“해변에서 놀던 아이들을 무자비하게 학살하는 모습이 카메라를 통해 전 세계에 공개되었는데도
어떻게 아무도 처벌받지 않은 채 넘어갈 수 있는지 도무지 이해할 수 없습니다.”

2014년 7월 16일, 이스라엘 공습으로 목숨을 잃은 소년 4명의 친척인 소비 바크르(Sobhi Bakr)의 말이다.

2016년 7월 8일은 이스라엘군이 50일간 가자(Gaza) 지구를 맹공격한 지 2년이 되는 날이다. 전례없이 많은 사람이 죽고, 기반시설과 주요 건물 등이 파괴되었다.

국제앰네스티는 7일 발표한 보고서(영문)를 통해 지금까지도 전쟁범죄에 대한 성의 있는 조사를 착수하지 않는지, 양측이 저지른 전쟁범죄에도 아무도 이 잔혹 행위에 대한 책임으로 처벌받지 않는지에 대해 의문을 제기한다.

필립 루터(Philip Luther) 국제앰네스티 중동북아프리카 국장은 “50일간 공격을 퍼부으며 이스라엘군은 가자지구에서 막대한 사망자를 발생시키고 대규모 파괴를 일으켜, 민간인 1,500여 명을 학살했으며 그중 550여 명이 어린이였다.”고 말했다.

이스라엘군은 자체적인 수사를 통해, ‘약탈’과 ‘수사 방해’ 혐의로 군인 3명을 기소한 것이 전부였다. 전쟁범죄와 같은 더욱 심각한 범죄에 대해서는 아무런 처벌도 없이 시간이 흘렀다.

팔레스타인의 경우에도 하마스(Hamas)와 팔레스타인 무장단체가 저지른 전쟁범죄를 비롯한 폭력에 대해서 진정성 있는 조사가 이루어지지 않았다. 팔레스타인 무장단체는 이스라엘 민간 구역에 비유도 로켓 미사일과 박격포 수천여 발을 발사하며 민간인 6명이 목숨을 잃었고, 하마스군은 적으로 간주되는 팔레스타인인을 즉결 처형하고 공격했다.

필립 루터 국장은 “분쟁당사자 양측이 저지른 것이 명백한 전쟁범죄에 대해 누구도 처벌을 받지 않았다는 사실은 절대 용납할 수 없다. 그로부터 2년이 지난 지금이야말로 정의 실현을 시작해야 할 때”라고 말했다.

보고서에는 전쟁 중 사망한 사람들의 가족과 한 인터뷰, 지금까지 이스라엘군이 시행한 수사의 허점에 대한 세부사항, 수차례 민간인을 조준하며 국제인도법을 위반한 내용 등이 담겨있다.

국제앰네스티는 이스라엘 정부에 조사 담당자들이 공습을 명령, 시행 또는 감독하는 사람들로부터 독립적일 수 있도록 보장하는 등 조사 체계를 개혁해야 한다고 촉구한다. 팔레스타인 국민합의정부(Palestinian National Consensus Government)는 2014년 전쟁 중 팔레스타인이 저지른 전쟁범죄에 대해 독립적인 범죄 수사가 이루어질 수 있도록 보장해야 한다.

가자지구의 하마스는 팔레스타인인 즉결 처형 등 가자에서 일어난 인권침해와 관련해 조사를 진행하는 모든 단계에서 투명성을 유지해야 한다.

국제앰네스티는 모든 분쟁당사자에 대해, 분쟁 중 저지른 것으로 알려진 범죄에 대한 국제형사재판소 검찰국의 예비조사에 전적으로 협조할 것을 촉구한다.

Israel/OPT: Two years on still no justice for war crimes victims

“I cannot understand how a crime that took place in view of cameras, where the whole world saw how boys playing on the beach were massacred mercilessly, can pass like that without any criminals held to account.” Sobhi Bakr, relative of four boys killed in an Israeli air strike on 16 July 2014.

