트럼프와 김정은의 '시간표' 맞추기

북미 정상회담 공동성명 분석

북한과 미국의 정상, 김정은 국무위원장과 트럼프 대통령이 6월 12일 9시 4분부터 아세안 국가인 싱가포르에서 만났다. 북한과 미국 정상의 '첫' 만남은, 역사상 유례가 없을 정도로 전 세계의 주목을 받았다. 인민복을 입은 김정은 국무위원장과 빨간 넥타이에 정장을 한 트럼프 대통령이 인공기와 성조기를 배경으로 서로의 손을 잡는 '역사적' 순간, 전 세계에서 탄성이 터져 나왔다. 김정은 국무위원장은 "발목을 잡는 과거"를 넘어서는 시공간으로 정상회담의 첫 순간을 정리했고, 트럼프 대통령의 모두 발언은 정상회담의 "성공"이었다. 2017년 9월 트럼프 대통령이 유엔총회 연설에서 "북한을 완전히 파괴할" 수도 있다고 발언했음을 상기한다면, 상상이 불가능했던 첫 북미 정상회담이었다. "첫"(first)과 "역사적"(historic)은 두 정상이 서명한 "공동성명"(Joint Statement)의 첫 머리였다. 이 두 단어는 미지의 길을 가야하는 현재의 한반도를 정의한다.

 

첫째, 이차대전이 계속되고 있던 1945년 미국이 한반도를 소련과 분할점령하기 위해 38도선을 그었을 때, 한반도의 북쪽지역은 미국과 적대할 소지를 가지게 되었다. 냉전과 열전과 냉전을 거치며 한반도 북쪽의 조선민주주의인민공화국과 미국은 적대적 관계를 생산해 왔다. 조선에게 미국은 "철천지 원쑤"였고, 미국에게 조선은 "악의 축"이었다. 이차대전 이후 패권국가 미국은 사회주의를 표방하는 국가들 가운데 전쟁을 했던 중국과 베트남과, 적대적 관계를 유지했던 쿠바와 관계개선을 했지만, 북한만은 미국에게 예외국가였다. 패권국가 미국과 작은 국가 북한의 싱가포르 정상회담은 70여 년의 적대 역사, 최후의 냉전을 종식시키려는 첫 걸음이었다.

 

둘째, 핵확산금지조약 밖에서 핵국가가 된 북한과 핵확산금지조약 안에서 공식적인 핵국가인 미국이 비핵화와 평화체제의 병행협상을 위해 만났다는 점도 주목의 대상이다. 탈냉전시대에 북한은 미국적 주류 국제정치학의 문법과 다른 국가행동을 계속해 왔다. 미국과 중국이란 강대국들의 틈새에서 한 국가에 편승하여 안보를 보장받는 방식이 아니라 핵억제력의 확보라는 내적 세력균형정책을 통해 체제와 정권을 유지하고자 했다. 북한은 작은 국가로서는 역사상 처음으로 핵무기 운반체인 대륙간탄도미사일 실험을 통해 미국 본토를 위협할 수 있는 능력을 확보하고, 그 능력을 미국으로부터 인정받고자 했다. 북한의 핵은 인정투쟁을 위한 도구였다. 핵국가를 선언한 북한이 남북 대화를 통해 비핵화의 길을 가겠다고 하자 미국의 트럼프 대통령은 북한의 정상회담 제의를 수용했다.

