예멘의 수도 사나에서 후티 반군이 사용하는 대공무기가 인구 밀집 지역에 떨어진 후 폭발해 민간인들이 목숨을 잃거나 불구가 되는 등 수백여 명의 사상자가 발생했다고 국제앰네스티가 밝혔다.

사나로 가는 일주일간의 여정 중 국제앰네스티가 만난 9개 병원의 의료진과 주민들은 사나 지역의 사상자가 주로 대공포화로 인해 발생하고 있다고 전했다. 사우디아라비아가 주도하는 연합군 역시 주거지역에 위치한 무기고에 공습을 가해 추가로 폭발을 일으키면서, 더욱 많은 민간인 사상자를 발생시키고 있다.

라마 파키흐(Lama Fakih) 국제앰네스티 위기대응 상임고문은 “사나 주민들은 사우디 주도 연합군의 공습과 후티 반군의 대공포화라는 치명적인 십자포화 속에 갇혀 있다. 양측 모두 필수적인 민간인 보호 대책을 취하지 않으며 전쟁법을 위반했고, 그 대신 공격을 가해 참혹한 민간인 피해를 낳았다”며 “피해 주민들에게 책임 소재 여부는 중요하지 않다. 어느 쪽이든 똑 같은 희생을 치르고 있다”고 말했다.

대공포화

사나에서 가장 큰 국립병원인 알 차우라 병원의 한 의사는 전쟁 부상자 중 약 90%에 가까운 대다수가 대공포에 부상을 입고 병원에 실려 온 것이었다고 국제앰네스티에 전했다. 지난 주 5일간의 휴전이 이루어지기 전만 해도 이렇게 부상을 입은 환자들이 매일 약 17~23명씩 이송되었다고도 했다. 이 병원에서 근무하는 또 다른 의사 역시, 분쟁이 일어나고 첫 한 달 동안 이곳에서 치료받은 부상자 1,024명 중 대다수가 대공포에 다친 사람들이었다고 확인했다.

사우디 저먼 병원과 알 무야드 모던 병원의 의료진들도 이를 뒷받침하는 증언을 했다. 알 무야드 병원의 한 의사는 이곳에서 치료한 부상자 대부분이 대공포화로 파열상을 입은 여성과 어린이였다고 국제앰네스티에 전했다.

라마 파키흐 상임고문은 “사나 지역에서 대공포화로 인한 부상자 수가 급격히 증가한 것은, 분쟁 중 민간인 보호라는 국제법상 의무가 공공연히 무시된 채 공격이 이루어지고 있는 걱정스러운 양상을 보여주는 것”이라고 말했다.

또한 국제앰네스티는 대공포화로 인해 아이를 잃은 부부와, 부상을 입은 민간인 4명을 만났다. 그 중에는 다리 골절과 배, 골반, 발에 파열상을 입은 9살 소년도 있었다.

두 아이의 어머니인 파트메흐(Fatmeh)는 3월 30일 대공포탄이 집에 떨어지면서 18개월 난 아이와 함께 머리와 손, 몸 등에 수많은 파열상을 입었다.

13세 소년 카림 알리 알 사그히르 파르한의 부모는 4월 27일, 아들이 점심 기도를 위해 집을 나서 모스크로 향하던 도중 떨어진 대공포탄에 목숨을 잃었다고 전했다.

카림의 어머니는 이렇게 말했다. “아들이 ‘알라후 아크바(신이시여)’ 하고 소리를 지르고 샤하다(기도문)를 외는 걸 들었어요. 아바야(이슬람 의상)를 입고 나서니 이웃 사람들이 아들을 병원으로 옮기는 게 보였죠. … 시끄러운 소리 때문에 대공포탄이 떨어졌다는 걸 알았어요. 그 날 포격은 이루어지지 않았어요.”

후티 반군이 전투기나 땅에 접촉할 때의 충격으로 폭발하는 대공무기를 사용하거나, 공중작렬탄을 오발하면서 수많은 민간인들의 사망과 부상을 야기했고, 이는 민간인 보호를 위해 적절한 사전대책을 취하지 않은 것에 해당하므로 국제인도법 위반이다.

대공 작렬탄은 공중에서 폭발하도록 되어 있어, 민간인 사상자를 줄일 수 있다. 5월 20일 사나에서 후티 반군이 대공포화를 가하는 영상에는 적어도 일부의 경우 작렬탄을 사용하고 있는 모습이 분명히 담겨 있다.

국제앰네스티는 후티 반군에 접촉신관을 이용하는 대공무기를 사용하지 않을 것과, 작렬탄 등의 그 외 대공포를 발사할 경우에는 민간인 보호 대책을 추가로 마련할 것을 촉구한다. 또한 후티와 안사룰라 반군은 자신들의 대공포에 민간인이 피해를 입은 것으로 알려진 사건에 대해 조사하고, 피해자들에게 치료비를 지급하고 손해를 배상하는 등의 보상을 해야 한다.

무기고 공습

국제앰네스티가 방문한 병원에는 사우디아라비아 주도 연합군이 5월 11일 누쿰 산 일대의 무기고에 공습을 가하면서 벌어진 2차 폭발로 부상을 입은 추가 민간인 피해자들도 다수 있었다.

국제앰네스티는 공습 현장을 목격한 누쿰 산 주민 4명과, 어린이 4명, 여성 2명 등 공습으로 인한 2차 폭발의 부상자 7명을 만나볼 수 있었다. 피해자 여성 중 한 명은 함께 폭발에 휘말린 아들은 목숨을 잃었다고 했다. 예멘 보건부는 당시 공습으로 약 40명이 숨졌다고 발표했지만, 국제앰네스티는 이 통계 수치를 독립적으로 확인할 수 없었다. 알 사와라 병원과 쿠웨이트 병원의 기록 및 의료진들의 증언에 따르면 당시 공습으로 약 140명의 부상자가 이송됐다.

그보다 앞선 4월 20일에도 사나 교외의 파즈아탄에 위치한 무기고에 공습이 이루어져 주민 수백 명이 부상을 입었다.

누쿰 산과 파즈아탄 공습으로 피해를 입은 주민들은 모두 연합군으로부터 사전 경고가 충분히 가능한 상황이었으며, 알려진 무기고의 위치와 매우 가까운 곳에 사는 주민들이 2차 폭발로 부상을 입을 가능성이 있었음에도 공격이 임박했다는 경고를 전혀 받지 못했다고 진술했다. 이러한 상황에서 효과적으로 사전 경고를 하지 않는 것은 국제인도법 위반에 해당한다. 공습의 횟수에 비례해 이러한 공습으로 야기되는 엄청난 민간인 피해에 대한 우려 역시 증가하고 있다.

국제앰네스티는 사우디아라비아 및 공습에 관련된 연합 소속 국가들에 대해, 국제인권법에 명시된 대로 민간인에 대한 위험을 최소화하기 위해 가능한 모든 사전 대책을 취할 것을 촉구한다. 이러한 사전 대책은 공격 대상이 군이 아니거나, 부적절한 공격일 가능성이 명백한 경우 공격을 취소 또는 연기할 것, 정황상 불가능할 경우를 제외하고 민간인에게 영향을 줄 수 있는 공격은 사전에 효과적으로 경고할 것 등을 포함한다. 또한 후티 반군은 가능한 한 인구가 밀집된 민간 구역으로부터 멀리 떨어진 곳으로 군 거점을 옮겨야 할 것이라고 국제앰네스티는 밝혔다.

또한 예멘 내 사상자가 급증하고 있는 만큼, 사우디아라비아에 무기, 탄약, 군사훈련 또는 그 외의 군사기술/지원을 공급하고 있는 모든 국가들은 극도의 주의를 기울이고 더 이상의 민간인 사상자를 늘리는 군사적 이전은 하지 않을 것임을 보여줘야 한다.

