예멘의 수도 사나에서 후티 반군이 사용하는 대공무기가 인구 밀집 지역에 떨어진 후 폭발해 민간인들이 목숨을 잃거나 불구가 되는 등 수백여 명의 사상자가 발생했다고 국제앰네스티가 밝혔다.

사나로 가는 일주일간의 여정 중 국제앰네스티가 만난 9개 병원의 의료진과 주민들은 사나 지역의 사상자가 주로 대공포화로 인해 발생하고 있다고 전했다. 사우디아라비아가 주도하는 연합군 역시 주거지역에 위치한 무기고에 공습을 가해 추가로 폭발을 일으키면서, 더욱 많은 민간인 사상자를 발생시키고 있다.

라마 파키흐(Lama Fakih) 국제앰네스티 위기대응 상임고문은 “사나 주민들은 사우디 주도 연합군의 공습과 후티 반군의 대공포화라는 치명적인 십자포화 속에 갇혀 있다. 양측 모두 필수적인 민간인 보호 대책을 취하지 않으며 전쟁법을 위반했고, 그 대신 공격을 가해 참혹한 민간인 피해를 낳았다”며 “피해 주민들에게 책임 소재 여부는 중요하지 않다. 어느 쪽이든 똑 같은 희생을 치르고 있다”고 말했다.

대공포화

사나에서 가장 큰 국립병원인 알 차우라 병원의 한 의사는 전쟁 부상자 중 약 90%에 가까운 대다수가 대공포에 부상을 입고 병원에 실려 온 것이었다고 국제앰네스티에 전했다. 지난 주 5일간의 휴전이 이루어지기 전만 해도 이렇게 부상을 입은 환자들이 매일 약 17~23명씩 이송되었다고도 했다. 이 병원에서 근무하는 또 다른 의사 역시, 분쟁이 일어나고 첫 한 달 동안 이곳에서 치료받은 부상자 1,024명 중 대다수가 대공포에 다친 사람들이었다고 확인했다.

사우디 저먼 병원과 알 무야드 모던 병원의 의료진들도 이를 뒷받침하는 증언을 했다. 알 무야드 병원의 한 의사는 이곳에서 치료한 부상자 대부분이 대공포화로 파열상을 입은 여성과 어린이였다고 국제앰네스티에 전했다.

라마 파키흐 상임고문은 “사나 지역에서 대공포화로 인한 부상자 수가 급격히 증가한 것은, 분쟁 중 민간인 보호라는 국제법상 의무가 공공연히 무시된 채 공격이 이루어지고 있는 걱정스러운 양상을 보여주는 것”이라고 말했다.

또한 국제앰네스티는 대공포화로 인해 아이를 잃은 부부와, 부상을 입은 민간인 4명을 만났다. 그 중에는 다리 골절과 배, 골반, 발에 파열상을 입은 9살 소년도 있었다.

두 아이의 어머니인 파트메흐(Fatmeh)는 3월 30일 대공포탄이 집에 떨어지면서 18개월 난 아이와 함께 머리와 손, 몸 등에 수많은 파열상을 입었다.

13세 소년 카림 알리 알 사그히르 파르한의 부모는 4월 27일, 아들이 점심 기도를 위해 집을 나서 모스크로 향하던 도중 떨어진 대공포탄에 목숨을 잃었다고 전했다.

카림의 어머니는 이렇게 말했다. “아들이 ‘알라후 아크바(신이시여)’ 하고 소리를 지르고 샤하다(기도문)를 외는 걸 들었어요. 아바야(이슬람 의상)를 입고 나서니 이웃 사람들이 아들을 병원으로 옮기는 게 보였죠. … 시끄러운 소리 때문에 대공포탄이 떨어졌다는 걸 알았어요. 그 날 포격은 이루어지지 않았어요.”

후티 반군이 전투기나 땅에 접촉할 때의 충격으로 폭발하는 대공무기를 사용하거나, 공중작렬탄을 오발하면서 수많은 민간인들의 사망과 부상을 야기했고, 이는 민간인 보호를 위해 적절한 사전대책을 취하지 않은 것에 해당하므로 국제인도법 위반이다.

대공 작렬탄은 공중에서 폭발하도록 되어 있어, 민간인 사상자를 줄일 수 있다. 5월 20일 사나에서 후티 반군이 대공포화를 가하는 영상에는 적어도 일부의 경우 작렬탄을 사용하고 있는 모습이 분명히 담겨 있다.

국제앰네스티는 후티 반군에 접촉신관을 이용하는 대공무기를 사용하지 않을 것과, 작렬탄 등의 그 외 대공포를 발사할 경우에는 민간인 보호 대책을 추가로 마련할 것을 촉구한다. 또한 후티와 안사룰라 반군은 자신들의 대공포에 민간인이 피해를 입은 것으로 알려진 사건에 대해 조사하고, 피해자들에게 치료비를 지급하고 손해를 배상하는 등의 보상을 해야 한다.

무기고 공습

국제앰네스티가 방문한 병원에는 사우디아라비아 주도 연합군이 5월 11일 누쿰 산 일대의 무기고에 공습을 가하면서 벌어진 2차 폭발로 부상을 입은 추가 민간인 피해자들도 다수 있었다.

국제앰네스티는 공습 현장을 목격한 누쿰 산 주민 4명과, 어린이 4명, 여성 2명 등 공습으로 인한 2차 폭발의 부상자 7명을 만나볼 수 있었다. 피해자 여성 중 한 명은 함께 폭발에 휘말린 아들은 목숨을 잃었다고 했다. 예멘 보건부는 당시 공습으로 약 40명이 숨졌다고 발표했지만, 국제앰네스티는 이 통계 수치를 독립적으로 확인할 수 없었다. 알 사와라 병원과 쿠웨이트 병원의 기록 및 의료진들의 증언에 따르면 당시 공습으로 약 140명의 부상자가 이송됐다.

그보다 앞선 4월 20일에도 사나 교외의 파즈아탄에 위치한 무기고에 공습이 이루어져 주민 수백 명이 부상을 입었다.

누쿰 산과 파즈아탄 공습으로 피해를 입은 주민들은 모두 연합군으로부터 사전 경고가 충분히 가능한 상황이었으며, 알려진 무기고의 위치와 매우 가까운 곳에 사는 주민들이 2차 폭발로 부상을 입을 가능성이 있었음에도 공격이 임박했다는 경고를 전혀 받지 못했다고 진술했다. 이러한 상황에서 효과적으로 사전 경고를 하지 않는 것은 국제인도법 위반에 해당한다. 공습의 횟수에 비례해 이러한 공습으로 야기되는 엄청난 민간인 피해에 대한 우려 역시 증가하고 있다.

국제앰네스티는 사우디아라비아 및 공습에 관련된 연합 소속 국가들에 대해, 국제인권법에 명시된 대로 민간인에 대한 위험을 최소화하기 위해 가능한 모든 사전 대책을 취할 것을 촉구한다. 이러한 사전 대책은 공격 대상이 군이 아니거나, 부적절한 공격일 가능성이 명백한 경우 공격을 취소 또는 연기할 것, 정황상 불가능할 경우를 제외하고 민간인에게 영향을 줄 수 있는 공격은 사전에 효과적으로 경고할 것 등을 포함한다. 또한 후티 반군은 가능한 한 인구가 밀집된 민간 구역으로부터 멀리 떨어진 곳으로 군 거점을 옮겨야 할 것이라고 국제앰네스티는 밝혔다.

또한 예멘 내 사상자가 급증하고 있는 만큼, 사우디아라비아에 무기, 탄약, 군사훈련 또는 그 외의 군사기술/지원을 공급하고 있는 모든 국가들은 극도의 주의를 기울이고 더 이상의 민간인 사상자를 늘리는 군사적 이전은 하지 않을 것임을 보여줘야 한다.

라마 파키흐 상임고문은 “예멘 전역에서 공습과 대공포화가 재개됨과 동시에 민간인 사상자 수는 이미 증가를 보이기 시작했다”며 “지금까지 분쟁 양측은 자신들의 활동이 주민들에게 미친 치명적인 영향에 대해 냉정한 무관심을 보였다. 모든 분쟁 당사자들은 민간인 피해 위험을 최소화하기 위해 가능한 모든 조치를 취할 수 있으며, 취해야만 한다”고 말했다.

2015년 3월 25일 처음 시작된 연합군의 공습은 지금까지 수백여 명의 민간인 사망자를 발생시켰다. 국제앰네스티는 이러한 공습이 국제인도법을 위반했을 가능성이 있는 다수의 사례에 대해 기록하고 있다.