Tomorrow, 8 July 2016, marks the second anniversary of the start of a 50-day Israeli military offensive which brought unprecedented death and destruction to the Gaza Strip.

In a new briefing issued today, Amnesty International asks why no genuine criminal investigations have been launched, and why no one has yet been held to account for atrocities in spite of war crimes being committed by both sides.

“During 50 days of attacks, Israeli forces wreaked massive death and destruction on the Gaza Strip, killing close to 1,500 civilians, more than 500 of whom were children,” said Philip Luther, Amnesty International’s Middle East and North Africa Programme Director.

The only criminal charges resulting from Israel’s military investigations were brought against three soldiers for the relatively minor abuses of looting and obstructing an investigation. Meanwhile, more serious crimes, some of which are likely war crimes, have gone unpunished.

On the Palestinian side, there have been no genuine investigations into violations, including war crimes, by Hamas and Palestinian armed groups. Palestinian armed groups fired thousands of unguided rockets and mortars at civilian areas in Israel, killing six civilians; and Hamas forces summarily killed and attacked Palestinians it deemed to be enemies.

“The fact that no one has been held to account for war crimes that were evidently committed by both sides in the conflict is absolutely indefensible. Two years have passed and it’s high time the wheels of justice started turning,” said Philip Luther.

The briefing contains interviews with relatives of those killed during the war, details the flaws in the investigations conducted so far by the Israeli military authorities, and outlines several attacks that clearly targeted civilians in violation of international humanitarian law.

Amnesty International is calling on Israel to reform its investigative mechanisms including by ensuring that those investigating are independent of those ordering, implementing or advising on attacks. The Palestinian National Consensus Government should ensure independent criminal investigations into war crimes committed by Palestinians during the 2014 war.

The Hamas authorities in Gaza must be transparent about any progress in its investigations into summary killings and other abuses of Palestinians in Gaza.

Amnesty International is urging all sides to co-operate fully with the preliminary examination being conducted by the Office of the Prosecutor of the International Criminal Court into alleged crimes committed during the conflict.

이스라엘의 팔레스타인 학살 외면한 한국

유엔 총회의 ‘팔레스타인 민간인 보호를 위한 결의안’에 기권

국제사회의 일원으로서 최소한의 책임 방기

지난 6월 13일 열린 유엔 총회 제10차 긴급 특별 세션에서 한국 정부는 팔레스타인 민간인 보호를 위한 결의안(A/ES-10/L.23)에 기권했다. 어떤 말로도 정당화할 수 없는 무책임한 선택이다. 최근 가자지구에서 벌어진 이스라엘의 무력 사용을 규탄하고, 팔레스타인 민간인에 대한 보호 조치 촉구를 주요 내용으로 삼고 있는 이번 결의안은 찬성 120, 반대 8, 기권 45로 최종 채택됐다. 이는 유엔 안보리에서 미국이 유사한 결의안에 거부권을 행사하여 총회에서 다시 제안된 것이었다. 우리는 이스라엘의 전쟁 범죄를 외면하고, 유엔인권이사회 의장국과 이사국을 역임한 국가로서의 최소한의 책임과 역할을 포기한 한국 정부를 강력히 규탄한다. 문재인 정부가 말하는 평화는 한반도의 국경에 멈춰 있다는 말인가.

비무장한 팔레스타인 시민들을 향한 이스라엘의 무차별적인 학살은 결코 용인할 수 없는 일이다. 지난 3월 30일 가자지구에서 시작된 ‘귀환 대행진(Great March of Return)’은 팔레스타인 난민의 귀환권을 요구하는 비폭력 시위였다. 그러나 이스라엘군은 행진 첫날부터 저격병과 탱크를 배치해 비무장 시위대를 무차별 진압했다. 팔레스타인 언론에 따르면, 시위가 시작된 3월 말부터 지금까지 팔레스타인인 135명이 사망하고, 약 8,500여 명이 부상을 입은 것으로 알려졌다. 사망자 중에는 미성년자, 기자, 심지어 부상자를 치료하던 의료진까지 포함되어 있었다. 5월 14일 미국 대사관 예루살렘 이전 개관식이 열렸던 날에는 이스라엘군의 발포로 팔레스타인 시위대 최소 52명이 사망하기도 했다. 이스라엘은 지난 10년 동안 가자지구를 3차례 대규모로 침공해 민간인 수천 명을 학살해왔고, 이번 비무장 시위대 학살 역시 그 연장선상에 있다.