라마 파키흐 상임고문은 “예멘 전역에서 공습과 대공포화가 재개됨과 동시에 민간인 사상자 수는 이미 증가를 보이기 시작했다”며 “지금까지 분쟁 양측은 자신들의 활동이 주민들에게 미친 치명적인 영향에 대해 냉정한 무관심을 보였다. 모든 분쟁 당사자들은 민간인 피해 위험을 최소화하기 위해 가능한 모든 조치를 취할 수 있으며, 취해야만 한다”고 말했다.

2015년 3월 25일 처음 시작된 연합군의 공습은 지금까지 수백여 명의 민간인 사망자를 발생시켰다. 국제앰네스티는 이러한 공습이 국제인도법을 위반했을 가능성이 있는 다수의 사례에 대해 기록하고 있다.

사례) 대공포에 숨지거나 다친 민간인

-3월 30일, 사나 사완 지역

24세에 두 아이를 둔 엄마인 파트메흐는 3월 30일 사나 사완에 위치한 자택에 대공포탄이 떨어지면서 18개월 난 아이와 함께 크게 다쳤다. 파트메흐는 오른손, 오른쪽 겨드랑이, 머리에, 어린 아들은 머리와 손에 파열상을 입었다. 아들은 부상 치료를 위해 2번 수술을 거쳐야 했고, 파트메흐의 집안은 그녀의 머리에 박힌 파편을 제거하는 수술의 수술비를 감당할 수 없었다. 파트메흐는 끔찍한 두통에 시달리고 있으며, 가끔은 두통 때문에 시력을 잃기까지 한다고 말했다. 국제앰네스티는 파트메흐의 집을 방문해 포탄으로 인한 피해를 살펴봤으며, 물리적 증거는 대공포화와 동일한 것이었다.

파트메흐의 남편 역시 아들과 함께 알 차우라 병원에 입원해 있는 며칠 동안, 대공포탄으로 인한 부상자들이 매일 10명 이상 응급실로 실려왔다고 전했다.

-4월 27일, 사나 슈마일라 지역

국제앰네스티는 4월 27일 대공포탄에 목숨을 잃은 13세 소년 카림 알리 알 사기르 파한의 부모와 만날 수 있었다. 사건 당시 집에 있었던 카림의 어머니는 오후 12시 무렵 집 앞에 대공포탄이 떨어지는 소리에 이어 아들이 울부짖는 소리를 들었다고 했다.

“아들이 ‘알라후 아크바(신이시여)’ 하고 소리를 지르고 샤하다(기도문)를 외는 걸 들었어요. 아바야(이슬람 의상)를 입고 나섰더니 이웃 사람들이 아들을 병원으로 옮기는 게 보였죠. … 시끄러운 소리 때문에 대공포탄이 떨어졌다는 걸 알았어요. 그 날 포격은 이루어지지 않았어요.”

카림의 부모는 예멘 요르단 병원으로 향했다. 이곳에서 의사와 이웃 사람들은 카림이 복부에 포탄의 파편을 맞아 부상을 입었고 수술을 해야 한다고 말했다.

“[카림은] 점심 기도를 하러 모스크에 가기 위해 대문을 나서고 있었어요. 공중에서 터지지 못한 대공포탄이 땅으로 떨어졌고, 카림은 배에 파편을 맞았어요. … 수술을 받았지만, 결국 살아나지 못했죠. 포탄이 터진 충격과, 카림이 다칠 때 현장에 있었던 사람들의 말을 듣고 이것이 대공포탄이었음을 알았어요. 폭발 소리가 온 도시에 들릴 정도였죠. 이 지역에서 공습은 일어나지 않았어요. 월요일에 두 번째 포탄이 지붕 위로 떨어졌지만 폭발하지는 않았어요.”

카림의 아버지는 국제앰네스티에 당시 지붕으로 떨어졌던 포탄을 보여주었다. 그리고 이 포탄은 후티 반군의 점령지인 자발 알 나데인에서 발사한 것이라고 했다. 또한 카림이 대공포화로 부상을 입은 것이라는 의료기록 사본도 제공했다.

-5월 5일, 사나 베이트바우스 지역

5월 5일 아침 약 11시, 퇴근한 후 집으로 돌아가던 50세의 사미르(Sameer)는 베이트바우스 지역의 총기 시장에서 대공포탄을 맞고 부상을 당했다고 친척이 국제앰네스티에 전했다. 이 공격으로 심하게 다친 사미르는 약 2주가 지난 지금도 알 차우라 병원의 중환자실에 입원해 있다. 공격 직후 사미르가 바로 이송된 에스라 병원을 찾아왔던 사미르의 친척은 같은 사건으로 부상을 당한 사람이 여러 명 더 있으며 병원에서 보기도 했다고 말했다. 또한 그 날 이 지역에는 공습이 없었고, 대신 대공포화가 가해졌다고 국제앰네스티에 진술했다.

-5월 6일, 사나의 누쿰 산 지역

국제앰네스티는 5월 6일 떨어진 대공포탄으로 부상을 입고 알 사와라 병원에 입원중인 9세 소년 살라(Salah)를 방문했다. 살라의 왼다리는 부러졌고 배, 골반, 오른발에 파열상을 입었다. 함께 병실에 있었던 살라의 삼촌은 5월 6일 살라가 사는 누쿰 산에서 부상을 당한 것으로, 당시 살라는 형제, 사촌들과 함께 거리에 있었다고 한다.

“우리는 [거리에서] 놀고 있었어요. 오후 5시였고 기도할 시간이었어요. 비행기가 나타났는데 라자(대공무기)로 비행기를 맞추려고 했어요.”

살라의 삼촌은 이 주변에서 대공포화는 정기적으로 이루어지는 것이라고 전했다. “[이 지역을] 항상 공격하고 있어요. 이제 파편을 보면 ‘라자(대공무기)’를 쏜 것인지 알 수 있게 됐죠. … 2주 전에도 비슷한 남자아이와 노인이 라자에 다친 적이 있어요.” 그는 살라가 한 달 이내에 다시 걸을 수 있을 것으로 기대하고 있었다.

-5월 5, 6일, 사나 다마르 알 가르 지역

국제앰네스티가 만난 아말(Amal)은 다마르 알 가르 지역에 사는 여성으로, 10~11일 전 마을에 떨어진 대공포탄으로 부상을 입고 알 차우라 병원에서 회복 중이었다. 아말은 아이들을 데리고 나서려던 차에 포탄이 떨어졌고, 동네의 학교 근처에 있었던 그녀는 큰 부상을 입었다고 했다. 또 사람들이 머리 위에서 비행기가 나는 소리를 들었지만 직접 보지는 못했으며, 그 날 이 지역에 공습이 이루어진 적은 없다고도 했다.

-5월 11일, 누쿰 산 무기고 공습

2015년 5월 11일 오후 공습이 가해질 당시 현장에 있었던 아흐마드(Ahmad)는 공습이 끝나고 4차례의 커다란 폭발음을 들었다고 국제앰네스티에 전했다. 공습으로 산 속에 있던 무기고가 피격을 당했고, 곧 연이어서 2차 폭발로 이어졌다. 아흐마드는 2차 폭발이 다음 날 아침 7시까지 끊임없이 계속됐다고 전했다. 또한 산 속에 저장되어 있던 대공무기가 이 지역에 “비 오듯” 떨어졌다고도 했다. 아흐마드는 무기고가 인구 밀집 거주 지역으로부터 약 200~250미터 떨어진 곳에 있었을 것이라고 추정했다.

2차 폭발 부상자인 누쿰 산 주민 바셀(16)은 공습이 시작됐을 때 해당 지역 여성들의 대피를 돕고 있었다고 한다.