 

셋째, 오리엔탈리즘의 발로이겠지만, 북미 정상회담은 서구적 시각에서 '문명국가' 미국이 '야만국가' 북한을 인정하는 자리였다. 미지의 국가 북한의 지도자 김정은 국무위원장 개인에 게 관심이 쏟아질 수밖에 없었다. 김정은 국무위원장이 "숭고한 의무"라고까지 표현했던 중국방문과 판문점 남측지역에서의 남북 정상회담을 제외한다면, 싱가포르는 김정은 국무위원장의 첫 해외방문지였다. 더불어 미국적 민주주의의 문법을 벗어난 지도자이자 이차대전 이후의 국제정치경제질서를 파괴하고 있는 트럼프 대통령과 '야만국가'의 지도자가 만난다는 사실도 북미 정상회담을 역사적 사건으로 만든 이유였다. 아시아적 가치를 담지하고 있다고 주장하는 네팔 출신의 용병을 쓰는 권위주의 도시국가 싱가포르가 북미 정상회담의 장소라는 사실도 트럼프 대통령과 김정은 국무위원장의 만남을 역사적 사건으로 만드는 데 한 몫을 했다.

 

첫, 역사적 만남에서 북미정상은 공동성명을 만들어냈다. 2018년 3월 8일 트럼프 대통령이 북미 정상회담을 수용한 후 북미 정상회담에 이르기까지 북미 간에 비핵화와 평화체제 구축과 관련한 실무협상이 전개되었음을 생각하면, 생각보다 간략한 합의문이었다. 그러나 70여년의 북미 적대역사를 생각한다면, 이견이 발생할 수밖에 없는 한반도 비핵화와 평화체제 구축과 관련한 세부내용보다는 북미의 "새로운" 관계를 '정치적으로 선언'하는 간략한 공동성명 일 수밖에 없었다. 북한은 김정은 국무위원장이 싱가포르를 향해 출발했다는 <조선중앙통신> 6월 11일 자 보도를 통해, "새로운 조미관계", "조선반도의 항구적이며 공고한 평화체제", "조선반도비핵화"를 둘러싸고 의견교환이 있을 것임을 제시하는 방식으로, 북미 정상회담의 공동성명을 예시했다.

 

공동성명은 "첫 역사적인 수뇌회담"을 언급한 이후, "새로운 조미관계수립"과 "평화체제구축"과 관련하여, 비핵화는 언급하지 않은 채, 두 정상이 논의했음을 밝히는 것으로 시작하고 있다. 그리고 "트럼프 대통령"이 "조선민주주의인민공화국에 안전담보를 제공할 것을 확언했으며", "김정은 위원장"이 "조선반도의 완전한 비핵화에 대한 확고부동한 의지를 재확인하였다"는 구절이 이어진다. 대통령과 위원장이 개인이 아니라 제도이기는 하지만, 미국과 조선이란 두 국가가 아니라 두 정상의 이름으로 "안전담보"(security guarantees)와 "완전한 비핵화"(complete denuclearization)가 언급되었다. "호상 신뢰구축이 조선반도의 비핵화를 추동할 수 있다는" 그 다음은, 트럼프 대통령과 김정은 위원장의 개인적 신뢰구축이 북미 정상회담의 일차적 목표였음을 보여준다. 트럼프 대통령이 6월 2일 김영철 조선로동당 부위전장을 만난 이후 북미 정상회담을 "과정"(process)이라 언급한 것과 상통하는 대목이다. 트럼프 대통령이 북한과 중국이 주장해 온 단계적, 동시적 비핵화에 동의했음을 추론하게 한다.

 

공동성명 1항은 북한과 미국이 "새로운 조미관계를 수립해나가기로 하였다"는 내용이다. 핵심은 "새로운"에 있다. 낡은 과거가 70여 년의 적대의 역사였다면, "새로운"은 사실상 적대의 종언을 선언하는 표현이다. 공동성명 2항에는 한반도에서 "항구적이며 공고한 평화체제를 구축하기 위하여 공동으로 노력할 것이다" 라는 내용이 담겼다. 2018년 4월 27일 남북 정상이 합의한 '판문점 선언' 3항과 같은 표현으로, 주체만이 "남과 북"에서 "조선민주주의인민공화국과 미합중국"으로 바뀌었을 뿐이다. 즉 남북미가 한반도 평화체제 구축을 위해 협력하겠다는 의지의 표현으로 공동성명 2항은 읽힌다. 그러나 새로운 북미관계와 한반도 평화체제 구축의 경로에 대한 세부계획이 공동성명에서 제시되지는 않았다.