사례) 대공포에 숨지거나 다친 민간인

-3월 30일, 사나 사완 지역

24세에 두 아이를 둔 엄마인 파트메흐는 3월 30일 사나 사완에 위치한 자택에 대공포탄이 떨어지면서 18개월 난 아이와 함께 크게 다쳤다. 파트메흐는 오른손, 오른쪽 겨드랑이, 머리에, 어린 아들은 머리와 손에 파열상을 입었다. 아들은 부상 치료를 위해 2번 수술을 거쳐야 했고, 파트메흐의 집안은 그녀의 머리에 박힌 파편을 제거하는 수술의 수술비를 감당할 수 없었다. 파트메흐는 끔찍한 두통에 시달리고 있으며, 가끔은 두통 때문에 시력을 잃기까지 한다고 말했다. 국제앰네스티는 파트메흐의 집을 방문해 포탄으로 인한 피해를 살펴봤으며, 물리적 증거는 대공포화와 동일한 것이었다.

파트메흐의 남편 역시 아들과 함께 알 차우라 병원에 입원해 있는 며칠 동안, 대공포탄으로 인한 부상자들이 매일 10명 이상 응급실로 실려왔다고 전했다.

-4월 27일, 사나 슈마일라 지역

국제앰네스티는 4월 27일 대공포탄에 목숨을 잃은 13세 소년 카림 알리 알 사기르 파한의 부모와 만날 수 있었다. 사건 당시 집에 있었던 카림의 어머니는 오후 12시 무렵 집 앞에 대공포탄이 떨어지는 소리에 이어 아들이 울부짖는 소리를 들었다고 했다.

“아들이 ‘알라후 아크바(신이시여)’ 하고 소리를 지르고 샤하다(기도문)를 외는 걸 들었어요. 아바야(이슬람 의상)를 입고 나섰더니 이웃 사람들이 아들을 병원으로 옮기는 게 보였죠. … 시끄러운 소리 때문에 대공포탄이 떨어졌다는 걸 알았어요. 그 날 포격은 이루어지지 않았어요.”

카림의 부모는 예멘 요르단 병원으로 향했다. 이곳에서 의사와 이웃 사람들은 카림이 복부에 포탄의 파편을 맞아 부상을 입었고 수술을 해야 한다고 말했다.

“[카림은] 점심 기도를 하러 모스크에 가기 위해 대문을 나서고 있었어요. 공중에서 터지지 못한 대공포탄이 땅으로 떨어졌고, 카림은 배에 파편을 맞았어요. … 수술을 받았지만, 결국 살아나지 못했죠. 포탄이 터진 충격과, 카림이 다칠 때 현장에 있었던 사람들의 말을 듣고 이것이 대공포탄이었음을 알았어요. 폭발 소리가 온 도시에 들릴 정도였죠. 이 지역에서 공습은 일어나지 않았어요. 월요일에 두 번째 포탄이 지붕 위로 떨어졌지만 폭발하지는 않았어요.”

카림의 아버지는 국제앰네스티에 당시 지붕으로 떨어졌던 포탄을 보여주었다. 그리고 이 포탄은 후티 반군의 점령지인 자발 알 나데인에서 발사한 것이라고 했다. 또한 카림이 대공포화로 부상을 입은 것이라는 의료기록 사본도 제공했다.

-5월 5일, 사나 베이트바우스 지역

5월 5일 아침 약 11시, 퇴근한 후 집으로 돌아가던 50세의 사미르(Sameer)는 베이트바우스 지역의 총기 시장에서 대공포탄을 맞고 부상을 당했다고 친척이 국제앰네스티에 전했다. 이 공격으로 심하게 다친 사미르는 약 2주가 지난 지금도 알 차우라 병원의 중환자실에 입원해 있다. 공격 직후 사미르가 바로 이송된 에스라 병원을 찾아왔던 사미르의 친척은 같은 사건으로 부상을 당한 사람이 여러 명 더 있으며 병원에서 보기도 했다고 말했다. 또한 그 날 이 지역에는 공습이 없었고, 대신 대공포화가 가해졌다고 국제앰네스티에 진술했다.

-5월 6일, 사나의 누쿰 산 지역

국제앰네스티는 5월 6일 떨어진 대공포탄으로 부상을 입고 알 사와라 병원에 입원중인 9세 소년 살라(Salah)를 방문했다. 살라의 왼다리는 부러졌고 배, 골반, 오른발에 파열상을 입었다. 함께 병실에 있었던 살라의 삼촌은 5월 6일 살라가 사는 누쿰 산에서 부상을 당한 것으로, 당시 살라는 형제, 사촌들과 함께 거리에 있었다고 한다.

“우리는 [거리에서] 놀고 있었어요. 오후 5시였고 기도할 시간이었어요. 비행기가 나타났는데 라자(대공무기)로 비행기를 맞추려고 했어요.”

살라의 삼촌은 이 주변에서 대공포화는 정기적으로 이루어지는 것이라고 전했다. “[이 지역을] 항상 공격하고 있어요. 이제 파편을 보면 ‘라자(대공무기)’를 쏜 것인지 알 수 있게 됐죠. … 2주 전에도 비슷한 남자아이와 노인이 라자에 다친 적이 있어요.” 그는 살라가 한 달 이내에 다시 걸을 수 있을 것으로 기대하고 있었다.

-5월 5, 6일, 사나 다마르 알 가르 지역

국제앰네스티가 만난 아말(Amal)은 다마르 알 가르 지역에 사는 여성으로, 10~11일 전 마을에 떨어진 대공포탄으로 부상을 입고 알 차우라 병원에서 회복 중이었다. 아말은 아이들을 데리고 나서려던 차에 포탄이 떨어졌고, 동네의 학교 근처에 있었던 그녀는 큰 부상을 입었다고 했다. 또 사람들이 머리 위에서 비행기가 나는 소리를 들었지만 직접 보지는 못했으며, 그 날 이 지역에 공습이 이루어진 적은 없다고도 했다.

-5월 11일, 누쿰 산 무기고 공습

2015년 5월 11일 오후 공습이 가해질 당시 현장에 있었던 아흐마드(Ahmad)는 공습이 끝나고 4차례의 커다란 폭발음을 들었다고 국제앰네스티에 전했다. 공습으로 산 속에 있던 무기고가 피격을 당했고, 곧 연이어서 2차 폭발로 이어졌다. 아흐마드는 2차 폭발이 다음 날 아침 7시까지 끊임없이 계속됐다고 전했다. 또한 산 속에 저장되어 있던 대공무기가 이 지역에 “비 오듯” 떨어졌다고도 했다. 아흐마드는 무기고가 인구 밀집 거주 지역으로부터 약 200~250미터 떨어진 곳에 있었을 것이라고 추정했다.

2차 폭발 부상자인 누쿰 산 주민 바셀(16)은 공습이 시작됐을 때 해당 지역 여성들의 대피를 돕고 있었다고 한다.

“오후 6시 30분 공습이 시작되기 직전까지 여성들을 이 지역에서 대피시키려고 애쓰고 있었어요. 친척들과 함께 감단 학교 앞에 있었죠. 군인들은 아무도 없었고, 사람들이 도망치고 있었어요. 저는 걸어가다가 파편에 맞았어요. 한 남자가 차를 타고 와서 저를 병원으로 데려갔어요. 어머니 역시 파편에 맞으셨죠.”

또한 국제앰네스티는 5월 11일 누쿰 산 근처의 집에서 2차 폭발에 부상을 당한 4세 소년 피라스를 만나, 병원에 함께 있던 친척과 인터뷰를 가졌다. 피라스는 왼손과 오른다리를 파편에 맞아 크게 다친 상태였고, 피라스의 어머니 역시 얼굴에 파열상을 입었다고 전했다.

Yemen: Scores of civilians killed and injured by anti-aircraft fire and airstrikes on weapons depots

Scores of casualties in Sana’a have been caused by anti-aircraft munitions shot by the Huthi armed group which detonated after landing in populated areas killing and maiming civilians, said Amnesty International.

During a week-long trip to the Yemeni capital, the organization spoke to medical staff at nine hospitals and residents who said that anti-aircraft weapons were the leading cause of casualties in the capital. Saudi Arabian-led coalition airstrikes against weapons depots in residential areas have triggered further explosions, also killing and injuring other civilians.

“Sana’a’s residents are caught in a deadly crossfire between the Saudi Arabian-led coalition airstrikes and anti-aircraft fire from the Huthi armed group. Both sides have failed to take the necessary precautions to protect civilian lives in violation of the laws of war. Instead they have carried out attacks that have had devastating consequences for the civilian population,” said Lama Fakih, Senior Crisis Advisor at Amnesty International.
“For the civilians affected, it doesn’t matter which side is responsible. They pay the same price.”

Anti-aircraft fire

A doctor at al-Thawra hospital, one of the largest public hospitals in Sana’a, told Amnesty International that the vast majority – around 90% – of war wounded patients admitted to the hospital had been injured by anti-aircraft fire. He said that before the five-day ceasefire last week around 17-23 patients with such injuries were admitted to the hospital daily. A second doctor working at the hospital also confirmed that the majority of the 1,024 wounded patients treated there during the first month of the conflict, had also been injured by anti-aircraft fire.

