태국의 수도 방콕과 동북부의 도시 콘카엔에서 학생들과 반쿠데타 활동가들을 임의로 구금한 사건이 22일에만 최소 3건 벌어진 것은, 군부 쿠데타 발발 1년째에 접어들고 있지만 평화적인 반대 시위조차 용인되지 않는 냉혹한 현실을 보여주는 것이라고 국제앰네스티가 22일 밝혔다.

리처드 베넷(Richard Bennett) 국제앰네스티 아시아태평양국장은 “태국 군부정권이 들어선 지 1년이 되었지만 여전히 거리에서는 평화적인 시위가 강경 진압되고 있다”며 “평화적 시위대는 군사정부가 불편하게 여기는 주제에 의문을 제기하거나 정부에 맞섰다는 이유만으로 임의로 체포 또는 구금되어서는 안 된다. 표현의 자유라는 인권을 평화적으로 행사했다는 이유만으로 구금된 사람들은 누구나 즉시 무조건적으로 석방되어야 하며, 모든 혐의는 취소되어야 한다”고 말했다.

또한 “정부는 평화적인 반대 시위자들을 존중은 물론 보호해야 하며, 태국에서의 표현과 집회의 자유를 제한하는 엄격한 법과 관행을 완화해야 한다”고 말했다.

현지시간으로 22일 오후 6시 20분경, 태국 경찰은 방콕 예술문화센터에서 2014년 군부 쿠데타를 반대하는 평화적, 상징적인 시위를 개최하려던 학생과 활동가 20명을 구금했다. 경찰은 상부의 지시를 기다리고 있는 중이라며 이들의 변호사 접견을 허용하지 않았다. 최소 2명 이상의 활동가들이 체포 과정에서 부상을 입어 치료가 필요한 상태인 것으로 알려졌다.

또한 같은 날 오후 3시, 군과 경찰은 방콕의 한 전철역에서 학생과 민주주의 활동가, 택시 운전사를 차례로 체포했다. 이들은 방콕 경찰서에 구금되어 있다가 곧 풀려났다.

세 사람은 모두 시민단체 ‘저항시민’ 소속으로, 현 태국 총리인 프라윳 찬-오차 장군에 대해 지난해 쿠데타를 일으킨 혐의로 방콕의 형사법원에 형사고발을 하러 가던 중이었다. 이 시민단체는 쿠데타 1주년을 맞기 수 일 전부터 이러한 계획을 공개적으로 밝혔던 바 있다. 그 외에 대학생인 시라윗 세리시왓, 2010년 당시 시위 강경진압으로 아들이 정부군에 목숨을 잃었던 판삭 스리셉, 그리고 택시 운전사인 와나키엣 추수완 등 저항시민 소속의 다른 회원들 역시 평화적 반쿠데타 시위를 준비하다 구금되었다.

세 번째 사건으로, 태국 북동부 콘카엔의 민주주의 기념비에서 오후 1시경 시위대 7명이 쿠데타와 채굴 개발 사업으로 인한 교외 지역의 강제퇴거에 반대하며 평화적인 시위를 벌였다가 최소 7명이 체포되었다. 이들은 모두 학생단체 다오딘(Dao Din)의 회원으로, 지난 2014년 11월 콘카엔에서 프라윳 총리의 연설 도중 영화 ‘헝거 게임’에 등장하는 세 손가락 경례를 했다가 체포된 학생들도 이 단체 소속인 것으로 알려졌다.

뉴스로 보도된 화면에서는 활동가들이 체포되기 전 사복 경찰들이 22일 시위를 해산시키는 장면이 담겼다. 다오딘 소속 활동가들은 체포된 후 군부대로 이송됐다가 현재는 콘카엔의 한 경찰서에 구금되어 있다.

리처드 베넷 국장은 “이날의 사건들은 계속되는 태국 정부의 반대세력 탄압의 연장선상일 뿐이다. 현재 태국에서는 정치적 활동에 참여할 경우 징역에 처해질 수도 있는 상황이다. 정부는 안보라는 이름으로 인권을 인정하지 않고 억압하기 위해 스스로의 초월적 권한을 용인하고 있다. 지금이야말로 사람들이 반대의견을 평화적으로 표현할 수 있도록 허용해야 할 때”라고 말했다.

