“이제는 바꾸자”…사상 첫 경찰개혁 전국경찰토론회

경찰은 오랜 시간동안 국민이 아닌 권력을 보호하는 활동을 했다.

경찰 노조 만들어서 권력이 아닌 국민에게 충성하는 경찰 만들자.

감찰기능을 민간에 넘겨서 시민들에게 통제받자.

경찰 개혁과 관련해 다소 과격하고 급진적으로 들릴 수도 있는 발언들이 쏟아졌다. 진솔한 과거 반성과 혁신적 개혁 방안은, 놀랍게도 시민단체나 경찰에 비판적인 그룹이 아닌 현직 경찰관들의 입에서 터져나왔다. 한국 경찰 역사에서 처음으로 열린 경찰 개혁 관련 전국 경찰 토론회에서다.

지난 19일 대전에선 ‘시민과 경찰의 인권 개선을 위한 전국 경찰 대토론회’가 열렸다. 경찰 내부 온라인 커뮤니티 폴네띠앙이 주최한 이 행사엔 전국의 현직 경찰관과 행정관, 주무관 등 130여 명이 모였다. 폴네띠앙 회장 류근창 경위는 “경찰개혁위원회로부터 경찰 개혁에 대한 일선 경찰관들의 의견을 수렴달라는 요청을 받았다”고 토론회 개최 배경을 설명했다.

일선 경찰관 등 130여 명 참석해 인권 경찰, 민주적 통제 방안 등 토론

토론회 시작 전, 폴네띠앙 관계자는 현직 경찰관들이 얼마나 참석할 수 있을지 걱정했지만 기우였다. 오후 1시 토론회가 시작될 무렵엔 미리 마련한 좌석이 부족할 정도로 많은 경찰 관계자들이 몰려왔고, 의자를 추가로 가져와 앉아야 할만큼 열기가 뜨거웠다.

토론회는 3부로 나눠 진행됐다. 1부에선 인권경찰 실현방안으로 경찰노조의 설립, 2부는 시민 중심 치안업무를 위한 인력재배치 필요성, 3부에선 경찰 조직의 민주적 통제방안이 논의됐다.

경남 진주경찰서에서 온 양영진 경정은 1부 발제를 통해 “인권경찰을 제대로 실현하려면 경찰노조가 설립돼야 한다”고 말했다. 그는 인권경찰의 3가지 장애물로 경찰 내부에서 경찰관들을 인격적으로 대우하지 않는 반인권적 내부문화, 시민들의 인권보호를 막는 실적 경쟁주의, 그리고 장시간 야간 교대근무에서 비롯되는 열악한 노동여건을 꼽았다. 양 경정은 “노조가 만병통치약은 아니지만 이 세 가지 장애물을 제거하는 데 노조보다 더 효과적인 것은 없다”고 주장했다.

“경찰노조 설립해서 시민인권침해하는 부당 지휘에 항거하자”

전북 완주경찰서 모두성 경위는 “지휘부가 바뀔 때마다 수시로 바뀌는 지휘방침에 경찰개혁을 내맡길 수 없다”며 “노조가 있어야 모든 개혁과제를 유지할 추진동력을 얻을 수 있다”고 말했다. 이어서 “당장 몇 명이라도 좋으니 법적 테두리 안에서 연구회나 토론회를 만들어서 노조 설립을 진행하자”, “경찰이 시민의 인권을 침해하는 부당한 지휘에 항거하려면 저항할 수 있는 내부적인 체계가 필요하고, 그게 바로 노조다” 등 경찰노조 설립의 당위성을 지지하는 발언이 계속됐다.

