예멘의 수도 사나에서 후티 반군이 사용하는 대공무기가 인구 밀집 지역에 떨어진 후 폭발해 민간인들이 목숨을 잃거나 불구가 되는 등 수백여 명의 사상자가 발생했다고 국제앰네스티가 밝혔다.

사나로 가는 일주일간의 여정 중 국제앰네스티가 만난 9개 병원의 의료진과 주민들은 사나 지역의 사상자가 주로 대공포화로 인해 발생하고 있다고 전했다. 사우디아라비아가 주도하는 연합군 역시 주거지역에 위치한 무기고에 공습을 가해 추가로 폭발을 일으키면서, 더욱 많은 민간인 사상자를 발생시키고 있다.

라마 파키흐(Lama Fakih) 국제앰네스티 위기대응 상임고문은 “사나 주민들은 사우디 주도 연합군의 공습과 후티 반군의 대공포화라는 치명적인 십자포화 속에 갇혀 있다. 양측 모두 필수적인 민간인 보호 대책을 취하지 않으며 전쟁법을 위반했고, 그 대신 공격을 가해 참혹한 민간인 피해를 낳았다”며 “피해 주민들에게 책임 소재 여부는 중요하지 않다. 어느 쪽이든 똑 같은 희생을 치르고 있다”고 말했다.

대공포화

사나에서 가장 큰 국립병원인 알 차우라 병원의 한 의사는 전쟁 부상자 중 약 90%에 가까운 대다수가 대공포에 부상을 입고 병원에 실려 온 것이었다고 국제앰네스티에 전했다. 지난 주 5일간의 휴전이 이루어지기 전만 해도 이렇게 부상을 입은 환자들이 매일 약 17~23명씩 이송되었다고도 했다. 이 병원에서 근무하는 또 다른 의사 역시, 분쟁이 일어나고 첫 한 달 동안 이곳에서 치료받은 부상자 1,024명 중 대다수가 대공포에 다친 사람들이었다고 확인했다.

사우디 저먼 병원과 알 무야드 모던 병원의 의료진들도 이를 뒷받침하는 증언을 했다. 알 무야드 병원의 한 의사는 이곳에서 치료한 부상자 대부분이 대공포화로 파열상을 입은 여성과 어린이였다고 국제앰네스티에 전했다.

라마 파키흐 상임고문은 “사나 지역에서 대공포화로 인한 부상자 수가 급격히 증가한 것은, 분쟁 중 민간인 보호라는 국제법상 의무가 공공연히 무시된 채 공격이 이루어지고 있는 걱정스러운 양상을 보여주는 것”이라고 말했다.

또한 국제앰네스티는 대공포화로 인해 아이를 잃은 부부와, 부상을 입은 민간인 4명을 만났다. 그 중에는 다리 골절과 배, 골반, 발에 파열상을 입은 9살 소년도 있었다.

두 아이의 어머니인 파트메흐(Fatmeh)는 3월 30일 대공포탄이 집에 떨어지면서 18개월 난 아이와 함께 머리와 손, 몸 등에 수많은 파열상을 입었다.

13세 소년 카림 알리 알 사그히르 파르한의 부모는 4월 27일, 아들이 점심 기도를 위해 집을 나서 모스크로 향하던 도중 떨어진 대공포탄에 목숨을 잃었다고 전했다.

카림의 어머니는 이렇게 말했다. “아들이 ‘알라후 아크바(신이시여)’ 하고 소리를 지르고 샤하다(기도문)를 외는 걸 들었어요. 아바야(이슬람 의상)를 입고 나서니 이웃 사람들이 아들을 병원으로 옮기는 게 보였죠. … 시끄러운 소리 때문에 대공포탄이 떨어졌다는 걸 알았어요. 그 날 포격은 이루어지지 않았어요.”

후티 반군이 전투기나 땅에 접촉할 때의 충격으로 폭발하는 대공무기를 사용하거나, 공중작렬탄을 오발하면서 수많은 민간인들의 사망과 부상을 야기했고, 이는 민간인 보호를 위해 적절한 사전대책을 취하지 않은 것에 해당하므로 국제인도법 위반이다.

대공 작렬탄은 공중에서 폭발하도록 되어 있어, 민간인 사상자를 줄일 수 있다. 5월 20일 사나에서 후티 반군이 대공포화를 가하는 영상에는 적어도 일부의 경우 작렬탄을 사용하고 있는 모습이 분명히 담겨 있다.

국제앰네스티는 후티 반군에 접촉신관을 이용하는 대공무기를 사용하지 않을 것과, 작렬탄 등의 그 외 대공포를 발사할 경우에는 민간인 보호 대책을 추가로 마련할 것을 촉구한다. 또한 후티와 안사룰라 반군은 자신들의 대공포에 민간인이 피해를 입은 것으로 알려진 사건에 대해 조사하고, 피해자들에게 치료비를 지급하고 손해를 배상하는 등의 보상을 해야 한다.

무기고 공습

국제앰네스티가 방문한 병원에는 사우디아라비아 주도 연합군이 5월 11일 누쿰 산 일대의 무기고에 공습을 가하면서 벌어진 2차 폭발로 부상을 입은 추가 민간인 피해자들도 다수 있었다.

국제앰네스티는 공습 현장을 목격한 누쿰 산 주민 4명과, 어린이 4명, 여성 2명 등 공습으로 인한 2차 폭발의 부상자 7명을 만나볼 수 있었다. 피해자 여성 중 한 명은 함께 폭발에 휘말린 아들은 목숨을 잃었다고 했다. 예멘 보건부는 당시 공습으로 약 40명이 숨졌다고 발표했지만, 국제앰네스티는 이 통계 수치를 독립적으로 확인할 수 없었다. 알 사와라 병원과 쿠웨이트 병원의 기록 및 의료진들의 증언에 따르면 당시 공습으로 약 140명의 부상자가 이송됐다.

그보다 앞선 4월 20일에도 사나 교외의 파즈아탄에 위치한 무기고에 공습이 이루어져 주민 수백 명이 부상을 입었다.

누쿰 산과 파즈아탄 공습으로 피해를 입은 주민들은 모두 연합군으로부터 사전 경고가 충분히 가능한 상황이었으며, 알려진 무기고의 위치와 매우 가까운 곳에 사는 주민들이 2차 폭발로 부상을 입을 가능성이 있었음에도 공격이 임박했다는 경고를 전혀 받지 못했다고 진술했다. 이러한 상황에서 효과적으로 사전 경고를 하지 않는 것은 국제인도법 위반에 해당한다. 공습의 횟수에 비례해 이러한 공습으로 야기되는 엄청난 민간인 피해에 대한 우려 역시 증가하고 있다.

국제앰네스티는 사우디아라비아 및 공습에 관련된 연합 소속 국가들에 대해, 국제인권법에 명시된 대로 민간인에 대한 위험을 최소화하기 위해 가능한 모든 사전 대책을 취할 것을 촉구한다. 이러한 사전 대책은 공격 대상이 군이 아니거나, 부적절한 공격일 가능성이 명백한 경우 공격을 취소 또는 연기할 것, 정황상 불가능할 경우를 제외하고 민간인에게 영향을 줄 수 있는 공격은 사전에 효과적으로 경고할 것 등을 포함한다. 또한 후티 반군은 가능한 한 인구가 밀집된 민간 구역으로부터 멀리 떨어진 곳으로 군 거점을 옮겨야 할 것이라고 국제앰네스티는 밝혔다.

또한 예멘 내 사상자가 급증하고 있는 만큼, 사우디아라비아에 무기, 탄약, 군사훈련 또는 그 외의 군사기술/지원을 공급하고 있는 모든 국가들은 극도의 주의를 기울이고 더 이상의 민간인 사상자를 늘리는 군사적 이전은 하지 않을 것임을 보여줘야 한다.

라마 파키흐 상임고문은 “예멘 전역에서 공습과 대공포화가 재개됨과 동시에 민간인 사상자 수는 이미 증가를 보이기 시작했다”며 “지금까지 분쟁 양측은 자신들의 활동이 주민들에게 미친 치명적인 영향에 대해 냉정한 무관심을 보였다. 모든 분쟁 당사자들은 민간인 피해 위험을 최소화하기 위해 가능한 모든 조치를 취할 수 있으며, 취해야만 한다”고 말했다.

2015년 3월 25일 처음 시작된 연합군의 공습은 지금까지 수백여 명의 민간인 사망자를 발생시켰다. 국제앰네스티는 이러한 공습이 국제인도법을 위반했을 가능성이 있는 다수의 사례에 대해 기록하고 있다.