 

공동성명 3항은, "조선민주주의인민공화국은 2018년 4월 27일에 채택된 판문점선언을 재확인하면서 조선반도의 완전한 비핵화를 향하여 노력할 것을 확약하였다"이다. 1항, 2항과 달리 3항의 주어는 북한이다. 북한이 '자발적' 비핵화를 하겠다는 의사를 밝힌 것으로 해석될 수 있다. 북한은 판문점 선언 이후인 5월 24일 풍계리 핵실험장을 폭파 방식으로 폐기했고, 이 사실을 5월 12일에 발표된 "조선민주주의인민공화국 외무성 공보"를 <로동신문>에 게재하는 형태로 북한 주민들에게도 알린 바 있다.

 

이 3항은 몇 가지 쟁점을 담고 있다. 

 

첫째, "판문점선언"의 "재확인"이란 구절이다. 판문점 선언에서 남북은 "완전한 비핵화"와 "핵 없는 한반도"를 실현하기로 합의했다. 공동성명 3항은 남북의 합의에 기초하여 북한이 완전한 비핵화의 길을 가겠다는 것에 미국이 동의하는 방식으로 구성되어 있다. 비핵화와 관련하여서도 북미관계만큼이나 남북관계가 자율성을 갖는 단위가 될 수 있다고 해석될 여지가 있는 부분이다.

 

둘째, 폼페이오 미국 국무장관은 싱가포르 북미 정상회담 하루 전 기자회견을 통해 '완전하고 검증가능하며(verifiable) 불가역적인(irreversible) 비핵화'가 미국이 수용할 수 있는 유일한 결과라고 말한 바 있다. 그러나 공동선언 3항에는 판문점 선언과 마찬가지로 완전한 비핵화만이 담겼다. 남한의 대북특사가 북한을 방문하고 3월 8일 미국에 가 트럼프 대통령의 북미 정상회담 수용의사를 확인한 후 6월 12일 싱가포르 북미 정상회담 직전까지 전개된 실무협상에서 '완전하고 검증가능하며 불가역적인 비핵화'는 핵심 의제였을 것이다. 그러나 결국 공동선언 3항에 완전한 비핵화만 담긴 것은, 북한의 반대 때문이었을 것이다. 싱가포르 북미 정상회담까지 벌어진 미국과 북한의 말의 공방에서, 북한의 김계관 외무성 제1부상과 최선희 외무성 부상은 '완전하고 검증가능하며 불가역적인 비핵화'를 받아들일 수 없음을 분명히 한 바 있다. 비핵화의 실행과정에서 다시금 검증과 불가역이 정치적 타협을 통해 선언될 수는 있지만, 북한은 주권의 문제와 관련된 검증과 '잠재적' 핵국가의 지위를 포기하게끔 하는 불가역이란 두 문구가 공동성명에 표현되는 것을 원하지 않았던 것처럼 보인다. 공동성명 3항은 미국의 후퇴로 읽힌다. 비핵화가 상당 시간이 소요되는 '과정'(process)으로 보기 시작한 트럼프 대통령의 인식 전환도 3항과 같은 미봉을 가능하게 했을 것으로 보인다.

 