이 현실을 앞에 두고, 도대체 결의안에 기권할 이유가 무엇이란 말인가. 그동안 한국은 오랫동안 반복되어 왔던 이스라엘의 불법 행위를 조사하거나 중단시키려는 노력에 최소한의 동참도 하지 않아 왔다. 지난 2006년 이스라엘의 레바논 민간인 살상, 집속탄과 백린탄 사용 등에 대한 유엔인권이사회의 조사위원회 구성 표결에서 이사국 지위임에도 불구하고 기권했다. 이에 앞서 이스라엘의 팔레스타인 분리장벽 건설을 국제사법재판소에 회부하고자 했던 유엔의 표결, 2014년 이스라엘의 가자지구 공격 조사 결의안, 지난 3월 유엔 인권이사회의 이스라엘 무기금수조치 결의안에도 기권했다. 이스라엘의 집단 학살 행위가 반복된 데는 한국 정부의 책임이 없다고 할 수 없다.

이스라엘이 국제사회의 비난을 무시할 수 있는 이유는 미국과, 미국의 눈치를 보며 이스라엘의 전쟁범죄 비판에 소극적인 한국과 같은 나라들이 있기 때문이다. 우리는 국제사회 일원으로서 이스라엘의 전쟁범죄를 비판하고 더이상의 팔레스타인 민간인 희생을 막으려는 최소한의 책임을 방기하고 있는 한국 정부의 각성을 촉구하며, 이스라엘군의 비무장 시위대를 향한 무차별적 공격을 중단시키기 위한 국제사회의 행동에 동참할 것을 강력히 요구한다. 나아가 이스라엘의 팔레스타인 학살은 즉각 중단되어야 하며, 가자지구 봉쇄와 팔레스타인 군사 점령도 이제는, 정말 끝내야 한다.

We stand for Justice, Human Rights and Freedom!

환경운동연합은 지구의벗(Friends of the earth) 한국으로 지구의벗 아시아태평양(Friends of the earth Asia-Pacific)과 함께 무고한 팔레스타인 시민의 인권과 자유를 위해 함께 팔레스타인 전쟁 중단과 인도적 지원을 촉구합니다. 환경운동연합은 11월 3일 지구의벗 아시아태평양과 세계 시민단체가 연대해 배포한 공동 성명 원본을 공유 드립니다.

As movements fighting against systems of injustice that view black, brown and indigenous peoples as disposable, to be sacrificed by racist and colonial systems of exploitation and domination, we see the struggle of the Palestinian people against occupation and apartheid as part and parcel of our collective struggle for climate, racial, economic and political justice and for a world where everyone has the right to live with dignity, free from oppression.

We are enraged and grieve equally the loss of lives of all civilians – Palestinian and Israeli – that have taken place since 7 October and call for those responsible to be held accountable for their actions.

We decry the fact that for many Northern Governments, Palestinian lives are deemed as being of less value and worth as those of Israeli citizens. This has allowed tens of thousands of Palestinians being killed with impunity over the decades as a result of Israel’s illegal occupation of Palestine. People whose names and dreams, like those of our peoples in the global South, sacrificed to colonialism.

In the latest indiscriminate bombing of Gaza, Israel has already killed more than 5000 Palestinians including at least 2360 children, displacing over 1 million people, as it collectively punishes the Palestinian people. In just one week, between 7-12 October, Israel dropped over 6,000 bombs on the Palestinian people living under its illegal occupation, more than the US dropped in a whole year during its war on Afghanistan. Whilst Human Rights Watch has confirmed that Israel has used a banned chemical weapon – white phosphorous – in civilian areas in the Gaza Strip, causing severe burns and uncontrollable fires.