사례) 대공포에 숨지거나 다친 민간인

-3월 30일, 사나 사완 지역

24세에 두 아이를 둔 엄마인 파트메흐는 3월 30일 사나 사완에 위치한 자택에 대공포탄이 떨어지면서 18개월 난 아이와 함께 크게 다쳤다. 파트메흐는 오른손, 오른쪽 겨드랑이, 머리에, 어린 아들은 머리와 손에 파열상을 입었다. 아들은 부상 치료를 위해 2번 수술을 거쳐야 했고, 파트메흐의 집안은 그녀의 머리에 박힌 파편을 제거하는 수술의 수술비를 감당할 수 없었다. 파트메흐는 끔찍한 두통에 시달리고 있으며, 가끔은 두통 때문에 시력을 잃기까지 한다고 말했다. 국제앰네스티는 파트메흐의 집을 방문해 포탄으로 인한 피해를 살펴봤으며, 물리적 증거는 대공포화와 동일한 것이었다.

파트메흐의 남편 역시 아들과 함께 알 차우라 병원에 입원해 있는 며칠 동안, 대공포탄으로 인한 부상자들이 매일 10명 이상 응급실로 실려왔다고 전했다.

-4월 27일, 사나 슈마일라 지역

국제앰네스티는 4월 27일 대공포탄에 목숨을 잃은 13세 소년 카림 알리 알 사기르 파한의 부모와 만날 수 있었다. 사건 당시 집에 있었던 카림의 어머니는 오후 12시 무렵 집 앞에 대공포탄이 떨어지는 소리에 이어 아들이 울부짖는 소리를 들었다고 했다.

“아들이 ‘알라후 아크바(신이시여)’ 하고 소리를 지르고 샤하다(기도문)를 외는 걸 들었어요. 아바야(이슬람 의상)를 입고 나섰더니 이웃 사람들이 아들을 병원으로 옮기는 게 보였죠. … 시끄러운 소리 때문에 대공포탄이 떨어졌다는 걸 알았어요. 그 날 포격은 이루어지지 않았어요.”

카림의 부모는 예멘 요르단 병원으로 향했다. 이곳에서 의사와 이웃 사람들은 카림이 복부에 포탄의 파편을 맞아 부상을 입었고 수술을 해야 한다고 말했다.

“[카림은] 점심 기도를 하러 모스크에 가기 위해 대문을 나서고 있었어요. 공중에서 터지지 못한 대공포탄이 땅으로 떨어졌고, 카림은 배에 파편을 맞았어요. … 수술을 받았지만, 결국 살아나지 못했죠. 포탄이 터진 충격과, 카림이 다칠 때 현장에 있었던 사람들의 말을 듣고 이것이 대공포탄이었음을 알았어요. 폭발 소리가 온 도시에 들릴 정도였죠. 이 지역에서 공습은 일어나지 않았어요. 월요일에 두 번째 포탄이 지붕 위로 떨어졌지만 폭발하지는 않았어요.”

카림의 아버지는 국제앰네스티에 당시 지붕으로 떨어졌던 포탄을 보여주었다. 그리고 이 포탄은 후티 반군의 점령지인 자발 알 나데인에서 발사한 것이라고 했다. 또한 카림이 대공포화로 부상을 입은 것이라는 의료기록 사본도 제공했다.

-5월 5일, 사나 베이트바우스 지역

5월 5일 아침 약 11시, 퇴근한 후 집으로 돌아가던 50세의 사미르(Sameer)는 베이트바우스 지역의 총기 시장에서 대공포탄을 맞고 부상을 당했다고 친척이 국제앰네스티에 전했다. 이 공격으로 심하게 다친 사미르는 약 2주가 지난 지금도 알 차우라 병원의 중환자실에 입원해 있다. 공격 직후 사미르가 바로 이송된 에스라 병원을 찾아왔던 사미르의 친척은 같은 사건으로 부상을 당한 사람이 여러 명 더 있으며 병원에서 보기도 했다고 말했다. 또한 그 날 이 지역에는 공습이 없었고, 대신 대공포화가 가해졌다고 국제앰네스티에 진술했다.

-5월 6일, 사나의 누쿰 산 지역

국제앰네스티는 5월 6일 떨어진 대공포탄으로 부상을 입고 알 사와라 병원에 입원중인 9세 소년 살라(Salah)를 방문했다. 살라의 왼다리는 부러졌고 배, 골반, 오른발에 파열상을 입었다. 함께 병실에 있었던 살라의 삼촌은 5월 6일 살라가 사는 누쿰 산에서 부상을 당한 것으로, 당시 살라는 형제, 사촌들과 함께 거리에 있었다고 한다.

“우리는 [거리에서] 놀고 있었어요. 오후 5시였고 기도할 시간이었어요. 비행기가 나타났는데 라자(대공무기)로 비행기를 맞추려고 했어요.”

살라의 삼촌은 이 주변에서 대공포화는 정기적으로 이루어지는 것이라고 전했다. “[이 지역을] 항상 공격하고 있어요. 이제 파편을 보면 ‘라자(대공무기)’를 쏜 것인지 알 수 있게 됐죠. … 2주 전에도 비슷한 남자아이와 노인이 라자에 다친 적이 있어요.” 그는 살라가 한 달 이내에 다시 걸을 수 있을 것으로 기대하고 있었다.

-5월 5, 6일, 사나 다마르 알 가르 지역

국제앰네스티가 만난 아말(Amal)은 다마르 알 가르 지역에 사는 여성으로, 10~11일 전 마을에 떨어진 대공포탄으로 부상을 입고 알 차우라 병원에서 회복 중이었다. 아말은 아이들을 데리고 나서려던 차에 포탄이 떨어졌고, 동네의 학교 근처에 있었던 그녀는 큰 부상을 입었다고 했다. 또 사람들이 머리 위에서 비행기가 나는 소리를 들었지만 직접 보지는 못했으며, 그 날 이 지역에 공습이 이루어진 적은 없다고도 했다.

-5월 11일, 누쿰 산 무기고 공습

2015년 5월 11일 오후 공습이 가해질 당시 현장에 있었던 아흐마드(Ahmad)는 공습이 끝나고 4차례의 커다란 폭발음을 들었다고 국제앰네스티에 전했다. 공습으로 산 속에 있던 무기고가 피격을 당했고, 곧 연이어서 2차 폭발로 이어졌다. 아흐마드는 2차 폭발이 다음 날 아침 7시까지 끊임없이 계속됐다고 전했다. 또한 산 속에 저장되어 있던 대공무기가 이 지역에 “비 오듯” 떨어졌다고도 했다. 아흐마드는 무기고가 인구 밀집 거주 지역으로부터 약 200~250미터 떨어진 곳에 있었을 것이라고 추정했다.

2차 폭발 부상자인 누쿰 산 주민 바셀(16)은 공습이 시작됐을 때 해당 지역 여성들의 대피를 돕고 있었다고 한다.

“오후 6시 30분 공습이 시작되기 직전까지 여성들을 이 지역에서 대피시키려고 애쓰고 있었어요. 친척들과 함께 감단 학교 앞에 있었죠. 군인들은 아무도 없었고, 사람들이 도망치고 있었어요. 저는 걸어가다가 파편에 맞았어요. 한 남자가 차를 타고 와서 저를 병원으로 데려갔어요. 어머니 역시 파편에 맞으셨죠.”

또한 국제앰네스티는 5월 11일 누쿰 산 근처의 집에서 2차 폭발에 부상을 당한 4세 소년 피라스를 만나, 병원에 함께 있던 친척과 인터뷰를 가졌다. 피라스는 왼손과 오른다리를 파편에 맞아 크게 다친 상태였고, 피라스의 어머니 역시 얼굴에 파열상을 입었다고 전했다.

Yemen: Scores of civilians killed and injured by anti-aircraft fire and airstrikes on weapons depots

Scores of casualties in Sana’a have been caused by anti-aircraft munitions shot by the Huthi armed group which detonated after landing in populated areas killing and maiming civilians, said Amnesty International.

During a week-long trip to the Yemeni capital, the organization spoke to medical staff at nine hospitals and residents who said that anti-aircraft weapons were the leading cause of casualties in the capital. Saudi Arabian-led coalition airstrikes against weapons depots in residential areas have triggered further explosions, also killing and injuring other civilians.

“Sana’a’s residents are caught in a deadly crossfire between the Saudi Arabian-led coalition airstrikes and anti-aircraft fire from the Huthi armed group. Both sides have failed to take the necessary precautions to protect civilian lives in violation of the laws of war. Instead they have carried out attacks that have had devastating consequences for the civilian population,” said Lama Fakih, Senior Crisis Advisor at Amnesty International.
“For the civilians affected, it doesn’t matter which side is responsible. They pay the same price.”

Anti-aircraft fire

A doctor at al-Thawra hospital, one of the largest public hospitals in Sana’a, told Amnesty International that the vast majority – around 90% – of war wounded patients admitted to the hospital had been injured by anti-aircraft fire. He said that before the five-day ceasefire last week around 17-23 patients with such injuries were admitted to the hospital daily. A second doctor working at the hospital also confirmed that the majority of the 1,024 wounded patients treated there during the first month of the conflict, had also been injured by anti-aircraft fire.