“오후 6시 30분 공습이 시작되기 직전까지 여성들을 이 지역에서 대피시키려고 애쓰고 있었어요. 친척들과 함께 감단 학교 앞에 있었죠. 군인들은 아무도 없었고, 사람들이 도망치고 있었어요. 저는 걸어가다가 파편에 맞았어요. 한 남자가 차를 타고 와서 저를 병원으로 데려갔어요. 어머니 역시 파편에 맞으셨죠.”

또한 국제앰네스티는 5월 11일 누쿰 산 근처의 집에서 2차 폭발에 부상을 당한 4세 소년 피라스를 만나, 병원에 함께 있던 친척과 인터뷰를 가졌다. 피라스는 왼손과 오른다리를 파편에 맞아 크게 다친 상태였고, 피라스의 어머니 역시 얼굴에 파열상을 입었다고 전했다.

Yemen: Scores of civilians killed and injured by anti-aircraft fire and airstrikes on weapons depots

Scores of casualties in Sana’a have been caused by anti-aircraft munitions shot by the Huthi armed group which detonated after landing in populated areas killing and maiming civilians, said Amnesty International.

During a week-long trip to the Yemeni capital, the organization spoke to medical staff at nine hospitals and residents who said that anti-aircraft weapons were the leading cause of casualties in the capital. Saudi Arabian-led coalition airstrikes against weapons depots in residential areas have triggered further explosions, also killing and injuring other civilians.

“Sana’a’s residents are caught in a deadly crossfire between the Saudi Arabian-led coalition airstrikes and anti-aircraft fire from the Huthi armed group. Both sides have failed to take the necessary precautions to protect civilian lives in violation of the laws of war. Instead they have carried out attacks that have had devastating consequences for the civilian population,” said Lama Fakih, Senior Crisis Advisor at Amnesty International.
“For the civilians affected, it doesn’t matter which side is responsible. They pay the same price.”

Anti-aircraft fire

A doctor at al-Thawra hospital, one of the largest public hospitals in Sana’a, told Amnesty International that the vast majority – around 90% – of war wounded patients admitted to the hospital had been injured by anti-aircraft fire. He said that before the five-day ceasefire last week around 17-23 patients with such injuries were admitted to the hospital daily. A second doctor working at the hospital also confirmed that the majority of the 1,024 wounded patients treated there during the first month of the conflict, had also been injured by anti-aircraft fire.

This was backed up by staff at the German-Saudi hospital and al-Mu’yyad Modern Hospital, where a doctor told Amnesty International that the majority of the wounded treated there were women and children suffering from fragmentation injuries caused by anti-aircraft fire.

“The sheer number of injuries caused by anti-aircraft fire in Sana’a points to a disturbing pattern of attacks in which the obligation under international law to protect civilians during a conflict is being flouted,” said Lama Fakih.

Amnesty International also met the parents of a child killed and four civilians who were injured by anti-aircraft fire, including a nine year old boy who was left with a broken leg and fragmentation wounds in his stomach, groin and foot.

Fatmeh, a mother of two, was injured along with her one-and-a-half-year-old-baby, when an anti-aircraft projectile struck their home in Sana’a on 30 March. She was left with several fragmentation injuries to her head, hand and body.

The parents of Karim Ali al-Sagheer Farhan, 13, described to Amnesty International how their son was killed by an anti-aircraft projectile on 27 April while he was leaving his home for the mosque for the noon prayer.

“I heard him scream Allahu Akbar and he was saying the shahada. I pulled my abaya on and then saw the neighbours taking him to the hospital…I knew it was anti-aircraft weaponry from the noise. There was no shelling that day,” Karim’s mother said.

The Huthi armed group’s apparent use of anti-aircraft weaponry which detonates on impact either with an aircraft or when it has landed, known as contact fuzing, or misuse of air-burst munitions, has killed and maimed civilians, and amounts to a failure to take adequate precautions to protect the civilian population, which is a violation of international humanitarian law.

Air-burst anti-aircraft weaponry is designed to detonate in the air, potentially reducing civilian casualties. Video of Huthi anti-aircraft fire taken in Sana’a on 20 May clearly shows that at least in some instances they are using air-burst munitions.

Amnesty International calls on the Huthi armed group not to use any contact fuzed anti-aircraft weaponry and to take additional precautions to protect civilians when firing other anti-aircraft munitions, including air-burst. The Huthi armed group and the Ansarullah political wing should also investigate cases in which civilians have reportedly been harmed by their anti-aircraft weaponry and compensate those who have been harmed, including by paying for medical treatment and to repair damaged property.

Airstrikes on weapons depots

Many of the other civilian victims in the hospitals Amnesty International visited were injured by secondary explosions when attacks by Saudi Arabian-led coalition aircraft struck a weapons cache in the Mount Nuqum neighbourhood on 11 May.

Amnesty International interviewed four residents of Mount Nuqum who witnessed the attack and seven others who were injured in secondary explosions caused by the air strikes, including four children and two women. One of the women interviewed said that her son was killed in the same blast that had injured her. Around 40 people were killed in the strike according to the Ministry of Health, although Amnesty International could not independently verify this figure. Nearly 140 people injured in the attack were admitted for treatment at al-Thawra and Kuwait hospitals according to hospital staff and records.

Scores of residents were also injured in an earlier airstrike on a weapons depot in Faj ‘Attan, on the outskirts of Sana’a, on 20 April.

All of the residents affected by the Mount Nuqum or Faj ‘Attan blasts told Amnesty International that no advance warning was given by coalition forces of an impending attack despite the apparent feasibility of such warnings and the likelihood that civilians living in such close proximity to the known storage facilities would be injured by secondary blasts. Failing to give an effective advance warning under these circumstances is a violation of the rules of international humanitarian law. The extensive harm to the civilian population resulting from these attacks also raises concerns about the proportionality of these strikes.

Amnesty International calls on Saudi Arabia and other coalition states involved in the airstrikes to take all feasible precautions to minimize the risks posed to civilians, as required by international humanitarian law. This includes cancelling or suspending an attack if it becomes apparent that the target is not military or that the attack is likely disproportionate; and giving effective advance warning of attacks which may affect civilians, unless circumstances do not permit. The Huthi armed group should also move its military positions away from populated civilian areas where feasible, Amnesty International said.

Given the mounting casualties in Yemen, Amnesty International is also calling on all states supplying weapons, ammunition, training or any other military technology/assistance to Saudi Arabia to exercise extreme caution and demonstrate that any military transfers will not fuel further civilian deaths and injuries.

“As airstrikes and anti-aircraft fire resume across Yemen, the number of civilian casualties is already beginning to rise,” said Lama Fakih.

“So far both sides have displayed a chilling indifference to the deadly impact of their actions on civilians. All parties to the conflict can and should take all feasible steps to minimize the risk to civilians.”

Coalition airstrikes have caused hundreds of civilian deaths since they began on 25 March 2015. Amnesty International has documented a number of cases in which airstrikes may have violated the rules of international humanitarian law.

Cases. Civilians injured or killed by anti-aircraft fire

Amnesty International spoke with Fatmeh, 24, a mother of two who was injured along with her one and a half year old child on 30 March by an anti-aircraft projectile that hit their home in Sa’wan, Sana’a. At around 9pm a projectile struck their home injuring both of them. She had fragmentation injuries in her right hand, right armpit, and head. Her son suffered from fragmentation injuries to the head and to his hand. Her son had two operations to treat his injuries, her family could not afford to cover the costs of surgery to remove the fragments lodged in her head. She told Amnesty International that she was suffering from debilitating headaches, at times causing her to lose her sight, as a result. Amnesty International visited their home and observed the damage caused by the projectile. The physical evidence was consistent with an anti-aircraft strike.

Fatmeh’s husband also told Amnesty International that in the days he spent with his son while he was recovering in the al-Thawra hospital more than 10 people came into the emergency room every day who were suffering from anti-aircraft projectile injuries.