셋째, 비핵화를 둘러싼 북미협상에는 북한이 비핵화의 길을 갈 때 그에 상응하여 제공되는 교환 품목들이 있다. 그 품목들은 미국이 제공하는 '군사적', '외교적', '경제적' 조치들이다. 비핵화의 내용과 시간표가 공동성명에 등장하지 않으면서, 외교적 보상은 "새로운 조미관계"와 "평화체제 구축"으로 모호하게 표현되었다. 트럼프 대통령이 싱가포르 북미 정상회담 전에 언급했던 종전선언도 공동성명에 담기지 않았다. 반면 미국이 제공하는 군사적 보상은 공동성명에 포함되어 있지는 않았으나 북미 정상회담 직후 열린 트럼프 대통령의 기자회견에서 그 일단이 제시되었다. 한미 연합 군사 훈련의 중단이 바로 그것이다. 북한은 2015년 1월부터 자신의 핵미사일실험의 중단과 한미 연합 군사 훈련의 중단, 이른바 쌍중단을 교환하고자 했다. 북한이 요구하는 "조선반도 비핵화"는 한반도 안보딜레마의 한 축인 북한의 비핵화가 시작되면 한미동맹에 기초한 핵관련 전략자산의 한반도 전개를 금지하는 '최소 비핵지대화'를 그 내용으로 하고 있다. 미국이 한국에 제공하는 핵우산의 제거가 '최대 비핵지대화'이지만 북한은 이를 의제화하지 않았다. 트럼프 대통령은 북미 정상회담 이후 기자회견에서 한미 연합 군사 훈련이 방어적이라는 공식 담론을 폐기하고 "도발적"(provocative)이었음을 인정했다. 사실상 한반도 안보딜레마를 인정하는 발언이었다. 한반도 비핵화, 한반도 평화체제, 한미동맹의 지속이란 세 목표가 동시에 달성될 수 없는 삼중모순(trilemma)의 해결을 위해 트럼프 대통령은 한미동맹의 수정을 선택한 셈이다. 미국의 전통적인 동맹국들과 무역전쟁을 하는 것과 비슷하게, 한미 연합 군사 훈련과 주한미군의 주둔의 비용 대비 효과를 계산하는 트럼프식 외교도 이 수정에 기여한 것처럼 보인다.

 

트럼프 대통령은 한미 연합 군사 훈련의 중단이 자신의 제안이라 밝혔다. 그러나 북한은 싱가포르 북미 정상회담 직후인 6월 13일 <로동신문>을 통해, 김정은 국무위원장이 평화체제 구축을 위해서는 "상대방을 자극하고 적대시하는 군사행동들을 중지하는 용단부터 내려야 한다고" 하자, 트럼프 대통령이 "이에 리해를 표시하면서, 조미 사이에 선의의 대화가 진행되는 동안 조선 측이 도발로 간주하는 미국-남조선합동군사연습을 중지하"기로 했다고 보도했다. 북미 서로의 국내정치적 필요 때문에 발생한 차이인 것처럼 보인다. 북한은 한미 연합 군사 훈련의 중지를 미국이 제공하는 군사적 보상, 즉 "안전 담보"로 해석했다. 북한이 미국에 제공한 상응의 대가는, <로동신문> 보도에 등장하지 않았지만, 미사일엔진 실험장의 폐쇄였다.

 

그리고 북한은 <로동신문> 보도에서 미국이 "대화와 협상을 통한 관계개선이 진척되는데 따라 대조선 제재를 해제할 수 있다는 의향을 표명하였다"는 내용을 첨가했다. 비핵화에 대한 경제적 보상도 북미 정상회담의 의제였음을 추론하게 하는 대목이다. 트럼프 대통령은 북미 정상회담 이후 기자회견에서 북중 국경이 느슨해지고 있다는 말로 중국이 사실상 대북제재를 해제하고 있음을 암시하는 발언을 했다. 그럼에도 중국을 종전선언 또는 평화협정의 당사자로 인정하는 또 다른 인식의 전환을 보여주었다.

 

북미 공동성명 4항은 북미가 "전쟁포로 및 행방불명자들의 유골발굴을 진행하여 이미 발굴 확인된 유골들을 즉시 송환할 것을 확약하였다"는 내용이다. 트럼프 대통령이 제기한 의제였고, 과거 미군 유해발굴과 송환작업을 한 경험이 있는 북한의 김정은 국무위원장은 즉각 이 의제를 수용했다고 한다. 4항은 트럼프 대통령의 국내정치적 고려가 담긴 추가였다.