This was backed up by staff at the German-Saudi hospital and al-Mu’yyad Modern Hospital, where a doctor told Amnesty International that the majority of the wounded treated there were women and children suffering from fragmentation injuries caused by anti-aircraft fire.

“The sheer number of injuries caused by anti-aircraft fire in Sana’a points to a disturbing pattern of attacks in which the obligation under international law to protect civilians during a conflict is being flouted,” said Lama Fakih.

Amnesty International also met the parents of a child killed and four civilians who were injured by anti-aircraft fire, including a nine year old boy who was left with a broken leg and fragmentation wounds in his stomach, groin and foot.

Fatmeh, a mother of two, was injured along with her one-and-a-half-year-old-baby, when an anti-aircraft projectile struck their home in Sana’a on 30 March. She was left with several fragmentation injuries to her head, hand and body.

The parents of Karim Ali al-Sagheer Farhan, 13, described to Amnesty International how their son was killed by an anti-aircraft projectile on 27 April while he was leaving his home for the mosque for the noon prayer.

“I heard him scream Allahu Akbar and he was saying the shahada. I pulled my abaya on and then saw the neighbours taking him to the hospital…I knew it was anti-aircraft weaponry from the noise. There was no shelling that day,” Karim’s mother said.

The Huthi armed group’s apparent use of anti-aircraft weaponry which detonates on impact either with an aircraft or when it has landed, known as contact fuzing, or misuse of air-burst munitions, has killed and maimed civilians, and amounts to a failure to take adequate precautions to protect the civilian population, which is a violation of international humanitarian law.

Air-burst anti-aircraft weaponry is designed to detonate in the air, potentially reducing civilian casualties. Video of Huthi anti-aircraft fire taken in Sana’a on 20 May clearly shows that at least in some instances they are using air-burst munitions.

Amnesty International calls on the Huthi armed group not to use any contact fuzed anti-aircraft weaponry and to take additional precautions to protect civilians when firing other anti-aircraft munitions, including air-burst. The Huthi armed group and the Ansarullah political wing should also investigate cases in which civilians have reportedly been harmed by their anti-aircraft weaponry and compensate those who have been harmed, including by paying for medical treatment and to repair damaged property.

Airstrikes on weapons depots

Many of the other civilian victims in the hospitals Amnesty International visited were injured by secondary explosions when attacks by Saudi Arabian-led coalition aircraft struck a weapons cache in the Mount Nuqum neighbourhood on 11 May.

Amnesty International interviewed four residents of Mount Nuqum who witnessed the attack and seven others who were injured in secondary explosions caused by the air strikes, including four children and two women. One of the women interviewed said that her son was killed in the same blast that had injured her. Around 40 people were killed in the strike according to the Ministry of Health, although Amnesty International could not independently verify this figure. Nearly 140 people injured in the attack were admitted for treatment at al-Thawra and Kuwait hospitals according to hospital staff and records.

Scores of residents were also injured in an earlier airstrike on a weapons depot in Faj ‘Attan, on the outskirts of Sana’a, on 20 April.

All of the residents affected by the Mount Nuqum or Faj ‘Attan blasts told Amnesty International that no advance warning was given by coalition forces of an impending attack despite the apparent feasibility of such warnings and the likelihood that civilians living in such close proximity to the known storage facilities would be injured by secondary blasts. Failing to give an effective advance warning under these circumstances is a violation of the rules of international humanitarian law. The extensive harm to the civilian population resulting from these attacks also raises concerns about the proportionality of these strikes.

Amnesty International calls on Saudi Arabia and other coalition states involved in the airstrikes to take all feasible precautions to minimize the risks posed to civilians, as required by international humanitarian law. This includes cancelling or suspending an attack if it becomes apparent that the target is not military or that the attack is likely disproportionate; and giving effective advance warning of attacks which may affect civilians, unless circumstances do not permit. The Huthi armed group should also move its military positions away from populated civilian areas where feasible, Amnesty International said.

Given the mounting casualties in Yemen, Amnesty International is also calling on all states supplying weapons, ammunition, training or any other military technology/assistance to Saudi Arabia to exercise extreme caution and demonstrate that any military transfers will not fuel further civilian deaths and injuries.

“As airstrikes and anti-aircraft fire resume across Yemen, the number of civilian casualties is already beginning to rise,” said Lama Fakih.

“So far both sides have displayed a chilling indifference to the deadly impact of their actions on civilians. All parties to the conflict can and should take all feasible steps to minimize the risk to civilians.”

Coalition airstrikes have caused hundreds of civilian deaths since they began on 25 March 2015. Amnesty International has documented a number of cases in which airstrikes may have violated the rules of international humanitarian law.

Cases. Civilians injured or killed by anti-aircraft fire

Amnesty International spoke with Fatmeh, 24, a mother of two who was injured along with her one and a half year old child on 30 March by an anti-aircraft projectile that hit their home in Sa’wan, Sana’a. At around 9pm a projectile struck their home injuring both of them. She had fragmentation injuries in her right hand, right armpit, and head. Her son suffered from fragmentation injuries to the head and to his hand. Her son had two operations to treat his injuries, her family could not afford to cover the costs of surgery to remove the fragments lodged in her head. She told Amnesty International that she was suffering from debilitating headaches, at times causing her to lose her sight, as a result. Amnesty International visited their home and observed the damage caused by the projectile. The physical evidence was consistent with an anti-aircraft strike.

Fatmeh’s husband also told Amnesty International that in the days he spent with his son while he was recovering in the al-Thawra hospital more than 10 people came into the emergency room every day who were suffering from anti-aircraft projectile injuries.

27 April, Shumaylah neighbourhood, Sana’a

Amnesty International also spoke with the parents of Karim Ali al-Sagheer Farhan, 13, who was killed by an anti-aircraft projectile on 27 April. Karim’s mother, who was home at the time of the strike, said that at 12pm she heard an anti-aircraft projectile strike in front of the house and then heard her son cry out:

“I heard him scream Allahu Akbar and he was saying the shahada. I pulled my abaya on and then saw the neighbours taking him to the hospital…I knew it was anti-aircraft weaponry from the noise. There was no shelling that day,” she said.

Karim’s mother and father went to the Yemen Jordan hospital where they were told by doctors and neighbours that their son had a shrapnel injury to the stomach and would need to undergo an operation. Karim’s father told Amnesty International that he was certain the injury was caused by an anti-aircraft projectile. Describing what happened, he said:

“[Karim] was at the gate of the house going to the mosque for the noon prayer. The anti-aircraft projectile failed to detonate in the sky and hit the ground and his stomach was hit with shrapnel…he went into surgery, but didn’t survive. From the impact of the strike and what people said who were at the site after he was injured we knew it was an anti-aircraft weapon. The whole area heard the explosion. There were no airstrikes here… A second shell hit the roof on Monday but it didn’t detonate.”

Karim’s father showed Amnesty International the projectile that hit the roof. He said the anti-aircraft fire was coming from Jabal al-Nahdayn, a Huthi armed group stronghold. He also provided Amnesty International with a copy of Karim’s medical records which stated he was injured by anti-aircraft fire.

5 May, Beit Baws neighbourhood, Sana’a

On 5 May at around 11AM, on his walk home from work, Sameer, 50, was injured by an anti-aircraft projectile on 50 Meter Road at a qat market in the Beit Baws area, his relative told Amnesty International. Sameer, who was badly injured in the attack, was still recovering in the intensive care unit at the al-Thawra hospital nearly two weeks after the incident. His relative, who visited him in the Essra’ Hospital where he was taken directly after the attack said that several other men were injured in the same incident and that he saw them at the hospital. He told Amnesty International that that day there were no airstrikes in the area, but that there was anti-aircraft fire.

6 May, Mount Nuqum neighbourhood, Sana’a

Amnesty International visited, Salah, 9, in the al-Thawra hospital where he was recovering from injuries sustained from an anti-aircraft projectile on 6 May. His left leg was broken and he had fragmentation injuries to his stomach, groin, and right foot. Salah’s uncle, who was with him in the hospital, told Amnesty International that Salah was injured while in Mount Nuqum, where he lives, on 6 May. He said that at the time Salah was in the street with his siblings and cousins.

“We were playing [in the street]” Salah said. “It was 5PM, prayer time. The plane was there and they tried to hit it with the Raja [anti-aircraft weaponry].”