27 April, Shumaylah neighbourhood, Sana’a

Amnesty International also spoke with the parents of Karim Ali al-Sagheer Farhan, 13, who was killed by an anti-aircraft projectile on 27 April. Karim’s mother, who was home at the time of the strike, said that at 12pm she heard an anti-aircraft projectile strike in front of the house and then heard her son cry out:

“I heard him scream Allahu Akbar and he was saying the shahada. I pulled my abaya on and then saw the neighbours taking him to the hospital…I knew it was anti-aircraft weaponry from the noise. There was no shelling that day,” she said.

Karim’s mother and father went to the Yemen Jordan hospital where they were told by doctors and neighbours that their son had a shrapnel injury to the stomach and would need to undergo an operation. Karim’s father told Amnesty International that he was certain the injury was caused by an anti-aircraft projectile. Describing what happened, he said:

“[Karim] was at the gate of the house going to the mosque for the noon prayer. The anti-aircraft projectile failed to detonate in the sky and hit the ground and his stomach was hit with shrapnel…he went into surgery, but didn’t survive. From the impact of the strike and what people said who were at the site after he was injured we knew it was an anti-aircraft weapon. The whole area heard the explosion. There were no airstrikes here… A second shell hit the roof on Monday but it didn’t detonate.”

Karim’s father showed Amnesty International the projectile that hit the roof. He said the anti-aircraft fire was coming from Jabal al-Nahdayn, a Huthi armed group stronghold. He also provided Amnesty International with a copy of Karim’s medical records which stated he was injured by anti-aircraft fire.

5 May, Beit Baws neighbourhood, Sana’a

On 5 May at around 11AM, on his walk home from work, Sameer, 50, was injured by an anti-aircraft projectile on 50 Meter Road at a qat market in the Beit Baws area, his relative told Amnesty International. Sameer, who was badly injured in the attack, was still recovering in the intensive care unit at the al-Thawra hospital nearly two weeks after the incident. His relative, who visited him in the Essra’ Hospital where he was taken directly after the attack said that several other men were injured in the same incident and that he saw them at the hospital. He told Amnesty International that that day there were no airstrikes in the area, but that there was anti-aircraft fire.

6 May, Mount Nuqum neighbourhood, Sana’a

Amnesty International visited, Salah, 9, in the al-Thawra hospital where he was recovering from injuries sustained from an anti-aircraft projectile on 6 May. His left leg was broken and he had fragmentation injuries to his stomach, groin, and right foot. Salah’s uncle, who was with him in the hospital, told Amnesty International that Salah was injured while in Mount Nuqum, where he lives, on 6 May. He said that at the time Salah was in the street with his siblings and cousins.

“We were playing [in the street]” Salah said. “It was 5PM, prayer time. The plane was there and they tried to hit it with the Raja [anti-aircraft weaponry].”

Salah’s uncle told Amnesty International that anti-aircraft fire was a regular occurrence in their neighbourhood. “They are always striking [this area],” he said. “We’ve started to know from the remnants when it is a Raja [anti-aircraft weaponry]…two weeks before another boy and an older man were also injured by a Raja.” He was optimistic that Salah would be walking again in one month

5 or 6 May, Damar al-Ghar neighbourhood, Sana’a

Amnesty International spoke to Amal, a woman from the Damar al-Ghar neighbourhood who was recovering from injuries at the al-Thawra hospital from an anti-aircraft projectile that hit the neighbourhood 10 or 11 days before. Amal said that she was getting kids from the family together to leave the area when the projectile struck, injuring her near a school in her neighbourhood. She said that they heard the plane overhead but she did not see it, and that no airstrikes struck the neighbourhood that day.

Mount Nuqum, airstrike on weapons depot on 11 May 2015

Ahmad, a resident of Mount Nuqum present during the airstrike early in the evening on 11 May 2015, told Amnesty International that he heard four large explosions following aerial attacks. The airstrikes hit a weapons cache in the mountain which then set off a series of secondary explosions and projectiles. Ahmad said that the secondary projectiles continued to go off until 7am the next day. He said that anti-aircraft weapons that had been stored in the mountain were “dropping like rain” on the neighbourhood. Ahmad estimated that the weapons cache was about 200-250 meters away from the homes in the congested residential area.

One of the residents injured in the secondary blasts was Bassel, a 16-year-old resident of Mount Nuqum who was helping to evacuate women from the area after the strikes had started. He told Amnesty International:

“I was trying to evacuate women from the area just before the strike at 6:30pm. We were in front of the Ghamdan School with our relatives. There were no fighters there. People were running away. I was walking when I was hit. One guy came in a car and took me to the hospital. My mom was also hit with shrapnel.”

Bassel’s right leg was amputated below the knee as a result of his injury.

Amnesty International also met Firas, a four year old who was injured in his home near to Mount Nuqum on 11 May from a secondary explosion, and spoke to a relative who was with him at the hospital. Firas’ left hand and right leg had been injured by shrapnel. His mother, the relative told us, also had a fragmentation injury to her face.

국제앰네스티는 구금시설을 철저하게, 독립적으로 감시하기 위한 방법으로 유엔 고문방지협약 선택의정서(UN Optional Protocol to the Convention against Torture, OPCAT)를 즉시 비준할 것을 호주 정부에 촉구한다.

참파 파텔(Champa Patel) 국제앰네스티 동남아시아태평양 상임조사고문은 “복면을 씌우고 의자에 포박하는 등 관타나모 수용소를 연상시키는 악명 높은 전략으로, 유엔 아동권리협약과 고문방지협약을 모두 위반하는 충격적인 행위에 해당한다. 호주의 소년원제도를 철저히 재정비하는 한편, 그 일환으로 법집행 및 교정제도 내에서의 의자포박, 복면 사용을 즉시 금지할 것을 요청한다”고 말했다.

그는 이어 “성인 남성 3명에게 강제로 옷이 벗겨지며 고통스러워하는 한 어린이의 모습과 아이들이 최루가스에 숨이 막혀가는 가운데 들려오는 교도관들의 웃음소리는 수년간 노던 준주 및 호주 전역 구금시설에서의 아동 인권 보호 증진 요청을 묵살해 왔던 결정권자들의 뇌리에 강렬히 각인되어야 한다”고 말했다.

7월 26일, ABC의 방송프로그램‘포 코너스(Four Corners)’는 호주 노던 준주의 다윈에 위치한 돈 데일 소년원에서 2010년부터 2015년까지 구금된 10대 소년들을 학대하는 교도관들의 모습이 담긴 영상을 공개했다.

끔찍한 영상

이 끔찍한 영상에서 소년들은 바닥에 내동댕이쳐지고 욕설을 듣거나, 강제로 옷이 벗겨져 나체로 독방에 감금되었다. 일부 아이들은 수도도 없고, 햇빛도 거의 들지 않는 감방에서 거의 하루 24시간을 갇혀 지내며 학교에 다니거나 교육자료를 접할 기회도 박탈당했다.

얼굴에 복면을 씌우는 관행은 특히 관타나모 수용소와 아부그라이브(Abu Ghraib) 교도소에서 주로 사용되는 것으로, 다수의 인권단체가 고문 및 잔혹하고 비인도적이며 굴욕적인 대우에 해당한다고 지적했다.

의자에 포박하는 것이 다른 안전한 대체안보다 더 효과적인 법집행수단이라는 증거는 없다.

이번 공개된 영상에는 교도관들이 소년 5명이 갇혀 있는 격리구금시설에 최루가스를 남용하는 모습도 담겨 있다. 이 시설은 제대로 환기가 되지 않고 출구도 없어 신체적 부상, 질식은 물론 사망까지 이를 수 있는 위험이 더욱 높았다.