The arbitrary arrests of students and anti-coup activists in at least three separate incidents today in Thailand’s capital Bangkok and the north-eastern city of Khon Kaen come as a stark reminder of the ongoing intolerance of peaceful dissent a year into military rule, Amnesty International said today.

“Peaceful protesters must not be arbitrarily arrested or detained just because they raise uncomfortable topics or defy military rule. Anyone held merely for peacefully exercising their human right to freedom of expression must be released immediately and unconditionally and all charges dropped.

“The authorities must respect and even protect peaceful dissent and lift draconian restrictions on expression and assembly in Thailand – in law and practice.”

At around 6:20 pm local time, police detained 20 students and activists in Bangkok, who were about to carry out a peaceful, symbolic protest against the 2014 coup at the Bangkok Art and Culture Centre, one of the first sites of spontaneous anti-coup protests last year. Police have denied the group access to lawyers, stating that they are awaiting orders from senior officers. At least two activists are reported to have sustained injuries during the arrest and require medical attention.

In a separate incident in Bangkok at 3 pm today, soldiers and police arrested a student, a pro-democracy activist and a taxi driver at a metro station. They were held at a Bangkok police station and later released.

All three belong to Resistant Citizen, a political protest group, and were on their way to file a criminal complaint at the capital’s criminal court against General Prayuth Chan-ocha, the current Prime Minister, for staging last year’s coup. The group had made their plans public in days preceding the anniversary of the coup. Other members of the group have been detained before for peaceful acts of symbolic protest in the country – including university student Sirawit Serithiwat, Pansak Srithep, whose son was killed by the army during the crackdown on protests in 2010, and taxi driver Wannakiet Chusuwan.

In a third incident, at least seven people were arrested in Khon Kaen, north-eastern Thailand, at the city’s Democracy Monument at around 1 pm, after seven protesters staged a peaceful protest against the coup and forcible evictions of rural communities in extractive and developmental projects. The protesters all belong to Dao Din, a student activist group, and are believed to include members previously arrested for flashing the three-finger “Hunger Games” salute during a speech by General Prayuth in Khon Kaen in November 2014.

News footage shows plainclothes officers breaking up today’s protest before the activists’ arrest. The Dao Din activists were first taken to a military camp and are now being held at a police station in Khon Kaen.

These are just the latest episodes in the Thai authorities’ continuing repression of public dissent in the country, where many people face imprisonment if they engage in political activities. Authorities have granted themselves extensive powers to restrict and deny rights in the name of security – it is high time that they allowed people to peacefully exercise their rights to dissent.

부르키나파소의 조혼, 강제결혼 풍습으로 13세 가량의 소녀 수천 명이 유년기를 박탈당하고 있으며, 피임에 드는 비용과 기타 장벽으로 임신 여부나 시기조차 선택하지 못하고 있다고 국제앰네스티가 26일 발표한 보고서를 통해 밝혔다.

보고서 <강압당하고 부정당하는 소녀들: 부르키나파소의 강제결혼과 피임 장벽>은 여성들이 임신 여부와 시기를 스스로 결정하려다 위협받거나 폭행당하는 일이 빈번히 벌어지고 있는 실태를 공개했다.

“일부 지역에서는 18세가 되기 전에 결혼한 여성이 전체 여성의 절반 이상을 차지했다. 이러한 일이 반복되어서는 안 된다. 가족들과 지역사회 모두, 여성의 신체에 대해 마음대로 결정하고 장래 꿈을 이룰 기회를 박탈할 수는 없다”고 말했다.

국제앰네스티는 2014년과 2015년에 걸쳐 여성 379명과 인터뷰하고, 피임 관련 의료 서비스를 받지 못하는 여러 가지 장벽에 대해 기록했다. 결혼생활에서 가까스로 도망친 조혼, 강제결혼 피해자 35명과도 인터뷰를 나눴다.

부르키나파소에서는 법적으로 17세 이상인 여성만 결혼이 가능하지만, 북부 사헬 지역에서는 15세부터 17세 사이의 여성 중 절반 이상(51.3%)이 이미 결혼한 상태였다.