We are devastated by the bombing of the Al-Ahli Arab Hospital in Gaza which killed 471 injured and sick Palestinians, including women, children, doctors, nurses, and those seeking refuge from the retaliatory bombardment by Israel. To date, the World Health Organisation has documented 76 attacks on healthcare workers, 26 healthcare facilities including 17 hospitals have been attacked, as well as attacks on UN schools where Palestinians are sheltering for safety.

The Occupied Palestinian Territory of Gaza is facing a “complete siege” with the purposeful targeting of civilian infrastructure such as hospitals and schools which constitute war crimes under international law. Israel is also blocking food, water, fuel and medicine to a captive population of 2.3 million Palestinians, half of whom are children, as a weapon of war.

While in the Occupied Palestinian Territory of the West Bank, Israel has imposed a total blockade. The Israeli military is attacking Palestinians protesting the genocide in the Gaza Strip with lethal military force, and is providing thousands of weapons to Israeli settlers inside the West Bank, who are attacking and killing Palestinians.

Israel has openly made genocidal statements that ‘Gaza will be reduced to rubble’ and called the Palestinians ‘human animals’. As climate justice movements we recognise the language of racism and colonialism that has been used to justify the sacrificing and killing of so many of our people across the global South.

The current war in Gaza is not an isolated event but is deeply rooted in ongoing colonization, illegal occupation, systemic injustices, and historical oppression of Palestine by an apartheid state. Israel has repeatedly disregarded the international humanitarian law and human rights principles that demand the protection of civilians, especially in conflict zones, as it escalated its genocidal attacks in Gaza.

Israel is planning a ground offensive with intent to indiscriminately kill Palestinians in north Gaza; and aims to ethnically cleanse more Palestinians in a single day than during the Nakba (Arabic for ‘catastrophe’) in 1948, when over 750,000 Palestinians were expelled from their homes – or any day since in their ongoing settler-colonial occupation of Palestine. The vast majority of Palestinians in Gaza are refugees from the Nakba.

The situation has never been more urgent. In the words of the Director of the United Nations Relief and Works Agency for Palestinian refugees (UNRWA), “Gaza is running out of life”. As vital resources run out and Gaza’s health infrastructure – already battered by Israel’s 16 year-long blockade and periodic bombardment – ‘collapse before our eyes’, Gaza’s remaining hospitals are turning into morgues.

We call for an immediate ceasefire, and for the international community to break the blockade and end the collective punishment of the Palestinian people. We must bring an end to apartheid and occupation.

We are appalled at the US and UK refusing to support the resolutions at the United Nations Security Council calling for a ceasefire to allow humanitarian aid access to the Gaza Strip. The complicity of powerful Western nations in enabling Israel to carry out these actions with impunity is a matter of grave concern. Despite the growing evidence of human rights violations, the provision of military and financial support to Israel from these nations continues unabated. The disregard for the lives of Palestinian people is inexcusable, and it is incumbent upon these nations to end their arming of Israel and prioritise human rights.

We also call out the role and bias of politicians and international media, led by northern media, fueling the islamophobic rhetoric and dehumanization of the Palestinian people as well as the role of international tech companies and platforms in allowing the rise of islamophobic and anti-semitic hate speech and fake news.

We condemn the attempt by Northern Governments – from Germany, France, to the UK, to attempt to criminalize and ban our movements from marching and calling for Justice for Palestine. The attacks on our right to protest mirror the attacks on climate protests that are taking place in countries that bear the greatest responsibility for these injustices.

We stand in immutable solidarity with the people of Gaza and all victims of brutality and demand upholding of international law and human rights principles to protect innocent civilians.

We also stand in solidarity with Palestinians and Jews who are protesting Israel’s bombardment of Gaza and advocating for peace and justice in the region. We condemn actions taken by several governments around the world to stop these protests and the arrest of peaceful demonstrators.

