국제앰네스티는 멕시코에서 불법 벌목에 반대하며 평화적인 활동을 벌인 데 대한 처벌로 부당하게 수감된 남성을 ‘양심수’로 보고, 이 남성을 즉시 조건 없이 석방해야 할 것이라고 밝혔다.
양심수인 일데폰소 사모라 발도메로(Ildefonso Zamora Baldomero)는 2015년 11월 멕시코시티에서 동남쪽으로 80km 떨어진 산후안 아칭고의 선주민 틀라우이카족 마을에서 체포되었다. 지난 2012년 7월 벌어진 절도행위에 가담했다는 혐의였다.
에리카 게바라 로사스(Erika Guevara-Rosas) 국제앰네스티 미주국장은 “일데폰소 사모라는 자신이 속한 지역과 환경이 피해를 입고 있는 것에 반대하고 나섰다는 이유로 처벌을 받은 것이다. 그는 처음부터 수감되지 말았어야 할 사람으로, 즉시 조건 없이 석방되어야 한다. 환경을 보호하고 인권을 옹호하는 것은 범죄가 아니다”라고 말했다.
일데폰소 사모라의 절도 혐의는 날조된 증언들을 근거로 적용된 것이다. 검사가 증인으로 신청한 목격자들은 마치 대본을 읽는 듯이 모두 똑같은 표현만을 사용해 증언했다. 범행 장소는 보존되지 않았으며, 증거 역시 적절한 처리과정을 거치지 않았다.
체포되기 이전에도 일데폰소 사모라는 벌목 반대 운동을 벌인 것과 관련해 계속해서 위협을 받고 괴롭힘을 당했다. 2007년에는 괴한의 공격으로 아들 알도(Aldo)가 목숨을 잃고 미사엘(Misael)이 부상을 당했지만 지금까지도 이 사건에 대한 조사는 충분히 이루어지지 않았다.
일데폰소 사모라는 교도소에서 “불법 벌목 중단을 위해 활동했다는 이유로 아들을 잃고 자유를 빼앗기는 엄청난 대가를 치렀다. 하지만 우리 마을을 위한 활동을 멈추지 않을 것이다. 이미 불법 벌목으로 지구의 상당한 부분이 파괴당하고 있기 때문이다”라고 전해왔다.
게바라 로사스 국장은 “일데폰소의 사연은 멕시코 각지의 많은 인권옹호자와 환경운동가들이 어떤 처지에 놓여 있는지를 대표적으로 보여주는 것이다. 일데폰소가 감옥에서 1초라도 더 머물러서는 안 된다. 멕시코 정부는 일데폰소와 그 가족을 공격하고 정치적인 이유로 기소한 책임자들을 찾는 쪽에 노력을 더 기울여야 할 것”이라고 말했다.
양심수는 폭력을 사용하거나 옹호하지 않고, 자신의 정치적, 종교적, 기타 양심적인 신념이나 인종, 성별, 피부색, 언어, 국적, 사회적 신분, 경제적 수준, 출신, 성적 지향성 등에 기반한 이유로 구금된 사람을 말한다.
Mexico: Indigenous environmental activist named ‘prisoner of conscience’
A Mexican man unfairly imprisoned in what appears to be a punishment for his peaceful activism against illegal logging must be released immediately and unconditionally, Amnesty International said as it named him a “prisoner of conscience”.
Ildefonso Zamora Baldomero was arrested in November 2015 in the Indigenous Tlahuica community of San Juan Atzingo, 80km south-west of Mexico City. He is accused of participating in a burglary in July 2012.
“Ildefonso Zamora is being punished for speaking out against the damage being done to his community’s territory and environment. He should have never been imprisoned in the first place and must be released immediately and unconditionally. Protecting the environment and defending human rights are not crimes,” said Erika Guevara-Rosas, Americas Director at Amnesty International.
The burglary charges against Ildefonso Zamora are based on a series of fabricated testimonies. The prosecutor registered the testimonies of eyewitnesses who described the events using the exact same words as if reading them from a script, the crime scene was not preserved, and the evidence was not properly handled.
His arrest is part of a series of threats and harassment in relation to ahis anti-logging campaigns. In 2007, his son Aldo was murdered and his son Misael was injured in an attack which hasn’t yet been fully investigated.
Speaking from prison, Idelfonso Zamora said: “I work to stop illegal logging, and that has cost me dearly: my son’s life and my freedom. I want to continue working for my community because illegal logging is destroying large parts of the planet earth.”
“Ildefonso’s story represents the way many human rights defenders and grassroots activists are treated all over Mexico. He must not be made to languish in jail for a second longer. Instead, the Mexican authorities should re-direct their efforts to find those responsible for the attacks and political persecution against him and his family,” said Erika Guevara-Rosas.
Prisoners of conscience are people who have been detained because of their political, religious or other conscientiously held beliefs, or on the basis of their ethnic origin, sex, colour, language, national or social origin, economic status, birth, sexual orientation or other status. It is a distinction Amnesty International only gives to individuals who have neither used nor advocated violence.