조혼과 강제 결혼
부르키나파소에서는 가족간의 유대를 강화하거나 사회적 지위를 얻기 위해, 또는 물건, 돈, 서비스와 교환하기 위해 딸을 결혼시키기도 한다. 이번 보고서에는 일부 지역에서 ‘포그 렌가(Pog-lenga)’, 또는 ‘추가 여자’로 신부가 결혼할 때 조카를 함께 데려와 시댁 식구와 결혼시키는 풍습에 대해서도 기록했다.

결혼식 당일 도망친 15세 소녀 셀린은 고모부의 친척과 강제로 결혼해야 했던 이야기를 전했다.
“그 남자와는 결혼하고 싶지 않았지만 고모가 ‘도망가면 죽인다’고 했어요. 남편의 집에서 도망쳤지만, 마을로 돌아왔더니 가족들이 이제 같이 살 수 없다고 했어요.”

강제결혼을 거부한 여성들은 가족과 사회로부터 폭행 위협 등의 엄청난 압박에 시달리게 된다.
13세 소녀 마리아는 “아빠가 이미 아내가 5명이나 있는 70세 할아버지와 나를 결혼시키려 했다. 결혼하지 않으면 죽이겠다고 협박했다”고 말했다.
남편의 집에서 도망친 마리아는 여성 쉼터에 몸을 피하기 위해 3일 동안 거의 170km를 걸어야 했다.

임신에 대한 선택권도 없어
국제앰네스티가 인터뷰한 여성들 거의 대부분이 남편에게 피임 문제를 거론했다가 언어적, 신체적 폭력을 당한 적이 있다고 답했다. 재정적인 권한도 없어 피임도구를 사려면 남편에게 돈을 부탁해야 한다고도 말했다.

25세 빈투는 국제앰네스티에 이렇게 전했다.
“막내아이를 임신하기 직전, 무료 피임 주간을 이용하려 찾아갔지만 너무 늦게 도착해서 이미 끝났더라구요. 남편에게 돈을 부탁했더니 화를 냈어요. 남편은 안 된다고만 했고, 우리 문화로는 여자들은 남편이 하는 말을 무조건 듣고 따라야 하거든요. 돈을 달라고 하면 식료품을 사려고 해도 때리는데, 피임을 하려 한다고 하면 어떻게 될 지는 뻔한 일이죠.”

피임 비용을 절감하려는 정부의 노력에도 불구하고 대부분의 여성들은 피임 물품을 구입할 여력이 없다고 말했다.
공식 통계에 따르면 현대식 피임법을 사용하는 여성은 16% 미만으로, 그렇지 않을 경우 원치 않거나 위험한 임신을 하게 될 확률이 급격하게 높아진다. 유엔 기구에서도 피임법 사용만으로 산모 사망률을 크게 줄일 수 있다고 강조한 바 있다.

교외지역에 거주하는 15세부터 19세 사이 여성 청소년 중 약 30%가 임신 중이거나 이미 첫 아이를 출산한 것으로 나타났다. 이 시기에 임신할 경우 20세 이상인 여성들보다 임신 또는 출산 중 사망할 위험이 2배 이상 높다.

법 개정 시급히 필요
부르키나파소는 이미 조혼과 강제결혼을 법적으로 금지하고 있지만 그 내용은 부적절하고 차별적으로, 남성의 결혼 가능 최저 연령은 21세인 반면 여성은 17세로 규정하고 있다. 또한 이 법은 국가에 신고된 결혼에만 적용될 뿐, 실제 이루어지는 결혼 중 대부분을 차지하는 전통적, 종교적 결혼은 해당되지 않는다.

정부는 문제가 되는 법 조항을 개선하겠다고 약속한 바 있지만, 모든 결혼이 국가에 등록되어 확인할 수 있도록 하고, 남녀에 똑같이 결혼 가능 연령을 18세로 지정하는 등 법 개정에 더욱 시급히 착수해야 한다.

또한 정부는 여성들이 임신 중에 의료 접근을 막는 핵심인 재정적 장벽을 해소하기도 했다.

국제앰네스티는 이에 따른 후속 조치와 여성들이 일부 피임 물품만이라도 안전하고 은밀하고 무료로 사용할 수 있게 할 것을 촉구한다.