 

북미 정상회담 공동성명에 대한 북한의 해석은, 미국이 "조미관계 개선을 위한 진정한 신뢰구축을 취해나간다면" "다음단계의 추가적인 선의의 조치를 취해나갈 수 있다"는 것이다. 즉 북미 정상이 "조선반도의 평화와 안정, 조선반도의 비핵화를 이룩해나가는 과정에서 단계별, 동시행동원칙을 준수"하기로 합의했다는 것이다. 중국과 러시아는 쌍중단을 선언한 북미 정상회담을 비핵화와 평화체제의 쌍궤병행으로 가는 첫 걸음으로 평가했다. 북한의 북미 정상회담 해석은 중러의 이해관계와 일치한다. 일본은 북미 공동성명에 대해 일단 비판적이지만, 북미관계의 진전에 따라 중국과 한국을 견제하기 위해 일본인 납치자 문제의 해결을 명분으로 내세우며 북일관계의 개선을 도모할 수도 있다. 트럼프 대통령은 북미 정상회담을 계기로 미국 본토에 대한 위협과 한반도에서의 전쟁 위기가 제거되었다고 자평했다. 

 

미국 내에서는 북미 공동성명에 비핵화의 내용과 시간표가 나오지 않은 것에 대해 '야만 국가' 북한을 인정한 것에 대해 비판의 목소리가 있다. 북한의 비핵화에 따른 미국의 외교적, 경제적 조치는 미국 국내정치를 통과해야만 가능한 보상이란 점을 고려한다면, 북미 공동성명의 실행이 관건일 수밖에 없다. 북미 공동성명 이외의 부속합의서가 있는지는 불분명하지만, 트럼프 대통령의 정치적 이익에 따른 시간표와 그 시간표에 조응하는 북한의 조치가 결합될 때, 북미 공동성명은 한반도 비핵화와 평화체제를 향한 전환의 기록으로 평가될 수 있을 것이다.

공동서한

국제 평화단체, 한반도⋅동북아 위기에 대한 외교적 해결 촉구

퍼그워시 회의 등 전세계 110개 평화단체, 무력사용 반대 입장 담은 서한을

미국과 북한 등 주요국가들에 전달

전 세계의 110개 평화단체들과 146인의 평화운동가들은 당면한 동북아와 한반도 위기에 대해 무력 사용을 반대하고 외교적 해결을 촉구하였습니다. 전 세계 평화와 군축을 위해 활동하는 이들은 이번 서한을 통해 지금의 위기가 오판과 우연에 의해 핵전쟁으로까지 비화된다면 전 세계는 핵참화를 피하기 어려울 것이라고 우려하며 △선제적 무력 사용 반대, △도발적인 군사연습 중단, △동북아비핵지대안 검토, △한국전쟁 종전, △6자회담 재개, △유럽연합의 외교적 협상 지원 환영, △외교적 해결 우선 등 7개 요구사항을 제시하였습니다.

 

이들은 이러한 입장을 담은 서한을 지난 9월 7일 남⋅북⋅미⋅중⋅러⋅일 등 6개국 대통령(또는 수상)과 유엔주재 대표, 유엔안보리 회원국, 안토니오 구테레스 유엔 사무총장 그리고 페데리카 모게리니 유럽연합 외교안보 고위대표에게 보냈다고 밝혔습니다. 

 

이번 공동서한에는 퍼그워시 회의(Pugwash Conference), Campaign for Nuclear Disarmament(영국), Coalition for Peace Action(미국), 원수폭금지협의회(일본), 참여연대(한국) 등 전세계 24개국에서 활동하는 평화단체들과 1976년 노벨평화상 수상자인 메어리드 코리건 매과이어(Mairead Corrigan Maguire)를 비롯한 대표적 평화운동가들이 함께 하였습니다.