There can be no peace without justice and it is a moral imperative for the global community to stand in unity with the oppressed. We call on all our governments and international bodies to work together to end the war, and to bring all those responsible for war crimes to justice. We demand an end to the occupation and genocide of the Palestinian people and urge for resolution that can ensure that both Palestinians and Israelis can live with security and dignity.

Our Demands
In light of the ongoing violence and the appalling human rights violations in Gaza by the apartheid state of Israel, we call for the following urgent measures:

Immediate Ceasefire: We echo the calls of the United Nations Secretary General and humanitarian and human rights organisations for an immediate ceasefire in Gaza.

End the illegal blockade: Urgent humanitarian and emergency aid must be provided to civilians in Gaza. The people of Gaza are in dire need of medical supplies, food, water, and other essential resources, which need to be restored urgently.

Stop War Crimes: Israel must be held accountable for its actions that breach international law, including attacks on hospitals, forced evacuations, and the illegal blockade on Gaza for decades.

End Impunity: All those responsible for war crimes including the State of Israel must be held to account for their actions. All civilian hostages, including the thousands of Palestinian political prisoners held without charge or trial must be released. Western powers must stop their support for Israel, including ending arms sales to Israel particularly in the context of human rights violations and stop all support and funding to Israel immediately. Political alliances should not take precedence over human lives.

End Apartheid and Occupation: We support the self-determination of the Palestinian people. We call on Israel to end its system of apartheid and for the right of return and compensation to Palestinian refugees. We call on the international community to finally uphold the UN resolutions for a safe, secure and viable State of Palestine alongside a State of Israel.

Stop Racism, Islamophobia and Anti-Semitism: We stand in solidarity with our comrades in the Jewish and Muslim communities facing an increase in racist attacks. The struggle for climate justice is a struggle for racial justice.

이중섭 박수근 ‘위작 판정’의 미스터리

지난 2005년 한 고서화 수집가가 한국 현대 미술계의 거장 이중섭, 박수근 화백의 미공개 작품 2,800여 점을 갖고 있다고 주장하면서 시작된 한국 미술계 사상 최대의 위작 시비.

검찰이 수사에 나서 결국 위작이라는 수사결과를 발표하자 언론도 이를 비중 있게 다뤘다. 특히 SBS는 ‘SBS스페셜’을 통해 위작 의혹 사건에 대한 사회적 공분을 일으키는 데 일조했다. 검찰은 소장자 김용수 씨 등을 사기 등 혐의로 기소했고 1, 2심 재판부 모두 위작 판결을 내렸다. 이후 이 사건은 국민의 기억 속에서 점차 멀어졌다.

그러나 뉴스타파가 위작 의혹 사건 수사와 재판 기록을 면밀히 검토한 결과 위조 논란 작품들이 위작으로 판정되는 과정에서 이상한 점을 여럿 발견했다.

지난 2007년 10월 검찰이 수사결과를 발표하고 이틀 뒤 SBS 스페셜은 ‘이중섭 박수근 위작논란 2829점의 진실’이라는 50분짜리 다큐멘터리를 방송했다. 이 프로그램은 위작 사건의 실체를 과학적으로 파헤쳤다는 이유로 방송위원회로부터 이달의 좋은 프로그램에 선정되기도 했다.

이 다큐는 과학적 검증을 위해 미술품 과학감정 전문가로 알려진 최명윤 전 명지대 교수의 자문을 받았다. 과학적 검증은 위작으로 의심되는 그림의 물감에서 산화티탄피복운모가 검출됐는지 여부를 확인하는 것.

SBS 스페셜은 “소장자의 동의를 받아 압수품의 일부에서 물감을 채취했다. 티타늄 성분의 단면을 잘라 조사했다. 그 결과 산화티타늄이 고르게 덮여있는 운모가 확인됐다”고 방송했다.

김용수 씨가 이중섭, 박수근 화백의 작품이라고 주장한 그림들이 위작임을 증명할 수 있는 과학적인 증거를 찾아냈다는 것이다.

