[판결비평] 난민신청자의 '무기한' 구금, 정당한가

 이란 국적 외국인인 H씨는 단기방문 체류자격으로 한국에 입국하였다가 난민인정신청을 하였지만 출입국관리소장에 의해 거부되었습니다. 출입국관리소장은 2012년 11월 1일 H씨에게 강제퇴거명령과 보호명령을 내렸고 H씨에게 이때부터 “언제 끝날지 알 수 없는 보호”가 시작되었습니다. 보호명령의 근거조항인 출입국관리법 제63조 제1항에는 언제까지 보호할 수 있는지 그 기간이 정해져 있지 않기 때문입니다. 그래서 H씨는 외국인보호소에 수용되어 있는 중에 출입국관리법 제63조 제1항에 대해 헌법소원을 제기하였던 것입니다. 그리고 H씨는 2014. 12. 24. 난민의 지위를 인정한다는 판결이 확정된 후에야 보호로부터 완전히 해제될 수 있었습니다. 

 

그런데 최근 헌법재판소 다수의견은 H씨가 청구한 헌법소원에 대해 재판의 전제성1이 인정되지 않는다며 각하결정을 내렸습니다. 출입국관리법 제63조 제1항이 헌법에 위반되는지에 대한 판단조차 하지 않은 것입니다. 반면 출입국관리법 조항이 헌법에 위반된다고 본 4인의 반대의견이 있었습니다. 다수의견과 반대의견의 결론이 이렇게 상반되는 이유는 무엇인지, 그리고 소수의견이 위헌이라고 본 ‘기한 없는’ 보호명령제도의 문제점은 무엇인지, 이주민 공익지원센터 ‘감사와 동행’ 대표인 고지운 변호사의 비평칼럼을 통해 알아보겠습니다.

문제의 제기 및 사안의 쟁점

 

출입국관리법 제63조 제1항은 강제퇴거명령을 받은 사람의 보호를 규정하면서도 그 구금기간의 상한을 별도로 두지 아니하고 있다. 여기서 보호라는 것은 강제퇴거대상에 해당한다고 의심할만한 상당한 이유가 있는 사람을 출국시키기 위해 외국인보호소, 외국인보호실 등에 인치하고 수용하는 집행활동을 의미한다(동법 제2조). 실무상 이루어지는 보호절차를 살피면, 출입국관리사무소의 외국인에 대한 단속 및 보호절차 개시, 외국인보호실에서의 조사, 보호명령처분 및 강제퇴거명령처분의 발동됨과 동시에 당해 외국인은 외국인 보호소에 보호조치 된다. 

 

여기서 문제는, 보호조치된 외국인이 당해 보호명령 및 강제퇴거명령을 다투는 경우, 특히 난민신청자가 보호명령 및 강제퇴거명령 뿐만 아니라 난민불인정처분을 소송으로 다투는 경우 꼼짝없이 외국인보호실 내지 외국인보호소라는 사실상 구금 상태에서 소송을 수행해야한다는 점이다. 특히, 보호명령 및 강제퇴거명령 내지 난민불인정처분에 대한 취소소송 기간은 통상적으로 1심만 최소 3∼4개월에서 최장 1∼2년 정도 걸리며 대법원 심리까지 구하는 경우 그 기간은 훨씬 늘어나게 된다. 이 때 출입국관리법 제63조 제1항의 보호제도가 그 구금기간의 상한을 규정하지 아니하고 있어, 보호명령 및 강제퇴거명령 내지 난민불인정처분을 다투고자하는 외국인은 그 소송기간 동안 외국인보호소에서 실질적 구금상태에 놓이게 되는데, 이러한 장기·무기한 구금이 헌법상 과잉금지원칙 및 적법절차원칙에 반하는지 여부가 이번 헌법재판소 결정의 핵심 쟁점이 된 것이다.     

 

헌법재판소의 판단  

 

이번 헌법재판소 결정은 5인의 다수의견으로, 출입국관리법 제63조 제1항의 위헌여부에 대한 판단을 하지 않고 각하 결정을 내렸다. 그 이유는 청구인이 난민불인정처분 취소소송에서 승소하여 난민 인정을 받았기에 청구인이 입은 권리와 이익의 침해가 해소되어 재판의 전제성이 인정되지 않아 부적법하다는 것이다. 그러나 이러한 헌법재판소의 결정은 다음의 이유에서 많은 아쉬움을 남기고 있다. 

 

이 사건에서 예외적인 심판의 이익이 인정될 수 없는가?

 

재판의 전제성이 인정되지 않는다 하더라도, 헌법적 해명이 긴요히 필요하거나 향후 기본권 침해가 반복될 우려가 있는 경우에는 예외적인 심판의 이익을 고려하여 본안판단을 하는 것이 타당하다. 그러나 이 사건에서 다수의견은 난민신청자의 경우 보호기간이 특히 길다는 점, 이러한 상황이 반복적으로 이루어질 가능성이 높다는 점, 그리고 ‘보호’의 성격을 명확히 함으로써 실질적 구금 상태에서 신체의 자유라는 기본권 침해 가능성을 막을 제도적 장치가 마련되어 있는지 여부 등은 도외시한 채 기계적으로 재판의 전제성을 해석하였다. 이로써 다수의견은 우리 헌법의 기본권 존중이념에 배치되는 판단을 하였다는 비판을 받을 수밖에 없게 되었다. 