Salah’s uncle told Amnesty International that anti-aircraft fire was a regular occurrence in their neighbourhood. “They are always striking [this area],” he said. “We’ve started to know from the remnants when it is a Raja [anti-aircraft weaponry]…two weeks before another boy and an older man were also injured by a Raja.” He was optimistic that Salah would be walking again in one month

5 or 6 May, Damar al-Ghar neighbourhood, Sana’a

Amnesty International spoke to Amal, a woman from the Damar al-Ghar neighbourhood who was recovering from injuries at the al-Thawra hospital from an anti-aircraft projectile that hit the neighbourhood 10 or 11 days before. Amal said that she was getting kids from the family together to leave the area when the projectile struck, injuring her near a school in her neighbourhood. She said that they heard the plane overhead but she did not see it, and that no airstrikes struck the neighbourhood that day.

Mount Nuqum, airstrike on weapons depot on 11 May 2015

Ahmad, a resident of Mount Nuqum present during the airstrike early in the evening on 11 May 2015, told Amnesty International that he heard four large explosions following aerial attacks. The airstrikes hit a weapons cache in the mountain which then set off a series of secondary explosions and projectiles. Ahmad said that the secondary projectiles continued to go off until 7am the next day. He said that anti-aircraft weapons that had been stored in the mountain were “dropping like rain” on the neighbourhood. Ahmad estimated that the weapons cache was about 200-250 meters away from the homes in the congested residential area.

One of the residents injured in the secondary blasts was Bassel, a 16-year-old resident of Mount Nuqum who was helping to evacuate women from the area after the strikes had started. He told Amnesty International:

“I was trying to evacuate women from the area just before the strike at 6:30pm. We were in front of the Ghamdan School with our relatives. There were no fighters there. People were running away. I was walking when I was hit. One guy came in a car and took me to the hospital. My mom was also hit with shrapnel.”

Bassel’s right leg was amputated below the knee as a result of his injury.

Amnesty International also met Firas, a four year old who was injured in his home near to Mount Nuqum on 11 May from a secondary explosion, and spoke to a relative who was with him at the hospital. Firas’ left hand and right leg had been injured by shrapnel. His mother, the relative told us, also had a fragmentation injury to her face.

세르게이 니키틴(Sergei Nikitin) 국제앰네스티 러시아사무소장은 “외국기관법은 비판적인 비정부단체를 구속하고, 낙인 찍고, 궁극적으로는 침묵시키기 위해 마련된 법이다. 광범위한 영역의 비정부단체들이 이 법의 그물망에 걸렸고, 이로 인해 러시아에서의 개인의 권리와 시민사회 토론의 질이 상당히 손상됐다. 결국 패배하는 것은 비정부단체들만이 아니라, 러시아 사회가 될 것”이라고 말했다.

지난 4년 동안 이 “외국기관” 명단에 포함된 단체는 148개로, 이 중 27개곳이 완전 폐쇄됐다. 이들 비정부단체는 평범한 사람들의 인권을 보호하는 데 중요한 역할을 수행해 왔다. 다수의 사례에서 차별 및 폭력 피해자들을 위한 법정대리, 심리지원 서비스, 환경 감시 등 국가가 제공하지 않는 서비스를 지원하기도 했다.

러시아 국민의 복지를 위한 이 같은 중요한 기여가 이제는 가로막히거나 위협받고 있다. 비정부단체들이 “정치적 활동”에 참여하는 것으로 간주되어 2012년 시행된 ‘외국기관법’에 따라 ‘외국 기관’으로 분류될 위기에 놓였고, 이미 그렇게 분류된 단체들도 있기 때문이다.

올해 6월 통과된 개정안은 이 법에서 금지한 “정치적 활동”의 범위를 확장해, 사실상 공공 정책 또는 정부 관계자의 행동에 대한 모든 언급 형식을 포함시키는 역할만을 했을 뿐이다.

국제앰네스티는 “외국 기관”으로 분류된 비정부단체 10여개곳 이상의 사례를 검토하고, 이들 단체의 대표 및 직원들과 인터뷰를 진행했다. 이에 포함된 비정부단체는 차별, 여성인권 및 LGBTI 인권 보호, 역사적 기록 보존, 학술연구, 형사사법제도 및 교정제도 개혁, 소비자 권리, 환경 문제 등 광범위한 영역에서 활동하고 있었다. 단 하나 공통점은 이들 단체 모두가 정부 정책을 비판적으로 평가하는 데 사람들의 참여를 독려했다는 것이다.

러시아에서의 모금 활동은 언제나 제한적이지만, 러시아 매체에서 비정부단체를 공격적으로 악마화하면서 기금 마련은 더욱 어려워졌다. “외국기관”법은 비정부단체들이 유일한 대책으로 해외에서 모금을 하게 만들어, 불안정한 자금원으로 상당한 법적 위험과 신임도 하락을 감수하게 하는 효과를 일으켰다. 해외에서 모금을 하고 정치적으로 간주되는 활동에 관여한 비정부단체는 모두 이 법에 따라 법적 책임을 지게 된다.

이 법에서는 “동식물 생태계를 보호하기 위한 활동”은 “정치적”으로 간주해서는 안 된다고 명시했음에도, 최소 21곳 이상의 환경단체가 “외국 기관” 목록에 포함됐다.

러시아 니즈니노브로고드에 위치한 드론트 환경센터는 이 목록에서 제외해 줄 것을 요청했지만, 해외 자금을 받았다는 이유로 거절됐다. 근거로 인용된 모금원 세 가지는 벨로나 무르만스크에서 드론트 소식지 정기구독을 신청하며 지불한 500루블(8달러)과, 드론트가 “외국기관”으로 분류된 또 다른 환경단체인 젤레니미르(‘녹색 세계’)로부터 빌렸다가 조사 전 갚은 금액이었으며, 더욱 충격적인 점은 러시아 정교회에서 운영하는 재단인 소라보트니체스트보의 보조금도 포함되어 있었다는 것이다.

드론트의 아슈카트 카이우모프(Ashkat Kaiumov) 회장은 “알고 보니 [교회에] 키프로스로부터 일부 유입된 현금이 있었고, 이 때문에 법무부가 (법률에 엄격히 준거하여) 이 돈을 ‘해외’ 자본이라고 간주한 것이었다. 정말 이상하고 비현실적인 상황”이라고 밝혔다.

결국 2016년 2월 1일 30만 루블(약 4,800달러)의 벌금을 명령받은 드론트는 지도부의 결정으로 “외국 기관” 목록에서 제외될 때까지 활동을 임시적으로 유예했다. 그 전까지는 정부의 허가를 받지 않아도 되는 미등록 운동으로써 활동을 계속할 예정이다.

드론트의 사례가 단체의 목을 서서히 조르는 대표적인 예라면, 돈 여성협회가 공격당한 사례는 비정부단체에 대한 끈질긴 탄압을 잘 보여준다. 돈 여성협회는 2014년 “외국기관”법에 따라 러시아 법무부가 단체들을 해당 목록에 강제 포함시킬 수 있었던 당시 가장 먼저 표적이 된 단체 중 하나였다. 이에 대응해 활동가들은 활동을 계속하기 위해 돈 여성 재단이라는 새로운 단체를 설립했지만, 2015년 10월 이 역시 “외국기관”으로 공표됐다.

2016년 6월 24일 돈 여성재단의 대표 발렌티나 체레야텐코는 자신이 러시아 형법 330조 1항에 따라 “외국기관”법상 “책임을 고의로 회피”한 혐의로 형사 기소되었다는 통지를 받았다. 발렌티나에게 유죄가 선고될 경우 징역 2년형까지 처해질 수 있다.

국제앰네스티는 러시아 정부에 “외국기관”법을 폐지하고, 비정부단체의 활동에 대한 임의적인 제한을 해제할 것을 촉구한다.

남편을 살해한 혐의로 불과 17세의 나이에 체포된 쿠르드계 여성 제이나브 세칸반드(Zeinab Sekaanvand)은 아주 불공정한 재판 끝에 유죄가 선고받았다. 국제앰네스티는 이란 정부가 제이나브 세칸반드의 사형 집행을 즉시 중단해야 한다고 밝혔다.

제이나브 세칸반드의 사형은 이르면 10월 13일 즈음 교수형으로 집행될 예정이었다.

필립 루터(Philip Luther) 국제앰네스티 중동북아프리카 조사자문국장은 “이번 사례에 대한 우려가 크다. 제이나브 세칸반드는 범죄 당시 18세 미만이었음은 물론, 변호사 접견도 허용되지 않았으며 체포된 이후 남성 경찰관들에게 온몸을 구타당하고 고문을 받았다고 밝혔다”며 “청소년 범죄자에게도 계속해서 사형을 부과하고 있는 것은 이란 정부가 직접 서명한 약속조차 무시하는 것이다. 이란 정부는 제이나브 세칸반드의 유죄 판결을 즉시 파기하고, 사형이 아닌 청소년 사법 원칙에 따라 공정하게 재심을 받을 수 있도록 보장해야 한다”고 말했다.