산화티탄피복운모는 말 그대로 운모에 산화티타늄을 코팅한 것으로, 반짝이는 색을 내는 재료다. 그런데 운모에 산화티타늄을 코팅하는 기술은 1980년대에 처음 세상에 나왔다. 이중섭은 1956년, 박수근은 1965년 각각 사망했다. 따라서 두 사람의 작품에 이 성분이 나왔다는 것은 진품이 아니라는 것을 입증하는 것이다.

그러나 뉴스타파는 최 교수를 수소문해 만난 자리에서 뜻밖의 얘기를 들었다.

이거는 저기서 만든 거에요. 아니 이건 내가 한 게 아니라 SC 뭐죠 이게. SBS? 거기서 조작한 거죠. 만든 거죠. 저렇게 안 나와요. SBS에서 조작을 했다고요? 이거는 사실은 내가 한 얘기가 아니죠.

최 교수는 자신이 직접 티타늄 성분의 단면을 잘라 조사한 적이 없다고 말했다. 방송에 나온 그림은 한국화학연구원이 위작사건과는 별개로 산화티탄피복운모의 일반적인 구조를 보여주기 위해 찍은 사진이었다. 그런데 SBS는 마치 이 사진이 이중섭 화백 그림의 물감에서 검출된 산화티탄피복운모인 것처럼 보도했다.

뉴스타파 취재진은 당시 프로그램 제작 담당자에게 사실 확인을 요청했다. 담당 기자는 이미 SBS에서 퇴직한 상태였다. 어렵사리 전화 연락이 닿았다. 그는 “일단 그게 굉장히 오래된 일이라서 전 전혀 기억을 못하겠다”고 말했다.

하지만 이 기자는 지난 2007년 방송이 나가고 난 뒤 1년도 채 안 된 시점에서 법정에 증인으로 나가서도 “잘 모른다”는 말을 반복했던 것으로 확인됐다.

산화티탄피복운모는 이중섭, 박수근 그림의 위작 여부를 과학적으로 판가름하는 매우 중요한 증거다. 물감에서 산화티탄피복운모가 존재한다는 것을 입증하려면 산화티타늄을 구성하는 티타늄과 산소, 그리고 운모를 구성하는 핵심 원소인 SI, 즉 규소가 동시에 검출돼야 한다.

검찰은 이를 입증하기 위해 지난 2007년 국립중앙박물관 등 4개 기관에 위작 논란 그림에 대한 성분 분석을 의뢰했었다. 하지만 서울시립역사박물관이 검사한 그림 10개 중 6개에서는 규소는 물론 티타늄조차 검출되지 않았다. 국립경주박물관이 분석한 14개 시료에선 티타늄이 검출되긴 했지만, 물감이 아니라 종이 자체에 있는 티타늄 성분인 것으로 확인됐다. 국립문화재연구소와 국립중앙박물관 분석결과에서도 비슷한 결과가 나왔다.

그러나 최 교수는 이 4개 기관의 분석결과를 종합한 보고서를 검찰에 제출하면서 위작으로 추정되는 그림에서 산화티탄피복운모가 검출됐다고 주장했다. 최 교수는 “검사에 사용된 이동식 X선 형광분석기는 경금속인 규소를 잘 검출해내지 못하는 것일 뿐 산화티탄피복운모는 존재한다”고 말했다. 하지만 이 주장은 사실과 달랐다. 국립중앙박물관 관계자는 “당시 운용한 이동형 X선 형광분석기는 규소를 검출해낼 수 있으며, 지금도 잘 사용하고 있다”고 반박했다.

산화티탄피복운모의 존재, 즉 위작 여부를 과학적으로 입증할 증거는 나오지 않은 것이다.

그럼에도 1심과 2심 재판부는 모두 전문가의 눈으로 판단하는 안목감정 이외에 과학감정에서도 산화티탄피복운모가 존재하는 것으로 판단해 2,800여점의 그림을 위작이라고 결론지었다. 만약 대법원에서도 하급심과 같은 결론을 내리면 현재 압수 상태인 2,800여점은 모두 소각돼 폐기처분된다. 대법원은 2심 판결이 난 이후 2년 넘게 이 사건에 대한 최종 결론을 내리지 않고 있다.