This was backed up by staff at the German-Saudi hospital and al-Mu’yyad Modern Hospital, where a doctor told Amnesty International that the majority of the wounded treated there were women and children suffering from fragmentation injuries caused by anti-aircraft fire.

“The sheer number of injuries caused by anti-aircraft fire in Sana’a points to a disturbing pattern of attacks in which the obligation under international law to protect civilians during a conflict is being flouted,” said Lama Fakih.

Amnesty International also met the parents of a child killed and four civilians who were injured by anti-aircraft fire, including a nine year old boy who was left with a broken leg and fragmentation wounds in his stomach, groin and foot.

Fatmeh, a mother of two, was injured along with her one-and-a-half-year-old-baby, when an anti-aircraft projectile struck their home in Sana’a on 30 March. She was left with several fragmentation injuries to her head, hand and body.

The parents of Karim Ali al-Sagheer Farhan, 13, described to Amnesty International how their son was killed by an anti-aircraft projectile on 27 April while he was leaving his home for the mosque for the noon prayer.

“I heard him scream Allahu Akbar and he was saying the shahada. I pulled my abaya on and then saw the neighbours taking him to the hospital…I knew it was anti-aircraft weaponry from the noise. There was no shelling that day,” Karim’s mother said.

The Huthi armed group’s apparent use of anti-aircraft weaponry which detonates on impact either with an aircraft or when it has landed, known as contact fuzing, or misuse of air-burst munitions, has killed and maimed civilians, and amounts to a failure to take adequate precautions to protect the civilian population, which is a violation of international humanitarian law.

Air-burst anti-aircraft weaponry is designed to detonate in the air, potentially reducing civilian casualties. Video of Huthi anti-aircraft fire taken in Sana’a on 20 May clearly shows that at least in some instances they are using air-burst munitions.

Amnesty International calls on the Huthi armed group not to use any contact fuzed anti-aircraft weaponry and to take additional precautions to protect civilians when firing other anti-aircraft munitions, including air-burst. The Huthi armed group and the Ansarullah political wing should also investigate cases in which civilians have reportedly been harmed by their anti-aircraft weaponry and compensate those who have been harmed, including by paying for medical treatment and to repair damaged property.

Airstrikes on weapons depots

Many of the other civilian victims in the hospitals Amnesty International visited were injured by secondary explosions when attacks by Saudi Arabian-led coalition aircraft struck a weapons cache in the Mount Nuqum neighbourhood on 11 May.

Amnesty International interviewed four residents of Mount Nuqum who witnessed the attack and seven others who were injured in secondary explosions caused by the air strikes, including four children and two women. One of the women interviewed said that her son was killed in the same blast that had injured her. Around 40 people were killed in the strike according to the Ministry of Health, although Amnesty International could not independently verify this figure. Nearly 140 people injured in the attack were admitted for treatment at al-Thawra and Kuwait hospitals according to hospital staff and records.

Scores of residents were also injured in an earlier airstrike on a weapons depot in Faj ‘Attan, on the outskirts of Sana’a, on 20 April.

All of the residents affected by the Mount Nuqum or Faj ‘Attan blasts told Amnesty International that no advance warning was given by coalition forces of an impending attack despite the apparent feasibility of such warnings and the likelihood that civilians living in such close proximity to the known storage facilities would be injured by secondary blasts. Failing to give an effective advance warning under these circumstances is a violation of the rules of international humanitarian law. The extensive harm to the civilian population resulting from these attacks also raises concerns about the proportionality of these strikes.

Amnesty International calls on Saudi Arabia and other coalition states involved in the airstrikes to take all feasible precautions to minimize the risks posed to civilians, as required by international humanitarian law. This includes cancelling or suspending an attack if it becomes apparent that the target is not military or that the attack is likely disproportionate; and giving effective advance warning of attacks which may affect civilians, unless circumstances do not permit. The Huthi armed group should also move its military positions away from populated civilian areas where feasible, Amnesty International said.

Given the mounting casualties in Yemen, Amnesty International is also calling on all states supplying weapons, ammunition, training or any other military technology/assistance to Saudi Arabia to exercise extreme caution and demonstrate that any military transfers will not fuel further civilian deaths and injuries.

“As airstrikes and anti-aircraft fire resume across Yemen, the number of civilian casualties is already beginning to rise,” said Lama Fakih.

“So far both sides have displayed a chilling indifference to the deadly impact of their actions on civilians. All parties to the conflict can and should take all feasible steps to minimize the risk to civilians.”

Coalition airstrikes have caused hundreds of civilian deaths since they began on 25 March 2015. Amnesty International has documented a number of cases in which airstrikes may have violated the rules of international humanitarian law.

Cases. Civilians injured or killed by anti-aircraft fire

Amnesty International spoke with Fatmeh, 24, a mother of two who was injured along with her one and a half year old child on 30 March by an anti-aircraft projectile that hit their home in Sa’wan, Sana’a. At around 9pm a projectile struck their home injuring both of them. She had fragmentation injuries in her right hand, right armpit, and head. Her son suffered from fragmentation injuries to the head and to his hand. Her son had two operations to treat his injuries, her family could not afford to cover the costs of surgery to remove the fragments lodged in her head. She told Amnesty International that she was suffering from debilitating headaches, at times causing her to lose her sight, as a result. Amnesty International visited their home and observed the damage caused by the projectile. The physical evidence was consistent with an anti-aircraft strike.

Fatmeh’s husband also told Amnesty International that in the days he spent with his son while he was recovering in the al-Thawra hospital more than 10 people came into the emergency room every day who were suffering from anti-aircraft projectile injuries.

27 April, Shumaylah neighbourhood, Sana’a

Amnesty International also spoke with the parents of Karim Ali al-Sagheer Farhan, 13, who was killed by an anti-aircraft projectile on 27 April. Karim’s mother, who was home at the time of the strike, said that at 12pm she heard an anti-aircraft projectile strike in front of the house and then heard her son cry out:

“I heard him scream Allahu Akbar and he was saying the shahada. I pulled my abaya on and then saw the neighbours taking him to the hospital…I knew it was anti-aircraft weaponry from the noise. There was no shelling that day,” she said.

Karim’s mother and father went to the Yemen Jordan hospital where they were told by doctors and neighbours that their son had a shrapnel injury to the stomach and would need to undergo an operation. Karim’s father told Amnesty International that he was certain the injury was caused by an anti-aircraft projectile. Describing what happened, he said:

“[Karim] was at the gate of the house going to the mosque for the noon prayer. The anti-aircraft projectile failed to detonate in the sky and hit the ground and his stomach was hit with shrapnel…he went into surgery, but didn’t survive. From the impact of the strike and what people said who were at the site after he was injured we knew it was an anti-aircraft weapon. The whole area heard the explosion. There were no airstrikes here… A second shell hit the roof on Monday but it didn’t detonate.”

Karim’s father showed Amnesty International the projectile that hit the roof. He said the anti-aircraft fire was coming from Jabal al-Nahdayn, a Huthi armed group stronghold. He also provided Amnesty International with a copy of Karim’s medical records which stated he was injured by anti-aircraft fire.

5 May, Beit Baws neighbourhood, Sana’a

On 5 May at around 11AM, on his walk home from work, Sameer, 50, was injured by an anti-aircraft projectile on 50 Meter Road at a qat market in the Beit Baws area, his relative told Amnesty International. Sameer, who was badly injured in the attack, was still recovering in the intensive care unit at the al-Thawra hospital nearly two weeks after the incident. His relative, who visited him in the Essra’ Hospital where he was taken directly after the attack said that several other men were injured in the same incident and that he saw them at the hospital. He told Amnesty International that that day there were no airstrikes in the area, but that there was anti-aircraft fire.

6 May, Mount Nuqum neighbourhood, Sana’a

Amnesty International visited, Salah, 9, in the al-Thawra hospital where he was recovering from injuries sustained from an anti-aircraft projectile on 6 May. His left leg was broken and he had fragmentation injuries to his stomach, groin, and right foot. Salah’s uncle, who was with him in the hospital, told Amnesty International that Salah was injured while in Mount Nuqum, where he lives, on 6 May. He said that at the time Salah was in the street with his siblings and cousins.

“We were playing [in the street]” Salah said. “It was 5PM, prayer time. The plane was there and they tried to hit it with the Raja [anti-aircraft weaponry].”

Salah’s uncle told Amnesty International that anti-aircraft fire was a regular occurrence in their neighbourhood. “They are always striking [this area],” he said. “We’ve started to know from the remnants when it is a Raja [anti-aircraft weaponry]…two weeks before another boy and an older man were also injured by a Raja.” He was optimistic that Salah would be walking again in one month

5 or 6 May, Damar al-Ghar neighbourhood, Sana’a

Amnesty International spoke to Amal, a woman from the Damar al-Ghar neighbourhood who was recovering from injuries at the al-Thawra hospital from an anti-aircraft projectile that hit the neighbourhood 10 or 11 days before. Amal said that she was getting kids from the family together to leave the area when the projectile struck, injuring her near a school in her neighbourhood. She said that they heard the plane overhead but she did not see it, and that no airstrikes struck the neighbourhood that day.