경찰 인력 재배치를 주제로 한 2부에서는 만성적인 현장 인력 부족, 조직 내 무기계약직 차별 문제 등이 집중 논의됐다. 발제를 맡은 충주경찰서 정현수 경사는 “경찰청은 틈만 나면 현장에서 인력을 빼내 행정 경찰 수를 늘렸다”고 지적했다. 정 경사는 “고도로 훈련된 경찰이 무기도 휴대하지 않고 전혀 위험하지도 않은 쾌적한 사무실에 앉아 행정 업무만 전담하는 것은 모순”이라고 비판했다. 정 경사는 해결책으로 경찰청 내에서 비정규직으로 차별받고 있는 주무관(행정담당 인력)들을 정규직으로 전환해서 행정업무는 이들에게 맡기고, 경찰관들은 현장으로 내보내는 인력재배치를 제안했다. 또 경찰 내에서 주무관에 대한 차별적 관행을 철폐해야 한다고 말했다. 토론회에 참석한 경찰청 주무관노조 조합원들도 그동안 비정규직으로서 받은 차별과 설움을 토로했다.

충남 아산경찰서 신중성 경정도 “경찰청의 여러 개 실무국들이 하는 일을 경찰서에서는 한 사람이 담당해서 업무가 거꾸로 되는 시스템”이라고 지적했다. 그는 현장인력이 부족한 상태에서 지방청, 경찰청 단위에서 사법경찰이 행정업무를 담당하는 현실을 비판하며 “인력재배치를 통해 주무관 분들 정원을 확보해서 행정경찰 업무를 처리하게 하고 사법경찰관을 현장으로 내보내야 한다”고 주장했다.

실적 경쟁의 폐해도 여러차례 언급됐다. 한 경찰관은 “스티커 단속실적 등을 수치화하는 실적경쟁은 국민과 경찰을 이간질시키는 공공의 적”이라고 목소리를 높였다. 다른 경찰관도 “실적경쟁은 경찰관이 시민을 하나의 인격체가 아니라 점수로 보게 한다”며 실적경쟁은 경찰에 전혀 맞지 않는다고 지적했다.

“경찰 내부감찰 기능 민간에 개방해 시민 통제 받자”

3부에서는 경찰을 정권이 아닌 시민에게 봉사하게 만들 수 있는 통제방안이 논의됐다. 발제를 맡은 청주흥덕경찰서 이장표 경감은 경찰조직의 민주적 통제방안으로 경찰위원회제도의 개선과 경찰청장 직위개방제, 그리고 감찰조직 개선 등을 꼽았다.

충주경찰서 정현수 경위는 지난 4월 파면당한 표정목 경장의 사례를 들며 감찰의 문제점을 지적했다.표 경장은 경찰 지휘부가 인권침해 소지가 있는 과도한 실적 경쟁 지시를 내렸다는 등의 비판글을 페이스북 등에 올렸다가 ‘먼지털이식 표적감찰’을 당한 후 파면된 바 있다. 정 경위는 경찰 지휘부가 자신들의 눈밖에 난 직원을 찍어내는데 감찰 기능을 악용했다며 “경찰관의 기강 확립을 할 수 있는 주체는 딱 하나, 국민이다. 왜 지휘관이 이걸 하고 있냐”고 질타했다. 부산북부서 정학섭 경위는 “감찰이 경찰 지휘부 입맛에 맞는 감찰활동을 하니까 문제가 된다”며 “아예 민간에 개방해서 시민들에게 통제를 받으면 우리 인권도 보장받을 수 있다”는 발언으로 큰 박수를 받았다.

폴네띠앙 회장 류근창 경위는 토론회 마무리 발언을 통해 “경찰청장을 앞에 두고 시나리오 없이 자유롭게 토론을 해보고 싶은데, 안타깝지만 아직은 멀었고 우리끼리 하니 서글프고 마음이 아프다”는 소감을 밝혔다. 그는 또 “이 토론회는 경찰관 처우개선을 목표로 하는 게 아니고, 경찰관이 국민들의 인권을 어떻게 더 잘 보호할 수 있을지 논의하는 자리”라고 재차 강조했다. 류 경위를 비롯한 폴네띠앙 회원들은 이번 토론회 내용을 정리해서 경찰개혁위에 전달할 예정이다.