티네 국장은 “부르키나파소는 세계에서 조혼, 강제결혼율이 가장 높은 국가이자 피임률이 가장 낮은 국가”라며 “어린 소녀들이 자신의 신체와 삶, 미래에 대한 결정을 스스로 내릴 수 있도록 정부가 이들의 권리를 보호하는 것이 가장 중요하다. 최근 조혼 풍습을 타파하겠다고 약속한 것은 환영할만한 진전이지만, 이러한 약속이 일상적인 현실로 이루어지지 않는다면 어린 소녀들이 그 대가를 치르게 될 것”이라고 말했다.

My Body, My Rights 캠페인
국제앰네스티는 2015년 7월 부르키나파소에서도 여성들이 직면한 문제의 인식을 높이는 글로벌 캠페인 My Body My Rights를 시작했다. 부르키나파소 대통령은 국제앰네스티가 발표한 인권선언서에 서명하고, 강제결혼과 조혼에 더욱 강경한 태도로 임할 것을 약속했다.

Burkina Faso: Forced and early marriage puts thousands of girls at risk

Early and forced marriage in Burkina Faso is robbing thousands of girls as young as 13 of their childhood, while the cost of contraception and other barriers prevent them from choosing if and when to have children, Amnesty International said in a report published today.

“Once married, girls are expected to have children as soon as possible. Early pregnancies greatly increase the risk of girls dying or experiencing life-changing physical injuries. Very few have the chance to go to school or complete their education.
“In some parts of Burkina Faso, more than half of all girls are married off before they turn 18. This has to stop. Neither family members nor the wider community should be able to make decisions about a girl’s body, denying her the chance to fulfil her own hopes and dreams for the future.”

Amnesty International researchers interviewed 379 women and girls in 2014 and 2015, documenting the multiple barriers that prevent them from accessing contraceptive health services. They spoke to 35 victims of early and forced marriage who managed to escape.

Under Burkina Faso law, girls should be aged 17 or older before they marry, yet more than half of girls (51.3%) aged 15-17 are already married in the Sahel region in the north of the country.

Forced and early marriage

Families in Burkina Faso often marry off girls to consolidate family alliances, acquire social status or in exchange for goods, money and services. The report also documents the practice in some areas of “Pog-lenga” or “bonus woman” where a bride may also bring her niece to the family of her husband as an additional girl for marriage.

Céline, a 15-year-old girl who fled on her wedding day, told Amnesty International how she was forced to marry a relative of her aunt’s husband:
“I did not want to marry the man. My aunt told me ‘if you flee, we will destroy you’. I fled my husband’s home, but when I got to the village my family said I could not live with them.”

Girls who resist forced marriage face huge pressure from their families and society, including threats of violence.

Maria, a 13-year-old girl, said:
“My dad married me [off] to a 70-year-old man who already has five wives. My dad threatened me saying if I don’t join my husband he will kill me.”

Maria fled his house and walked nearly 170km over three days to seek refuge at a shelter for young girls.

No choice over birth control

Nearly all the women and girls interviewed by Amnesty International said that they suffer verbal abuse or physical violence when they raise the issue of birth control with their partners. They also said that their lack of control over financial resources meant that they had to ask for money from their partners to buy contraceptive products.

Bintou who is 25 years old told Amnesty International:

“Right before I became pregnant with my youngest child, I went to take advantage of the free contraception week, but I arrived too late, it was already over. I had asked my husband for money. He got angry. He would systematically say no and in our culture, when the husband says something, women have to listen and obey. Asking for money already leads to beatings when it’s for groceries, so you can imagine when you want money for contraceptives.”

Despite the government’s efforts to reduce the cost of contraceptives, most women and girls said that they could not afford to buy them.

According to official figures, less than 16% of women use a modern method of contraception, dramatically increasing the risk of unwanted and sometimes high-risk pregnancies. UN agencies have highlighted that contraceptive use could greatly reduce maternal deaths.

Nearly 30% of 15- to 19-year-old girls and young women in rural areas are pregnant or have had their first baby despite the risk that they are twice as likely to die during pregnancy or childbirth as those over the age of 20.