Mount Nuqum, airstrike on weapons depot on 11 May 2015

Ahmad, a resident of Mount Nuqum present during the airstrike early in the evening on 11 May 2015, told Amnesty International that he heard four large explosions following aerial attacks. The airstrikes hit a weapons cache in the mountain which then set off a series of secondary explosions and projectiles. Ahmad said that the secondary projectiles continued to go off until 7am the next day. He said that anti-aircraft weapons that had been stored in the mountain were “dropping like rain” on the neighbourhood. Ahmad estimated that the weapons cache was about 200-250 meters away from the homes in the congested residential area.

One of the residents injured in the secondary blasts was Bassel, a 16-year-old resident of Mount Nuqum who was helping to evacuate women from the area after the strikes had started. He told Amnesty International:

“I was trying to evacuate women from the area just before the strike at 6:30pm. We were in front of the Ghamdan School with our relatives. There were no fighters there. People were running away. I was walking when I was hit. One guy came in a car and took me to the hospital. My mom was also hit with shrapnel.”

Bassel’s right leg was amputated below the knee as a result of his injury.

Amnesty International also met Firas, a four year old who was injured in his home near to Mount Nuqum on 11 May from a secondary explosion, and spoke to a relative who was with him at the hospital. Firas’ left hand and right leg had been injured by shrapnel. His mother, the relative told us, also had a fragmentation injury to her face.

쿠웨이트에서 1월 12일자로 시행되는 새로운 사이버범죄 관련법은 이미 표현의 자유를 엄격히 제한하고 있는 쿠웨이트의 현행 법망을 더욱 강화하게 될 것이며, 시급히 재검토가 이루어져야 할 것이라고 국제앰네스티가 11일 밝혔다.

이번에 시행되는 ‘전자범죄법’은 온라인상의 다양한 의견 표현을 범죄화하는 조항을 담고 있으며, 특히 정부와 종교적 인사, 해외 지도자들에 대한 비판을 대상으로 하고 있다. 쿠웨이트에서는 이미 트위터(Twitter)와 같은 소셜미디어를 통해 이러한 언급을 했다가 다른 법에 따라 체포 및 기소된 사람들이 수십 명에 이른다.

전자범죄법은 1970년에서 2006년 사이, 정부와 사법부 및 종교계 인사, 지역정부 대표자 등을 비판하는 것으로 해석될 수 있는 평화적인 표현을 모두 범죄화하면서 문제가 된 기존법의 모호한 조항을 그대로 답습하고 있다. 지금도 이미 쿠웨이트의 평화적인 표현의 자유를 제한하는 데 이러한 법이 적용되고 있다.

이번 전자범죄법이 시행되면 쿠웨이트 국민들은 인터넷상에 자신의 의견을 평화적으로 표현한 것만으로 최대 징역 10년형에 처해질 수 있다.

전자범죄법은 네트워크상 미승인 접속 시도, 위조 등을 통한 데이터 변조, 불법으로 수집한 정보 유포, 인터넷을 이용한 밀매 등 상황에 따라 범죄임을 쉽게 알 수 있는 행위를 주로 다루고 있으나, 이러한 행위에 평화적인 의견 표현을 포함시키는 실책을 범했다.

또한 범죄의 정의를 분명하고 정확하게 명시할 것을 요구하는 국제법과 상충됨은 물론, 각국 정부에 “인터넷 보안 문제 해결에 임할 때는 각국의 국제적 인권 의무에 따를 것”을 촉구하는 인터넷상 인권 증진, 보호, 향유에 관한 2014년 유엔 인권위원회 결의안에도 위배된다. 표현의 자유 보호 역시 결의안에서 요구하는 내용에 포함된다.

“전자범죄법은 21세기에 어울리지 않으며, 그 내용과 취지에 있어 구시대의 억압적인 법을 답습하는 시대착오적 법이다. 쿠웨이트 국민은 더 나은 대우를 받을 권리가 있다”

사이드 부메두하 부국장은 “쿠웨이트 정부는 이번 전자범죄법의 시행에 앞서 이 법이 쿠웨이트의 국제법상 인권 의무를 따르고 있는지 검토하기를 우선해야 한다”며 “전자범죄법은 21세기에 어울리지 않으며, 그 내용과 취지에 있어 구시대의 억압적인 법을 답습하는 시대착오적 법이다. 쿠웨이트 국민은 더 나은 대우를 받을 권리가 있다”고 말했다.

2015년 12월, 국제앰네스티는 쿠웨이트 정부에 육성과 서면, 전자적 수단 등을 막론하고 표현의 자유와 관련된 모든 법을 국제인권법과 국제인권기준에 따르도록 개정할 것을 촉구한 바 있다.

배경

국제앰네스티는 2015년 12월 발표한 보고서 <’철권 정책’: 쿠웨이트의 평화적 비판 범죄화>를 통해 쿠웨이트의 평화적인 표현의 자유에 관련하여 우려되는 점과 권고사항을 제시했다.

기자이자 양심수인 아야드 칼레드 알 하르비(26)는 쿠웨이트 국왕과 정부에 비판적인 것으로 해석되는 트윗을 작성한 것과, 유명 정부 비판가인 무살람 알 바락의 발언 및 아랍 지도자들을 비판하는 내용의 시 구절을 전파했다는 이유로 2014년 10월부터 교도소에 수감되어 있다.

블로거 하마드 알 나키 역시 트위터에 바레인과 사우디아라비아 지도자들을 비판하는 것으로 보이는 글과, 이슬람을 “모욕하는” 듯한 글을 남긴 혐의로 현재 징역 10년형을 복역 중인 양심수다.

인권옹호자이자 정치활동가이며 또 다른 양심수인 압둘라 파이루즈는 왕족이라고 해서 기소를 면해서는 안 된다는 트윗을 게재했다가 징역 5년형을 복역하고 있다.

2014년 7월 28일, 변호사 칼레드 알 샤티는 무장단체 자칭 ‘이슬람국가’에 가담한 사람들을 은연중 비난하는 트윗을 작성했다. 이에 12월 17일 경범죄법원은 이슬람교를 모욕했다는 혐의로 징역 1년에 처하고 형을 즉시 집행할 것을 명령했으나, 항소법원에서는 판결이 나올 때까지 형 집행을 중지하라고 지시했다. 칼레드 알 샤티의 징역형이 확정될 경우 양심수가 된다.

Kuwait: Electronic Crimes law threatens to further stifle freedom of expression

A new cybercrimes law, which is due to take effect on 12 January 2016, will add a further layer to the web of laws that already restrict the right of people in Kuwait to freedom of expression and must be urgently reviewed, said Amnesty International today.

The law includes criminalization of a range of online expression – in particular, criticism of the government, religious figureheads or foreign leaders. Dozens of people in Kuwait have already been arrested and prosecuted under other legislation for comments of this kind made on social media sites such as Twitter.

“This repressive law is the latest, flawed strand in a tangled web of legislation that is designed to stifle free speech,” said Said Boumedouha, Deputy Director of Amnesty International’s Middle East and North Africa programme.

“Like anyone else in the world, Kuwaitis have a right to peacefully express their opinion, including by criticizing their own or other governments online without fear of imprisonment.”

The law repeats vaguely worded provisions of flawed laws dating back to 1970 and 2006 which criminalize a range of peaceful expression that could be construed as criticism of government and judicial officials, religious figures or leaders of regional governments. These laws have already been used to restrict peaceful expression in Kuwait.

With the introduction of this new law, people in Kuwait will face up to 10 years’ imprisonment for peacefully expressing their opinions over the internet.

The law addresses actions which, depending on circumstances, could be recognizably criminal acts; such as unauthorized access to an electronic network, the alteration of data, such as by way of forgery, the dissemination of unlawfully accessed information and the use of the internet for trafficking. However, the law mistakenly conflates this type of activity with peaceful expression.

The new legislation also conflicts with international law, which requires the definition of crimes to be clear and precise. It flies in the face of the UN Human Rights Council’s 2014 resolution on the promotion, protection and enjoyment of human rights on the Internet, which called upon states to ensure that they “address security concerns on the Internet in accordance with their international human rights obligations”, including the protection of freedom of expression.

“The Kuwaiti authorities must not apply this law until they have reviewed its compatibility with Kuwait’s international human rights obligations,” said Said Boumedouha.

“This law does not belong to the 21st century. In spirit and indeed, in letter, it is a retrograde piece of legislation that merely draws upon earlier, repressive laws. Kuwaitis deserve better.”

In December 2015, Amnesty International urged the government to revise all laws relating to freedom of expression, whether in speech, print or by electronic means, and to bring them in line with international human rights law and standards.

Background

Amnesty International set out its concerns and recommendations relating to freedom of peaceful expression in Kuwait in its December 2015 report, The iron fist policy: Criminalization of peaceful dissent in Kuwait.