오후 1시에 시작한 경찰개혁 대토론회는 저녁 6시까지 이어졌다. 토론에 참석했던 경찰관들은 변화에 대한 기대감을 드러냈다. 류근창 경위는 “분위기가 좋아지면 앞으로 2회, 3회도 토론회도 가능하다”고 말했다. 대전둔산경찰서 민인근 경위는 “이번에는 정말 바뀌어야 하는데.. 바꿀 수 있지 않을까 싶다”고 결의를 다졌다.

[의견서] 인권·시민사회단체, 더불어민주당 &apos;군성범죄근절TF&apos;에 의견서 제출

어제(6/17) 군인권센터, 군피해치유센터 '함께', 민주사회를 위한 변호사모임, 천주교인권위원회, 참여연대, 한국성폭력상담소 등 6개 인권·시민사회단체는 '더불어민주당 군 성범죄 근절 및 피해자 보호 혁신 태스크포스'(이하 'TF')에 군인권보호관 제도 도입, 군사법체계 개혁에 관한 의견서를 제출하였습니다.

단체들은 군인권보호관 제도 도입 과정에서 군인권보호관의 독립적 지위가 보장되어야 하며 군인권보호관에게 불시방문조사권, 수사 중 자료 제출요구권 등 실효적 권한이 반드시 보장되어야 한다고 강조하였습니다. 아울러 현재 국회에 계류중인 '국가인권위원회법 개정안'(조승래 의원 대표발의)은 이러한 내용을 포괄하지 못하고 있을 뿐 아니라, 국방부장관에게 조사중단요구권을 부여하는 등 독소조항을 포함하고 있어 신중하게 검토하여야 한다는 의견을 제출하였습니다.

또한 단체들은 “평시 군사법원은 폐지되어야 한다.”고 강조하며 군사법체계 개혁안이 충분한 숙의의 과정을 거치지 않은 채 마련되고 있는 상황에 대한 우려를 표하였습니다. 현재 TF는 성폭력 범죄의 관할만 민간으로 이관하는 내용을 골자로 하는 군사법원법 개정을 추진하고 있는 것으로 알려져있습니다. 이는 군사법체계의 존재 가치에 대한 근본적 의문을 제기하고 있는 국민의 눈높이와는 동떨어진 방향입니다. 억울한 희생을 반복하지 않기 위해서라도 군사법체계에 대한 근본적 개혁이 필요한만큼 시민사회, 학계, 전문가 등의 의견을 폭넓게 수렴하는 숙의의 과정이 반드시 필요하다는 의견을 제출하였습니다.

군에서 안타까운 희생이 반복되지 않도록 TF 활동을 통한 제도 개혁의 방향이 실효적 대안이 되기를 기대합니다.

2. 군인권보호관 입법 관련 의견

인권·시민사회단체는 ‘더불어민주당 군 성범죄 근절 및 피해자 보호 혁신 태스크포스’에서 진행 중인 군인권보호관 제도 도입을 위한 입법 논의에 대하여 아래와 같이 의견을 제출합니다.

2015년 7월 24일 국회에서 통과된 ‘군 인권개선 및 병영문화 혁신 과제의 조속한 이행 촉구 결의안’ 의 세부 내용 중 ‘군 옴부즈만제도 도입’과제의 이행을 위하여 군인권보호관 설치가 추진되기 시작했습니다.

이후 19대 국회에서 황영철 의원(새누리당)이 대표발의한 법안, 20대 국회에서 백혜련 의원(더불어민주당)이 대표발의한 법안은 모두 국가인권위원회에 군인권보호관을 설치하는 것을 전제로 하고 있었습니다.

그러나 처음 입법이 시도된 2015년 이래 약 5년간 다양한 쟁점에서 각 관계자의 의견이 합치되지 않아 군인권보호관 설치는 계속 미뤄지고 있었습니다.