▣ 공동서한 국문

 

동북아 상황의 외교적 해결을 호소합니다

 

전 세계에서 평화와 군축을 위해 활동하는 ‘어볼리션(Abolition) 2000’의 회원단체들을 대신하여 미국과 북한에 동북아가 직면하고 있는 전쟁 직전의 상황에서 한 걸음 물러나, 대신 전쟁을 막기 위한 외교적 접근법을 택하라고 촉구합니다. 

 

우리는 군사 갈등이 발발하는 것을 막고 나아가 근본적인 갈등을 해결하기 위해 즉시 협상에 나설 것을 요구합니다. 그러한 협상은 양자 간은 물론 중국, 일본, 북한, 러시아, 한국, 미국을 포함하는 새로운 6자회담 틀을 통해 이뤄져야 합니다. 

 

북한의 핵‧미사일 능력을 두고 고조되는 긴장과 군사 갈등 위협은 외교적 해법이야말로 필수적이며 최우선임을 다시금 일깨워줍니다. 전쟁 위기가 높아지고 오판과 우연, 또는 의도에 의해 핵무기가 사용될 수도 있다는 사실은 매우 끔찍한 일입니다. 

 

1950년에서 1953년까지 이어진 한국전쟁에서 목숨을 잃은 사람들의 수는 남북, 중국, 미국 등 다 합해 총 300만 명을 넘습니다. 만일 전쟁이 다시 발발한다면, 특히 핵무기가 사용된다면 사망자 수는 훨씬 더 많을 것입니다. 한반도에서 발발하는 핵전쟁은 핵 참사로 전 세계를 집어 삼킬 것이며 이는 우리 모두가 알듯이 문명의 종말을 가져올 것입니다. 

 

전쟁보다 외교적 해법을 지지하며, 우리는 다음과 같이 요구합니다.

  1. 우리는 그 어느 측의 선제적 무력 사용에도 반대합니다. 이는 역효과를 낳을 것이며 상황을 핵전쟁으로 이끌 것입니다. 
  2. 우리는 모든 측에 군국주의적 수사와 도발적인 군사 연습을 그만두기를 촉구합니다. 
  3. 우리는 중국, 일본, 북한, 러시아, 한국, 미국이 3+3 방식의 동북아 비핵지대 수립을 위한 단계적이고 포괄적인 접근법을 검토하기를 권합니다. 이는 일본과 한국에서 두 개 이상의 정당의 지지를 받고 있으며 북한 정부도 관심을 가지고 있습니다. 
  4. 우리는 중국, 일본, 북한, 러시아, 한국 그리고 미국이 또한 한국전쟁(1950-1953)을 공식적으로 끝내도록 1953년 정전협정을 전환하기 위한 가능한 옵션과 양식을 고려할 것을 권합니다. 
  5. 우리는 6자회담을 재개하라는 유엔 사무총장의 요구와, 협상을 지원하겠다는 그의 제안을 환영합니다. 
  6. 우리는 이란 핵 프로그램 협상을 성공적으로 이끌었던 것처럼 외교적 협상을 지원하겠다는 유럽연합(EU)의 제안 역시 환영합니다. 
  7. 우리는 유엔 안전보장이사회에 갈등에 대한 외교적 해결을 우선시할 것을 요구합니다.

Appeal for a diplomatic solution in North East Asia

 

The Abolition 2000 members and affiliated networks listed below, representing peace and disarmament organisations from around the world, call on the United States and North Korea to step back from the brink of war in North East Asia, and instead adopt a diplomatic approach to prevent war. 
 
We call for the immediate commencement of negotiations to prevent a military conflict from erupting, and to resolve the underlying conflicts. Such negotiations should take place both bilaterally and through a renewed Six-Party framework involving China, Japan, North Korea, Russia, South Korea and the United States.
 
The escalating tensions and threat of military conflict over North Korea's nuclear and missile capabilities makes a diplomatic solution of vital importance and the highest priority. The increasing risk of war - and possibly even the use of nuclear weapons by miscalculation, accident, or intent - is frightening. 
 