제니아브 세칸반드는 17세이던 2012년 2월, 15세 때 결혼했던 남편을 살해한 혐의로 체포되어 경찰서에 20일간 구금되었으며, 그 과정에서 남성 경찰관들에게 폭행을 당했다. 이후 세칸반드는 자신이 수개월 동안 신체적, 언어적 폭력을 가하고 이혼 요구를 거부한 남편을 흉기로 찔러 살해했다고 “자백”해야 했다.

제니아브 세칸반드의 재판은 매우 불공정했다. 미결구금 기간 내내 변호사와의 면담은 허용되지 않았고, 2014년 10월 18일 최종 재판일이 되어서야 처음으로 국선 변호사를 만날 수 있었다. 이 재판에서 세칸반드는 자신이 앞서 법정대리인도 없는 상태에서 “자백”한 것을 철회하며, 구금 중 당한 폭력을 진술했다.

세칸반드는 재판에서 남편의 형제에게 이전부터 수차례 강간을 당했고, 그가 남편을 죽인 후 자신에게 범행을 “자백”하라고 강요했다고 증언했다. 이슬람 율법에 따라 살인 피해자의 가족은 가해자를 용서하고 대신 금전적인 보상을 받으면, 가해자를 사면할 수 있는 권한이 있기 때문에 사면을 약속했다는 것이다.

그러나 법원은 그의 진술을 묵살하고, 변호사 없이 했던 “자백”에 상당한 근거를 두고 판결을 내렸다.

그 후인 2014년 10월 22일, 서아제르바이잔 주 지방형사법원 제2 지부는 “동일한 방법으로 보복”하는 이슬람 율법의 ‘께사(qesas)’에 따라 제이나브 세칸반드에게 사형을 선고했으며, 이란 대법원 제7 지부 역시 이 판결을 확정했다.

법원은 이란의 2013 이슬람 형법에 명시된 청소년범에 대한 판결 기준을 적용하지 않았고, 범죄를 저지를 당시 피고의 “정신적인 성장과 성숙도”를 평가하는 법의학 보고서를 작성하라고 명령하지도 않았다. 또한, 피고가 형법 91조에 따라 “재심 신청(e’adeyeh-e dadresi)”을 할 수 있다는 점도 알리지 않았다.

이란 형법은 국제인권법에 따른 청소년범 안전조치가 턱없이 부족하며, 그나마 재심 청구권이 있음을 알려주는 등 제한적인 수준으로 마련된 안전조치조차 정부가 시행하지 않는 경우가 많다.

배경

아동권리협약과 시민, 정치적 권리에 관한 국제규약의 당사국으로서 이란은 18세 미만의 모든 사람을 어린이로 대우하고, 어떤 경우에도 이들이 사형 및 석방 가능성이 없는 무기징역의 대상이 되지 않도록 보장해야 할 법적 의무가 있다.

아동권리협약을 비롯한 국제법에서는 18세 미만의 피고인이 저지른 범죄에 대해 사형을 부과하는 것을 금지하고 있다.

이란법에 따라, 사형으로 유죄 판결을 받고 ‘께사’가 선고된 사람은 자신의 사형을 사면 또는 감형해 달라고 요청할 권리를 인정받지 못한다. 이러한 권리는 시민, 정치적 권리에 관한 국제규약 6조 4항에도 명시되어 있는 것이다.

국제앰네스티는 모든 경우에 대해 예외 없이 사형을 반대하며, 이란 정부에 사형 폐지를 목적으로 하는 공식적인 사형집행 유예를 선포할 것을 촉구한다.

Iran: 22-year-old Iranian Kurdish woman faces imminent execution after grossly unfair trial

The Iranian authorities must urgently halt their plans to execute Zeinab Sekaanvand, a 22-year-old Iranian-Kurdish woman who was arrested when she was just 17-years-old and convicted of the murder of her husband after a grossly unfair trial, Amnesty International said today.

She is due to be executed by hanging as soon as 13 October.

“This is an extremely disturbing case. Not only was Zeinab Sekaanvand under 18 years of age at the time of the crime, she was also denied access to a lawyer and says she was tortured after her arrest by male police officers through beatings all over her body,” said Philip Luther, Research and Advocacy Director for the Middle East and North Africa at Amnesty International.

“Iran’s continued use of the death penalty against juvenile offenders displays the authorities’ contempt even for commitments they themselves have signed up to. The Iranian authorities must immediately quash Zeinab Sekaanvand’s conviction and grant her a fair retrial without recourse to the death penalty, and in accordance with principles of juvenile justice.”

Zeinab Sekaanvand was 17-years-old when she was arrested in February 2012 for the murder of her husband, whom she had married at the age of 15. She was held in the police station for the next 20 days where she has said she was beaten by male police officers. She “confessed” to them that she stabbed her husband after he had subjected her to months of physical and verbal abuse and had repeatedly refused her requests for divorce.

Her trial was grossly unfair. She was denied access to a lawyer during her entire pre-trial detention period and only met her state-appointed lawyer for the first time at her final trial session on 18 October 2014. It was at this session that she retracted “confessions” that she had made earlier when she had no access to legal representation.

She told the court that her husband’s brother, who she said had raped her several times, was responsible for the murder and had coerced her into “confessing”, promising that he would pardon her (under Islamic law, murder victims’ relatives have the power to pardon the offender and accept financial compensation instead).

This statement was ignored by the court, which instead relied heavily on “confessions” she had made without a lawyer present, to reach its verdict.

Subsequently, on 22 October 2014, Branch 2 of the Criminal Court of West Azerbaijan Province sentenced Zeinab Sekaanvand to death under qesas (“retribution in kind”), a conviction and sentence which were later upheld by Branch 7 of the Supreme Court of Iran.

The courts failed to apply juvenile sentencing guidelines from Iran’s 2013 Islamic Penal Code and order a forensic report to assess her “mental growth and maturity” at the time of the crime. Additionally, they failed to inform her that she could submit an “application for retrial” (e’adeyeh-e dadresi) based on Article 91 of the Penal Code.

Iran’s Penal Code falls woefully short of safeguards required for juvenile offenders under international human rights law, and even those limited safeguards that do exist, such as informing juvenile offenders of their right to apply for a retrial, are often not implemented by the authorities.

Background

As a state party to the Convention on the Rights of the Child and the International Covenant on Civil and Political Rights, Iran is legally obliged to treat everyone under the age of 18 as a child and ensure that they are never subject to the death penalty nor to life imprisonment without possibility of release.

International law, including the Convention on the Rights of the Child, absolutely prohibits the use of the death penalty for crimes committed by persons when the defendant was below 18 years of age.

Under Iranian law, those convicted of murder and sentenced to qesas have no right to seek pardon or commutation of their death sentence from the State, as is required by Article 6(4) of the International Covenant on Civil and Political Rights.

Amnesty International opposes the death penalty in all cases without exception, and calls on the Iranian authorities to establish an official moratorium on executions with a view to abolishing the death penalty.

1년 전 멕시코 게레로주 이괄라의 아욧지나파 교육대학교 학생 43명이 실종된 사건에 대해 정부가 불성실하게 조사에 임한 것은 정부 고위층이 주도적으로 사건을 은폐하려 했다는 충격적인 사실을 드러내는 것이라고 국제앰네스티가 밝혔다.

에리카 게바라 로사스(Erika Guevara-Rosas) 국제앰네스티 미주국장은 “아욧지나파 사건은 멕시코 현대사에 기록될 최악의 인권 참사다. 이 나라에서는 누구든 흔적도 없이 사라질 수 있으며, 권력자들은 단서를 감추는 데만 급급하고 있음을 적나라하게 보여준 사건이다. 페냐 니에토 멕시코 대통령은 지금 즉시 실질적인 행동을 취하지 않는다면 앞으로도 전세계인에게 공포를 조장하는 자로만 인식될 것”이라고 말했다.

또한 “멕시코 정부가 학생들이 마약 범죄조직에 살해되었고 이들의 시신이 쓰레기통에서 불태워졌다는 주장을 구태여 고집하면서, 정작 사건 조사에 의미 있는 단서는 놓치고 있다. 특히 피해 학생들을 대상으로 인권침해가 이루어지고 있음을 알면서도 아무런 행동에 나서지 않았던 군과 경찰이 학생들의 실종에 어떤 역할을 했는지 조사해봐야 할 것”이라고 말했다.

2014년 9월 26일 체포된 대학생 42명의 행방은 아직도 밝혀지지 않고 있다.

라울 이시드로 부르고스 지방교육대학교(널리 알려진 이름은 ‘아욧지나파 지방대학교’) 소속 대학생 43명은 2014년 9월 26일 밤 시위에 참여하기 위해 멕시코시티로 향하던 중 지방경찰에 체포된 이후 강제 실종되었다.