Journalist and prisoner of conscience Ayad Khaled al-Harbi, 26, has been in prison since October 2014 in connection with, among other things, tweets deemed critical of Kuwait’s Amir and government and echoing the words of prominent government critic, Musallam al-Barrak, as well as verses of poetry criticizing Arab rulers.

Blogger Hamad al-Naqi is currently serving a 10-year prison term for posting comments on Twitter that were considered critical of the leaders of Bahrain and Saudi Arabia and other messages deemed “insulting” to Islam. He is a prisoner of conscience.

Prisoner of conscience, Abdullah Fairouz, a human rights defender and political activist, is serving a five-year jail term because he posted tweets saying that those who lived in royal palaces should not be immune from prosecution.

On 28 July 2014, lawyer Khaled al-Shatti tweeted a thinly veiled condemnation of members of the armed group calling itself Islamic State. He was sentenced to one year in prison with immediate implementation by a Misdemeanours Court on 17 December for insult to religion. However the Appeals Court halted the implementation of this sentence until it issued its verdict. If Khaled al-Shatti is jailed, he will be a prisoner conscience.

올해 들어 지금까지 사우디아라비아에서 최소 151명 이상이 처형되며 1995년 이후 가장 높은 사형집행 건수를 기록한 것은 사우디아라비아 정부의 사형제도 사용에 암울한 기록을 남긴 전례 없는 움직임이라고 국제앰네스티가 밝혔다.

제임스 린치(James Lynch) 국제앰네스티 중동 북아프리카 부국장은 “사우디아라비아 정부는 올해 들어 지금까지 평균 이틀에 한 명꼴로, 최소 151명의 목숨을 빼앗은 잔혹한 사형집행을 의도적으로 계속해서 남발하는 것으로 보인다”고 말했다. 사우디아라비아의 연간 사형집행 건수는 최근 몇 년 동안 한 해 90건을 넘기는 일이 거의 없었다. 가장 최근에 사형이 집행된 것은 11월 9일이다.

올해 처형된 151명 중 거의 절반에 가까운 사람들이 국제인권법상 사형이 부과될 수 있는 “매우 중대한 범죄”라는 조건에 해당하지 않는 범죄로 사형이 집행됐다. 매우 엄격한 안전조치 하에 사형을 적용하고 있다는 정부의 주장과는 명백히 상반되는 것이다.

올해 마약 관련 범죄로 처형된 63명 중에는 외국인이 45명으로 대다수를 차지했다. 올해 들어 지금까지 처형된 외국인의 수는 총 71명이다. 사우디아라비아에서는 외국인에게 사형이 부과되는 경우가 월등히 더 많다. 이러한 외국인들은 주로 개발도상국 출신의 이주노동자로, 보통 아랍어를 잘하지 못하고 재판 과정에서 적절한 통역이 이루어지지 않기 때문에 특히 취약하다.

제임스 린치 부국장은 “사형을 부과하는 것은 어떤 경우에라도 끔찍하지만, 사우디아라비아 정부가 국제인권법과 국제인권기준을 위반하면서도 이처럼 광범위하게, 매우 불공정한 재판을 거쳐, 때로는 정치적인 이유로 계속해서 사형을 부과하고 있다는 것은 특히 더욱 충격적인 일”이라고 말했다.

급증하는 사형집행 건수가 더욱 우려되는 것은 반정부 성향인 사우디아라비아의 시아파 이슬람교도들을 탄압하기 위해 명백한 정치적 도구로 사형제도가 이용되고 있다는 점 때문이다.

지난달 사우디 대법원은 동부 출신의 유명 시아파 이슬람 사제인 셰이크 님르 바키르 알 님르(Sheikh Nimr Baqir al-Nimr)에 대해 사형 선고를 확정했다. 사우디아라비아의 악명 높은 특수형사법원에서 정치적이고 매우 불공정한 재판을 거쳐 선고된 것이었다.

이에 앞서 셰이크 알 님르의 조카인 알리 모하메드 바키르 알 님르(Ali Mohammed Baqir al-Nimr)와 시아파 청년활동가인 다우드 후세인 알 마르훈(Dawood Hussein al-Marhoon), 압둘라 하산 알 자헤르(Abdullah Hasan al-Zaher) 역시 반정부시위에 참여했다가 미성년자임에도 체포된 후, 마찬가지로 사형 선고가 확정되었다. 최근 세 명 모두 독방으로 이감되면서, 사형집행이 임박한 것이 아니냐는 우려가 더욱 커지고 있다.

사우디아라비아는 18세 이하의 미성년자에게도 사형을 부과하고 집행하기를 계속하고 있다. 이는 국제관습법과 유엔 아동권리협약에 따른 사우디아라비아의 의무를 위반하는 것이다.

제임스 린치 부국장은 “미성년자 피고인에게 사형을 부과하는 것은 심각한 국제인권법 위반이다. 사우디아라비아 정부가 사형집행을 정치적 반대세력에 대해 처벌과 박해의 도구로 사용하고 있는 것은 충격적인 권력 남용”이라며 “정부는 사형을 집행하겠다며 사람들을 위협하기보다는 현재 임박한 사형집행을 모두 중단하고 즉시 사형집행 유예를 선언해야 함은 물론 심각한 결함이 있는 사우디아라비아의 사법제도를 재점검해야 한다”고 말했다.

Saudi Arabia: 151 executed this year in highest recorded toll in nearly two decades

At least 151 people have been put to death in Saudi Arabia so far this year –the highest recorded figure since 1995 – in an unprecedented wave of executions marking a grim new milestone in the Saudi Arabian authorities’ use of the death penalty, said Amnesty International.

So far in 2015, on average, one person has been executed every other day. Annual execution tolls for Saudi Arabia in recent years have rarely exceeded 90 for the entire year. The latest execution took place on 9 November.

“The Saudi Arabian authorities appear intent on continuing a bloody execution spree which has seen at least 151 people put to death so far this year – an average of one person every two days,” said James Lynch, Deputy Director at Amnesty International’s Middle East and North Africa Programme.

According to Amnesty International’s records, the last time Saudi Arabia executed more than 150 people in a single year was in 1995, when 192 executions were recorded. In 2014 the total number of executions carried out was 90 – meaning that so far there has been a 68% increase in executions over the whole of last year.

Death sentences in Saudi Arabia are frequently imposed for non-lethal offences, such as drug-related ones, and after unfair trials which lack basic safeguards for fair trial provided for under international human rights law and standards. This was documented in Amnesty International’s August 2015 report Killing in the Name of Justice: The death penalty in Saudi Arabia .

Almost half of the 151 executions carried out this year were for offences that do not meet the threshold of “most serious crimes” for which the death penalty can be imposed under international human rights law. This blatantly contradicts the Saudi Arabian authorities’ claims to apply the death penalty with the strictest safeguards in place. Under international human rights standards “most serious crimes” are crimes that involve intentional killing.

Of the 63 people executed this year for drug-related charges, the vast majority, 45 people, were foreign nationals. The total number of foreign nationals executed so far this year is 71. The death penalty is disproportionately used against foreigners in Saudi Arabia. Foreign nationals, mostly migrant workers from developing countries, are particularly vulnerable as they typically lack knowledge of Arabic and are denied adequate translation during their trials.

“The use of the death penalty is abhorrent in any circumstance but it is especially alarming that the Saudi Arabian authorities continue to use it in violation of international human rights law and standards, on such a wide scale, and after trials which are grossly unfair and sometimes politically motivated,” said James Lynch.

Concerns over the increase in executions have been further compounded by the apparent use of the death penalty as a political tool to clamp down on Saudi Arabian Shi’a Muslim dissidents.

Last month the Supreme Court upheld the death sentence of Sheikh Nimr Baqir al-Nimr, a prominent Shi’a Muslim cleric from the Kingdom’s Eastern Province, after a politicized and grossly unfair trial at Saudi Arabia’s notorious counter-terror court (the Specialized Criminal Court).

This followed news that Sheikh al-Nimr’s nephew Ali Mohammed Baqir al-Nimr, and two other young Shi’a activists, Dawood Hussein al-Marhoon and Abdullah Hasan al-Zaher, who were arrested as juveniles after participating in anti-government rallies, also had their death sentences upheld. All three have said they were tortured and denied access to a lawyer during their trials. The three young men have recently been transferred to solitary confinement heightening fears that their executions could be imminent.

Saudi Arabia also continues to impose death sentences on and execute people below 18 years of age, in violation of the country’s obligations under international customary law and the Convention on the Rights of the Child.

“Using the death penalty against juvenile offenders is an egregious violation of international human rights law. The use of the threat of executions as a tool to punish and intimidate political dissidents by the Saudi Arabian authorities is an appalling abuse of power,”said James Lynch.

“Instead of intimidating people with the threat of state sanctioned killing, the Saudi Arabian authorities should halt all impending executions and urgently establish a moratorium on executions as well as overhaul the Kingdom’s deeply flawed justice system.”