 

보호명령 및 강제퇴거명령 대상자는 모두 소위 불법·미등록체류자인가?

 

또한 다수의견 중 2인의 보충의견에서는 기각의견을 제시하며, 불법체류사실이 발각된 외국인들이 무조건 난민인정신청을 할 수 있고 이 경우 출입국관리행정에 일대 혼란을 야기할 수 있으며, 불법체류자들이 잠적할 경우 국내 치안질서유지에도 부정적으로 작용할 수 있다는 점, 보호기간 상한설정이 어려운 점 등을 근거로 제시하고 있다. 그러나 난민신청자는 본국에서의 위험을 피해 도망치듯 나올 수밖에 없는 경우가 많아 여권 내지 비자가 제대로 구비되지 않는 경우가 대부분이고, 따라서 보호명령 및 강제퇴거명령을 우선 받은 상태에서 난민신청을 하는 경우도 상당수 있다. 따라서 이러한 난민신청자는 체류만을 목적으로 하는 소위 불법·미등록체류자와는 구별해야 한다. 또한 보호명령 및 강제퇴거명령대상자가 되는 사유는 소위 불법·미등록체류만이 아니며 오히려 적법하게 체류하던 중에도 여러 사유로, 즉 교통사고 가해자로 벌금형 받은 경우, 형사사건에서 외국인으로서 제대로 통역 서비스 지원을 받지 못해 벌금형에 처해진 경우 등 다툼의 여지가 충분히 있는 사안도 상당수 존재한다. 보호명령 및 강제퇴거명령대상자는 형사 범죄자와 구분해야한다. 이런 점들을 고려한다면, 오히려 헌법재판소의 다수의견은 지극히 행정 편의주의적 사고에 치우치고 있으며 어쩔 수 없는 상황에서 비자 등을 제대로 갖추지 않고 입국한 난민신청자를 잠재적인 범죄자로 생각하는 오류를 범하고 있다고 생각된다.

 

청구를 인용한 4인의 반대의견  

 

다만 4인의 반대의견에서, ‘보호’를 실질적 ‘구금’으로 보아 신체의 자유 제한이라고 판단한 것은 보호제도의 성격을 명확하게 함과 동시에 ‘보호’를 형사절차상 ‘체포 또는 구속’에 준하는 제도로 보아 엄격한 영장주의는 아니더라도 적어도 객관적·중립적 지위에 있는 자가 그 인신구속의 타당성을 심사할 수 있는 장치가 마련되어야 한다고 판단한 점은 고무적이라 하겠다. 하지만, 사법통제적 관점으로 접근하기 보다는 인간의 기본적인 신체의 자유 보장, 인신 구속에 있어서의 적법절차 보장, 나아가 국제적, 국내적 기준에 따른 보호조치 외국인에 대한 처우 보장 등 관련 헌법적 의무 관점에서 논의의 폭을 넓히는 것이 무엇보다 필요하다. 

 

인신구속의 성격을 가진 외국인 보호제도에 대해 근본적 논의가 필요하다 
 
이번 헌재결정의 다수의견 및 반대의견은 모두 청구인이 외국인보호소에 구금된 난민신청자라는 점을 고려하여 각 논지를 개진하고 있으나, 이 사건 심판조항은 출입국관리법 상 ‘보호’에 관한 것이라는 점, 그리고 보호제도는 우리나라에 있는 모든 외국인에게 적용되는 것이며 보호명령 및 강제퇴거 대상자는 형사범죄자와는 엄밀히 구분해야한다는 점, ‘보호’ 자체가 인신구속의 성격이 있으므로 그 절차 및 내용의 타당성을 판단할 수 있는 객관적 절차를 마련해야하며 ‘보호’ 자체를 소송으로 다투는 경우 장기구금이 정당화되기는 어렵다는 점, 만약 그 소송에서 승소하여 보호명령이 취소된 경우 보호기간 동안 구금상태에 대하여 보상절차는 어떻게 이루어질 수 있는지 등도 앞으로 보호 조치된 일반 외국인과 관련하여 폭넓게 논의되어야할 문제라고 생각한다.

러시아 정부가 비호를 신청했다가 구금된 시리아 난민 3명을 강제 송환하려 하는 것은 국제법 위반이라고 국제앰네스티가 밝혔다.

유엔난민기구(UNHCR)는 러시아 정부에 이들 난민 3명을 전쟁국가로 추방하지 말 것을 요청했음에도, 25일 시리아 다마스커스로 추방했다.

데니스 크리보셰프(Denis Krivosheev) 국제앰네스티 유럽중앙아시아 부국장은 “러시아 정부는 자국 역시 시리아에서 발생하고 있는 전쟁에 개입하고 있으면서, 시리아로 난민들을 돌려보내는 것이 안전한 것처럼 주장한다. 이는 시리아의 난민 위기를 무시하는 것”이라며, “이들 난민 3명을 추방하려는 것은 국제인권법과 난민법을 위반하는 것임은 물론, 국제적 보호가 필요한 사람들에 대한 러시아 정부의 접근 방법이 부끄러운 수준임을 보여주는 새로운 예”라고 말했다.