이후 실종 학생 중 한 명인 19세 알렉산더 모라 베난시오의 유해가 확인되었는데, 근처 강가에서 쓰레기 봉지에 담겨 있던 것을 발견한 것으로 알려졌다. 멕시코 정부는 최근 또 다른 실종 학생인 20세 조시바니 게레로 델라크루즈의 유골 한 개가 같은 봉지에서 발견되었다고 주장했다. 그러나 아르헨티나 법의학인류학팀 소속 전문가들은 유해를 대상으로 특수 DNA 실험을 수행했으나 결국 결론에 이르지 못했다고 밝혔다.

미주인권위원회가 지정한 독립적 전문가 합동연구팀(GIEI) 역시 사건에 대한 멕시코 정부의 공식 발표 내용을 반박했다. 지난 9월 6일 발표한 보고서에서 GIEI는 정부가 주장하는 조건에서 이 정도 숫자의 시신을 쓰레기통에서 태우는 것은 과학적으로 불가능한 일이라고 밝혔다.

조사의 결함

학생 실종 사건의 공식 조사 과정에서 또 한 가지 심각한 실책은 법의학적으로 주요한 증거를 부주의하게 다룬 것으로, 심지어 일부 증거는 아예 다뤄지지조차 않았다.

학생들이 체포된 날 밤 처음으로 이괄라 현장에 도착한 관계자들은 현장 사진을 찍지 않았고, 혈흔, 머리카락, 옷, 지문 흔적도 수집하지 않았다. 사건 현장에 대한 처리도 전혀 이루어지지 않았다.

또한 멕시코 정부는 학생들이 체포되었던 마을에 위치한 보병 27사단 소속 장병들과 독립적 전문가들의 면담도 금지했다. 기밀 해제된 당시 정보문서를 통해 이괄라의 군 관계자들이 학생들에 대한 불법구금과 인권침해에 대해 이미 알고 있었던 것으로 드러난 바 있다.

학생들이 체포되고 강제실종된 사건 이후로 이에 관련해 100명 이상이 체포되었으며, 이 중 대략50%가 경찰관, 50%가 범죄조직원 혐의를 받은 사람들이었다. 이들 중에는 학생들을 납치했다고 자백하도록 고문을 받았다고 주장한 사람들도 있었다.

에리카 게바라 로사스 국장은 “관련 절차의 투명성 부족과 피해 학생 가족에 대한 대우는 인권침해 문제 해결이 전혀 불가능한 듯 보이는 멕시코의 기준으로 봐도 경악스러울 정도”라며 “멕시코 정부는 피해 학생 가족들을 더 이상 우롱해서는 안 된다. 정부는 시급히 조사 방향을 재설정하고 무엇보다도 독립적 전문가들이 이괄라 안팎의 모든 소각장에 출입할 수 있도록 허가해야 한다”고 말했다.

인권의 위기

대학생 실종 사건 이후, 수십여 명의 유해가 묻힌 대형 매립지가 최소 70곳 이상 발견됐다. 이들 시신의 신원은 아직까지 밝혀지지 않았다.

이번 실종 사건이 벌어지기 앞서도 멕시코에서 그간 실종되거나 사라진 사람의 수는 26,500명 이상으로 국가적 인권 위기에 이르는 수준이다. 이러한 실종 사건 중 절반 이상이 페냐 니에토 대통령 집권 이후 발생했다.

Mexico: Reckless investigation into Ayotzinapa disappearances exposes government cover-up

The Mexican authorities’ reckless handling of the investigation into the enforced disappearance of 43 students from the Ayotzinapa teaching school in Iguala, Guerrero a year ago, exposes a scandalous cover-up orchestrated by the highest levels of government, said Amnesty International.

“The Ayotzinapa tragedy is one of the worst human rights tragedies in Mexico’s recent history. It has exposed how anyone can be forcibly disappeared into thin air in the country with those in power focused on covering up the traces. Unless President Peña Nieto takes real action now he will continue to be seen around the world as an enabler of horrors,” said Erika Guevara-Rosas, Americas Director at Amnesty International.

“The Mexican government’s unshakable determination to convince the world that the students were killed by a drug gang and their remains burned in a dumpster is distracting from any other valuable lines of investigation. In particular, they should look into the military and law enforcement agencies’ role in the tragedy after they failed to take action despite being aware of the abuses against the students as they were taking place.”

The whereabouts of 42 of the students arrested on 26 September 2014 is still unknown.

The 43 students from the Raúl Isidro Burgos Rural Teacher Training College (Escuela Normal Rural Raúl Isidro Burgos, widely known simply as “Escuela Rural de Ayotzinapa”) were forcibly disappeared after they were arrested by municipal police while travelling to a demonstration in Mexico City on the night of 26 September 2014.

Since then, the remains of one of the students, 19-year-old Alexander Mora Venancio, has been identified, allegedly from remains found in a trash bag in a local river. Authorities have recently claimed that a bone that belongs to 20-year-old Jhosivani Guerrero de la Cruz, another Ayotzinapa student, was found in the same bag. However, experts from the Argentine Forensic Anthropology Team said that the very specific DNA test run on the remains was inconclusive.

The Interdisciplinary Group of Independent Experts (GIEI) appointed by the Inter-American Commission on Human Rights have also refuted the Mexican government’s official account of events. In a report made public on 6 September, they said it was scientifically impossible for that number of bodies to have been burned in a dumpster in the conditions claimed by the authorities.

Flawed investigations

Other deep failures in the official investigation into the student’s enforced disappearance include the reckless handling of key forensic evidence, some of which was never processed at all.

Officials who first arrived in Iguala the night the students were arrested did not take pictures, collect blood, hair, clothes or fingerprints. Whole areas of the crime scene were not processed at all.

Mexican authorities have also barred the independent experts from interviewing soldiers of the 27th infantry battalion, based in the town where the students were arrested. Declassified intelligence documents have since revealed that military officers in Iguala knew about the illegal detentions and the abuses against the students.

“If the government is convinced the military do not have any relevant information to provide, what are they so worried about? Concealing local soldiers from the investigations raises alarming questions,” said Erika Guevara-Rosas.

Since the students were detained and forcibly disappeared, more than 100 people were arrested in relation to the disappearances (roughly 50% police officers and 50% alleged members of criminal gangs). Some of them have claimed they were tortured into confessing to abducting the students.

“The lack of transparency and the way the students’ relatives are being treated is astonishing, even by the standards of a country that seems utterly incapable of tackling human rights abuses,” said Erika Guevara-Rosas.

“Mexican authorities must stop playing games with the relatives of the Ayotzinapa students. They must urgently redirect investigations and, amongst other measures, allow independent experts access to all crematories in and near Iguala,” said ErikaGuevara-Rosas.

Human rights crisis

Since the enforced disappearance of the students, at least 70 mass graves containing the remains of dozens of people were uncovered. Most of those bodies have not been identified yet.

The disappearance of the students happened in the context of a national human rights crisis with more than 26,500 people disappeared or missing in Mexico in the past years, almost half of them during the current administration of President Peña Nieto.

러시아의 시리아 공습으로 민간인 수백 명이 숨지고 주택과 모스크, 시장 등은 물론 의료 시설에도 폭격을 가해 주거 지역이 대규모로 파괴되었으며, 이러한 공격 유형은 국제인도법을 위반한 증거라고 국제앰네스티가 23일 발표한 신규 브리핑을 통해 밝혔다.

<‘민간 피해 없다’: 러시아 공습 발표에 대한 진실 드러나>는 러시아의 공격으로 추정되는 시리아 전역의 공습으로 민간인들이 큰 피해를 입은 점을 강조하고 있다. 2015년 9월과 11월 사이 시리아 홈즈, 이들렙, 알레포 지역에서 이루어진 6차례의 공습으로 민간인 최소 200명이 숨지고 전투기 십여 대가 파괴된 사건을 다룬 이번 보고서는, 러시아 정부가 모스크와 야전병원을 대상으로 가한 공습에서 민간 피해가 발생했음에도 이를 은폐하기 위해 거짓 발표를 했을 가능성과 그 증거 역시 함께 제시했다. 또한 러시아가 국제법상 금지된 확산탄을 사용하고, 인구가 밀집한 주거 지역에 비유도 미사일을 투하했다는 증거도 수록했다.

러시아 정부는 자국 군이 오직 “테러리스트” 표적만을 공격했다고 주장하고 있다. 공습이 이루어진 후 민간인 사망자가 발생했다는 보고에 대해 정부는 민간인 피해 사실을 부인했고, 어떤 경우에는 침묵으로 대응하기도 했다.

국제앰네스티는 공습 목격자와 생존자들 인터뷰를 비롯해 공습 이후의 현장을 담은 사진과 영상 자료를 수집했고, 무기 전문가들의 자문을 거쳤다. 각 공습 사례의 세부사항과 “테러리스트” 표적을 타격했다는 러시아 국방부의 발표 내용과, 목격자 증언으로 파악한 세부적인 내용을 대조한 결과 러시아가 주도한 공격으로 추정된다는 점이 확인됐다.