Urgent need for reform

Under Burkina Faso law, early and forced marriage is already banned, but in an inadequate and discriminatory way: the age limit for marriage is 21 for males but 17 for females. The law only applies to marriages registered by the state – a fraction of the marriages taking place – but not traditional and religious ones.

The government has committed to changing the law but it needs to undertake these legal reforms urgently to ensure that all marriages are registered and checked, and to make 18 the minimum age of marriage for everyone.

The government has also lifted key financial barriers faced by women in accessing health care during pregnancy.

Amnesty International is calling on it take the next step and make at least some contraceptive products, which women can use safely and discreetly, available free of charge.

“Burkina Faso has some of the highest rates of early and forced marriage in the world, and one of the lowest use of contraceptives,” said Alioune Tine.
“It is crucial that the government upholds the rights of girls to make their own decisions about their bodies, lives and future. Recent commitments to end child marriage constitute a welcome step, but until those promises become an everyday reality, girls will pay the price.’’

My Body My Rights campaign

Amnesty International launched its global My Body My Rights campaign in Burkina Faso in July 2015, seeking to raise awareness about barriers women and girls face. The organization published a human rights manifesto signed by the current President, who committed to taking a tougher stance on forced and early marriage.

지난 1일 중국 입법부를 통과한 이번 국가보안법은 ‘국가 안보’를 광범위하고 모호한 단어로 규정하고 있으며 정치, 문화, 금융, 인터넷 등의 다양한 영역에 적용된다.

니콜라 베클란(Nicholas Bequelin) 국제앰네스티 동아시아 지역국장은 “이번 신규 법안에서 규정하는 ‘국가 안보’는 사실상 무한한 수준이다. 이 법은 인권활동가, 정부에 비판적인 사람, 그 외의 반정부 세력 등 정부의 마음에 들지 않는 사람은 누구나 처벌하고 감시할 수 있는 백지수표와 같은 권한을 부여하고 있다”고 밝혔다.

“이 법은 국가 안보보다는 공산당의 국가 통제력을 잃지 않으려는 것과 더욱 관계가 있음이 명백하다. 공산당의 집권과 정치력 독점은 이번 법에서 ‘국가 안보’의 일환으로 명시되어 있다”며 “중국 정부는 오래 전부터 ‘체제 전복 선동’, ‘분리주의’, ‘국가기밀 유출’ 과 같은 국가 안보 명목의 혐의를 적용해 왔다. 이번에 새롭게 마련된 국가보안법에서는 그 범위가 더욱 확대되어 이러한 경향을 악화시킬 가능성이 높다”고 말했다.

또한 “중국 정부는 이 법을 즉시 폐지하고 백지화해야 한다. 국민의 인권을 보호하기 위해 무엇보다도 필수적으로 취해야 할 조치로, 국가 안보와 개인의 인권 사이에서 균형을 맞출 수 있는 적절한 안전장치가 마련되어야 할 것”이라고 말했다.

China: Scrap draconian new national security law

The Chinese government must immediately repeal a new national security law that gives the authorities sweeping powers to crack down on and suppress human rights, Amnesty International said.

China’s legislature today passed the law which defines “national security” in broad and vague terms, covering areas including politics, culture, finance and the internet.

“The definition of ‘national security’ under this new law is virtually limitless. The law gives a blank cheque to the government to punish and monitor anyone it does not like – human rights activists, government critics and other opposition voices,” said Nicholas Bequelin, Amnesty International’s Regional Director for East Asia.

“This law clearly has more to do with protecting the Communist Party’s control of the country than with national security. The leadership of the Party and its monopoly on political power is explicitly listed as being part of ‘national security’ in the law.”

“The government has long been using national security charges, such as ’inciting subversion’, ’separatism’ and ’leaking state secrets’ to suppress and imprison activists and government critics. The expansive definition given by the new law is likely to further this trend.”

“Chinese authorities must scrap this law immediately and go back to the drawing board. Among other essential measures to protect people’s human rights, there need to be adequate safeguards put in place to balance security with individuals’ human rights.”

파키스탄이 사형집행을 재개한 이후 처형된 사람이 300명에 육박하게 되면서, 세계 최다 사형집행국이라는 불명예를 얻었다고 국제앰네스티가 24일 밝혔다.