참혹한 학대

국제앰네스티 호주지부는 노던 준주 소년원에서 최루가스를 사용하는 등의 학대행위에 대해 계속해서 우려를 제기했으며, 지난 5년간 다른 2개주 지역에서 이와 비슷하게 심각한 학대가 이루어진 것에 대해서도 대응한 바 있다.

국제앰네스티는 호주 정부에 유엔 고문방지협약 선택의정서(OPCAT)를 비준하고 소년원에 대한 독립적인 감사가 이루어지도록 할 것을 다른 단체들과 함께 수년간 촉구해 왔다. 현재 호주는 고문방지협약 선택의정서 서명국이지만 아직 비준하지는 않았다. 이 선택의정서를 비준하면 모든 구금시설을 무제한적으로 방문할 수 있는 독립적 국가기관(National Preventive Mechanism, NPM)을 설립해야 한다.

파텔 상임고문은 “호주의 사법권 내 모든 지역정부에게 구금시설에서의 부당대우에 관한 책임을 묻기 위해서는 고문방지협약 선택의정서를 비준해야 한다. 이번에 공개된 충격적인 영상은 호주 정부가 이를 더 이상 미룰 수 없게 되었음을 증명한다. 어린이들이 끔찍한 학대에 시달리고 있다”고 말했다.

차별

ABC가 공개한 영상은 호주에서 선주민 구금률이 부끄러울 정도로 높다는 것을 재차 강조하는 것이기도 했다. 선주민 청소년이 구금될 확률은 비선주민 청소년보다 26배 이상 높았다. 호주 선주민과 토레스해협 선주민 청소년이 호주의 10세부터 17세 사이 청소년 인구에서 차지하는 비율은 5%를 조금 넘는 정도에 불과하지만, 구금된 청소년 중에서는 절반 이상(59%)을 차지하고 있다.

국제앰네스티 호주지부는 지난해 발표한 보고서를 통해 웨스턴, 퀸즈랜드, 노던 준주의 상황이 특히 더욱 심각한 수준이며, 호주 전역에 변화가 시급하다고 강조했다.

참파 파텔 상임고문은 “이번에 공개된 영상 속의 소년들이 선주민인 것은 우연의 일치가 아니다. 유엔 고문방지협약에서는 차별이 고문과 부당대우로 이어질 수 있다고 인정하고 있다. 선주민에 대한 뿌리깊은 인종차별과 의료, 교육, 주거의 거대한 불평등을 해결하지 못한 호주 정부는 이와 같은 학대 문화가 만연하도록 방치하고 있다”고 말했다.

배경

2012년 아동인권위원회(Committee on the Rights of the Child, CRC)는 호주의 소년사법제도가 국제기준에 상응하는 수준이 되려면 상당한 개정이 필요하다고 밝혔으며, 일례로 호주에서 형사책임이 인정되는 최소 연령은 10세로, 아동인권위원회가 국제적으로 인정하는 최소 연령보다 두 살 어리다는 점을 지적했다.

Australia: Guantanamo-style abuse of child prisoners shows current detention system has failed

Chilling footage showing detained Indigenous children being tear gassed and a child being hooded and strapped to a restraint chair in Australia’s Northern Territory must serve as a wakeup call for the government on the need to urgently change its policies on juvenile detention, Amnesty International said today.

The organization is calling on Australia’s authorities to immediately ratify the UN Optional Protocol to the Convention against Torture (OPCAT) as a way of ensuring that detention facilities are thoroughly and independently monitored.

“Hooding and the use of restraint chairs are notorious tactics that recall the horrors of Guantanamo Bay – they constitute a shocking violation of both the UN Convention on the Rights of the Child and the Convention against Torture. We are calling for an immediate prohibition on the use of restraint chairs and hooding for law enforcement and in the prison system, as part of a complete overhaul of Australia’s juvenile detention system,” said Champa Patel, Amnesty International’s Senior Research Adviser for South East Asia and the Pacific.

“The image of a distressed child being forcibly stripped by three men, and the sound of guards laughing while children choke on teargas, should be ingrained on the minds of Australia’s leaders, who for years have ignored calls for better protection of children’s human rights in detention facilities in Northern Territory and across the country.”

On Monday 26 July ABC’s Four Corners Program screened footage of the Don Dale Youth Detention Centre in Darwin, Northern Territory which showed prison officials abusing detained teenage boys from 2010 to 2015.

Chilling scenes

In a series of chilling scenes, the boys were shown being knocked to the floor and verbally abused, or forcibly stripped and then left naked and alone in locked rooms. Some were kept locked in their cells for almost 24 hours a day with no running water, little natural light, and were denied access to school and educational material.

A number of human rights bodies have determined that the practice of hooding, most notably used at Guantanamo Bay and in the Abu Ghraib prison camp, constitutes a form of torture and other cruel, inhuman and degrading treatment.

There is no evidence that the use of restraint chairs is more effective as a means of law enforcement thansafer alternatives.

The film also shows prison officials misusing tear gas by pumping it into a confined isolation unit where five boys were locked in their cells with limited ventilation and no exit, increasing the risk of physical injury, suffocation and even death.

Horrendous abuse

Amnesty International Australia has repeatedly raised concerns about tear gassing and other abuses in Northern Territory youth detention centres, and in the past five years has also responded to similar serious allegations in two other states.

Amnesty International, along with others, has for years been calling on Australia to ensure that youth detention centres are being independently inspected by ratifying the UN Optional Protocol to the Convention against Torture (OPCAT). Australia is currently a signatory to OPCAT, but has not yet ratified it. Ratification would mean the establishment of a National Preventative Mechanism (NPM), an independent national body which would have unlimited access to all places of detention.

“Only after it ratifies OPCAT can the Australian Government, and all states and territories in its jurisdiction, be held to account for the mistreatment of people in detention facilities. This alarming new footage proves that Australia cannot delay any longer – children are suffering horrendous abuse,” said Champa Patel.

Discrimination

The ABC footage has also highlighted, once again, the shameful rate of Indigenous incarceration in Australia. In 2013–2014, Indigenous young people were 26 times more likely to be in detention than non-Indigenous young people. Aboriginal and Torres Strait Islander young people make up just over five per cent of the Australian population of 10 to 17-year-olds, but more than half (59 per cent) of those in detention.

In a report released last year, Amnesty International Australia stressed that the situation is particularly bad in Western Australia, Queensland and the Northern Territory and highlighted the urgent need for change throughout Australia.

“It is no coincidence that the boys seen in this footage are Indigenous – the UN Convention on Torture acknowledges that discrimination paves the way for torture and ill-treatment. By failing to tackle entrenched racism against Indigenous people and huge inequalities in health, education and housing, the Australian government has allowed this culture of abuse to flourish,” said Champa Patel.

In 2012 the Committee on the Rights of the Child (CRC) said that Australia’s juvenile justice system required substantial reform before it would meet international standards, noting, for example, that children in Australia are held criminally responsible from the age of 10, two years younger than the CRC’s internationally acceptable minimum.

킴벌리 프로세스는 반정부 무장단체의 자금원으로 쓰이는 소위 ‘블러드 다이아몬드(blood diamonds)’의 국제적 유통을 막기 위해서라는 의도로 지난 2003년 마련된 인증체계이나, 국제앰네스티의 2015년 9월 발표한 보고서를 통해 킴벌리 프로세스의 제도적인 약점이 밝혀졌다. 일례로 중앙아프리카공화국(CAR)의 무장단체들은 채굴한 다이아몬드를 내수시장에서 유통하는 방법으로 킴벌리 프로세스를 피해 국제적으로 수출하여 이익을 얻고 있다.

오는 2016년 1월 1일이면 세계 최대 규모로 다이아몬드 거래가 이루어지는 아랍에미리트연합(UAE)이 킴벌리 프로세스의 다음 의장국이 된다. 국제앰네스티는 보고서를 통해, 두바이 면세 지역의 경우 다이아몬드 유통업체에 대해 개발도상국의 희생으로 막대한 이익을 창출하도록 오히려 장려하는 등 UAE의 ‘블러드 다이아몬드’ 유통 규제 제도에 다수의 허점이 존재한다고 공개한 바 있다.