국제앰네스티의 조사 결과 폭격을 당한 지역 부근에는 군사적 표적이나 군대가 전혀 없었던 것으로 밝혀졌다. 이는 러시아의 공습이 국제인도법을 위반했을 가능성이 있으며 일부의 경우는 전쟁범죄까지 해당할 수 있음을 시사한다.

이번 브리핑에서 다룬 사례 중 가장 피해가 큰 공격은 이들렙 주 아리하 중심부의 붐비는 시장에 미사일 3발이 떨어져 민간인 49명이 숨진 사건이었다. 당시 목격자들은 불과 몇 초 만에 북적거리던 일요장이 아수라장으로 변했다고 증언했다.

지역 언론활동가인 모하메드 쿠라비 알 가잘은 “순식간에 사람들이 비명을 지르기 시작했고, 사방에 탄 냄새가 자욱했으며 그야말로 난장판이었다. 근처에는 초등학교가 있었는데, 어린이들이 완전히 겁에 질린 채 뛰쳐나오고 있었다. 사방에 목이 없고 사지가 떨어져 나간 시신이 가득했다”고 전했다.

“순식간에 사람들이 비명을 지르기 시작했고, 사방에 탄 냄새가 자욱했으며 그야말로 난장판이었다.”

쿠라비 알 가잘은 또 40구의 시신이 일렬로 놓인 옆에서 주저앉아 울고 있는 한 여성을 목격했다고 한다. 이 여성은 남편과 세 아이를 모두 잃었다. 그는 “아이들의 시신은 말 그대로 자루에 담겨 있었다. 지금까지도 잊을 수가 없다”고 덧붙였다.

10월 15일 홈즈 주 알 간투에서는 러시아의 공격으로 추정되는 또 다른 공습으로 주거 건물 지하에 피난해 있던 어린이 32명과 여성 11명을 포함해 최소 46명의 민간인들이 숨졌다. 공습 직후 현장을 촬영한 동영상에서는 군대가 있었던 흔적을 전혀 찾아볼 수 없다. 공습 현장 사진을 분석한 무기 전문가들은 파괴된 형태를 보아 기체 폭탄을 사용했을 가능성이 있다고 밝혔다. ‘진공 폭탄(vacuum bomb)’으로도 알려진 기체 폭탄은 특히 민간 지역 부근에서 사용할 경우 무차별적인 피해를 입히기 쉬운 무기다.

10월 7일 알레포 주 다랏 이자에서는 러시아가 발사한 것으로 추정되는 해상발사 순항미사일이 주택가에 떨어져 민가 십여 채가 파괴되고 민간인 5명이 숨졌다.

한 지역 주민은 “다른 공습과는 느낌이 매우 달랐다. 지진이 일어난 듯 땅이 흔들렸고… 본 것 중 가장 심각한 파괴 현장이었다. 한 집에서는 어머니와 두 아이가 숨졌고, 다른 집에서는 부부가 모두 목숨을 잃었다. 이 부부는 공습이 벌어지기 불과 일주일 전에 결혼한 사람들이었다”고 말했다. 이 주민은 당시 폭격을 당한 지역이 주택가였으며, 근처에 어떤 무장단체의 군사 기지도 없었다고 분명히 밝혔다.

러시아의 공습으로 추정되는 폭격은 병원에도 이루어졌다. 의료 시설은 국제인도법상 특별히 보호해야 하며, 이를 공격하는 것은 전쟁범죄에 해당할 수 있다. 이들렙 주의 세르민 야전병원에 공습이 가해지는 현장을 불과 몇 미터 떨어진 곳에서 목격한 한 증인은 미사일이 떨어지기 전까지 전투기를 목격하거나 소리를 전혀 듣지 못한 것으로 보아 최첨단 전투기로 폭격을 가했을 것으로 추정된다고 전했다.

10월 1일 이들렙 주 지스르 알 슈고르의 중심에 위치한 오마르 빈 알 캇탑 모스크를 폭격한 것에 대한 러시아 정부의 대응은, 러시아의 군사작전에 대한 비판을 잠재우기 위해 준비한 전략이 아니냐는 심각한 의혹을 제기시켰다. 파괴된 모스크의 사진과 그에 관련된 보고서들이 공개되자 러시아 정부는 모두 “날조”된 정보라 주장하며, 모스크는 여전히 온전하다는 의미로 위성 사진을 제시했다. 그러나 위성 사진에 나타난 것은 공습으로 파괴된 모스크와는 다른 모스크였다.

11월 24일 터키 공군에 러시아 전투기가 요격된 이후, 러시아 국방부는 시리아에서의 군사작전에 대한 정보를 이전보다도 더욱 제한적으로 공개하고 있다.

국제앰네스티는 이외에도 러시아가 인구 밀집 주택가에 비유도 미사일 및 국제법상 금지된 확산탄을 사용했음을 시사하는 사진, 동영상 자료 등의 증거를 수집했다.

확산탄은 어떤 상황에라도 사용해서는 안 되는 무차별적인 무기로, 한 발마다 축구 경기장만한 면적에 수백 개의 파편을 흩뿌린다. 불발률이 매우 높은 탓에 발사된 지 수 년이 지난 뒤에도 민간인들에게 지속적인 위협이 되고 있다. 인구가 밀집한 주거 지역 부근에 비유도 미사일을 반복적으로 사용하는 것은 무차별 공격을 금지하는 국제법 조항을 위반하는 것이다.

필립 루터 국장은 “러시아는 무차별적인 불법 공격을 중단해야 한다. 또한 확산탄 사용을 전면 중지하고, 민간 지역에 비유도 미사일을 투하하는 것 역시 중단해야 한다”고 말했다.

Syria: Russia’s shameful failure to acknowledge civilian killings

Russian air strikes in Syria have killed hundreds of civilians and caused massive destruction in residential areas, striking homes, a mosque and a busy market, as well as medical facilities, in a pattern of attacks that show evidence of violations of international humanitarian law, said Amnesty International in a new briefing published today.

‘Civilian objects were not damaged’: Russia’s statements on its attacks in Syria unmasked highlights the high price civilians have paid for suspected Russian attacks across the country. The report focuses on six attacks in Homs, Idleb and Aleppo between September and November 2015 which killed at least 200 civilians and around a dozen fighters. The briefing includes evidence suggesting that Russian authorities may have lied to cover up civilian damage to a mosque from one air strike and a field hospital in another. It also documents evidence suggesting Russia’s use of internationally banned cluster munitions and of unguided bombs in populated residential areas.

“Some Russian air strikes appear to have directly attacked civilians or civilian objects by striking residential areas with no evident military target and even medical facilities, resulting in deaths and injuries to civilians. Such attacks may amount to war crimes,” said Philip Luther, Director of the Middle East and North Africa Programme at Amnesty International.

“It is crucial that suspected violations are independently and impartially investigated.”

The Russian authorities have claimed that their armed forces are only striking “terrorist” targets. After some attacks, they have responded to reports of civilian deaths, by denying they killed civilians; after others, they have simply stayed silent.

Amnesty International interviewed eyewitnesses and survivors of attacks as well as examining video evidence and images showing the aftermath of attacks, aided by analysis by weapons experts. The attacks were identified as suspected Russian air strikes by cross-referencing details of each attack with statements from the Russian Ministry of Defence announcing “terrorist” targets struck, or from details about the nature of the attack in witness testimony.

The organization’s research into these strikes indicate that there were no military targets or fighters in the immediate vicinity of the areas that were struck. This suggests that the attacks may have violated international humanitarian law and may, in some circumstances, constitute war crimes.

In one of the deadliest attacks documented in the briefing three missiles were fired on a busy market in the centre of Ariha in Idleb governorate killing 49 civilians. Witnesses described how within seconds the bustling Sunday market turned to a scene of carnage.

“In just a few moments, people were screaming, the smell of burning was in the air and there was just chaos. There was a primary school nearby, and children were running out absolutely terrified… there were bodies everywhere, decapitated and mutilated,” said Mohammed Qurabi al-Ghazal, a local media activist.

He saw one woman sitting and crying beside 40 bodies lined up in a row. She had lost her husband and three children. ”Her children were literally in bags. To this day, I cannot get over it,” he added.

In another suspected Russian attack, at least 46 civilians, including 32 children and 11 women who were sheltering for safety in the basement of a residential building, were killed on 15 October in al-Ghantu, Homs governorate. Video footage of the scene after the attack shows no evidence of a military presence. Weapons experts who analysed images of the attack said the nature of the destruction indicated possible use of fuel-air explosives (also known as “vacuum bombs”), a type of weapon particularly prone to indiscriminate effects when used in the vicinity of civilians.
In another attack five civilians were killed and a dozen homes were destroyed when a suspected Russian sea-launched cruise missile struck residential buildings in Darat Izza, Aleppo governorate, on 7 October.