군인권보호관 입법에서 반드시 고려되어야 할 사항과 쟁점 사항에 대한 판단은 제도 도입 논의의 연원 속에서 이루어져야 합니다.

2014년 윤 일병 사건 당시 국방부와 군은 윤 일병이 수개월 동안 구타와 가혹행위를 당할 동안 이를 알지도 못했고, 심지어 사인(死因)을 은폐하여 기도폐쇄에 의한 사망 등으로 여론을 호도하는 등의 모습을 보여 장병 인권 보호 영역에서 국민의 신뢰를 잃었습니다. 특히 폐쇄적인 군 조직 내부의 인권 보호 체계로는 장병 인권 보호가 불가능할 것이라는 여론이 팽배했습니다.

이러한 가운데 성역없는 조사를 통해 사건의 은폐·축소 가능성을 일소하고, 폐쇄적인 군을 상대로 제3자의 관점에서 신속히 인권 침해 피해를 구제할 수 있는 방안으로 등장한 것이 군옴부즈만, 즉 군인권보호관입니다.

그렇다면 법안과 관련한 쟁점 역시 군인권보호관 제도 도입 취지에 맞게 논의되어 결정되었어야 하는데, 조승래 의원이 발의한 법안(국가인권위원회법 개정안, 2020. 12. 08.)의 세부 내용을 살펴보면 앞서 살펴본 도입취지와는 거리가 먼 것으로 보입니다.

기본적으로 군인권보호관이 제 역할을 다하기 위해서는 합당한 수준의 조직, 인력, 권한이 확보되어야 합니다. 이 때문에 2015, 2017년 법안에서는 각각 국회가 추천하는 상임위원 1인을 추가하여 군인권보호관을 맡기고, 군인권본부를 설치하여 조사관 인력을 확충하며, 불시방문조사권과 수사중 사건에 대한 자료제출권을 명시하였던 것입니다.

그러나 이번 법안에서는 군인권보호관은 기존 상임위원 중 1명이 겸직하고, 군인권본부 등 인력확충에 대한 언급은 없으며, 불시방문조사권은 사실상 폐지(부득이한 불시방문 시 국방부장관에게 통보하게 함)되었고, 수사중 사건에 대한 자료제출권도 언급이 없습니다.

당초 불시방문조사권과 수사중 사건 자료제출권은 국방부가 반대했던 내용으로 알고 있습니다. 이러한 권한을 군인권보호관에게 부여하는 것을 국방부가 왜 반대하는지는 인권위에서도 익히 잘 알고 있을 것이라 생각합니다. 뿐만 아니라 사전에 통보한 뒤 진행하는 조사에서 피해자가 갖는 부담감, 관련자 진술의 신빙성 저하 등의 문제도 잘 알고 있을 것이라 생각합니다. 또한 자료제출 문제 역시 군 수사당국이 늘 ‘수사중 사건’을 방패 삼기 때문에 원활하게 이루어지지 않는다는 점도 잘 알고 있을 것이라 생각합니다.

군인권보호관은 군이 인권침해 사건을 스스로 처리할 자정능력이 온전히 갖추어지지 않았다고 판단하여 도입하는 제도입니다. 군이 반대한다고 하여 군인권보호관이 스스로 반드시 지녀야 할 권한을 내려놓는다는 것은 있을 수 없는 일입니다.

뿐만 아니라 법안에서는 국방부장관에게 국가 안위에 중대한 영향을 주거나 국가비상사태, 또는 작전임무수행에 지장을 주는 등의 사정이 있을 때 조사 중단을 요구할 수 있는 황당한 권한까지 부여하고 있습니다. 국방부는 군인권보호관의 조사대상기관입니다. 세계 어디에 옴부즈만의 피감기관이 옴부즈만의 조사를 중단시킬 수 있는 나라가 있습니까. 군인권보호관에게는 불시에 방문하여 조사할 권한도 주지 않으면서, 거꾸로 조사대상기관인 국방부에는 사실상 아무 때나 조사를 중단시킬 수 있는 권한을 부여한 까닭을 이해할 수 없습니다.