2015년 한 해 동안 러시아에서 난민 지위를 받은 시리아 난민은 단 한 명도 없었으며, 임시 보호가 허용된 사람도 단 482명에 불과했다.

자카리 바리 압달무즈마, 드루비 카이삼, 와판 사다흐 에들린 등 시리아 남성 3명은 지난 24일 모스크바에서 다게스탄 마하치칼라의 외국인 임시 수용소로 보내졌다.

유엔난민기구는 추방중단을 요청했으며, 유럽인권재판소(ECHR) 역시 중재에 나서 러시아 정부에 압달무즈마를 추방해서는 안 된다고 판결했다.

데니스 크리보셰프 부국장은 “러시아 국방부는 시리아 공습으로 민간인이 사망한 사실도 부인하고 있을 뿐만 아니라, 중대한 인권침해 위험이 실재하는 시리아로 난민들을 고의로 돌려보내려고 하고 있다”며 “러시아 정부는 이들의 추방을 중단하고, 대신 이들 3명을 비롯한 난민들에게 난민 지위를 제공함으로써 이들을 보호해야 할 국제적 의무를 다해야 할 것”이라고 말했다.

마하칠라카 외국인 수용소에는 이들 3명 외에도 다른 시리아인 2명이 구금되어 있다. 그 중 알레포에서 온 쿠로 사브리는 1년 전 구금된 이후 지금까지 거듭 비호 신청을 요청했지만 제도적으로 받아들여지지 않고 있다.

2011년부터 러시아에서 거주한 사브리는 러시아인 아내와 자녀도 있지만, 러시아 정부의 입장은 변하지 않았다. 유럽인권재판소의 중재로 지금까지 사브리는 시리아로 송환되지 않을 수 있었다.

러시아 이민국은 러시아 법원의 판결을 무시하고 알레포 출신 난민인 샤바 모하메드의 비호 신청을 거절하려 했다. 이민국은 알레포에서 전투가 일어난 바가 없으며 보호가 필요한 사람은 쿠르드인, 아르메니아인, 체르케스인 뿐이라고 주장했다.

국제앰네스티는 알레포에서 격렬한 무력충돌로 올 2월에만 수만 명이 고향을 떠났다고 기록한 바 있다.

Russia: ‘Shameful’ plan to deport Syrian refugees back to warzone violates international law

Russia is violating international law by trying to deport three Syrian refugees who were detained in Dagestan after seeking asylum in the country, Amnesty International has said.

The three men are due to be flown to Damascus on Thursday despite the United Nations Refugee Agency (UNHCR) asking Russia not to deport them to a country at war.

“The Russian authorities are pretending it is safe for people to go back to the country where Russia itself is a warring party and is unforgivably ignoring the country’s refugee crisis,” said Denis Krivosheev, Amnesty International’s Deputy Director for Europe and Central Asia.

“The attempt to deport these three men – in violation of international human rights and refugee law – is the latest example exposing Russia’s shameful approach to people in need of international protection.”

In 2015, not a single person from Syria was given refugee status in Russia, while temporary asylum was given to only 482 people.

The three Syrian men, Zakari Barri Abdalmuzma, Drubi Khaisam and Wafan Sadakh Edlin, were taken to Moscow from a temporary detention centre for foreigners in Makhachkala, Dagestan on Wednesday.

UNHCR has called for the deportations to be halted, while the European Court of Human Rights (ECtHR) has also intervened and ordered the Russian authorities not to deport Abdalmuzma.

“Not only is Russia’s Ministry of Defence falsely denying that civilians are being killed in its aerial bombardment of Syria, it is also knowingly sending refugees back to a country where they are at real risk of serious human rights violations,” said Denis Krivosheev.

“The Russian authorities must stop this deportation and instead fulfil their international obligation to protect refugees by offering asylum to these three men, along with other refugees from Syria.”

Two other Syrians are held in the detention centre for foreigners in Makhachkala. One of them, Kuro Sabri from Aleppo, has seen his requests for asylum systematically rejected since he was detained a year ago today.

Sabri has been living in Russia since 2011 and has a Russian wife and child, but this has had no impact on the stance of the Russian authorities. Until now, only the intervention of the ECtHR has prevented his return to Syria.

The Russian Migration Service has also attempted to deny asylum to another refugee, Shava Mohamed from Aleppo, in defiance of a Russian court ruling. The Migration Service claimed that there is no fighting in the city and that only Kurds, Armenians or Circassians are in need of protection.

Amnesty International has documented heavy fighting in Aleppo that has displaced tens of thousands of people in February alone.

레바논 정부가 8일 시리아 난민 100명 이상을 본국에 강제 송환한 것으로 파악했다고 국제앰네스티가 밝혔다. 송환되지 않은 난민 약 150명은 여전히 레바논 베이루트의 라픽 하리리 국제공항에서 발이 묶인 채로 수 시간 내에 강제 송환될 위기에 처해 있다. 레바논 정부는 뒤이어 도착하는 현지 시간 오후 9시 30분 항공편으로 이들을 돌려보낼 계획인 것으로 알려졌다.

이들은 터키로 향하기 위해 시리아에서 항공편을 이용해 베이루트에 도착한 난민들로, 1월 7일 베이루트를 떠날 예정이었다. 그러나 터키 정부의 난민 입국 제한 정책이 8일부터 시행되면서 시리아 난민에 대한 비자 규정도 변경되었고, 이에 앞서 터키항공 항공편 2대가 취소됨에 따라 난민들의 발이 묶이게 되었다.