루시 그라함 조사관은 “UAE와 같은 국가 정부는 리더십을 발휘해야 한다. 이를 위해서는 다이아몬드 업체들이 공급체계에서 발생하는 불법행위와 중대한 인권침해에 대해 책임을 다하도록 하는 새로운 법률을 제정해야 할 것”이라고 말했다.

Time for diamond companies to stop hiding behind Kimberley Process

Diamond companies must stop using the Kimberley Process to claim that their diamonds are free from human rights abuses and conflict, Amnesty International said as the certification scheme holds its annual plenary in Luanda, Angola.

The Kimberley Process was created with good intentions in 2003 to stop so-called “blood diamonds” that fund rebel groups from entering global markets. But a September 2015 Amnesty International report exposed systemic weaknesses in the scheme. Armed groups in the Central African Republic (CAR), for example, are profiting from the country’s internal diamond trade, with diamonds from CAR finding their way into global markets despite a Kimberley Process export ban.

“The Kimberley Process was created to stop the international trade in blood diamonds, but it has not even achieved that limited goal. Meanwhile, the ethical problems facing the diamond sector have grown: our report exposed child labour, smuggling, exploitative working conditions and tax-evasion issues,” said Lucy Graham, Researcher in Amnesty International’s Business and Human Rights team.

“Despite evidence exposing the clear need for change, the diamond industry reacted defensively to our report and ignored the issues we raised. They continue to hide behind the veneer of respectability offered by the Kimberley Process rather than taking responsibility for what happens along their supply chains.”

The United Arab Emirates, one of the world’s biggest diamond trading centres, is expected to take over the rotating chair of the Kimberley Process on 1 January 2016. Amnesty International’s report exposed loopholes in the UAE’s system for preventing the trade in blood diamonds while finding that Dubai’s Tax Free Zone encourages diamond traders to make massive profits at the expense of developing countries.

“Governments like the UAE need to show leadership. This means new laws that ensure companies take responsibility for illegal acts and serious human rights abuses in their diamond supply chains,” said Lucy Graham.

12월 21일, 에콰도르 경찰은 모로나 산티아고에 위치한 수아르-아추아르 공동주립연방센터 시설에 강제 진입하고 선주민 인권옹호자 아구스틴 와차파 대표를 체포했다.

최근 모로나 산티아고의 동광 건설 계획에 반대하고 나섰던 수아르 선주민들이 정부로부터 일련의 폭력행위와 괴롭힘, 압력을 당한 데 이어 와차파 대표 역시 체포된 것이다.

선주민 인권옹호자를 체포하기 앞서, 에콰도르 내무부는 12월 20일 지역 단체인 환경행동협회(Corporación Acción Ecológica)를 폭력행위 혐의로 고발했다. 이들은 SNS에 해당 지역에서 채광을 할 경우 미치게 되는 환경 영향에 대한 정보를 게시하고, 이로 인해 벌어질 수 있는 인권침해도 함께 강조했었다.

3월 8일 EU 정상들과 터키 간 회담 이후에 국제앰네스티는 난민 재정착에 무조건적인 노력을 기울이고 유럽으로 향하는 안전하고 합법적인 경로를 제공해야 하는데, 그 대신 난민과 이주민들을 터키에 돌려보내는 방법에만 계속해서 집착하는 것은 난민 위기에 충격적일 만큼 근시안적이고 비인도적인 태도를 보여주는 것이라고 밝혔다.

아흐메트 다부토울루 터키 총리와 도널드 투스크 EU 상임의장, 장 클로드 융커 유럽집행위원회(EC) 회장은 3월 17일과 18일 열리는 EU 정상회담에 앞서 EU-터키간 최종 합의를 위한 난민 대응 계획의 윤곽을 공유했다.

그리스의 시리아 난민 전원을 터키로 돌려보내고 일부의 난민만을 유럽에 수용하겠다는 이번 계획은 윤리적, 법적 문제를 초래한다. 유럽에서 제공되는 시리아 난민 재정착지는 목숨을 걸고 위험한 뱃길에 올라 그리스로 향했던 시리아 난민들을 대가로 한 것이다.

이베르나 맥고완(Iverna McGowan) 국제앰네스티 유럽국장은 “EU와 터키 정상들은 이날 회담에서 사실상 세계에서 가장 취약한 사람들의 존엄성과 인권을 거래 수단으로 팔아 넘기며 최악의 모습을 보였다. 난민과 난민을 맞교환한다는 발상은 위험하리만치 비인간적일뿐만 아니라, 당면한 인도주의적 위기에 대해 장기적으로 지속가능한 해결책이 될 수도 없다”고 말했다.

이번 계획이 국제법상 적법한가 하는 의혹에 대해 EU 정상들은 EU법상 터키가 ‘안전 국가’로 지정되면 가능할 것이라고 답했다.

국제앰네스티는 ‘안전한 제3국’이라는 개념에 강력히 이의를 제기한다. 충분하고 공정한 절차를 거쳐 망명 신청이 받아들여져야 할 권리를 침해함은 물론, 이후 본국으로 강제송환되는 결과로 이어져 강제송환을 금지하는 농르풀망 원칙을 위반할 수 있기 때문이다. 특히 터키는 현재 국내 상황과 이주민과 난민에 대한 처우를 봤을 때 상당한 우려를 낳고 있다.

맥고완 국장은 “터키는 시리아 난민들을 시리아로 강제송환시켰던 바 있고, 지금도 수많은 난민들이 적절한 주거지 없이 절박한 상황 속에 살아가고 있다. 난민 어린이 수만 명은 정규 교육을 받지 못하는 상태다. 유럽이 편리하게 의무를 떠넘길 수 있는 ‘안전한 제3국’으로 간주하기에는 아무리 생각해도 불가능한 일”이라고 덧붙였다.

시리아 난민이 아니더라도 국제적인 보호가 필요한 사람들은 터키로 송환하지 않겠다고 주장하고는 있으나, 대규모로 송환이 이루어지는 제도하에서 이러한 일부 개개인의 권리를 어떻게 보장할 것인가에 대해서는 분명한 설명이 부족한 상태다. 모든 난민들이 시리아 출신이 아니라는 것과, 터키의 난민 제도는 제대로 기능하지 않고 있다는 것이 현재 닥친 현실이다.

이번 계획은 망명 신청이 가능하게 해야 할 EU의 의무를 완전히 웃음거리로 만들었다. 누구든 공정하고 강력한 망명 신청 절차를 밟을 권리가 있다는 원칙에 기반하지 않은 송환 제도는 매우 큰 문제의 소지가 있다.

맥고완 국장은 “이라크와 아프가니스탄 난민들은 시리아 난민과 함께 그리스에 도착하는 난민들 중 약 90%를 차지한다. 이들이 국제적인 보호를 강력히 요구한다는 것을 알면서도 터키로 돌려보낸다면 난민 인권을 존중하겠다는 EU의 주장이 허황됨을 드러낼 뿐”이라고 말했다.

투스크 의장은 또한 서부 발칸반도 지역의 입국 경로를 폐쇄할 것이라고도 언급했다. 이 경로를 차단할 경우 수천여 명의 난민들이 추위 속에서 계획도 없이 시급한 인도적 요구와 국제적으로 보호받을 권리로부터 방치되는 결과로 이어진다.

유럽연합과 국제사회는 난민 위기를 해소하기 위해 인도적, 재정적 지원을 제공하고 더 많은 수의 난민을 수용해 재정착시키는 등 시급히 행동에 나서야 할 것이다.