2015년 동남아시아 ‘보트 난민 위기’에서 살아남은 수백여 명의 사람들이 지금까지도 열악한 환경 속에 구금되어 있다. 국제앰네스티는 참사 1주기를 맞아 생존자들의 처우를 조사하고자 말레이시아를 방문했다.

지난해 5월 절박한 난민과 이주민들이 바다에서 표류하고 있는 참담한 모습이 전세계에 공개되면서 말레이시아는 난민 1,100명을 받아들이는 데 동의했다. 이 중 약 400명은 미얀마에서 박해를 피해 나온 로힝야족 난민이었다. 그로부터 1년이 지났지만, 로힝야족 난민 상당수는 지금도 말레이시아의 벨란티크 수용소에 구금되어 있다.

카이루니사 달라(Khairunissa Dhala) 국제앰네스티 난민 전문가는 “보트 참사 생존자들의 처우를 조사하고자 말레이시아를 방문했고, 여전히 수백 명은 고통과 인권침해에 시달리고 있는 것을 확인했다. 박해를 피해 미얀마를 떠난 남녀와 어린이들은 해로를 장악하고 있는 파렴치한 범죄조직이 바다에 버리는 공포를 경험했다. 말레이시아는 이들의 안식처가 되기는커녕, 기약도 없이 수용소에 갇혀 1년을 보냈다”고 말했다.

말레이시아에 도착한 난민 보트에는 로힝야족 난민 외에도 방글라데시 난민 700여명이 타고 있었고, 이들 중 많은 수가 인신매매의 피해자가 되었을 것으로 추정된다.

국제앰네스티는 보트 위기에 대해 조사한 2015년 보고서에서 인도네시아에 상륙한 방글라데시 난민 생존자 수백 명이 인신매매 대상이 되었을 것으로 추정했다.

인도네시아와 말레이시아에 상륙한 방글라데시 난민은 이후 거의 전원이 강제 송환됐다.

그러나 말레이시아 소식통이 국제앰네스티에 전한 바에 따르면, 방글라데시 난민 중 65명은 여전히 말레이시아에 남아 있고 다른 난민들과 마찬가지로 벨란티크 수용소에 구금되어 있다고 했다.

보트 참사를 일으킨 책임이 있는 범죄조직들은 지금까지 누구도 재판에 회부되지 않았다. 동남아시아 국가 정부가 대대적인 밀수와 인신매매 단속에 나설 것이라 여긴 선원들은 남녀노소 난민들로 가득 들어찬 보트 대부분을 해상에 버리고 떠났다.

카이루니사 달라는 “말레이시아 정부는 인신매매의 피해자가 될 위험이 가장 높은 난민과 이주민을 범죄자로 몰아 처벌하기를 중단하고, 책임자를 처벌하기 위해 독립적이고 공정한 조사를 해야 한다”고 말했다.

국제앰네스티는 말레이시아 정부에 수용소의 모든 난민과 이주민을 즉시 석방하고, 국제적 협력을 통해 난민들이 국제법에 명시된 보호조치를 받을 수 있도록 할 것을 촉구한다.

배경
2015년 안다만 해에서 위험에 처한 수천명의 난민을 실은 보트 수십 척이 해상에 버려진 채 방치됐다. 태국, 말레이시아, 인도네시아 정부는 이들 난민의 자국 상륙을 거부했고, 이로 인해 ‘보트 난민 위기’가 전세계적인 주목을 끌었다. 말레이시아와 인도네시아는 결국 난민과 이주민 2,900명 이상을 태운 보트 총 3척을 받아들이고, 1년의 기한을 정해 국제사회에 재정착하거나 송환되기 전까지 임시 정착지를 제공하기로 합의했다. 지금까지 말레이시아에 수용된 로힝야족 난민 50여명이 제3국에 재정착할 대상으로 지정됐다.

국제앰네스티는 수개월 내로 보트 참사와 인신매매 피해 생존자들의 상황을 더욱 자세히 공개할 예정이다.

Malaysia: One year on, no justice for the ‘boat crisis’ survivors

Hundreds of refugees who survived the 2015 boat crisis in South East Asia have been locked up in poor conditions in Malaysia ever since, Amnesty International said, following a visit to the country to investigate the fate of people one year on.

After harrowing footage of desperate refugees and migrants stranded at sea was beamed around the world last May, Malaysia agreed to accept 1,100 people. Almost 400 of those were identified as Rohingya refugees – people fleeing persecution in Myanmar. One year on, the majority of the Rohingya remain in Malaysia’s Belantik detention centre.

“We went to Malaysia to investigate the fate of the boat crisis survivors and found that, for hundreds of them, the suffering and human rights abuse continue,” said Khairunissa Dhala, a refugee expert at Amnesty International.

“Women, men and children fled from persecution in Myanmar, only to undergo the horror of being abandoned at sea by the unscrupulous gangs who run the sea routes. Malaysia should have been their place of safety – but instead they have spent a year in detention, with no end in sight.”

In addition to Rohingya refugees, the boats that arrived in Malaysia were carrying some 700 people from Bangladesh, many likely to have been victims of human trafficking.

In a 2015 investigation into the boat crisis Amnesty International found that hundreds of Bangladeshi survivors who reached Indonesia had likely been trafficked.

Almost all of those from Bangladesh in both Indonesia and Malaysia have since been repatriated.

However sources in Malaysia told Amnesty International that 65 people from Bangladesh remain in Malaysia, and are also detained at Belantik.

The criminal gangs responsible for the boat crisis have not been brought to justice. Most of the boats, crammed with men, women and children, were abandoned by their crews, apparently because they believed the South East Asian authorities were about to take action to combat people smuggling and trafficking.

“The Malaysian government must stop criminalising and punishing refugees and migrants – who are most likely victims of trafficking – and carry out independent and impartial investigations to hold perpetrators to account,” said Khairunissa Dhala.

Amnesty International is calling on the Malaysian authorities to immediately release the refugees and migrants, and work with international partners to ensure they are given the protection they are entitled to under international law.

Background

The 2015 Andaman Sea ‘boat crisis’ claimed global attention when dozens of boats carrying thousands of desperate people were abandoned at sea and the governments of Thailand, Malaysia and Indonesia refused to allow them to disembark. Malaysia and Indonesia eventually accepted a total of three boats carrying more than 2,900 refugees and migrants. They agreed to provide temporary shelter to the group for a one-year timeframe provided that they would be resettled or repatriated by the international community within that period. To date, approximately 50 Rohingya refugees from the group in Malaysia were put forward for resettlement to a third country.
Amnesty International will publish further details on the situation of survivors of the boat crisis and human trafficking in the coming months.

시리아 북부 지역에서 쿠르드계 정치세력인 민주동맹당(Partiya Yekîtiya Demokrat, PYD, 이하 PYD)이 주도하는 자치정부에 의해 전쟁범죄에 이르는 수준의 강제이주와 건물 파괴가 이루어졌다는 사실이 현장 조사 결과 드러났다고 국제앰네스티가 13일 발표한 보고서를 통해 밝혔다. 이곳 자치정부는 무장단체 자칭 이슬람국가(IS, 이하 IS)를 격퇴하기 위해 미국이 주도하는 연합세력의 중요한 구성원이다.

<’더 이상 갈 곳이 없다’: 북부 시리아의 파괴와 강제이주> 보고서에서 목격자 증언과 위성사진 등 충격적인 인권침해의 증거를 공개하고 있다. PYD 자치정부는 주로 주민들이 IS와 같은 무장단체 단원들에게 동정심을 보였거나 관련이 있다는 이유를 들어, 세력권 하에 위치한 마을 주민 수천 명을 강제로 이주시키고 마을을 완전히 파괴했다.

일부 주민들은 마을을 떠나지 않을 경우 미국이 주도하는 연합군의 공습이 있을 것이라며 위협을 받았다고 전했다.

국제앰네스티 조사단은 2015년 7월과 8월 알 하사케흐와 알 라카의 14개 마을을 방문해, 자치정부 점령지였던 이곳에서 벌어진 강제이주와 주택 파괴에 대해 조사했다.

국제앰네스티가 입수한 위성사진을 보면 농촌 지역인 텔 하메스(Tel Hamees)의 후세이니야(Husseiniya) 마을에서 벌어진 주택 파괴의 규모가 상세히 드러나 있다. 2014년 6월 촬영된 사진에는 225채의 건물이 들어서 있으나 2015년 6월에는 14채밖에 남아있지 않다. 건물의 93.8%가 사라진 충격적인 결과다.

2015년 2월, 자치정부의 군사조직인 인민수비대(YPG, 이하 YPG)는 이전 IS 점령지였던 후세이니야 마을을 재점령한 후 건물 파괴와 주민 강제 이주를 자행하기 시작했다. 이곳을 방문한 조사단은 파괴된 건물의 잔해를 볼 수 있었고, 당시 목격자들과 인터뷰를 나눴다.