군이 이미 감찰, 군사경찰, 군검찰 등의 조직을 두고 사건 조사, 수사를 다 진행하고 있는 상황에서 군인권보호관이 별도 조직으로 설치되어야 하는 까닭은 보다 공정하고 실효적인 인권 보호를 담보하기 위함입니다. 조직과 인력 확보 문제도 불분명한 상황에서 공정하고 실효적인 조사를 담보할 법적 권한도 확보하지 못한다면 수년에 걸쳐 어렵게 설치한 군인권보호관은 무용론에 직면하게 될 것입니다.

군인권보호관은 군에서 발생한 끔찍한 죽음들을 교훈으로 만드는 자리입니다. 이들의 죽음이 헛되지 않게끔 군인권보호관이 제 역할을 다할 수 있도록 법안의 내용에 세심하게 고려되길 바랍니다. 군인권보호관 제도 입법 과정에서 조승래 의원안이 담고 있지 않은 불시방문조사권, 수사중 자료 제출 요구권 확보와 국방부장관의 조사중단요구권 폐지는 반드시 관철되어야 합니다. 안규백 의원안의 경우 불시방문조사권, 수사중 자료 제출 요구권이 포함되어있고, 국방부장관의 조사중단요구권은 명시되어있지 않습니다.

3. 군사법원법 개정안 관련 의견

인권·시민사회단체는 ‘더불어민주당 군 성범죄 근절 및 피해자 보호 혁신 태스크포스’에서 진행 중인 군사법원법 개정안 입법 논의에 대하여 아래와 같이 의견을 제출합니다.

각종 군 내 인권 침해·성폭력 사건 등이 발생할 때마다 군 사법체계 개혁 논의가 이어져 온 지 오래입니다. 인권·시민사회단체는 평시 군사법원 폐지의 원칙을 강조해온 바 있습니다.

그러나 현재 태스크포스에서 ‘성폭력 범죄’에 대한 재판 관할만을 민간으로 이관할 수 있게 하자는 논의가 이루어지고 있다는 점이 보도 등을 통해 확인되고 있는 바, 인권·시민사회단체는 우려를 표하지 않을 수 없습니다.

사법제도는 한 번 바뀌면 단기간 내에 다시 바꾸기가 쉽지 않습니다. 군사법체계의 문제로 억울한 죽음이 이어지고 있는 가운데 어렵게 제도 개선의 계기가 마련되었습니다. 마땅히 관련 단체, 학계, 전문가의 의견을 폭넓게 수렴하여 노정 된 문제를 해결하고 장병의 인권을 보장할 수 있는 개혁의 방향을 모색해야 할 때입니다. 군사법제도 개혁은 서둘러 결정하고 추진할 문제가 아닌 것입니다.

상식을 넘어서는 군사법체계에 시민들은 환멸을 느끼고 있으며, 존재 가치에 대한 근본적 질문을 던지고 있습니다. 그럼에도 집권 여당이 성폭력 범죄의 관할만을 민간으로 이관하는 안에 만족한다면 이는 개혁의 가능성을 스스로 제한하는 일이나 다름없게 될 것입니다.

유의미한 변화는 더 많은 이들의 머리를 모았을 때 만들어 낼 수 있습니다. 인권·시민사회단체는 태스크포스가 군사법체계 개혁안을 마련함에 있어 숙의의 과정을 거칠 것을 제안드립니다.

근본적 개혁을 통해 더 이상 억울한 희생이 반복되지 않도록 위 의견을 적극적으로 고려하여 주시기를 바랍니다.