EU Turkey Summit: EU and Turkish leaders deal death blow to the right to seek asylum

The persistent preoccupation with shipping people back to Turkey instead of making unconditional efforts on resettlement and offering other safe and legal ways to Europe shows an alarmingly short-sighted and inhumane attitude to handling this crisis, said Amnesty International after European Council talks with Turkey today.

Prime Minister of Turkey Ahmet Davutoğlu, President of the European Council Donald Tusk and President of the European Commission Jean Claude Juncker shared the outline of the plan for a final agreement between the EU and Turkey, in advance of the European Council meeting on 17 and 18 March.

The proposal that for every Syrian refugee returned to Turkey from Greece, a Syrian will be settled within the EU is wrought with moral and legal flaws. Unsettlingly, this plan would make every resettlement place offered to a Syrian in the EU contingent upon another Syrian risking their life by embarking on the deadly sea route to Greece.

“EU and Turkish leaders have today sunk to a new low, effectively horse trading away the rights and dignity of some of the world’s most vulnerable people. The idea of bartering refugees for refugees is not only dangerously dehumanising, but also offers no sustainable long term solution to the ongoing humanitarian crisis,” said Iverna McGowan, Head of Amnesty International’s European Institutions Office.

When questioned on the legality of this proposal under international law, EU leaders responded that this would be possible under EU law once Turkey be designated as a ‘safe country’.

Amnesty International strongly contests the concept of a ‘safe third country’ in general, as this undermines the individual right to have asylum claims fully and fairly processed and may result in individuals being subsequently deported to their country of origin – in violation of the principle of non-refoulement. In the case of Turkey in particular, there is huge cause for concern given the current situation and treatment of migrants and refugees.

“Turkey has forcibly returned refugees to Syria and many refugees in the country live in desperate conditions without adequate housing. Hundreds of thousands of refugee children cannot access formal education. By no stretch of imagination can Turkey be considered a ‘safe third country’ that the EU can cosily outsource its obligations to,” she added.

Although it was claimed that those needing international protection that are not Syrian would not be returned to Turkey, it has not been made clear how those individual rights could be guaranteed in the context of a system of mass returns. The reality is that not all asylum seekers are coming from Syria, and Turkey does not have a fully functioning asylum system.

The proposal makes a mockery of the EU’s obligation to provide access to asylum at its borders. Any returns system not built on the principle of an individual’s right to access a fair and robust asylum process is deeply problematic.

“Iraqi and Afghan nationals, along with Syrians, make up around 90 percent of arrivals to Greece. Sending them back to Turkey knowing their strong claim to international protection will most likely never be heard reveals EU claims to respect refugees’ human rights as hollow words,” said Iverna McGowan.

It was also stated by President Tusk that the Western Balkans route would be closed. Closure of this route would lead to thousands of vulnerable people being left in the cold with no clear plan on how their urgent humanitarian needs and rights to international protection would be dealt with.

It is urgent that the European Union and the international community as a whole urgently step up their commitment to solving this crisis, both in terms of humanitarian and other financial assistance and by resettling far greater numbers of refugees.

또한 국제앰네스티는 현재 복역 중인 모든 양심수를 석방할 것을 촉구하고, 그 외의 수감자들 모두 석방하거나 국제공정재판 기준에 따라 즉시 재판에 부칠 것, 독립적 감시단이 모든 구금시설을 자유롭게 즉각 방문할 수 있도록 허용할 것을 요청하고 있다.

이번 보고서에 수록된 인권자료분석그룹(Human Rights Data Analysis Group)의 새로운 통계자료도 주목할만한 내용이다. 모든 단계에서의 인권침해

생존자 대다수는 수용소에 발을 들이기 전에도, 체포된 순간부터 이송되는 과정까지 인권침해가 계속됐다고 증언했다.

구금시설에 도착하면 수감자들은 “환영회”라며 의례적으로 심한 폭행을 당했고, 실리콘 또는 쇠막대기, 전선을 동원하는 경우도 많았다. 하마 인근에서 체포된 변호사 사메르는 “그들은 우리를 짐승처럼 대했다. 가능한 한 가장 인간답지 않은 모습이 되기를 원했다. … 피가 강물처럼 흐르는 모습을 봤다. … 그들은 바로 그 때 그 자리에서 우리를 살해했더라도 아무런 문제가 없었을 것이다.” 라고 증언했다.

이러한 “환영회”에 이어 “보안 검사”가 이루어지는데, 특히 여성들은 이 과정에서 남성 교도관들에게 강간과 성폭행을 당했다고 한다.

보안시설의 수감자들은 심문 과정에서 무자비한 고문과 부당대우를 견뎌야 했고, 이러한 고문은 보통 “자백”이나 기타 정보를 얻어내기 위해, 또는 처벌의 일환으로 이루어졌다. 고문의 방법은 피해자의 신체를 타이어에 강제로 구겨 넣는 ‘둘라브(dulab)’와 발바닥에 채찍질을 가하는 ‘팔라가(falaga)’ 등이 있다. 또한 수감자들은 전기충격, 강간, 성폭행을 당하거나, 손톱, 발톱을 뽑히거나, 끓는 물에 화상을 입거나, 담뱃불에 지져지기도 했다.

홈즈의 군사보안시설 수감자였던 알리는 몇 시간에 걸쳐 손목으로 매달려 있는 ‘샤베흐(shabeh)’ 자세로 구금되어 있었으며, 반복적으로 폭행을 당했다고 증언했다.

지나치게 많은 인원을 구금하고, 식사 및 치료의 부족, 부적절한 위생시설 등 보안시설 내의 중첩된 열악한 환경은 잔인하고 비인도적이며 굴욕적인 대우에 해당하고, 이는 국제법상 금지되어 있다. 생존자들은 감방에 지나치게 많은 수감자들이 구금되어 번갈아가며 잠을 자거나, 쪼그린 채로 잠을 자야 했다고 증언했다.

또 다른 수감자 “지아드”(신원 보호를 위해 가명을 사용함)는 다마스커스의 235 군사보안시설에서 어느 날 환기장치가 작동을 멈추며 7명이 질식해 숨졌다고 증언했다. “그들은 산 사람과 죽은 사람을 구별하기 위해 발길질을 하기 시작했고, 나와 다른 생존자들에게 일어서라고 말했다. … 나는 그때서야 7명이 죽은 걸 알았고, 내가 지난밤 시신 7구의 옆에서 잠을 잤다는 걸 알았다. … [그 후] 복도에서 약 25구 정도의 다른 시신이 놓여있는 걸 봤다.”

수감자들은 음식과 식수, 위생시설 접근이 매우 제한적인 수준이었으며, 대부분 제대로 씻지 못하는 상태였다고 증언했다. 이러한 환경에서 옴과 이가 들끓었고, 질병이 만연했다. 대부분 제대로 된 치료를 받지 못했기 때문에 많은 경우 수감자들이 매우 기본적인 도구만으로 서로 직접 치료해야 했고, 이것이 2011년 이후 구금 중 사망자가 급격히 증가하는 원인이 됐다.

수감자들은 이러한 시설에 구금되어 있는 동안 일반적으로 주치의나 가족, 변호사와의 면담이 허용되지 않았고, 다수의 사례에서 이러한 대우는 강제실종에 해당한다.

세이드나야의 수감자들은 처음 몇 주 동안은 지하 감방에 구금된다. 겨울에는 살을 엘 듯이 추운 곳이지만 담요도 주어지지 않는다. 그 후 지상 감방으로 이감되지만 수감자들의 고통은 계속된다.

고문과 부당대우 생존자들의 대부분은 그들이 겪은 시련으로 신체적, 정신적인 상처를 입었다. 대다수가 석방 후 달아나 1,100만 명이 넘는 시리아 난민에 포함되었다. 국제앰네스티는 고문 생존자들이 신체적, 정신적 치료를 받음은 물론 재사회화에 필요한 사회적 지원도 제공받을 수 있도록 보장할 것을 국제사회에 촉구한다.

