of a referendum on a draft constitution, Amnesty International said today.

At least a dozen Facebook commenters have been detained or charged on 27 April under a draconian new Order issued by the head of the military government. The arrests come after they commented on the controversial draft of a new constitution Thailand’s military government is seeking to impose.

The Facebook users who were charged under the law now face up to 10 years in prison and a fine of 200,000 baht ($5,715).

“If ordinary people cannot comment on a Facebook post without facing the threat of 10 years behind bars and a hefty fine, what hope is there for any open and honest debate on the military government’s draft constitution?” said Josef Benedict, Amnesty International’s Director of Campaigns for South East Asia.

“Thailand’s military government must immediately withdraw charges against the commenters and release them unconditionally. It is not up to any government to determine what can or cannot be said about a referendum where citizens are expected to exercise their own political judgment.”

Thailand’s military government has proposed a draft constitution which will be voted on in a referendum on 7 August. In the lead up, however, the authorities have intensified their campaign to suppress the human right to freedom of expression. On a near-daily basis, people are arrested and punished for even making basic observations about political events.

Somchai Sriusthiyakor, the Election Commissioner, has chillingly said that he wishes to “to make an example” of those who post comments on the draft constitution that the authorities disapprove of.

He accused the commenters of “using foul and strong language,” arguing that the authorities would welcome debate that assumed “an academic fashion with reason and logic”.

“The Election Commissioner claims to want an enlightened debate, but the steps the government has taken to choke dissent suggest that the authorities have no patience for opinions different from their own.”

트럼프 당선자는 모든 사람의 인권을 차별 없이 지지하겠다고 공개적으로 약속해야 한다. 포로 수용소에서 고문 자행까지, 우리는 국민의 대표자로 선출한 사람이 인권 옹호라는 미국의 의무를 무시했을 때 벌어지는 처참한 결과를 목격해 왔다. 백악관 참모진부터 시의원까지, 오늘 선출된 사람들은 모두 이 교훈을 깊이 새겨야 한다”고 밝혔다.

USA: Poisonous Rhetoric Must Not Become Government Policy
WASHINGTON – In response to the election of Donald Trump to the United States presidency, Amnesty International released the following statements.

Salil Shetty, Secretary General of Amnesty International, said: “President-elect Trump has provoked grave consternation at many points throughout his election campaign, and raised serious concerns about the strength of commitment we can expect to see from the United States towards human rights in the future. He must now put this behind him and both reaffirm and abide by the United States’ obligations on human rights, at home and abroad.”

Margaret Huang, Executive Director of Amnesty International USA, said: “In the lead up to this week’s election, the United States has witnessed disturbing and, at times, poisonous rhetoric from President-elect Trump and others. This rhetoric cannot and must not become government policy. The xenophobic, sexist and other hateful remarks made by Trump have no place in government.
President-elect Trump must publicly commit to upholding the human rights of all without discrimination. From internment camps to the use of torture, we have seen disastrous results when those we elect to represent us flout the United States’ obligations to uphold human rights. All who have been elected today – from the executive office to city council – should bear these lessons in mind.”