뿐만 아니라 법안에서는 국방부장관에게 국가 안위에 중대한 영향을 주거나 국가비상사태, 또는 작전임무수행에 지장을 주는 등의 사정이 있을 때 조사 중단을 요구할 수 있는 황당한 권한까지 부여하고 있습니다. 국방부는 군인권보호관의 조사대상기관입니다. 세계 어디에 옴부즈만의 피감기관이 옴부즈만의 조사를 중단시킬 수 있는 나라가 있습니까. 군인권보호관에게는 불시에 방문하여 조사할 권한도 주지 않으면서, 거꾸로 조사대상기관인 국방부에는 사실상 아무 때나 조사를 중단시킬 수 있는 권한을 부여한 까닭을 이해할 수 없습니다.

군이 이미 감찰, 군사경찰, 군검찰 등의 조직을 두고 사건 조사, 수사를 다 진행하고 있는 상황에서 군인권보호관이 별도 조직으로 설치되어야 하는 까닭은 보다 공정하고 실효적인 인권 보호를 담보하기 위함입니다. 조직과 인력 확보 문제도 불분명한 상황에서 공정하고 실효적인 조사를 담보할 법적 권한도 확보하지 못한다면 수년에 걸쳐 어렵게 설치한 군인권보호관은 무용론에 직면하게 될 것입니다.

군인권보호관은 군에서 발생한 끔찍한 죽음들을 교훈으로 만드는 자리입니다. 이들의 죽음이 헛되지 않게끔 군인권보호관이 제 역할을 다할 수 있도록 법안의 내용에 세심하게 고려되길 바랍니다. 군인권보호관 제도 입법 과정에서 조승래 의원안이 담고 있지 않은 불시방문조사권, 수사중 자료 제출 요구권 확보와 국방부장관의 조사중단요구권 폐지는 반드시 관철되어야 합니다. 안규백 의원안의 경우 불시방문조사권, 수사중 자료 제출 요구권이 포함되어있고, 국방부장관의 조사중단요구권은 명시되어있지 않습니다.

3. 군사법원법 개정안 관련 의견

인권·시민사회단체는 ‘더불어민주당 군 성범죄 근절 및 피해자 보호 혁신 태스크포스’에서 진행 중인 군사법원법 개정안 입법 논의에 대하여 아래와 같이 의견을 제출합니다.

각종 군 내 인권 침해·성폭력 사건 등이 발생할 때마다 군 사법체계 개혁 논의가 이어져 온 지 오래입니다. 인권·시민사회단체는 평시 군사법원 폐지의 원칙을 강조해온 바 있습니다.

그러나 현재 태스크포스에서 ‘성폭력 범죄’에 대한 재판 관할만을 민간으로 이관할 수 있게 하자는 논의가 이루어지고 있다는 점이 보도 등을 통해 확인되고 있는 바, 인권·시민사회단체는 우려를 표하지 않을 수 없습니다.

사법제도는 한 번 바뀌면 단기간 내에 다시 바꾸기가 쉽지 않습니다. 군사법체계의 문제로 억울한 죽음이 이어지고 있는 가운데 어렵게 제도 개선의 계기가 마련되었습니다. 마땅히 관련 단체, 학계, 전문가의 의견을 폭넓게 수렴하여 노정 된 문제를 해결하고 장병의 인권을 보장할 수 있는 개혁의 방향을 모색해야 할 때입니다. 군사법제도 개혁은 서둘러 결정하고 추진할 문제가 아닌 것입니다.

상식을 넘어서는 군사법체계에 시민들은 환멸을 느끼고 있으며, 존재 가치에 대한 근본적 질문을 던지고 있습니다. 그럼에도 집권 여당이 성폭력 범죄의 관할만을 민간으로 이관하는 안에 만족한다면 이는 개혁의 가능성을 스스로 제한하는 일이나 다름없게 될 것입니다.

유의미한 변화는 더 많은 이들의 머리를 모았을 때 만들어 낼 수 있습니다. 인권·시민사회단체는 태스크포스가 군사법체계 개혁안을 마련함에 있어 숙의의 과정을 거칠 것을 제안드립니다.