Lebanon: Forcible return of more than 100 refugees to Syria a shocking setback

More than 100 Syrian refugees have been forcibly returned to Syria by the Lebanese authorities today, Amnesty International has learned. Around 150 others are still stranded at Beirut’s Rafic Hariri International Airport and are at risk of imminent deportation in the coming hours. The authorities are reportedly planning to force them to leave on the next flight at 9:30pm local time.

The refugees had arrived in Beirut on flights from Syria with the intention of travelling on to Turkey. They were due to depart on 7 January but were unable to leave as two Turkish Airlines flights were cancelled ahead of new visa regulations for Syrian refugees imposed by the Turkish authorities that came into force today restricting access to the country.

“By forcibly returning more than 100 refugees to Syria the Lebanese government has stooped to a shocking new low and is putting these people in mortal danger. This is an outrageous breach of Lebanon’s international obligations to protect all refugees fleeing bloodshed and persecution in Syria. The Lebanese government must halt all further deportations of Syrian refugees immediately,” said Sherif Elsayed-Ali, Head of Refugee and Migrants’ Rights at Amnesty International.

“The new visa regulations in Turkey present yet another hurdle for Syrians desperate to seek sanctuary from the conflict and show what devastating consequences such restrictions can have for refugees.”

2011년 3월 15일 시리아 반정부시위가 시작된 이후, 지난 5년간 전쟁범죄와 반인도적 범죄 등 끔찍한 인권침해가 시리아를 휩쓸며 수많은 사람이 고통 속에 신음하게 되었다고 국제앰네스티가 밝혔다.

살릴 셰티(Salil Shetty) 국제앰네스티 사무총장은 “시리아 시위가 처음 시작된 이후로 지난 5년간의 세월은 엄청난 규모의 공포와 유혈사태로 얼룩져 왔다. 시리아 정부군이 평화적인 시위대를 향해 처음 발포했던 순간부터 민간인의 고통과 잔혹함은 시리아 사태를 비극적으로 상징하게 되었다”고 말했다.

또한 “시리아군을 비롯해 자칭 ‘이슬람국가(IS)’와 같은 비정부 무장단체는 인권과 전쟁법은 물론, 자신들로 인해 목숨을 잃고 상처 입거나, 피난을 떠나고, 포위당한 지역에서 굶주리는 민간인들에 대해 싸늘한 무관심으로 일관하고 있다. 시리아군은 민간 지역에 무자비한 ‘드럼통 폭탄(barrel bomb)’ 공격을 가하고, 대규모의 납치 활동과 산업 규모의 조직적 고문을 자행하는 등 끔찍한 전략을 사용하며 반인도적 범죄를 버젓이 저질렀다. 특히 IS와 같은 일부 무장단체는 세계 언론에 주목받는 점을 이용해 시리아인과 외국인을 막론한 민간인을 납치하고 약식 처형하는 등 자신들이 저지른 전쟁범죄를 아랑곳 하지 않고 홍보하고 있다”고 말했다.

다음은 지난 5년간 시리아 사태가 최악으로 치닫게 된 다섯 가지 결정적 순간을 정리한 것이다.

  • 반정부 시위가 시작된 지 3일이 지난 2011년 3월 18일, 남부 데라아(Dera’a)에서 반정부 성향의 그래피티를 그렸다는 이유로 체포, 고문당한 소년들의 석방을 요구하던 평화적 시위대를 향해 시리아군이 실탄을 발사했다. 이날 이후 시위는 유혈 사태로 번졌고, 이날의 발포는 정부군이 평화적인 시위를 탄압하는 데 치명적 무력을 광범위하게 사용하며 결국 전면적인 무장 분쟁으로까지 이어지게 되는 전조였다.
  • 2013년 8월 다마스쿠스 동부 고타(Ghouta)에서 화학무기 공격으로 고통스러워하는 주민의 모습을 담은 영상이 공개되면서 세계는 충격에 휩싸였고, 시리아에서 자행되고 있는 끔찍하고 잔혹한 인권침해에 대해 경종을 울렸다. 그러나 안타깝게도 이는 빙산의 일각에 불과했다. 화학무기 외에도 확산탄과 같은 금지 무기를 사용해 공격하거나 정기적인 미사일, 박격포 폭격을 가하면서 시리아 전역에서는 매일같이 점점 더 많은 사람들 목숨을 잃고 있다. 그런데도 유엔 안전보장이사회는 시리아 상황을 국제형사재판소(ICC) 검찰부에 회부하는 데 합의하지 못했고, 특히 러시아와 중국은 거부권을 행사해 민간인 보호 결의안 통과를 여러 차례 저지하는 등 수년째 제대로 대처하지 못하고 있다.
  • 2014년 1월 다마스쿠스 외곽 야르무크(Yarmouk)에서 봉쇄된 지역에 갇힌 주민들이 구호물품을 받기 위해 길게 늘어선 충격적인 모습은 시리아 전역의 봉쇄된 지역에서 식량과 의료 지원이 부족해 죽어가는 수천 명의 안타까운 현실을 알리는 계기가 되었다. 야르무크 외에도 모아다미야(Moadamiya), 동부 고타, 마다야(Madaya), 알포아(al-Fouaa) 등지를 봉쇄하며 정부군과 무장단체는 주민들의 굶주림을 전쟁 무기로 사용했다. 현재 시리아 15개 지역에서 40만 명 이상이 봉쇄지역에 갇혀 있다. 최근 합의된 휴전 협정의 일환으로 봉쇄지역에 한정된 수준의 구호물품이 전달되고 있지만, 여전히 이곳 주민들은 아사할 위험에 처해 있으며 제한 없는 인도적 지원이 절실히 필요한 상황이다.