한 목격자는 “군인들이 집에서 우리를 끌어내더니 집을 불태우기 시작했습니다… 마을에 불도저를 끌고 와서는 마을 전체가 없어질 때까지 집을 하나하나 철거했습니다”라고 했다.

술룩(Suluk) 남부 지역 마을에는 YPG 군인들에게 IS 지지자로 몰려, 마을을 떠나지 않으면 사살하겠다고 위협을 당했다는 주민들도 있었다. 일부의 경우 마을에 IS 지지자가 소수 있었던 것은 사실이었다고 주민들도 인정한 경우도 있었지만, 대다수는 IS를 지지하지 않는 사람들이었다.

또한 YPG 군인들은 주민들이 명령에 따르지 않을 경우 미국 연합군의 공습을 받을 것이라고 위협하기도 했다.

마을 주민 사프완은 “군인들은 우리가 마을을 떠나지 않으면 미국 연합군에 테러리스트라고 보고할 것이며, 전투기가 우리 가족을 공격할 것이라고 했습니다”라고 했다.

YPG는 주민들의 안전을 위해서라며, 또는 군사적 필요를 주장하며 강제이주를 정당화했다.

라마 파키흐 상임고문은 “중대한 문제입니다. 시리아에서 IS와 맞서고 있는 미국이 주도하는 연합군을 비롯해, PYD 자치정부를 지지하거나 군사적으로 협력하는 모든 국가는 이러한 인권침해에 대해 모른 척하지 않아야 합니다. 공개적으로 강제이주와 불법 파괴를 규탄하는 입장을 취하고, 자국의 군사적 협력이 국제인도법 위반행위에 기여하지 않도록 해야 할 것”이라고 말했다.

잔혹성을 보여준 특정 사례에서는 YPG 군인들은 사람들이 아직 집을 떠나지 않은 상태에서도 기름을 퍼부은 뒤 불을 붙이겠다고 위협하기도 했다.

당시 피해자였던 바사마는 “군인들이 처가에 기름을 붓기 시작했습니다. 장모가 집을 떠나기를 거부하며 아직 안에 있었지만 아랑곳 않고 그 주변으로 기름을 부어댔고… 장인을 보고는 마구 때리기 시작했습니다. 나는 군인들에게 ‘우리 집을 불태워도 텐트를 치고 살 것이다. 여기는 우리 집이다. 우리 집에 남겠다’고 했습니다”라고 전했다.

이처럼 부당하게 피해를 입은 주민들의 대부분이 아랍족과 투르크만족이었지만, 술룩과 같이 다양한 인종이 모인 지역의 경우 쿠르드족 주민들 역시 자치정부의 자경단인 아사이시(Asayish)와 YPG에 가로막혀 집으로 돌아가지 못하고 있다. 이외에 압디 코이(Abdi Koy) 마을에서도 소수의 쿠르드족 주민들이 YPG에 의해 강제로 이주해야 했다.

아사이시 마을의 대표는 국제앰네스티와의 인터뷰를 통해, 주민들이 이렇게 강제로 이주당한 것이 다른 마을과 ‘별개의 일’이 아님을 인정했다. YPG 대변인은 주민들의 안전을 위해 대피시킨 것이라는 주장을 반복했다.

그러나 주민들 중 대부분은 전투 발발 지역이 아니고, 전선에서도 멀리 떨어져 있어 IS가 설치한 급조폭발물(IED)의 피해를 입을 위험이 전혀 없음에도 강제로 마을을 떠나야 했다고 말했다. 중대한 군사적 필요 없이 민간인을 강제로 이주시키는 것은 국제인도법 위반이다.

라마 파키흐 상임고문은 “PYD 자치정부는 불법적인 민가 파괴를 즉시 중단하고, 부당하게 집을 잃은 모든 민간인들에게 보상을 지급해야 한다. 또한 불법 강제이주를 중단하고, 주민들이 마을로 돌아와 재건할 수 있도록 허가해야 한다”고 말했다.

Syria: US ally’s razing of villages amounts to war crimes

A fact-finding mission to northern Syria has uncovered a wave of forced displacement and home demolitions amounting to war crimes carried out by the Autonomous Administration led by the Syrian Kurdish political party Partiya Yekitiya Demokrat (PYD) controlling the area, said Amnesty International in a report published today. The Autonomous Administration is a key ally, on the ground, of the US-led coalition fighting against the armed group calling itself the Islamic State (IS) in Syria.

‘We had nowhere else to go’: Forced displacement and demolitions in northern Syriahttps://www.amnesty.org/en/documents/mde24/2503/2015/en/ reveals evidence of alarming abuses, including eyewitness accounts and satellite images, detailing the deliberate displacement of thousands of civilians and the razing of entire villages in areas under the control of the Autonomous Administration, often in retaliation for residents’ perceived sympathies with, or ties to, members of IS or other armed groups.

“By deliberately demolishing civilian homes, in some cases razing and burning entire villages, displacing their inhabitants with no justifiable military grounds, the Autonomous Administration is abusing its authority and brazenly flouting international humanitarian law, in attacks that amount to war crimes,” said Lama Fakih, Senior Crisis Advisor at Amnesty International.

“In its fight against IS, the Autonomous Administration appears to be trampling all over the rights of civilians who are caught in the middle. We saw extensive displacement and destruction that did not occur as a result of fighting. This report uncovers clear evidence of a deliberate, co-ordinated campaign of collective punishment of civilians in villages previously captured by IS, or where a small minority were suspected of supporting the group.”

Some civilians said they were threatened with US-led coalition airstrikes if they failed to leave.

Amnesty International researchers visited 14 towns and villages in al- Hasakeh and al-Raqqa governorates in July and August 2015, to investigate the forced displacement of residents and demolition of homes in areas under the control of the Autonomous Administration.

Satellite images obtained by Amnesty International illustrate the scale of the demolitions in Husseiniya village, in Tel Hamees countryside. The images show 225 buildings standing in June 2014 but only 14 remaining in June 2015 – a shocking reduction of 93.8%.

In February 2015, the Autonomous Administration’s military wing, the YPG (the People’s Protection Units), took control of the area, which had been under IS control, and began demolitions, displacing villagers. Researchers visiting Husseiniya saw ruins of destroyed homes and interviewed eyewitnesses.

“They pulled us out of our homes and began burning the home… they brought the bulldozers… They demolished home after home until the entire village was destroyed,” said one witness.

In villages south of the town of Suluk, some residents said YPG fighters had accused them of supporting IS and threatened to shoot them if they did not leave. While in some cases residents acknowledged that there had been a handful of IS supporters in their villages the majority were not supporters of the group.

In other cases, villagers said YPG fighters had ordered them to leave threatening them with US coalition airstrikes if they failed to comply.

“They told us we had to leave or they would tell the US coalition that we were terrorists and their planes would hit us and our families,” said one resident, Safwan.

The YPG has justified the forced displacement of civilians by saying it was necessary for the civilians’ own protection or militarily necessary.

“It is critical that the US-led coalition fighting IS in Syria and all other states supporting the Autonomous Administration, or co-ordinating with it militarily, do not turn a blind eye to such abuses. They must take a public stand condemning forced displacement and unlawful demolitions and ensure their military assistance is not contributing to violations of international humanitarian law,” said Lama Fakih.

In one particularly vicious attack, YPG fighters poured petrol on a house, threatening to set it alight while the inhabitants were still inside.

“They started pouring fuel in my in-laws’ house. My mother-in-law was there refusing to leave and they just poured it around her…They found my father-in-law and began hitting him on his hands… I said, ‘Even if you burn my house I will get a tent and pitch it.This is in my place. I will stay in my place,” said Bassma.

Although the majority of residents affected by these unlawful practices are Arabs and Turkmen, in some cases, for example in the mixed town of Suluk, Kurdish residents have also been barred by the YPG and Asayish, the Autonomous Administration’s police force, from returning to their homes. Elsewhere, for example in Abdi Koy village, a small number of Kurdish residents have also been forcibly displaced by the YPG.

In an interview with Amnesty International, the head of the Asayish admitted civilians had been forcibly displaced but dismissed these as “isolated incidents”. The spokesperson for the YPG repeated claims that civilians were being moved for their own security.

However, many residents said they were forced to leave even though their villages had not been the site of clashes, or were at a distance from the frontline and there was no danger from improvised explosive devices (IEDs) laid by IS. Forcibly displacing civilians without imperative military necessity is a violation of international humanitarian law.

“The Autonomous Administration must immediately stop the unlawful demolition of civilian homes, compensate all civilians whose homes were unlawfully destroyed, cease unlawful forced displacements, and allow civilians to return and rebuild,” said Lama Fakih.

부르키나파소는 강제결혼과 조혼, 원치 않는 임신, 성교육 부재로 수만 명의 여성들이 2등시민으로 전락하고 있는 국가적 위기를 시급히 해결해야 할 것이라고 국제앰네스티가 15일 밝혔다.