More than three million citizens of Korea, China, USA and other countries lost their lives in the Korean War from 1950-1953. Should a war erupt again, the loss of lives could be considerably worse, especially if nuclear weapons are used. Indeed, a nuclear conflict erupting in Korea could engulf the entire world in a nuclear catastrophe that would end civilization as we know it.
 
In supporting diplomacy rather than war, we:
 

  1. Oppose any pre-emptive use of force by any of the parties, which would be counter-productive and likely lead to nuclear war;
  2. Call on all parties to refrain from militaristic rhetoric and provocative military exercises; 
  3. Encourage China, Japan, North Korea, Russia, South Korea and the United States to consider the phased and comprehensive approach for a North-East Asian Nuclear-Weapon-Free Zone with a 3+3 arrangement*, which already has cross-party support in Japan and South Korea and interest from the North Korean government;
  4. Encourage China, Japan, North Korea, Russia, South Korea and the United States to also consider options and modalities for turning the 1953 Armistice Agreement into a formal end to the 1950-1953 Korean War;
  5. Welcome the call of the UN Secretary-General for a resumption of Six-Party talks and his offer to assist in negotiations;
  6. Welcome also the offer of the European Union to assist in diplomatic negotiations, as they did successfully in the negotiations on Iran’s nuclear program;
  7. Call on the United Nations Security Council to prioritise a diplomatic solution to the conflict

 
* The 3+3 arrangement would include Japan, South Korea and North Korea agreeing not to possess or host nuclear weapons, and would require China, Russia and the USA agreeing not to deploy nuclear weapons in Japan, South Korea or North Korea, nor to attack or threaten to attack them with nuclear weapons.

오는 5월 9일에 있을 19대 대선에 출사표를 던진 국회 원내 5개 정당 후보 14명이 중앙선거관리위원회에 제출한 전과기록을 조사한 결과, 이 중 6명이 1건 이상의 전과가 있는 것으로 나타났다. ‘국가보안법’ 위반 등 민주화운동과 노동운동 과정에서 얻게 된 전과가 있는 가 하면, 음주운전 등 도로교통법 위반 등의 이력도 포함되어 있었다.

선관위는 후보자들의 벌금 100만 원 이상 전과기록을 유권자들이 열람할 수 있도록 공개하고 있다. 뉴스타파 취재진은 원내 5개 정당 대선 예비후보 14명이 이번 대선을 앞두고, 혹은 과거 총선과 지방선거 때 선관위에 제출한 전과기록을 살펴봤다.

더불어민주당 문재인 후보는 2건의 전과가 있는데, 하나는 대학시절 박정희 유신 독재 반대 운동을 하다가 서대문 구치소에 수감돼 1975년 징역 8개월에 집행유예 1년을 선고받은 건이다. 나머지 한 건은 문 후보가 청와대 시민사회수석시절 이른바 민경찬 사설 펀드 조성 의혹과 관련돼 열린 국회 청문회에 불참해 국회에서의 증언 감정 등에 관한 법률 위반 혐의로 2004년 선고받은 벌금 200만 원 형이다.

더불어민주당 안희정 후보는 대학생 시절 국가보안법 사건으로 두 차례 수감됐다. 87년 고려대 애국학생회 사건으로 징역 1년 6개월에 집행유예 2년을 선고받았고, 88년 2월 특별사면을 받았다. 하지만 같은 해 반미청년회 사건으로 다시 징역 1년 6개월에 집행유예 2년을 선고받았다. 또 2002년 대선 과정에서 노무현 캠프에서 일하며 기업 등으로부터 불법 정치자금을 수수한 혐의로 2004년 징역 1년을 선고받았다. 이후 2006년 노무현 대통령의 임기 중 광복절 특별사면 때 복권됐다. 안 후보는 이렇게 총 3건의 전과기록이 공개돼 있다.

