광주환경운동연합(이하 환경연합)은 10월 16일, 광주광역시 감사위원회에 “도시공원위원회를 비롯한 각종 위원회(도시계획, 건축, 경관, 교통심의위원회)에 대한 감사 청구서”를 제출하였다.

환경연합은 도시 개발과 관련 도시계획, 건축, 경관, 교통, 공원을 다루는 위원회가 그간 적법하지 않게 자의적으로 운영되어온 상황을 제기하고, 광주시 감사위원가 이를 바로잡아, 도시개발 행정의 공공성을 갖을 것을 요구하고 있다.

감사 청구서를 통해 최근 위촉된 도시공원위원회가 위원을 모집, 선정하는 과정에서 공개모집 위반, 연임규정 위반하였고 인력풀제로 운영되는 건축위원회와 교통영향분석개선대책심의위원회(이하 교통심의위원회)가 소수 위원에게 심의권한을 집중시킨 점, 경관위원회가 경관법을 위배한 채 자의적으로 팀을 나누어 운영하고 동일 위원에게 재심의를 진행한 점을 제기하였다.

또한 국민권익위원회에서 권고한 “이해충돌소지가 높은 위원” 위촉 제한에도 불구하고 도시개발정책을 심의하는 위원회(도시계획, 건축, 경관위원회)에 이해충돌소지가 높은 개발업종 당사자들이 30%이상 참여하고 있는 점 등을 감사해줄 것을 요구하였다.

기형적인 광주의 도시 개발에 대한 시민들의 우려가 높은 가운데, 개발정책을 심의하는 위원회의 법령과 조례, 지침을 위배한 위원 모집과 위촉, 운영은 심의 결과를 시민들이 신뢰하지 못하는 상황을 만들고 있다.

결국 공정하지 못한 위원회는 정책결정의 거버넌스 역할에 시민이 배제되거나 시민이 거부하는 상황을 만들며, 이는 곧 행정에 대한 불신을 가져오게 된다.

광주시와 시의회가 위원회 운영의 투명성, 공정성, 그리고 시민참여 확대의 틀을 만들기 위해 민선 6기, 개정한 ‘광주광역시 각종 위원회 구성 및 운영에 대한 조례’를 개정한 노력이 있었다. 그러나 실제 위원회 운영에는 조례는 유명무실하였다.

도시철도 2호선의 전략환경영향평가 재협의 절차 누락.

(2호선의 노선변경과정에서 푸른길공원, 운천저수지 등 생태적 민감지역에 미치는 환경영향 검토하지 않아……)

광주시는 지난 4월 ‘광주 도시철도2호선 1단계 건설사업 환경영향평가 및 교통영향분석ㆍ개선대책수립용역’을 발주하였다. 2호선 환경영향평가 등 수립용역은 8억 9천 880만원으로 내년 12월까지 진행될 예정이다.

그러나 2호선의 환경영향평가 용역을 위해 들인 혈세 9억여원이 물거품이 될 상황에 놓여있다.

환경영향평가법 및 시행령, 환경영향평가서등에 관한 협의업무 처리규정에 따르면, 전략환경영향평가 협의 이후, 사업의 규모가 30%이상 증가할 경우에는 환경부와 재협의과정을 거치도록 되어있다.

그러나 광주시는 2013년 고가경전철에서 저심도로 공법과 노선 16.2km를 변경하면서, 전체 사업규모의 38%이상 변경· 증가하였음에도 전략환경영향평가 재협의 과정을 생략한 채 기본계획변경을 확정하고, 현재 환경영향평가 용역등을 진행하고 있다.

환경부는 재협의 과정을 거치지 않은 환경영향평가 협의에 대해 거부하도록 규정하고 있어, 현재 광주시가 진행중인 환경영향평가 용역의 결과는 무용지물이 될 상황에 놓여있다.

전략환경영향평가는 개발계획에 대해 사전환경영향을 평가하고 대안의 설정과 분석을 통해 환경적 측면에서 해당 계획의 적정성 및 입지의 타당성 등을 검토하기 위해 시행되고 있다.

2011년 당시 작성된 사전환경성검토(2011년 7월, 전략환경영향평가로 용어 변경)에서는 고가경전철에 대한 경관 및 일조, 진동 등에 대한 검토가 이루어졌다. 그러나 기본계획의 변경으로 인해, 16.2km, 전체의 38%에 해당하는 구간에 대한 환경영향은 생략된 것이다.

또한 2013년 변경된 17.11km는 푸른길공원, 운천저수지, 월드컵경기장, 첨단대교, 광신대교 등 11곳의 노선이 포함되어 있으며 변경된 구간 중 환경적 영향이 클 것으로 판단되는 푸른길공원과 운천저수지의 노선의 경우, 저심도 지하철 건설로 인한 환경적 피해와 주변 영향에 대해서는 단 한번도 환경영향이 검토된 바가 없다.

광주시는 환경에 미치는 영향을 미리 예측하고 평가하기 위해 만들어진 환경영향평가법을 위반했을 뿐 아니라 100년 이상 사용할 2호선의 환경영향을 졸속으로 검토한 것이 드러났다.

결국 대안노선에 대한 검토, 노선의 적정성 등에 대한 아무런 검토없이 2호선이 졸속적으로 추진되었으며, 이로 인해 피해는 고스란히 시민들에게 전가되고 있다.

광주시는 무용지물이 될 환경영향평가를 중단하고 2호선에 대한 전략환경영향평가를 다시 해야 한다. 또한 졸속적으로 추진되고 있는 2호선 과정의 문제점을 명백히 밝혀야 할 것이다.

우리는 광주시의 향후 조처를 지켜볼 것이며, 필요할 경우, 국민감사청구와 공익감사청구를 통해 추진과정의 문제점을 밝혀낼 것이다.