국제앰네스티는 이날 부르키나파소에서 <My Body My Rights> 캠페인을 시작하고, 오는 2015년 10월 11일 치러질 국회의원 총선거 및 대통령 선거 출마자를 대상으로 강제결혼과 조혼에 대해 더욱 강경한 입장을 취할 것과, 여성들이 피임 및 성과 재생산건강 관련 정보, 서비스를 더욱 쉽게 접할 수 있도록 할 것을 촉구하는 내용의 인권선언을 발표했다.

알리오네 티네(Alioune Tine) 국제앰네스티 서-중앙아프리카 지역국장은 “오늘날 부르키나파소에서 자라나는 소녀들은 살아가면서 꿈과 희망을 마음껏 펼치지 못하게 가로막는 수많은 장벽과 마주하고 있다. 가족에 의해 강제로 결혼해야 하거나, 피임을 할 수 있어도 배우자가 거부하거나 허락하지 않을 수도 있다”며 “부르키나파소 정부는 너무나 오랫동안 여성인권 문제를 등한시해 왔다. 이러한 문제점을 해결하고 여성들의 장벽을 허무는 것이 후보자들의 중심 공약이 되어야 할 것”이라고 말했다.

양성평등은 부르키나파소의 헌법과 국내법에도 명시되어 있지만, 실제로는 여성들의 음부 절제, 강제결혼, 조혼, 가정폭력이 만연히 이루어지고 있다. 국제앰네스티와 인터뷰를 나눈 여성들은 임신과 결혼에 대한 의사결정이 주로 남성 가족 구성원의 몫이라고 전했다. 그 결과, 부르키나파소 여성 중 불과 17%만이 피임법을 사용하며 매년 2,000명 이상의 산모가 출산 중 사망하고 있다.

성-재생산건강과 피임법 접근을 가로막는 장벽

남성들이 아내에게 폭력으로 위협하며 피임을 하지 못하게 하는 경우가 매우 흔하게 나타나고 있다. 23세의 과일 상인이자 세 아이의 어머니인 테레즈는 국제앰네스티에 이렇게 전했다.

“둘째 아이를 낳은 뒤로 몰래 피임약을 먹고 있어요. 다른 피임법에 비해 싸게 구할 수 있거든요. 남편은 피임에 대해서 전혀 몰라요. 피임을 하면 병에 걸린다고 생각해서, 피임 때문에 병이 나면 저를 가둬버리겠다고 위협하고 있어요.”

여성들이 피임을 하지 못하는 이유로는 높은 가격과 보편적인 성교육을 받지 못한다는 점도 있다. 세 아이의 엄마인 24세의 마리아마는 성교육을 받지 못한 것이 원치 않는 임신으로 이어지게 되었다고 말했다.

“성관계를 갖고 처음 임신을 했을 때, 저는 성관계를 하면 임신이 될 수도 있다는 사실을 몰랐어요. 피임에 대해서도 전혀 몰랐고요. 그래서 첫 아이를 낳은 뒤 다시 임신하게 됐죠. 아무런 피임법도 사용하지 않았어요. 아직도 어떻게 하는 건지 모르겠어요.”

충격적인 강제 조혼 비율

향후 부르키나파소에 새롭게 수립될 정부는 딸을 본인의 동의 없이 결혼시키는 가족에게는 제재를 부과하는 등의 방법을 통해 법적으로 강제 조혼을 금지할 수 있도록 현행법을 검토해, 충격적인 수준의 조혼률에 대처해야 할 것이라고 국제앰네스티가 밝혔다.

부르키나파소의 조혼률은 아프리카 국가 중 6번째로 높은 수준으로, 18세 소녀 중 52%가 기혼이며, 그 중 반 이상이 이미 자녀가 있다.

말라이카는 부모가 강요하는 결혼을 하지 않으려 집에서 도망쳐 나왔다. 그녀를 데려간 경찰은 부모님께 다시 돌려 보냈다고 한다.

“제가 열다섯 살 때 부모님은 75세 노인과 절 결혼시키려 했어요. 아버지보다도 나이가 많은 데다 이미 부인이 셋이나 있었고 제 나이 또래의 딸들도 있는 사람이었죠. 그 할아버지를 소개받기로 한 날, 저는 부모님께 이 결혼을 원하지 않고 마저 공부를 하고 싶다고 했지만 부모님은 제가 이 사람과 결혼해야 하고, 저는 아무 선택권이 없다고 했어요.”

알리오네 티네 국장은 “국제앰네스티는 모든 국회의원 및 대통령 후보자들에게 국제앰네스티의 인권선언문에 서명할 것과, 여성들이 자신의 신체와 성재생산권에 대한 기본적인 선택을 스스로 할 수 있도록 의미 있는 변화를 만들겠다고 약속할 것을 촉구한다”며 “앞으로 부르키나파소를 이끌고자 하는 사람은 누구든 이와 같은 어린 소녀들에 대한 차별을 철폐해야 한다. 유년기는 단절되고, 여성들은 자신의 삶과 신체에 관한 결정권조차 빼앗겼다. 오늘날의 부르키나파소 여성들은 자신의 결혼 상대와 시기, 임신 시기와 횟수도 항상 자유롭게 결정하지 못한다. 이는 바뀌어야 한다”고 말했다.

Burkina Faso: Elections cannot ignore women’s crisis

Burkina Faso must urgently tackle the nationwide crisis where forced and early marriage, unwanted pregnancy and lacking sex education reduce hundreds of thousands of girls and women to second class citizens, said Amnesty International today.

Amnesty International is today launching the My Body My Rights campaign in Burkina Faso, with a human rights manifesto calling on presidential and legislative candidates in the 11 October 2015 elections to commit to a tougher stance on forced and early marriage, and to making it easier for women and girls to access contraception and sexual and reproductive health information and services.

“A young girl growing up in Burkina Faso today faces many barriers preventing her from fulfilling her own hopes and dreams for her life. She could be married off by her family and even if she can afford contraception, her partner may refuse to use it or not allow her to use it,” said Alioune Tine, Amnesty International regional director for West and Central Africa.

“For too long, the Burkinabé authorities have neglected the rights of women and girls. Redressing this wrong and lifting the barriers faced by women and girls must be a central aim of any election candidate’s campaign.”

While gender equality is protected under Burkina Faso’s constitution and law, in practice, female genital mutilation, forced and early marriage and domestic violence are widespread. Women and girls told Amnesty International that decisions about pregnancy and marriage are often taken by male family members. As a result, only 17% of women in Burkina Faso use contraception and more than 2,000 women die in childbirth every year.

Several barriers to sexual and reproductive health and access to contraception

It is very common for men to prevent their wives from using contraception with threats of violence. Therese, a 23 year-old fruit seller and mother of three told Amnesty International:

“Since I gave birth to a second child, I hide to take my contraceptive pills, which are also cheaper for me than other methods. My husband does not know about contraception. He thinks that it brings diseases and he threatens to lock me up if I fall ill because of it.”

Other barriers women face in accessing contraception include high costs and a lack of access to comprehensive sex education. Mariama, a 24 year-old mother of three, told Amnesty International how lack of education can lead to unwanted pregnancy:

“When I had sex and got pregnant for the first time, I didn’t know that I could get pregnant after having sex. I didn’t know anything about contraception. After my first child was born, I got pregnant again. I did not use any method of contraception because I still didn’t know what to do.”

Alarming rates of forced and early marriage

Burkina Faso’s next government will have to respond to alarming rates of early marriage by reviewing national legislation to ensure that laws prohibiting early marriage are enforced, including through sanctioning families who marry girls without their consent, Amnesty International said.

Burkina Faso has the sixth highest rate of early marriage in Africa, with 52% of girls married by the age of 18 and nearly half already mothers at that age.

Malaika ran away from home to avoid being married off by her parents. When she was picked up by the police they told her to go back to her mum and dad, she told Amnesty International:

“I was 15 when my parents wanted me to marry an old man of 75. He is older than my father and already has three wives and daughters of my age. The day that I had to be introduced to the old man I told my parents that I did not agree with their choice and that I wanted to finish my education. They told me that I had to marry the man they had chosen and that I had no choice but to accept.”

“Amnesty International is calling on all legislative and presidential candidates to sign its human rights manifesto and commit to making the meaningful changes that will enable women and girls to make fundamental decisions about their bodies and their sexual and reproductive rights,” said Alioune Tine.

“Whoever wants to lead the country in future must end this discrimination against young people. Childhood is cut short, and women and girls are robbed of their right to make decisions about their lives and their bodies. Today in Burkina Faso women and girls are not always free to choose when they marry, and who; when they have children and how many – this has to change.”

My Body My Rights

My Body My Rights is Amnesty International’s global campaign against government efforts to control women and girls. The campaign is already running in El Salvador and Ireland.

The campaign in Burkina Faso will seek to raise awareness about barriers facing women and girls through advertisements, concerts and other activities, with Amnesty International supporters handing out free condoms to highlight the need for greater access to contraception.