Harrowing accounts of torture, inhuman conditions and mass deaths in Syria’s prisons

The horrifying experiences of detainees subjected to rampant torture and other ill-treatment in Syrian prisons are laid bare in a damning new report published by Amnesty International today which estimates that 17,723 people have died in custody in Syria since the crisis began in March 2011 – an average rate of more than 300 deaths each month.

‘It breaks the human’: Torture, disease and death in Syria’s prisons documents crimes against humanity committed by government forces. It retraces the experiences of thousands of detainees through the cases of 65 torture survivors who described appalling abuse and inhuman conditions in security branches operated by Syrian intelligence agencies and in Saydnaya Military Prison, on the outskirts of Damascus. Most said they had witnessed prisoners dying in custody and some described being held in cells alongside dead bodies.

“The catalogue of horror stories featured in this report depicts in gruesome detail the dreadful abuse detainees routinely suffer from the moment of their arrest, through their interrogation and detention behind the closed doors of Syria’s notorious intelligence facilities. This journey is often lethal, with detainees being at risk of death in custody at every stage,” said Philip Luther, Director of Amnesty International’s Middle East and North Africa Programme.

“For decades, Syrian government forces have used torture as a means to crush their opponents. Today, it is being carried out as part of a systematic and widespread attack directed against anyone suspected of opposing the government in the civilian population and amounts to crimes against humanity. Those responsible for these heinous crimes must be brought to justice.

“The international community, in particular Russia and the USA, which are co-chairing peace talks on Syria, must bring these abuses to the top of the agenda in their discussions with both the authorities and armed groups and press them to end the use of torture and other ill-treatment.”

Amnesty International is also calling for all prisoners of conscience to be freed, and all others to be released or promptly tried in line with international fair trial standards, and for independent monitors to be allowed immediate and unfettered access to all places of detention

The report highlights new statistics from the Human Rights Data Analysis Group (HRDAG), an organization that uses scientific approaches to analyse human rights violations, which indicate that 17,723 people died in custody across Syria between March 2011 when the crisis began and December 2015. This is equivalent to an average of more than 300 deaths each month. In the decade leading up to 2011, Amnesty International recorded an average of around 45 deaths in custody in Syria each year – equivalent to between three to four people a month.

However, the figure is a conservative estimate and both HRDAG and Amnesty International believe that, with tens of thousands of people forcibly disappeared in detention facilities across Syria, the real figure is likely to be even higher.

For the launch of this report Amnesty International has also partnered with a team of specialists at Forensic Architecture, University of Goldsmiths to create a virtual 3D reconstruction of Saydnaya, one of Syria’s most notorious prisons. Using architectural and acoustic modelling and descriptions from former detainees, the model aims to bring to life the daily terror they experienced and their appalling detention conditions.

“Using 3D modelling techniques and the memories of those who survived horrendous abuse there, for the first time we are able to get a true glimpse inside one of Syria’s most notorious torture prisons,” said Philip Luther.

Abused at every stage

The majority of survivors told Amnesty International that the abuse would begin instantly upon their arrest and during transfers, even before they set foot in a detention centre.

Upon arrival at a detention facility detainees described a “welcome party” ritual involving severe beatings, often using silicone or metal bars or electric cables.

“They treated us like animals. They wanted people to be as inhuman as possible… I saw the blood, it was like a river… I never imagined humanity would reach such a low level… they would have had no problem killing us right there and then,” said Samer, a lawyer arrested near Hama.

Such “welcome parties” were often described as being followed by “security checks”, during which women in particular reported being subjected to rape and sexual assault by male guards.

At the intelligence branches detainees endured relentless torture and other ill-treatment during interrogation, generally in order to extract “confessions” or other information or as a punishment. Common methods included dulab (forcibly contorting the victim’s body into a rubber tyre) and falaqa (flogging on the soles of the feet). Detainees also faced electric shocks, or rape and sexual violence, had their fingernails or toenails pulled out, were scalded with hot water or burned with cigarettes.

Ali, a detainee at the Military Intelligence branch in Homs, described how he was held in the shabeh stress position, suspended by his wrists for several hours and beaten repeatedly.

The combination of poor conditions in the intelligence branches, including overcrowding, lack of food and medical care, and inadequate sanitation amount to cruel, inhuman and degrading treatment and are prohibited by international law.

Survivors described being held in cells so overcrowded they had to take turns to sleep, or sleep while squatting.

“It was like being in a room of dead people. They were trying to finish us there,” said Jalal, a former detainee.

Another detainee, “Ziad” (whose name has been changed to protect his identity), said ventilation in Military Intelligence Branch 235 in Damascus stopped working one day and seven people died of suffocation:

“They began to kick us to see who was alive and who wasn’t. They told me and the other survivor to stand up… that is when I realized that… seven people had died, that I had slept next to seven bodies… [then] I saw the rest of the bodies in the corridor, around 25 other bodies.”

Detainees also reported that access to food, water and sanitation facilities was often very restricted. Most said that they were prevented from washing properly. In such environments, infestations of scabies and lice, and diseases thrived. As most detainees were denied access to proper medical care, in many cases detainees were forced to treat each other with only the most rudimentary supplies, further contributing to the dramatic increase in deaths in custody since 2011.

Detainees generally have neither access to their doctors, nor their families or lawyers while in these branches, and as such this treatment in many cases amounts to enforced disappearance.

Saydnaya Military Prison

Detainees often spend months or even years in the branches of the various intelligence agencies. Some eventually face outrageously unfair trials before military courts – often lasting no more than a matter of minutes – before being transferred to Saydnaya Military Prison where conditions are particularly dire.

“In [the intelligence branch] the torture and beating were to make us ‘confess’. In Saydnaya it felt like the purpose was death, some form of natural selection, to get rid of the weak as soon as they arrive,” said Omar S.

The torture and other ill-treatment in Saydnaya appears to be part of a relentless effort to degrade, punish and humiliate prisoners. Survivors said prisoners there are routinely beaten to death.

Salam, a lawyer from Aleppo who spent more than two years in Saydnaya, said: “When they took me inside the prison, I could smell the torture. It’s a particular smell of humidity, blood and sweat; it’s the torture smell.”

He described one incident when guards beat to death an imprisoned Kung Fu trainer after they found out he had been training others in his cell: “They beat the trainer and five others to death straight away, and then continued on the other 14. They all died within a week. We saw the blood coming out of the cell.”

Detainees at Saydnaya are initially held for weeks at a time in underground cells which are freezing cold in the winter months, without access to blankets. Later they are transferred to cells above ground where their suffering continues.

Deprived of food some detainees said they ate orange rinds and olive pits to avoid starving to death. They are forbidden from speaking or looking at the guards, who regularly humiliate and taunt detainees apparently just for the sake of it.

Omar S described how on one occasion a guard forced two men to strip naked and ordered one to rape the other, threatening that if he did not do it he would die.

“The deliberate and systematic nature of the torture and other ill-treatment at Saydnaya prison represents the basest form of cruelty and a callous lack of humanity,” said Philip Luther.

“The international community must make it a priority to end this kind of appalling and entrenched abuse. For years Russia has used its UN Security Council veto to shield its ally, the Syrian government, and to prevent individual perpetrators within the government and military from facing justice for war crimes and crimes against humanity at the International Criminal Court. This shameful betrayal of humanity in the face of mass suffering must stop now.”

Most survivors of torture and other ill-treatment have been left physically and psychologically scarred by their ordeals. The majority have fled after their release and are among the more than 11 million Syrians displaced from their homes.

Amnesty International is calling on the international community to ensure that torture survivors receive the medical and psychological treatment, as well as social support, necessary for their rehabilitation.