더불어민주당 이재명 후보는 3건의 벌금형 전과가 있는데, 변호사 시절 검사 사칭을 방조한 혐의로 2003년 벌금 150만 원 형, 음주운전으로 인한 도로교통법 위반으로 2004년 벌금 150만 원 형, 특수공무집행방해 등 혐의로 2004년 벌금 500만 원을 선고받았다. 이 후보는 그동안 과거 전과를 페이스북에 공개하고 일일이 해명하는 등 적극적으로 대처하고 있다. 음주운전에 대해서는 본인 페이스북 글을 통해 “변명여지 없는 잘못임을 인정”한다고 밝혔지만, 분당 주상복합인 파크뷰 특혜분양사건 보도에 협조하던 과정에서 발행한 검사 사칭 방조와 성남 시립의료원 설립조례 폐기에 항의하면서 특수공무집행방해로 처벌된 건에 대해서는 “변호사로서, 시민운동가로서 이 사회의 부정부패를 청산하기 위해서 희생적으로 싸우다 생긴 일”이라고 입장을 밝혔다.

자유한국당 홍준표 후보는 1996년 4.11총선 선거운동 기간 중 지역구 선거운동 조직에 거액의 금품을 제공한 혐의로 공직선거 및 선거부정방지법 위반죄로 벌금 500만 원을 선고받았다. 이때 의원직을 상실했지만 이후 2000년 8월15일 특별복권됐다.

바른정당 남경필 후보의 경우 라디오에 출연해 특정 언론사의 명예를 훼손하는 발언을 한 혐의가 인정돼 2011년 100만 원의 벌금형 처분을 받은 기록 1건이 있다.

정의당 심상정 후보는 과거 노동운동 시절 구로동맹파업을 주동한 혐의로 수배됐다가 1993년 징역 1년에 집행유예 2년을 선고받았고, 이후 2003년 일반교통방해 및 집시법 위반으로 벌금 100만 원을 선고받았다. 이렇게 총 2건의 전과기록이 있다.

더불어민주당 최성 후보, 국민의당 안철수, 손학규, 박주선 후보, 자유한국당 김관용, 김진태, 이인제 후보의 경우 선관위에 제출한 전과기록은 없는 것으로 나타났다.

하지만 뉴스타파는 유권자들의 보다 정확한 알 권리를 위해 선관위의 공개 범위에 포함되지 않은 후보들의 100만 원 미만의 벌금형과 현재 후보와 관련해 진행 중인 사건들도 조사했는데, 이 결과 선관위에 공개된 전과기록이 없는 후보들의 범죄 이력도 추가로 확인할 수 있었다.

더불어민주당 이재명 후보는 2010년 지방선거를 앞두고 지하철역 구내에서 명함을 배포해 공직선거법 위반으로 벌금 50만 원을 선고받았다. 국민의당 박주선 후보도 2012년 총선 당시 지역 동장 모임에 참석해 지지를 호소한 혐의로 선거법 위반으로 벌금 80만 원 형이 확정됐다.
바른정당 남경필 후보는 2000년 16대 총선에서 허위 학력을 기재한 혐의로 벌금 70만 원을 선고받았다.

자유한국당 홍준표 후보는 이른바 ‘성완종 리스트’ 연루 의혹으로 대법원 판결을 앞두고 있는 상황이다. 홍 후보는 성완종 전 경남기업 회장으로부터 1억 원의 불법 정치자금을 받은 혐의로 기소돼 1심에서 징역 1년 6개월에 추징금 1억 원을 명령받았지만, 항소심에서는 무죄가 선고됐다.

같은 당 김진태 후보는 지난해 총선 당시 9만 명이 넘는 선거구민에게 “한국매니페스토실천본부 공약이행평가 71.4%로 강원도 3위”라는 내용의 문자메시지를 발송해 허위 사실을 공표한 혐의로 기소돼 1심 재판을 받고 있다.