근본적 개혁을 통해 더 이상 억울한 희생이 반복되지 않도록 위 의견을 적극적으로 고려하여 주시기를 바랍니다.

We stand for Justice, Human Rights and Freedom!

환경운동연합은 지구의벗(Friends of the earth) 한국으로 지구의벗 아시아태평양(Friends of the earth Asia-Pacific)과 함께 무고한 팔레스타인 시민의 인권과 자유를 위해 함께 팔레스타인 전쟁 중단과 인도적 지원을 촉구합니다. 환경운동연합은 11월 3일 지구의벗 아시아태평양과 세계 시민단체가 연대해 배포한 공동 성명 원본을 공유 드립니다.

As movements fighting against systems of injustice that view black, brown and indigenous peoples as disposable, to be sacrificed by racist and colonial systems of exploitation and domination, we see the struggle of the Palestinian people against occupation and apartheid as part and parcel of our collective struggle for climate, racial, economic and political justice and for a world where everyone has the right to live with dignity, free from oppression.

We are enraged and grieve equally the loss of lives of all civilians – Palestinian and Israeli – that have taken place since 7 October and call for those responsible to be held accountable for their actions.

We decry the fact that for many Northern Governments, Palestinian lives are deemed as being of less value and worth as those of Israeli citizens. This has allowed tens of thousands of Palestinians being killed with impunity over the decades as a result of Israel’s illegal occupation of Palestine. People whose names and dreams, like those of our peoples in the global South, sacrificed to colonialism.

In the latest indiscriminate bombing of Gaza, Israel has already killed more than 5000 Palestinians including at least 2360 children, displacing over 1 million people, as it collectively punishes the Palestinian people. In just one week, between 7-12 October, Israel dropped over 6,000 bombs on the Palestinian people living under its illegal occupation, more than the US dropped in a whole year during its war on Afghanistan. Whilst Human Rights Watch has confirmed that Israel has used a banned chemical weapon – white phosphorous – in civilian areas in the Gaza Strip, causing severe burns and uncontrollable fires.

We are devastated by the bombing of the Al-Ahli Arab Hospital in Gaza which killed 471 injured and sick Palestinians, including women, children, doctors, nurses, and those seeking refuge from the retaliatory bombardment by Israel. To date, the World Health Organisation has documented 76 attacks on healthcare workers, 26 healthcare facilities including 17 hospitals have been attacked, as well as attacks on UN schools where Palestinians are sheltering for safety.

The Occupied Palestinian Territory of Gaza is facing a “complete siege” with the purposeful targeting of civilian infrastructure such as hospitals and schools which constitute war crimes under international law. Israel is also blocking food, water, fuel and medicine to a captive population of 2.3 million Palestinians, half of whom are children, as a weapon of war.

While in the Occupied Palestinian Territory of the West Bank, Israel has imposed a total blockade. The Israeli military is attacking Palestinians protesting the genocide in the Gaza Strip with lethal military force, and is providing thousands of weapons to Israeli settlers inside the West Bank, who are attacking and killing Palestinians.

Israel has openly made genocidal statements that ‘Gaza will be reduced to rubble’ and called the Palestinians ‘human animals’. As climate justice movements we recognise the language of racism and colonialism that has been used to justify the sacrificing and killing of so many of our people across the global South.

The current war in Gaza is not an isolated event but is deeply rooted in ongoing colonization, illegal occupation, systemic injustices, and historical oppression of Palestine by an apartheid state. Israel has repeatedly disregarded the international humanitarian law and human rights principles that demand the protection of civilians, especially in conflict zones, as it escalated its genocidal attacks in Gaza.

