엘살바도르 법원이 아이를 유산했다는 이유로 4년간 교도소에 수감됐던 여성을 석방하라고 판결한 것은 인권의 위대한 승리라고 국제앰네스티가 밝혔다.
마리아 테레사 리베라(33)는 아이를 유산하고 “고의 살인” 혐의로 징역 40년형이 선고되어 지난 2011년 교도소에 수감됐다.
에리카 게바라 로사스(Erika Guevara-Rosas) 국제앰네스티 미주국장은 “마리아 테레사의 석방으로 여성을 그저 2등 시민으로만 대우하는 국가인 엘살바도르에서 정의를 향한 진전이 또 한 걸음 이루어지게 됐다”며 “마리아 테레사는 단 1초라도 감방에 있어서는 안 될 사람이었다. 여성 수천 명의 목숨을 위험으로 몰아넣을 뿐인 터무니없는 낙태금지법 때문에 지금도 수많은 여성들이 교도소에 수감되어 있는 엘살바도르에서 이번 석방이 변화의 기폭제가 되어야 할 것”이라고 말했다.
마리아 테레사는 자택 화장실에서 거의 의식을 잃은 상태로 피를 심하게 흘리고 있는 모습을 시어머니가 발견하고 병원으로 옮겨졌다가 병원에서 체포되었다. 마리아 테레사가 낙태를 한 것으로 의심한 병원 직원이 경찰에 신고한 것이었다.
재판 과정에서 마리아 테레사의 직장 상사는 마리아 테레사가 2011년 1월에 임신한 사실을 알고 있었다며 불리한 증언을 했다. 이 증언대로라면 유산이 일어날 당시 임신 11개월이었다는 말이 된다. 이처럼 터무니없는 증언도 마리아 테레사의 유죄를 입증하는 증거로 사용됐다.
결국 법원이 혐의를 입증할 증거가 충분하지 않다고 판결하면서 20일 마리아 테레사의 석방이 결정됐다.
1998년 개정된 형법에 따라 엘살바도르에서는 모든 경우에 대해 낙태를 금지하고 있다. 강간, 근친상간으로 인한 임신이거나 산모의 생명이 위험한 상황이라도 마찬가지다. 이로 인해 여성들은 부당한 기소를 당하고, 오용된 형법에 따라 즉시 유죄로 몰리게 되었다. 특히 경제적 여유가 거의 없는 여성들이 낙태금지법에 큰 영향을 받았다.

A court’s decision today to release a woman who spent four years in jail in El Salvador for miscarrying her pregnancy is a great victory for human rights, said Amnesty International.
María Teresa Rivera, 33, was jailed in 2011 and sentenced to 40 years in prison for “aggravated homicide” after having a miscarriage.
“The release of María Teresa is yet another step towards justice in a country where women are treated as mere second class citizens,” said Erika Guevara-Rosas, Americas Director at Amnesty International.

María Teresa was arrested in a hospital after her mother-in-law found her in her bathroom almost unconscious and bleeding heavily. Staff at the hospital reported her to the police and accused her of having an abortion.
During the trial, one of Maria Teresa’s bosses testified against her saying she knew she was pregnant in January 2011. This would have made her 11 months pregnant by the time the miscarriage took place. The outrageous testimony was used as one of the pieces of evidence to convict her.
The release today came after a judge ruled there was not enough evidence to prove the charges against her.
Her release must be a catalyst for change in El Salvador, where dozens of women are put in prison because of an utterly ridiculous anti-abortion law which does nothing but put the lives of thousands of women and girls in danger.
Following a change in the Penal Code in 1998, abortion in El Salvador has been banned in all circumstances – even when the pregnancy is the result of rape, incest or when the life of the woman is at risk. The change in the law has led to wrongful prosecutions and misapplication of criminal law where women are immediately assumed guilty. Women with few economic resources are particularly affected by the ban.