현재 이중섭, 박수근 화백의 작품은 600여 점이 있는 것으로 알려졌는데 주로 유명 미술관과 부유층 개인 소장가들이 보유하고 있다. 2005년 당시 김용수 씨가 두 거장의 작품 2천여 점이 있다고 주장하고 나서자 미술계에서는 이 그림들이 시장에 풀리면 기존 작품들의 가치가 크게 떨어질 것이라는 우려가 퍼지기도 했다. 하지만 지금은 대법원이 과학적으로 명확하게 입증되지도 않은 상태에서 최종적으로 위작 판정을 내리게 되면 혹시 일부라도 있을지 모르는 우리의 소중한 문화 자산이 잿더미가 될 수 있다는 우려가 제기된다.

이중섭·박수근 위작 판결…‘추정’으로 가짜다?

한국의 대표적 화가 이중섭·박수근 화백 작품의 대규모 위작 의혹 사건과 관련해 법원이 1심과 2심에서 모두 위작이라는 결론을 내렸지만 정작 이를 뒷받침할 과학적 증거는 희박한 것으로 확인됐다. 특히 2심 재판부는 국립과학수사연구원의 그림물감 분석에서 위작으로 볼만한 과학적 증거가 나오지 않은 감정 결과는 배제한 한 것으로 드러나 논란이 예상된다.

통상적으로 미술품의 진위 여부는 안목감정, 과학감정, 자료감정을 종합해 판단한다. 안목감정은 해당 작가의 그림을 오래 접한 전문가가 직관으로 위작 여부를 가르는 것이다. 하지만 안목감정은 주관적이기 때문에 객관적인 과학감정이 중요할 수밖에 없다.

이중섭·박수근 위작 의혹 사건 재판에서 과학감정의 핵심은 물감의 성분인 산화티탄피복운모의 존재 여부와 그림에 기재된 서명이었다. 산화티탄피복운모가 들어간 물감이 1980년대에 개발돼 사용됐기 때문에 만약 위작 의혹을 받는 그림에서 이 성분이 검출된다면 진품이 아니라는 결론을 내릴 수 있기 때문이다.

산화티탄피복운모 존재 여부와 서명이 쟁점

이 때문에 지난 2012년 2심 재판 과정에서 피고인이자 위조 논란 작품 소장자인 김용수 씨의 변호인은 법원에 물감 성분 분석을 요청했고, 재판부는 국립과학수사연구원에 감정을 의뢰했다. 국과수는 위작 논란 그림 17점에 대해 1차로 X선 형광기 분석을 했다. 그 결과 7점에서 산화티타늄의 성분인 티타늄과 운모의 주성분인 규소가 검출된다. 그리고 2차 X선 회절기 분석에서 산화티타늄이 검출된 동일 부위에서 운모도 검출되는지 확인했다. 그 결과 운모는 검출되지 않았다.

2심 재판부는 판결문에서 국과수 2차 감정 결과는 반영하지 않고 1차 감정 결과만을 토대로 “산화티타늄의 주성분인 티타늄과 운모의 주성분인 규소가 동시에 검출된다면 높은 확률로 산화티탄피복운모가 존재한다고 추정된다”고 판시했다. ‘추정된다’는 것은 산화티탄피복운모가 존재할 수도 있지만 존재하지 않을 수도 있다는 뜻이다. 그러나 위작 논란 그림 소장자 김용수 씨가 사기 혐의 등으로 기소된 형사사건에서 이렇게 추정을 근거로 유죄 결론을 내리는 것은 형사소송법은 물론 대법원 판결에도 배치된다는 지적이다.