파키스탄 정부는 11월 25일 압둘 바시트(Abdul Basit)에 대한 사형을 집행할 예정으로, 하반신마비 환자인 이 남성은 복역 중 결핵성 뇌수막염 진단을 받았다. 해당 교도소에는 교수대에 서지 못하는 사형수의 형 집행에 대한 규칙이 없기 때문에 압둘의 처형은 여러 차례 연기되었다.

국제앰네스티는 사형이 적용될 수 있는 사건마다 반드시 고려해야 할 공정재판기준과 안전조치를 상습적으로 위반하며 강행되는 이러한 사형집행이 파키스탄 인권상황에 심각한 오점으로 남게 되었다고 밝혔다.

국제앰네스티가 기록한 사형집행 건수는 현재까지 공식적으로 확인된 수치로 299건이다. 특히 2015년 10월에만 45명이 처형되며 사형집행 재개 이후 가장 많은 사형이 집행된 달이 되었다. 지금까지 처형된 사형수들은 대부분 테러 관련 범죄로 유죄가 선고된 사람들이 아니었고, 2008년 파키스탄이 사형집행 유예를 선언한 이후로 사형집행을 재개하게 된 원인이었던 지난 12월 탈레반의 페샤와르 학교 학살 사건 역시 마찬가지였다.

초기에는 테러 관련 범죄에 대해서만 사형집행을 재개했으나 수 개월이 지나자 더욱 넓은 범위의 범죄에 대해서도 사형이 집행되고 있다.

국제앰네스티는 범죄의 성격이나 정황, 개인의 유죄 여부나 기타 특성, 사형집행 방식에 상관없이 모든 국가의 모든 경우에 대해 사형을 반대한다.

Pakistan will imminently have executed 300 people since it lifted a moratorium on executions, shamefully sealing its place among the world’s worst executioners, Amnesty International said today.

On 25 November, Pakistani authorities are set to execute Abdul Basit, a man with paraplegia who developed tubercular (TB) meningitis while on death row. His execution has been postponed several times, since the prison has no rules on how to hang someone who cannot stand on the scaffold.

Amnesty International said the executions are a serious stain on Pakistan’s human rights record, compounding repeated violations of fair trial standards and other safeguards that must be observed in all death-penalty cases.

“Pakistan’s ongoing zeal for executions is an affront to human rights and the global trend against the death penalty. Even if the authorities stay the execution of Abdul Basit, a man with paraplegia, Pakistan is still executing people at a rate of almost one a day,” said David Griffiths, South Asia Research Director at Amnesty International.

“Not only are these relentless executions casting a large shadow over Pakistan’s human rights record, they are also ill-conceived. There is no evidence to suggest they have successfully countered the terrorism threat in the country. Indeed, prison officials told Amnesty International that the banned Lashkar-e-Jhangvi group distributed sweets to celebrate the ‘martyrdom’ of one their members executed in prison.”

Amnesty International has recorded 299 executions to date, based on publicly-reported figures. Forty-five were recorded in October 2015 alone, the deadliest month since the moratorium on executions was lifted. A majority of those executed so far were not convicted of offences related to terrorism, even though it was a Taliban massacre – of mostly schoolchildren in Peshawar last December – that prompted the authorities to lift the moratorium in place since 2008.

It was initially lifted for terrorism-related offences only – but within months, executions for a wider range of crimes were being carried out.

Amnesty International opposes the death penalty at all times in all countries, regardless of the nature or circumstances of the crime; guilt, innocence or other characteristics of the individual; or the method used by the state to carry out the execution.

“Many death sentences are handed down after trials that do not meet international fair trial standards. These trials are characterised by prisoners not receiving adequate legal counsel and by the acceptance of evidence inadmissible under international law, such as evidence obtained as a result of torture,” said David Griffiths.

“Pakistan should halt executions immediately, comply with its human rights obligations, and take steps to phase out this punishment once and for all.”

배로 이주를 결행한 사람들 중 대다수가 이슬람계 로힝야족으로, 이들은 미얀마에서 수십 년에 걸쳐 제도화된 차별을 겪고 있는 소수민족이다. 지난 2012년 당시 이슬람계와 불교계 사이에서 빚어진 폭력사태로 인해 주로 로힝야족으로 이루어진 수만 명은 아라칸 주로 강제 이주되어, 불결한 환경의 캠프에서 생활하고 있다. 또다른 수만 명은 2012년 폭력사태 이후 배를 타고 벵골 만으로 건너간 것으로 추정된다.