Israel is planning a ground offensive with intent to indiscriminately kill Palestinians in north Gaza; and aims to ethnically cleanse more Palestinians in a single day than during the Nakba (Arabic for ‘catastrophe’) in 1948, when over 750,000 Palestinians were expelled from their homes – or any day since in their ongoing settler-colonial occupation of Palestine. The vast majority of Palestinians in Gaza are refugees from the Nakba.

The situation has never been more urgent. In the words of the Director of the United Nations Relief and Works Agency for Palestinian refugees (UNRWA), “Gaza is running out of life”. As vital resources run out and Gaza’s health infrastructure – already battered by Israel’s 16 year-long blockade and periodic bombardment – ‘collapse before our eyes’, Gaza’s remaining hospitals are turning into morgues.

We call for an immediate ceasefire, and for the international community to break the blockade and end the collective punishment of the Palestinian people. We must bring an end to apartheid and occupation.

We are appalled at the US and UK refusing to support the resolutions at the United Nations Security Council calling for a ceasefire to allow humanitarian aid access to the Gaza Strip. The complicity of powerful Western nations in enabling Israel to carry out these actions with impunity is a matter of grave concern. Despite the growing evidence of human rights violations, the provision of military and financial support to Israel from these nations continues unabated. The disregard for the lives of Palestinian people is inexcusable, and it is incumbent upon these nations to end their arming of Israel and prioritise human rights.

We also call out the role and bias of politicians and international media, led by northern media, fueling the islamophobic rhetoric and dehumanization of the Palestinian people as well as the role of international tech companies and platforms in allowing the rise of islamophobic and anti-semitic hate speech and fake news.

We condemn the attempt by Northern Governments – from Germany, France, to the UK, to attempt to criminalize and ban our movements from marching and calling for Justice for Palestine. The attacks on our right to protest mirror the attacks on climate protests that are taking place in countries that bear the greatest responsibility for these injustices.

We stand in immutable solidarity with the people of Gaza and all victims of brutality and demand upholding of international law and human rights principles to protect innocent civilians.

We also stand in solidarity with Palestinians and Jews who are protesting Israel’s bombardment of Gaza and advocating for peace and justice in the region. We condemn actions taken by several governments around the world to stop these protests and the arrest of peaceful demonstrators.

There can be no peace without justice and it is a moral imperative for the global community to stand in unity with the oppressed. We call on all our governments and international bodies to work together to end the war, and to bring all those responsible for war crimes to justice. We demand an end to the occupation and genocide of the Palestinian people and urge for resolution that can ensure that both Palestinians and Israelis can live with security and dignity.

Our Demands
In light of the ongoing violence and the appalling human rights violations in Gaza by the apartheid state of Israel, we call for the following urgent measures:

Immediate Ceasefire: We echo the calls of the United Nations Secretary General and humanitarian and human rights organisations for an immediate ceasefire in Gaza.

End the illegal blockade: Urgent humanitarian and emergency aid must be provided to civilians in Gaza. The people of Gaza are in dire need of medical supplies, food, water, and other essential resources, which need to be restored urgently.

Stop War Crimes: Israel must be held accountable for its actions that breach international law, including attacks on hospitals, forced evacuations, and the illegal blockade on Gaza for decades.

End Impunity: All those responsible for war crimes including the State of Israel must be held to account for their actions. All civilian hostages, including the thousands of Palestinian political prisoners held without charge or trial must be released. Western powers must stop their support for Israel, including ending arms sales to Israel particularly in the context of human rights violations and stop all support and funding to Israel immediately. Political alliances should not take precedence over human lives.

End Apartheid and Occupation: We support the self-determination of the Palestinian people. We call on Israel to end its system of apartheid and for the right of return and compensation to Palestinian refugees. We call on the international community to finally uphold the UN resolutions for a safe, secure and viable State of Palestine alongside a State of Israel.

Stop Racism, Islamophobia and Anti-Semitism: We stand in solidarity with our comrades in the Jewish and Muslim communities facing an increase in racist attacks. The struggle for climate justice is a struggle for racial justice.