From hope to horror: Five years of crisis in Syria

A horrifying catalogue of human rights abuses including war crimes and crimes against humanity have overwhelmed Syria over the past five years causing human suffering on a vast scale, said Amnesty International, marking the five-year anniversary of the start of anti-government protests in the country on 15 March 2011.

“The five years since the uprising in Syria first began have been marred by horror and bloodshed on a colossal scale. From the moment that Syrian government forces first opened fire on peaceful protesters, brutality and civilian suffering have been the tragic hallmarks of this crisis,” said Salil Shetty, Secretary General of Amnesty International.

“Government forces and non-state armed groups, including the one calling itself the Islamic State (IS), have displayed a callous indifference to human rights and the laws of war as well as the civilians they have killed, maimed, displaced and, in some areas under siege, starved.

“Government forces have brazenly committed crimes against humanity through the use of appalling strategies such as relentless barrel bomb attacks on civilian areas, a campaign of mass disappearances and systematic, industrial-scale torture. Some armed groups, particularly IS, have exploited the international media spotlight to cynically broadcast their own war crimes, such as the abduction and summary killing of Syrian and foreign civilians.”

Here is a reminder of five key moments that saw the crisis in Syria go from bad to worse over the past five years:

On 18 March 2011, three days after the start of the uprising Syrian government forces opened fire on peaceful protesters in the southern city of Dera’a, using live ammunition against demonstrators demanding the release of boys arrested and tortured for anti-government graffiti. This marked a bloody turning point, and was a precursor to the widespread use of lethal force by government forces to suppress peaceful protests, which eventually evolved into a full-blown armed conflict.

Video footage showing civilians suffering from the effects of a chemical weapons attack in Eastern Ghouta, east of Damascus in August 2013 shocked the world, acting as a wake-up call to the horrific and cruel nature of the abuses being committed in Syria. Sadly, this was just the tip of the iceberg. Across Syria, civilians continued to be killed on a daily basis often in far greater numbers in attacks using both other banned weapons such as cluster munitions and regular bombs, missiles and mortars. However, for years the UN Security Council dragged its feet, with member states failing to unite to refer the situation in Syria to the Prosecutor of the International Criminal Court and Russia and China in particular blocking several resolutions on the protection of civilians using veto powers.

The surreal images of crowds of besieged civilians queuing for aid parcels in Yarmouk on the outskirts of Damascus in January 2014 brought to life the tragic reality that thousands of people trapped under siege across Syria were dying from lack of food and medical care. Beyond Yarmouk starvation has been used as a weapon of war by both government forces and armed groups in areas such as Moadamiya, Eastern Ghouta, Madaya and al-Fouaa. Today more than 400,000 people are under siege in 15 locations across Syria. Despite limited deliveries of aid to besieged areas as part of the ceasefire agreed in recent weeks, civilians are still at risk of starving to death and in desperate need of unfettered humanitarian aid.

Harrowing photographs showing tortured, starved and burnt bodies, known as the “Caesar” torture photos, were smuggled out of Syria by a military defector and published in January 2014. These provided the strongest evidence yet of systematic torture and extrajudicial executions taking place inside government detention centres, opening the world’s eyes to the ruthless tactics used to punish those who dare to oppose the government of President Bashar al-Assad. Tens of thousands remain missing after being arrested by one of Syria’s various security and intelligence forces.

Russia began its first air strikes in support of the Syrian government in September 2015, ostensibly targeting IS but mostly hitting areas under the control of armed opposition groups. Russia’s entry into the fray has led to intensive aerial bombardments, particularly in northern Syria, that have killed hundreds of civilians, including in attacks that appear to be war crimes. Most recently an offensive in the vicinity of Aleppo has seen Russian and Syrian warplanes bomb hospitals as part of its military strategy in flagrant violation of international law.

시리아의 비극, 끝나지 않은 이야기 


2011년 시작된 시리아 내전이 발생한지 어느덧 4년이 되었습니다.
내전이 장기화되고 유엔난민기구, 유니세프 등 국제기금이 고갈됨에 따라 
난민 캠프의 지원이 끊겨 난민들이 대거 유럽으로 유립되고 있습니다.

 

최근 터키 해안가에서 발생한 꼬마 난민의 비극으로 
시리아 내전과 난민에 대한 책임과 반성이 잇따르고 있습니다. 

 

독일에서는 시리아 난민을 모두 수용하기로 결정하였으나, 
일부 국가에서는 중동난민을 전면 차단하고 국가 비상사태를 선포하기도 하였습니다.

2월 4일 런던 시리아 공여국 회의 개최를 앞둔 가운데, 턱없이 부족한 국제적 지원과 레바논 정부의 차별 정책으로 인해 레바논의 난민 여성에 대한 착취와 인권침해를 더욱 부추기는 환경이 조성되고 있다고 국제앰네스티가 보고서를 통해 밝혔다.