“It felt very different from other air strikes… the ground shook like an earthquake… this was the worst destruction I had seen… A mother and her two children were killed in one house and a young couple in another house. The couple were married about a week before the attack,” said one local witness, who confirmed the area struck was residential and that there were no nearby military bases of any armed groups.

Suspected Russian air strikes have also struck hospitals. Medical facilities have special protection under international humanitarian law, and attacking them can amount to a war crime. A witness to an attack just a few metres from Sermin field hospital in Idleb said the attack appeared to have been carried out by a more sophisticated plane as they did not see or hear the plane before the missiles were dropped.

The Russian authorities’ reaction to an attack on Omar Bin al-Khattab mosque in central Jisr al-Shughour, Idleb governorate, on 1 October raises serious questions about the tactics they are prepared to deploy to undermine criticism of their operations. After reports and photos of the destroyed mosque emerged, the Russian authorities responded by calling it a “hoax”, presenting a satellite image purporting to show the mosque still intact. However, the mosque shown in the image was a different one from the one destroyed in the attack.

“By presenting satellite imagery of an intact mosque and claiming it showed another that had been destroyed, the Russian authorities appear to have used sleight of hand to try to avoid reproach and avert scrutiny of their actions in Syria. Such conduct does not cultivate confidence in their willingness to investigate reported violations in good faith. Russia’s Ministry of Defence must be more transparent and disclose targets of their attacks in order to facilitate assessment of whether they are complying with their obligations under international humanitarian law,” said Philip Luther.

Since a Russian fighter jet was shot down by the Turkish air force on 24 November, Russia’s Ministry of Defence has released even less information about its campaign in Syria than it did before then.

Amnesty International has also gathered evidence, including photos and video footage, suggesting the Russians have used unguided bombs in densely populated civilian areas, as well as internationally banned deadly cluster munitions.

Cluster munitions are inherently indiscriminate weapons that must not be used in any circumstances. Each cluster bomb scatters scores of bomblets over an area the size of a football pitch. Because of their high dud rate they pose a continuing threat to civilians for years after their initial use. The repeated use of unguided bombs in the vicinity of densely populated civilian areas would violate the prohibition of indiscriminate attacks.

“Russia must end indiscriminate and other unlawful attacks. They must halt all use of cluster munitions and stop dropping unguided bombs on civilian areas,” said Philip Luther.

시민결합의 범위를 동성커플까지 확대하기로 결정한 그리스 의회는 올바른 방향으로 나아가는 역사적이자 중요한 한 걸음을 내딛었다.

“이번 법안의 통과는 동성관계의 법적인 인정을 위해 수 년 동안 쉼 없이 싸워온 활동가들의 작지만 어렵게 얻은 승리다.” 라고 가우리 반 굴릭 국제앰네스티 유럽 및 중앙아시아 부국장이 밝혔다.

이번에 통과된 법은 국가가 동성관계가 존재하고 중요한 사안이라는 것을 인정한 것으로, 레즈비언, 게이, 양성애자, 성전환자, 그리고 인터섹스(이하LGBTI) 뿐 아니라 정의와 평등을 위해 싸워온 모든 사람들에게 그리스가 더 관용적인 사회로 가고 있다는 희망의 메시지가 되고 있다.

그리스 정교회와 몇몇 정당은 새로운 법안에 강력히 반대했다. 새로운 법은 동성결합에 의한 파트너를 가장 가까운 친족으로 인정한다. 또한 병원 방문 권리, 긴급한 의료에 대한 결정권, 그리고 유산 상속권 등 여타 결혼한 부부들이 갖는 권리를 동성커플도 누릴 수 있게 되었다.

“그럼에도 불구하고 그리스의 LGBTI는 여전히 적대적인 분위기에서 살고 있고, 당국은 이들을 적절하게 보호하지 못하고 있다. 물리적인 공격이 계속되고, 혐오 발언이 일상적으로 나오고 있지만 당국은 이를 제지하지 못하고 있다. 심지어 TV프로그램에서 동성커플의 애정표현도 검열되고 있다” 고 굴릭 국장은 덧붙였다.

비영리단체 컬러유스(Colour Youth)는 국제앰네스티에 LGBTI에 대한 공격들이 지난해에 비해 3배 이상 늘었다고 전했다. 개인의 진짜 혹은 알려진 성적 지향 혹은 성 정체성 때문에 폭행과 총격, 강간 등의 공격이 보고되었다.

이번에 통과된 법은 또한 성전환자들의 성별 전환을 법적으로 인정하지 않는다.

“모든 LGBTI의 권리는 전적으로 존중되고 보호 받아야 한다. 어떠한 사람도 단지 자신이 누구이고, 누구를 사랑하며 혹은 자신의 성적 지향을 표현했다는 이유 만으로 차별이나 폭력을 경험해서는 안 된다. 그리스 정부는 이번 기회를 이용해 활동가들이 용감히 싸워온 ‘완전한 평등’을 달성해야 한다.”

배경정보

2008년 그리스 정부는 ‘결혼’의 대안으로 시민결합법을 도입했다. 그러나 이 법은 이성애자들에게만 적용되었다. 2013년 유럽인권재판소는 이 법이 유럽인권협약 8조와 14조의 사생활을 존중 받을 권리에 있어서 성적 지향을 이유로 대상자를 차별하고 있다고 판결했다. 이에 따라 162 커플이 소송을 제기 했고 현재도 진행 중이다.
국제앰네스티는 모든 국가에 성적 지향이나 성 정체성을 기반으로 한 동성결혼법에 있어서 차별을 종식 시킬 것을 요구한다. 올 3월 국제앰네스티는 그리스 법무부장관과 만나 완전한 결혼 평등과 성 전환자의 법적 성별 변경 인정을 포함하여 LBGTI를 향한 차별을 종식시킬 것을 촉구했다.

Greece: Historic recognition of same-sex relationships

The Greek Parliament’s vote to extend civil unions to same-sex couples is an historic and important step in the right direction, but falls short of guaranteeing full equality with married couples, said Amnesty International.

“The passing of this law represents a small but hard-won victory for activists in Greece, who have fought tirelessly for years for the legal recognition of same-sex relationships,” said Gauri van Gulik, Amnesty International’s Deputy Director for Europe and Central Asia.

“This law means that the State acknowledges that same-sex relationships exist, and that they matter. It sends a message of hope not only to lesbian, gay, bisexual, transgender and intersex (LGBTI) people, but to everyone fighting for justice and equality. The message is that Greece is becoming more tolerant.”

The new law, which was strongly opposed by the Greek Orthodox Church and several political parties, recognizes partners of a civil union agreement as next of kin and enables same-sex couples to enjoy some of the same rights granted to married couples. These include hospital visitation rights, emergency medical decisions, and inheritance rights.

Amnesty International stresses that the fight for LGBTI rights is far from over and urges the Greek government to guarantee all rights, including equality before the law (including marriage), adoption rights and legal gender recognition for transgender people.

“Despite this first step, LGBTI people in Greece still live in a climate of hostility from which the authorities are failing to protect them adequately. Physical attacks are on the rise, hate speech is common and goes unchecked by the authorities. Even displays of affection between same-sex couples are censored on television,” said Gauri van Gulik.

The NGO Colour Youth told Amnesty International that reported attacks against LGBTI people have more than tripled in 2015 compared to 2014. Reported attacks include beatings, shootings, and rapes because of individuals’ real or perceived sexual orientation or gender identity.

The legislation also fails to provide legal gender recognition to transgender people.
“The rights of every lesbian, gay, bisexual, transgender and intersex persons must be fully respected and protected. No one should experience discrimination or violence because of who they are, who they love, or how they express their gender. The Greek government should use this momentum to provide what activists have been bravely fighting for: nothing less than full equality.”

Background

In 2008 the Greek government introduced civil unions as an alternative to marriage, but the law applied only to heterosexual couples. In November 2013, the European Court of Human Rights ruled that the legislation discriminated against the applicants’ enjoyment of their right to private life on grounds of sexual orientation, amounting to a breach of Articles 8 and 14 of the European Convention on Human Rights. Due to non-implementation of the ruling, a new lawsuit by 162 couples was initiated and is currently ongoing.

Amnesty International calls on all states to end discrimination in civil marriage laws based on sexual orientation or gender identity. In March 2015, Amnesty International met with the Minister of Justice in Greece and urged him to combat discrimination towards LGBTI persons including introducing full marriage equality and legal gender recognition of transgender people.

In June 2015, the Minister of Justice announced that it would legislate for civil partnership rights for all couples. On 15 December, LGBTI NGOs made interventions to the Parliamentary Committee on what they found lacking from the draft law, leading to some new commitments including the establishment of drafting committees for the legal recognition of gender identity and the right to found a family for same-sex people, a commitment which Amnesty International urges the Greek government to fulfil.