이번 특별회의는 수천 명이 절박한 환경 속에 바다에 표류하고 있다는, 장기간 계속되었던 인권위기의 새로운 장을 연 문제를 해결하는 데 조금은 진전을 이룩한 것이었다. 각국 정부가 마침내 해야 할 역할에 대해 논의하고, 후속 회의 개최를 약속한 것은 환영할 일이다. 그러나 하선하기 안전한 장소 선별, 구조한 사람들의 적절한 수용 절차 마련 등에 대해 적절한 합의가 이루어져야 한다.

수색구조 작전의 세부적인 사항 외에도 여러 주요 사안에 대한 논의 역시 이루어지지 않았다.

최근 인도네시아와 말레이시아에 도착한 보트에 이주민 외에 난민 역시 타고 있었다는 사실은 회의에 참석한 각국 대표 중 누구도 거론하지 않았다. 이처럼 중요한 사안이 향후 ‘보호가 필요한 사람 선별’에 대한 논의에서 이루어지기를 기대한다. 국제난민법에 따라, 유엔 인권위원회의 지원을 통해 공정한 절차를 거치고, 장기간의 거처가 필요한 사람들에게 난민 지위를 인정하는 등의 대책이 마련되어야 한다.

또한 처음부터 이와 같은 난민 위기를 촉발시킨 근본 원인의 해결 방법에 대해서는 세부사항이 거의 완전히 누락된 상태다. ‘인권에 대한 전적인 존중을 증진’시킴으로써 근본 원인을 해결하겠다는 성명서의 표현은 미얀마의 로힝야족과 같은 소수민족 박해를 종식시키기 위한 노력으로 이어져야 한다. 그렇지 못할 경우 사람들은 여전히 본국의 견딜 수 없는 환경에서 도망칠 수밖에 없을 것이다.

South East Asia: ‘Boat people’ crisis summit an opportunity that must not be missed

Regional governments must take immediate action to save lives and address the root causes of the South East Asian refugees and migrant crisis, Amnesty International said ahead of a key summit in Thailand on Friday.

“The Bangkok summit is an opportunity to develop a genuine regional effort to address all the many dimensions of the crisis in line with international human rights law that must not be missed,” said Richard Bennett, Amnesty International’s Asia Pacific Director.

“We have seen thousands of people crammed onto boats with little or no food or water, while governments have been slow to provide shelter or other basic humanitarian assistance. There clearly needs to be immediate action.”

Indonesia, Thailand and Malaysia have taken crucial first steps by offering temporary humanitarian assistance and reversing appalling policies of turning back boats. However, efforts must be stepped up to address all forms of migration while respecting human rights. Governments have a responsibility to ensure legal and safe routes of migration.

“Countries must develop a common set of policies to ensure that refugees and migrants – including people fleeing persecution – are protected, and not criminalized or simply left to fend for themselves,” said Richard Bennett.

Representatives of 17 countries will gather in Bangkok on 29 May to discuss the current asylum seeker and migrant crisis in South East Asia. Approximately 3,500 people have over the past weeks landed in Malaysia and Indonesia or returned to Myanmar.

In an open letter this week, Amnesty International has urged governments to take immediate steps to address not only the current crisis, but also the underlying conditions that have caused it.

“The thousands who have landed in Malaysia and Indonesia must be ensured safety and dignity, including the shelter, food, water, clothing, health care and protection they need. Claims for asylum should be fairly processed and under no circumstances should people be returned to or sent to countries where their lives are at risk,” said Richard Bennett.

“People should not be detained solely on the basis of their method of arrival in a country. Prolonged periods of detention and uncertainty have a damaging impact on asylum seekers’ mental health, as we have seen through Australia’s cruel refugee policies. South East Asian countries must not repeat these mistakes.”
Amnesty International is urging all governments to take immediate steps to address the root causes of the crisis, which are driving people to flee in the first place.