보고서 <‘안전한 곳을 원해요’: 레바논에서 소외되고 보호받지 못하는 시리아 난민 여성(영문)>은 레바논 정부가 난민들의 체류 기간 연장을 거부하고, 국제적 재정 지원도 한계에 달하면서 불안정한 상황에 놓인 난민 여성들이 집주인과 고용주, 심지어 경찰과 같은 권력자들에 의해 착취당할 위험에 빠졌다고 지적하고 있다.

2015년부터 레바논은 유엔난민기구(UNHCR)를 통한 더 이상의 시리아 난민 수용을 중단하고, 난민들이 체류 기간을 연장하기 더욱 어려워지는 신규 규정을 도입했다. 합법적인 체류가 아닐 경우 임의 체포, 구금, 강제 송환까지 당할 수 있어 많은 난민이 인권침해 사실을 경찰에 신고하지 못하고 있다.

레바논에 거주하는 시리아 난민 가정 중 20%는 여성이 세대주다. 시리아에서 남편이 살해, 구금, 강제 실종, 또는 납치된 뒤로 여성이 가족의 생계를 책임지게 된 경우도 있다.

램지 조사관은 “레바논의 시리아 난민 대부분이 주로 절박한 상황에서 살아가고자 분투하고 있다. 식량이나 집, 일자리를 구하는 데도 만연한 차별과 큰 역경에 마주하게 된다. 이러한 상황에서 여성 난민들의 삶은 이보다 더 힘겨운 경우가 많은데, 특히 가족의 생계를 책임져야 하는 여성들은 직장과 거리에서 괴롭힘과 착취, 인권침해의 대상이 될 위험이 매우 크기 때문”이라고 말했다.

가난과 고용주, 집주인의 착취

시리아 난민 가정 약 70%가 레바논의 빈곤선에 한참 미치지 못하는 생활을 하고 있다. 시리아 난민 사태에 대한 유엔의 인도주의적 지원은 만성적인 재정 부족에 시달리고 있다. 지난해 유엔이 받은 국제 지원금은 레바논에서의 활동을 위해 필요하다고 요청한 액수의 57%에 불과했다. 이처럼 심각한 재정 부족으로 세계식량계획 역시 가장 취약한 난민들에게 제공하던 월간 식비를 2015년 중반부터 미화 30달러에서 13.5달러로 삭감해야 했다. 2015년 말 자금 투입으로 21.60달러로 인상되긴 했으나 하루 0.72달러에 불과한 금액이다. 국제앰네스티가 인터뷰를 나눈 여성 4명 중 1명은 지난해부터 식비를 받지 못했다.

많은 난민 여성들이 레바논의 높은 물가와 식비, 집세를 감당하기 어렵다고 했다. 이 때문에 난민 여성들은 착취의 대상이 될 위험에 노출되기 쉽다. 남성들이 부적절하게 성적인 접근을 하거나, 재정적 및 기타 지원을 대가로 성관계를 요구하는 경우도 있다고 한다.

난민 차별이 만연한 레바논에서 간신히 일자리를 구해 생계를 이어갈 수 있게 되더라도 난민 여성들은 고용주로부터 극도로 낮은 급료를 받으며 착취를 당하고 있다고 전했다. 시리아의 팔레스타인 난민 ‘하난(가명)’은 “고용주들은 우리가 절박한 상황에서 아무리 낮은 급료를 준다고 해도 받아들일 수밖에 없다는 걸 알고 있다”고 했다.

시리아에서 온 팔레스타인 난민인 56세 ‘아스마’는 베이루트 남부 교외에 있는 난민캠프 샤틸라에 거주하고 있다. 그녀는 딸들이 성추행을 당할까 걱정되어 직장에 다니는 것을 허락하지 않았다고 한다. “딸이 한 상점에서 일했었는데, 점장이 추행하고 만지기 일쑤였어요. 그래서 지금은 딸들에게 일하지 말라고 했습니다.”

고용주의 행동이 부적절하다고 느껴 직장을 그만두거나 일을 시작하지 않았다고 밝힌 여성들도 다수였다.

집세를 지불할 만큼 충분한 돈을 구하는 것도 상당히 힘든 일이다. 시리아 난민 최소 58% 이상이 임대아파트나 임대주택에 거주하고, 나머지는 다 허물어져 가는 건물이나 비공식 정착지에서 살아가고 있다. 그러나 많은 여성들이 지나치게 비싼 집세를 감당하지 못하고 결국 누추한 건물에서 살게 되었다고 말했다.

램지 조사관은 “적은 급료를 받고 일을 하거나, 불결하고 쥐가 들끓으며 물이 새는 집에서 사는 등, 재정적 불안정으로 인해 난민 여성들은 엄청난 어려움에 처하고, 권력자의 위치에 있는 사람들은 이들을 쉽게 이용할 수 있다”고 말했다.

합법적 지위 상실로 위험 더욱 커져

레바논 정부는 2015년 1월부터 번거로운 관료제적 절차와 비싼 비용을 부과해 난민들이 체류 기간을 연장하기 어렵게 하는 정책을 시행하고 있다. 합법적인 체류 허가가 없는 시리아 난민들은 체포될 것을 우려해 인권침해 사실을 경찰에 신고하지 못하는 경우가 많다.