대법원은 1987년 “형사재판에서 유죄의 증거는 형사소송법상 엄격한 증거여야 한다”며 “그 증명력도 법관으로 하여금 합리적 의심을 할 여지가 없을 정도의 확신을 생기게 할 수 있는 우월한 증명력을 가진 것이어야 한다”고 판결한 바 있다. 오길영 신경대 경찰행정학과 교수는 “형사소송법에 의하면 법관은 자유 심증을 할 수 있지만, 유죄 입증의 증거에 대해서는 합리적인 의심의 여지가 없어야 한다”며 “단순히 추정되는 정도 가지고 유죄 입증의 증거로 사용됐다면 문제가 있다고 볼 수 있다”고 말했다.

더군다나 국과수는 재판부의 사실 조회에 대한 답변에서 ‘산화티타늄이 피복된 운모’와 ‘산화티타늄과 운모의 혼합물’을 구별할 수 있는 장비를 보유하고 있지 않아 결과적으로 산화티탄피복운모 확인 시험은 불가하다는 입장을 전했다. 결국, 국과수의 감정 결과로는 위작 여부를 과학적으로 판단하기 힘든 상황이었다. 이에 대해 2심 재판장은 공보담당판사를 통해 뉴스타파에 “판결문 외에는 할 말이 없다”는 입장을 밝혔다.

서울중앙지검은 2005년 국과수에 필적 감정도 의뢰했다. 국과수는 진품에 있는 서명과 비교했을 때 “같은 필법으로 작성된 것으로 보기 어렵다”면서도 “객관적인 단정은 곤란하다”고 판단했다. 하지만 2심 재판부는 “같은 필법으로 보기 어렵다”는 부분만 판결문에 인용했다.

재판부는 위작 여부 판단에 있어서 전문가들의 안목감정에 기댔다. 2005년 서울중앙지검의 요청으로 안목감정에 참여한 16명의 전문가는 대부분 “위작으로 보인다”는 의견을 내놨다. 16명의 전문가 감정단은 평론가와 교수 9명, 화가 4명, 화랑대표 3명으로 구성됐다.

하지만 국내 미술품 감정학 분야의 권위자인 한 미대 교수는 “작가에 대해 A부터 Z까지 연구한 사람만 그림의 진위를 얘기할 수 있다”며 “(그동안 이뤄진) 많은 사람의 논의가 전부는 아니겠지만, 상당 부분이 문제가 있을 수 있다”고 말했다. 2013년 2심 판결 후 대법원은 3년째 위작 여부에 대해 결론을 내리지 못하고 있다. 대법원이 1, 2심 재판부의 결론을 그대로 유지할지 그 결과가 주목된다.

‘익산 약촌오거리 택시기사 살인사건’의 재심은 그래서 중요하다. 불법 감금 폭행 및 가혹수사로 억울한 누명을 쓰게 된 이의 누명을 벗기는 것, 책임자를 처벌하는 것이 이 나라 사법 정의를 세우는 가장 소중한 일이기 때문이다. 너무나 쉽게 은폐되어버리고, 감춰져 버리는 진실을 수면위로 띄우고 세상이 정의와 마주하게 해야 한다. 약하기 때문에 피해자가 되고, 약하기 때문에 삶을 마감하게 되는 불온한 질주를 이제는 멈춰야 한다. 최군은 억울한 옥살이를 하고, 박모경위는 자살로 삶을 마감했다. 얼마나 더 많은 이들이 불행해져야 하는가? 더 이상의 희생자가 나오는 것을 막기 위해서는 ‘익산 약촌오거리 택시기사 살인사건’의 엄정한 재수사가 이루어져야 한다. 진실을 마주할 때에만 아픔을 멈출 수 있다. 더 이상 최군 같은 피해자가 나오지 않도록 한국사회가 은폐된 사법폭력의 진실과 마주하고, 재발방지대책을 마련해야 한다. 국가와 공권력에 의해 온전한 삶을 누릴 권리를 빼앗긴 최군과 사회의 정의를 위해서 재수사를 촉구하며, 재심 사건에 대한 올바른 판결을 기대한다.