A large proportion of those fleeing by boat appear to be Muslim Rohingya, a minority that has faced decades of institutionalised discrimination in Myanmar. Waves of violence between Muslims and Buddhists dating back to 2012 has left tens of thousands of people – mainly Rohingya – displaced in Rakhine state, where they live in camps in squalid conditions. Tens of thousands of others are believed to have fled across the Bay of Bengal by boat since the 2012 violence.

“Many thousands of Rohingya in Myanmar are desperate enough to risk their lives on dangerous boat journeys to escape the conditions they face at home. Myanmar’s response so far has been one of denial – even that the Rohingya even exist. This cannot be the basis on which to proceed,” said Richard Bennett.

“The international community must urge Myanmar to end systemic discrimination against the Rohingya, starting with granting them citizenship and repealing all other discriminatory laws.”

29 May 2015 a regional summit to address the South East Asia “boat people” crisis reaffirmed existing commitments to carry out search and rescue operations. Many key proposals and recommendations, including on addressing urgent humanitarian needs, and the root causes of the crisis were deferred to a follow up meeting.

The meeting missed an opportunity to develop concrete measures to address the crisis. Recommendations alone are cold comfort to thousands of people who remain adrift at sea and others who have been rescued but remain in a desperate situation.

It is critical that countries immediately address these key issues, including by intensifying search and rescue operations, stepping up humanitarian assistance and addressing the root causes of the crisis.

The summit was a small step towards addressing the latest chapter of a long-term human rights crisis that has seen thousands stranded at sea in desperate conditions. It’s welcome that governments are finally discussing what must be done and there was a commitment to another meeting. However, adequate arrangements must include identification of places of safety for disembarkation and adequate reception arrangements for those rescued.
In addition to the details of search and rescue operations, several key issues were also left off the table.
At no point did those attending acknowledge that refugees were also on the boats that recently arrived in Indonesia or Malaysia. We hope that the that the talk of ’identifying those with protection needs’ will address this key issue, by using fair proceedings and granting refugee status to those who need longer-term shelter, in full accordance with international refugee law and with assistance from UNHRC.

There was also an almost complete lack of specifics on how to address the root causes that sparked this crisis in the first place. The statement’s mention of addressing root causes by ‘promoting full respect for human rights’ must translate into steps towards ending the persecution of ethnic minorities like the Rohingya in Myanmar– otherwise people will still feel compelled to flee unbearable conditions at home.

Syria after the ‘Arab Spring’: Eight key facts

Five years ago, Bashar al-Assad’s government brutally suppressed mass protests which began on 15 March 2011. The violent response sparked the region’s most severe armed conflict.

1. More than 250,000 people have been killed, according to the UN. War crimes and crimes against humanity are rife.

2. Since then, more than 11 million people have been forced from their homes, including around 7 million people within Syria and more than 4 million who are now refugees abroad, mostly in Turkey, Lebanon and Jordan. Tens of thousands of refugees from Syria have also fled to Europe, often risking their lives in the process.

3. Government forces have repeatedly shelled and bombed civilian areas using indiscriminate weapons, including barrel bombs. They’ve also bombed hospitals, targeted medical workers and mounted long-running sieges of opposition-held areas, depriving people of food, medicines and other necessities. According to Physicians for Human Rights, 112 medical facilities were attacked in 2015 alone, the majority by government forces.

4. According to the Syrian Network for Human Rights, approximately 65,000 people have been arrested by government security forces and are now missing in a network of unofficial detention centres. Others have been jailed for helping people forced from their homes by the fighting, or for speaking out about the situation in Syria. Lawyers, doctors and journalists have been locked up just for doing their jobs.

5. Intelligence agencies and other government forces continue to use torture on a massive scale. Thousands have died in custody since 2011 due to torture and other factors, including lack of food and medical access.

6. The armed group calling itself the Islamic State (IS) has shelled civilian areas and killed scores of civilians and prisoners. The group has abducted, tortured and executed journalists, peaceful activists and other perceived opponents. IS also besieges civilian areas, which means people struggle to get food, medical supplies and other necessities.

7. Other armed groups including Jabhat al-Nusra have also attacked civilian areas, abducted suspected opponents and killed captives.

8. Russian air strikes in support of the al-Assad government have killed hundreds of civilians and struck medical facilities.