국제앰네스티와 인터뷰를 나눈 난민 여성 대다수가 체류 허가가 없기 때문에 레바논 정부에 범죄를 신고하지 못한다고 밝혔다. 베이루트 인근의 난민캠프에서 딸 3명과 함께 사는 시리아의 팔레스타인 난민 ‘하난’은 버스 기사에게 성추행을 당했다고 경찰에 신고했지만, 거절을 당했다고 했다. ‘법적 지위’가 없으므로 신고할 자격이 없다는 것이다.

램지 조사관은 “인터뷰를 나눈 여성들이 체류 허가가 없다는 이유로 도움이나 보호를 요청할 곳이 아무 데도 없다는 사실 때문에 이들에 대한 괴롭힘과 착취가 더욱 심각해졌다는 것은 매우 명백하다”고 말했다.

또 다른 시리아 여성은 경찰에 알린 이후로 괴롭힘의 대상이 됐다고 밝혔다.

“한동안 경찰들이 우리 집 앞을 지나가거나 우리를 불러내면서 데이트를 하자고 말하곤 했어요. 우리 신고를 받았던 경찰관 3명과 같은 사람들이었죠. 합법적인 [체류] 허가가 없다는 이유로 우리를 위협했어요. 데이트해 주지 않으면 감옥에 보내겠다는 말도 했어요.”

레바논은 인구 1인당 수용하고 있는 난민 수가 세계에서 가장 많은 국가이며 국제사회가 충분한 지원을 하지 못하고 있는 것은 사실이지만, 이 때문에 난민을 착취와 인권침해로부터 보호하지 않는 것이 정당화될 수는 없다.

램지 조사관은 “몰려드는 난민으로 인한 레바논의 부담이 상당하긴 하지만, 이것이 정부가 엄격한 제한을 부과하고 난민을 위험으로 몰아넣을 정당한 이유라고 할 수는 없다”며 “레바논 정부는 공포와 위협이 만연한 분위기를 조성하기보다, 난민 여성들이 보호받을 수 있도록 보장하고, 레바논의 모든 난민이 제재 없이 쉽게 체류 기간을 연장할 수 있도록 시급히 정책을 수정해야 한다”고 말했다.

국제적 지원이 반드시 필요

레바논 난민에 대한 국제적인 재정 지원 부족은 난민 여성들을 가난과 불안정한 위치에 놓이게 하고, 이 때문에 더욱 큰 위험에 노출되게 만드는 직접적인 요인이다.

유엔난민기구는 각국에 수용된 시리아 난민 중 45만 명에 해당하는 최소 10%가 취약한 상태로, 다른 지역의 국가로 재정착해야 할 필요성이 시급하다고 파악했으며, 특히 여성들은 ‘가장 취약한’ 난민의 기준에 포함될 위험이 있다고 보고 있다.

국제앰네스티는 국제사회에 재정착지를 확충하고, 시리아 난민들에게 안전한 출국 경로를 제공할 것을 촉구한다.

더불어 재정 지원을 확대하고, 이번 주 개막하는 공여국 회의를 통해 유엔이 2016-2017년 시리아 위기를 지원하기 위해 요청한 기금을 채울 것을 약속해야 할 것이다.

캐트린 램지 조사관은 “유럽연합과 영국, 걸프 지역 국가와 미국 등 세계적인 부유국으로 꼽히는 국가들은 특히 다른 어느 국가보다도 난민 위기 해소를 위해 더 많은 역할을 해야 한다. 시리아와 난민들에 대한 인도적 지원을 확대함은 물론, 더욱 많은 난민을 재정착시킴으로써 난민 위기의 책임을 공유해야 할 것”이라며 “또한 레바논과 같은 난민 수용국과 공조해 난민이 합법적으로 체류 허가를 받고 필수 서비스를 받을 수 있도록 장벽을 제거해야 하며, 위험에 처한 여성을 포함해 모든 난민이 인권침해 대상이 되지 않도록 도와야 한다”고 말했다.

Syrian refugee women in Lebanon face heightened risk of exploitation and sexual harassment

Shortfalls in international assistance and discriminatory policies imposed by the Lebanese authorities are creating conditions that facilitate the exploitation and abuse of women refugees in Lebanon, said Amnesty International in a new report published ahead of the Syria Donors Conference in London on February 4.

The report, ‘I Want a Safe Place’: Refugee Women from Syria Uprooted and Unprotected in Lebanon, highlights how the Lebanese government’s refusal to renew residency permits for refugees and a shortage of international funding, leaves refugee women in a precarious position, and puts them at risk of exploitation by people in positions of power including landlords, employers and even the police.

“The combination of a significant shortage in international funding for the refugee crisis and strict restrictions imposed on refugees by the Lebanese authorities, is fuelling a climate in which refugee women from Syria are at risk of harassment and exploitation and are unable to seek protection from the authorities,” said Kathryn Ramsay, Gender Researcher at Amnesty International.

In 2015, Lebanon stopped the UN Refugee Agency (UNHCR) from registering any more Syrian refugees and introduced new regulations making it difficult for refugees to renew their residency status. Without proper legal status they face arbitrary arrest, detention and even deportation leaving many afraid to report abuse to police.

Twenty percent of Syrian refugee households in Lebanon are headed by women. In some cases women became the main income providers supporting the family after their husbands were killed, detained, forcibly disappeared or abducted in Syria.

“The majority of refugees from Syria in Lebanon – are struggling to survive in often desperate conditions. They face widespread discrimination and major obstacles in obtaining food, housing or a job. For women refugees surviving in such circumstances can often be even more difficult, with many – particularly women who are the heads of their households – at increased risk of harassment, exploitation and abuse at work and in the streets,” said Kathryn Ramsay.

Poverty, exploitation by employers and landlords

Around 70 percent of Syrian refugee families are living significantly below the Lebanese poverty line. The UN humanitarian response to the Syria refugee crisis has consistently been underfunded. Last year the UN only received 57 percent of the funds it requested for its work in Lebanon. The severe shortage of funds forced the World Food Program to reduce the monthly food allowance provided to the most vulnerable refugees from $30 to $13.50 in mid-2015. After an injection of funding in late 2015, it was increased to $21.60- just $0.72 a day. A quarter of the women Amnesty International spoke to had stopped receiving payments for food over the last year.

Many refugee women said they struggle to meet the high cost of living in Lebanon and to afford food or rent which has exposed them to greater risk of exploitation. Some said that they received inappropriate sexual advances from men or offers of financial or other assistance in exchange for sex.

In a climate of widespread discrimination against refugees in Lebanon, refugee women who managed to find jobs to support themselves reported being exploited by employers who paid excessively low wages.

“They know we will agree to whatever low wage they offer because we are in need,” said “Hanan” a Palestinian refugee from Syria whose name has been changed to protect her identity.

“Asmaa,” a 56-year-old Palestinian refugee from Syria living in Shatila, a refugee camp in Beirut southern suburbs said she did not permit her daughters to work for fear they would face harassment: “My daughter worked in a store. The manager harassed her and touched her. That is why I don’t let my daughters work now.”

Several women also said they had left a job or not taken a job because they felt the employers’ behavior had been inappropriate.

Finding enough money to pay for accommodation is another significant challenge. At least 58 percent of Syrian refugees live in rented apartments or houses, others live in dilapidated buildings and informal settlements. Yet many women said they were unable to afford the exorbitant rents and found themselves in squalid accommodation.

“Whether they are underpaid at work or living in dirty, rat-infested, leaking homes, the lack of financial stability causes immense difficulties for women refugees and encourages people in positions of power to take advantage of them,” said Ramsay.

Lack of legal status increases risks

Burdensome bureaucratic procedures and high costs for refugees to renew their residence permits, introduced by the Lebanese government in January 2015, have prevented many refugees from being able to renew their residency permits. Without a valid residence permit, refugees from Syria often fear arrest and fail to report abuse to the police.

The majority of refugee women who spoke to Amnesty International said the lack of a residence permit stopped them from reporting a crime to the Lebanese authorities. “Hanan,” a Palestinian refugee from Syria who lives in a refugee camp near Beirut with her three daughters, said she went to the police to complain when a bus driver harassed her and was turned away. They told her she was not eligible to present a complaint because she lacked “legal status.”

“It was very clear to the women we spoke to that the harassment and exploitation they face is made even worse by the fact they have nowhere to turn to for help and protection because they lack valid residence permits,” said Ramsay.

Another Syrian woman told Amnesty International said she became a target for harassment after going to the police: “After a while the police would pass by our house or would call us and ask us to go out with them. It was the same three police officers who took our report. Because we don’t have legal [residence] permits, the officers threatened us. They said that they would imprison us, if we didn’t go out with them.”

Lebanon has more refugees per capita than any other country in the world and the international community has failed to support the country, however this is no justification for not offering protection to refugees from exploitation and abuse.

“The influx of refugees has placed a considerable strain on Lebanon, but this is no excuse for the stringent restrictions the authorities have imposed on refugees which are putting them in danger,” said Ramsay. “Instead of contributing to the climate of fear and intimidation the Lebanese authorities must urgently amend their policies to ensure women refugees are protected, and that all refugees in Lebanon are able to easily renew their residence permits without restrictions.”

International support crucial

The lack of international funding and support for refugees in Lebanon is a direct factor contributing to the poverty and precarious circumstances of refugee women which has exposed them to greater risks.

UNHCR has identified at least 10 percent of the Syria refugee population in host countries, the equivalent of 450,000, as vulnerable and in urgent need of resettlement in another country outside the region. UNHCR considers women and girls at risk as among those who meet the criteria of “most vulnerable” refugees.

Amnesty International is calling on the international community to increase the number of resettlement places and other safe routes out of the region offered to refugees from Syria.

In addition, they must boost financial assistance and use this week’s donor conference to pledge to fulfil the UN’s funding requirements for assistance for the Syria crisis for 2016-2017.

“The world’s wealthiest countries, from the EU including the UK, Gulf states and the USA, among others all need to do much more to alleviate this crisis. As well as boosting humanitarian support to those in Syria and refugees in the region they must also offer to share responsibility for the crisis by resettling more refugees,” said Ramsay.

“They must also work with host countries such as Lebanon to remove barriers to legal registration for refugees and access to vital services and help ensure all refugees, including women at risk do not face abuse.”
